The European External Action Service (EEAS) is a functionally autonomous body of the European Union, separate from the General Secretariat of the Council and from the Commission. It is treated as an institution for the purposes of the Financial Regulation and therefore subject to the procedure of discharge provided for in Article 319 of the TFEU and in Article 263 of the Financial Regulation.

It is placed under the authority of the High Representative/Vice-President (HRVP) of the Union for Foreign Affairs and Security Policy, Mr Josep Borrell Fontelles, who is invited to the CONT meeting for a discharge hearing with Members on the implementation of EEAS budget and activities during the financial year 2019.

In accordance with the timetable for the discharge procedure, the written questions addressed to the EEAS were sent on 6 October 2020. The answers received from the EEAS were e-mailed to the CONT Members on 30 October 2020 and are available on the CONT website.

The questionnaire mainly deals with the following issues: the budget management and control activities, the EEAS human resources and related trends, transparency and conflict of interests, the EEAS anti-fraud policy, the EEAS building policy, the EEAS interinstitutional cooperation and the communication, digitalisation and cybersecurity policies.

According to the observations of the ECA's annual report related to Chapter 9 'Administration - MFF heading 5', no specific issues were identified on the sample of transactions concerning the EEAS and no material level of error was identified in the EEAS annual activity report.

The documents are available on CONT website, of particular relevance for the hearing as regards the 2019 EEAS discharge are:

- The ECA’s 2019 Annual Report, Chapter 9;- The EEAS 2019 Annual Activity Report;- The EEAS Budgetary and Financial Management Report;- The EEAS report on the follow-up to the discharge 2018.

It is proposed that the discharge hearing will proceed as follows:

- introduction by the Member of the European Court of Auditors, Mr François-Roger Cazala, who will present the findings of the ECA Annual Report 2019;- High Representative/Vice-President Jose Borrell Fontelles will briefly reply to this introduction and present the EEAS‘s achievements;- CONT Rapporteur Christian Ghinea and other Members will question the HR/VP and/or the ECA;- Closing remarks by the CONT Rapporteur.

Member of the European Court of Auditors, Mr Jan Gregor, will present the

main conclusions of the Report on the performance of the EU budget - Status at the end of 2019.

For the financial year 2019, the Court of Auditors has for the first time split the annual report in two parts. This second part covers the performance of spending programmes under the EU budget. The first part of the annual report was presented to the CONT Committee on 10 November.

According to Article 287 of the TFEU, the ECA draws up an annual report at the end of each financial year. This report, including the statement of assurance (DAS - Declaration d'Assurance) concerning the reliability of the accounts and the legality and regularity of the underlying transactions, is considered by the Council and the Parliament in the framework of the discharge procedure under Article 319 of the TFEU.

The presentation of the European Court of Auditors Annual Report marks the beginning of the discharge cycle related to the year 2018. Upon examination of all relevant documents and a series of hearings with Commissioners in the EU's main spending areas, Parliament will decide in spring 2020 - acting on a recommendation from the Council - whether to grant discharge to the Commission and other EU bodies in respect of the implementation of the EU budget for the year 2018.

The Report of the European Court of Auditors on the performance of the EU budget - Status at the end of 2019 will be published in English first on Friday 13 November at 09h00 on the ECA website eca.europa.eu. It will also be available on the CONT website after publication

Written questions

Following the established procedure for the adoption of the EP discharge questionnaire, Members were asked to submit questions related to the 2019 budget implementation to their Coordinators by 24 September 2020. The questionnaire was finalised and submitted to the Secretary-General on 30 September 2019. The Secretary-General's written replies were made available to Members on 9 November 2020 and are published on CONT website.

Structure of the hearing

It is proposed that the discussion will take the following structure:

– statement by the Court of Auditors;– short presentation by the Vice-President responsible for budgetary affairs;– brief presentation by the Secretary-General of the answers to the written questions ;– presentation by the Internal Auditor of the European Parliament of his 2019 annual

report;
