  • Iowa Public Records Law

    Chapter 22 of the Iowa Code requires state government entities like the University of Iowa to provide the public with access to its records.

    The federal Freedom of Information Act (“FOIA”) imposes similar requirements on federal institutions. 5 U.S.C. 552.

  • Iowa Public Records Law Definition of a “Public Record”

    “All records, documents, tapes, or other information stored or preserved in any medium” that belong to a governmental body, as well as “investment policies, instructions, trading orders, or contracts, whether in the custody of the public body responsible for the public funds or a fiduciary or other third party.” Iowa Code § 22.1(3).

    Who may request access to public records?

    ANYONE!

    The law does not limit the class of persons who may request access to public records.

    Requestor doesn’t need to sign their name or explain their reason.

    In what form must the request be made?

    Requests may be made by telephone, e-mail, in person, or in writing.

    The request need not contain any magic words. In fact, a “FOIA request” triggers the state’s obligations, even though FOIA pertains only to federal records.

    Seek clarification from the requesting party, when appropriate Gather responsive records from the individuals and offices that are in

    Assess and collect fees for copying costs or collection time○ Note that the Iowa Code allows state institutions to charge for the time taken

    to gather records. If you anticipate that it will take you more than one hour, please notify the Office of Transparency before you collect the records.

  • Iowa Public Records Law Time to respond?

    The law allows 20 days to determine whether records are subject to disclosure, but the University attempts to respond as soon as reasonably possible.

    What if the University has the data but no actual document exists? University may extract/compile the data, but there could be charges

    associated with that effort that the requestor is unwilling to pay. May charge computer programming fee if new or original programming

    is required.

    Subpoena is a court order and the rules for responding to a subpoena differ from the rules under the Public Records law.

    If you or your department is served with a subpoena, please notify the University Office of the General Counsel immediately.

    Confidential Records: Iowa Code 22.7 provides for several categories of confidential records that are NOT subject to disclosure. Personal information about students – prospective, current, or former

    ○ The Family Educational Rights and Privacy Act (FERPA) is a federal law that also protects the privacy of student records. 20 U.S.C. 1232g.

    Personnel records○ However, the following information is deemed public Salary/Compensation Employment agreements (including settlement agreements) Dates of employment Positions held with the current state employer Educational institutions attended, degrees held, previous employers and dates,

    positions held with previous employers The fact that an employee was discharged or demoted as a result of final

    disciplinary action or resigned in lieu of termination (does not include termination during probation, resignation, conclusion of term appointment and several other circumstances)

  • Iowa Public Records Law Data Processing Systems: The law specifically excludes access to any data

    processing system used by a state entity.

    Enforcement: Complaints may be filed with the Iowa Public Information Board

    If a court finds that a state entity failed to comply with a lawful request, the law allows the court to: issue an injunction mandating compliance, impose fines ranging from $100 to $500 per occurrence, require the custodian to pay for the production of the records and the requestor’s

    attorneys’ fees, terminate the custodian’s employment, and/or find the custodian guilty of a criminal misdemeanor.

  • Requests for Personnel Files Iowa Code Chapter 91B.1 gives employees the right to access

    and copy their personnel file.

    The statute refers to records including, “performance evaluations, disciplinary records, and other information concerning employer-employee relations.”

    Not every document that refers to an employee is part of the personnel file – the University defines what categories of records make up the personnel file.○ Note that there may be some records that are not subject to disclosure

    under the personnel records exemption in the public records law, but not part of the personnel file either.

  • Requests for Personnel FilesResponding to a Request

    The employer may be present while the employee is viewing the file and may charge a “reasonable fee” for each copied page. University copy fee is 10 cents per copy. Note that unlike the public records law, this law does not allow the employer to charge for time spent responding to the

    request.

    Personnel files have multiple components a the UI. They include not just the personnel files kept by the employee’s department. They also include records in: Departmental files Central Human Resources, including payroll and benefits Dean’s file and/or College file Provost’s Office files Hospital HR file Files kept by past departments

    If you receive a request from an employee’s lawyer, please contact the OGC before responding.

  • Requests for Records

    Example:

    Your department receives a letter from a member of the Iowa City community asking for all emails, records, documents, etc., regarding the University’s contract with ABC CORPORATION.

    An attorney sends you a letter on behalf of her client (a former University employee) requesting a full and complete copy of her client’s personnel file.

