TERMS & CONDITIONS FOR RENTING OF OUARTERS TO RETIRED BSNLlDOT EMPLOYEES.

I. Monthly rent for the quarters shall be paid in advance on or before S'h of every month. In addition to it, the tenant shall also refund monthly water andservice charges. Rent and the charges for the first month shall be paid in advance before allotment of the quarters. Electricity charges, as per actuals, willbe paid by the tenant directly to the Electricity Department under intimation to the concerned SDE (Elect) BSNL. If the rent or any other dues remainunpaid upto 15 days from the due date of payment, an interest at the rate of 12% per annum for the period of delay calculated on day-to-day basis shall becharged. Such interest shall be compounded on a monthly basis. If the rent or any other dues still remain unpaid upto 45 days from the due date ofpayment, the accommodation will be deemed to be under unauthorized occupation of the tenant from the original due date of payment.2. The accommodation will be leased out to retired employee for the applied period or maximum 2 years with the condition of either side's two monthsnotice for vacation. The minimum lock in period for occupancy shall be of three months. Tenants shall deposit interest free Security Deposit equivalent tothree months rent and minimum one month advance rent before taking possession. Such tenants shall also have an option to provide the guarantee of oneserving BSNLlDoT employee who is not due for retirement within six months after the allotment period, in which case the Security Deposit can be waivedoff.3. The tenant shall be bound by all the rules and regulations which are applicable for allotment of BSNL accommodation in the normal course regardingconduct, sharing, payment of water and electricity charges etc.4. Only minimum maintenance of the quarters, will be done by BSNL and any material replacement, therein will be borne by you. However, noaddition/alteration/damages etc. to the existing structure of the quarters shall be carried out by you. The major repair, if required, shall be done by BSNLat your cost to be paid in advance. Further, on vacation you shall handover the allotted quarters in the same condition as it was handed over to you and ifany damages barring normal wear & tear is found, the same shall be recti fied at your cost.5. In case this accommodation will be required for allotment to any working BSNL employee. The tenant shall be required to vacate the quarters on issuedof two months notice for vacation. No appeal against such notice will be entertained. If the quarter is not vacated in aforesaid notice period you will beliable to pay Damage Charges for such period at twice the normal rent of such quarters for first four months and four times the normal rent of suchquarters thereafter. Interest @ 12% per annum (to be compounded monthly) shall also be charged on the due amount. This shall be without prejudice toother actions for eviction, disconnection of utility connections, etc. to be taken by the BSNL. Any amount remaining due even after adjusting securitydeposit shall be recovered from salary of the tenant! Guarantor of the tenant or from the tenant through all available means including legal actions.6.The allotted quarters shall be for the use of immediate family members of the tenant i.e. wife/children and their spouses and parents only. No sub-lettingof rented-out accommodation shall be allowed. The tenant shall not derive any financial benefit in lieu of the allotment. In case of any violation, the tenantshall liable to vacate the quarters immediately on issue of written notice by the Estate Officer. Decision of the Estate Officer in this regard shall be finaland binding.7. The tenant shall be responsible for all the acts/omissions of his above mentioned family members occupying the accommodation. Any illegal activity orany nuisance to neighbours may render him ineligible for allotment and may lead to termination of lease without prejudice to any other action deemed fitby BSNL.8. All the FRSR rules/conditions applicable for regular accommodation shall also be applicable on the tenant for this accommodation also.9. Further, the tenant shall be liable to pay the GST Tax if imposed by the statutary body including arrears thereof, if any.

10. The tenant shall also refund all the taxes/cess/charges leviable by the statutory bodies on the builtup area and its compound in proportion to the builtuparea of the quarters. Decision of the undersigned in this regard shall be final and binding.If. In case of any revision in the above mentioned rent /charges/taxes, the same shall be applicable on the tenant alongwith payment of any arrearsthereof.12. The tenant shall be required to submit the attested Copy of PPO. He/she shall also furnish a guarantee in the prescribed proforma enclosed herewith onRs.I 00/- stamp paper from a working BSNL employee, who is not due for retirement upto six months beyond the allotment period.13. In case, it is found that the allotted quarters is occupied or shared by unauthorized person(s) or subletted by the tenant, he/she shall be required tovacate the accommodation immediately. Decision of the undersigned in this case shall be final and binding. Failing which eviction procedings against thetenant shall be initiated to get vacated the quarters. Further, for the period for which the quarters has remained occupied unauthorised (the decision of theundersigned shall be final and binding) as mentioned above, the tenant shall pay the damage rent intimated to him/her separately. In case he/she fails topay the said damage rent, it shall be recovered from his/her Security Deposit from the Guarantor.14. The tenant shall be liable to pay all the charges imposed by the registered Residential Welfare Association of the colony.15. The Premises including the Fixtures and Fittings shall be handed over by the tenant to the Building JTO (C)/JTO(E) in good condition at the time ofvacation, failing which cost of damages are liable to be recovered from the tenant.16. The premises should be kept in neat and tidy conditions to the satisfaction of the officer of Muncipal Corporation Mumbai as required by the lawsthereof and to the satisfaction of the Building S.D.E (C) of BSNL.17. The tenant should not keep flower pots on the parapet. He/she shall not keep any animal or poultry in the premises or any where else in the colony.18. Any persons/Officers authorised by the undersigned will be at liberty to inspect the a allotted premises on any day between 5 A.M. to lOP. M.19. All the liability of Income Tax, what so ever, arising out of this allotment of the quarters shall be borne by the tenant.20. The tenant shall be required to pay interest free Security Deposit of the amount equal to three months Rent. Same will be refunded on vacation of theallotted quarters after adjusting the dues, if any, on production of Original receipt of the Security Deposit.21. In case of the death of tenant, his/her family member shall vacate the allotted quarters within two months after the death of the retired employ e.