  • FERPA – Education Records

    What is FERPA?

    Family Educational Rights and Privacy Act of 1974 Also known as the Buckley Amendment Applies to all schools that receive funds from the Department of

    Education (including federally funded financial aid) Provides:

    (1) student education records are generally confidential, and (2) students may access their records

  • What is an Education Record?FERPA is a records law, applying specifically to “education records.” It does not necessarily extend to all educational information. Education Records: broadly defined to include all records

    that are (1) directly related to a student, and (2) maintained by the educational institution. “Directly related” generally means containing personally

    identifiable information (name, address, ID number, DOB, place of birth, information about family, combinations of information that would reveal identity, etc.)

  • What is an Education Record? (cont.)FERPA extends to information derived from an education record.

    FERPA does not extend to information gained by personal observation or in some circumstances, information learned from others.

    Examples: grades, enrollment records, class schedules, printed class lists, test papers, employment records for student jobs

    Combinations of information that would allow a “reasonable person” to identify the student

    Can exist in any form – handwritten note, computer file, print, tape, film, microfilm

    Email that identifies a student or “directly relates” is arguably an education record.

  • Records That Are Not Subject to FERPASole Possession Records are not education records Records kept in the sole possession of the maker Used exclusively as a memory aid Not shared with anyone, other than a temporary substitute

    for the maker of the record

    Law Enforcement and Student Health records are noteducation records But they become education records once sent to an

    educational institution

  • All current or former students who have attended UI.

    At UI, “attendance” means actual enrollment. However, Iowa law provides that records of “prospective students”

    are also confidential.

    How do we define “student?”

    Students have rights to: Review their own records○ School has 45 days to provide access○ Students are not entitled to copies unless direct review is

    not feasible○ Redact records that include information about other

    identifiable students Seek correction of erroneous records

    Students have rights to: Block disclosure of any or all directory information○ Directory information – information whose release is generally not

  • Confidentiality Exceptions Generally, disclosure of education records requires the written

    consent of the student. However, there are some common exceptions: Records are directory information (unless blocked), Final disciplinary results of a crime of violence committed by a student, Parental notification of an alcohol/drug violation committed by a student

    under 21 years of age, Disclosures to parents of dependent students, Disclosures to victims of crimes of violence or non-forcible sex offenses, Disclosures to other schools which the student seeks or intends to enroll

    or where the student is already enrolled as long as the disclosure is for purposes related to the student's enrollment or transfer, or

    Emergency situations (imminent risk to health and safety)

  • FERPA and “School Officials”Use of Education Records within the UI Generally, records can be shared among “school officials” for legitimate

    educational purposes. “A school official is a person employed by the University in an administrative,

    supervisory, academic or research, or support staff position (including law enforcement unit personnel and health staff); a person or company with whom the University has contracted (such as an attorney, auditor, collection agent, or software vendor); a person serving on the Board of Regents; or a student serving on an official committee, such as a disciplinary or grievance committee, or assisting another school official in performing their tasks. A volunteer or contractor outside of the University is considered a school official for purposes of this policy if they perform an institutional service or function for which the University would otherwise use its own employees and who is under the direct control of the University with respect to the use and maintenance of personally identifiable information from education records.”○ https://dos.uiowa.edu/policies/student-records-policy/

    Contractors should agree to abide by FERPA in the contract document.

  • The university must keep a record of (1) requests for, and (2) disclosures of educational records.

    Exceptions to these requirements: Directory information Disclosure to the student or to another with the student’s written

    consent School official disclosures Subpoenas that include instructions that the existence or content

    of the subpoena shall not be disclosed

    Example:

    Your department/college receives a subpeona for any and all academic records, including but not limited to, all classes attended and courses completed for John Smith from 1995 to the present.

  • Confidential Communications: Attorney-Client PrivilegeIn general, the attorney client privilege prohibits the disclosure of

    the substance of a communication (1) made in confidence, (2) between attorney and client, and (3) for the purpose of obtaining legal advice.

    Attorney must be acting in that capacity for the University. Who is the client?

  • Confidential Communications: Attorney-Client Privilege (cont.) Copying an attorney does not necessarily make the

    communication privileged. Communication must be made “in confidence,” i.e., inclusion of

    “outsiders” who are not the client waives the privilege. Subsequently sharing the communication (by forwarding an

    email, for example) with others waives the privilege.
