PUBLICITY RELEASE DATED: ________, ____ 20____ In consideration of the possible inclusion of my Appearance (as defined below) in any form of media and for other good and valuable consideration, the sufficiency and receipt of which are hereby acknowledged, I, the undersigned, hereby irrevocably grant to Pure Fishing, Inc., its affiliates, successors, licensees and assignees (collectively, the “Company”) the unrestricted irrevocable and perpetual worldwide absolute right and permission to record, photograph, visually identify or otherwise use, reproduce and edit as desired, my voice, performance, appearance, likeness, image, photograph, name and/or biography (collectively my “Appearance”) on film, video and/or audio tape, still photography, video recordings, digital images and/or otherwise to incorporate my Appearance into any form of media and in all materials relating thereto, and to exhibit, distribute, transmit and/or otherwise exploit my Appearance, edited or altered as the Company may see fit, in connection with any and all media now or hereafter known or devised and by any and all means now or hereafter known or devised, and in advertising, marketing, promotion and/or publicity in connection therewith. The rights and permissions granted by me hereunder are granted forever and throughout the universe and no compensation will be payable to me at any time. I will have no right of consultation or approval in connection with the rights granted hereunder. The Company will own all rights, title and interest, including the copyright, in and to any and all media incorporating my Appearance, now or hereafter known or devised throughout the universe in perpetuity, to be used and disposed of without limitation as the Company will in its sole discretion determine. I further acknowledge and agree that any materials I submit to the Company hereunder shall become the property of the Company and may be used by the Company in its sole discretion. I also acknowledge and agree that the Company is not obligated to use materials that I submit to the Company hereunder. I represent and warrant that I have the sole and exclusive right to enter into this Publicity Release and to grant the rights granted herein, that the rights I have granted hereunder will not conflict with or violate any commitment, agreement or understanding I have or will have to or with, nor infringe upon any rights of, any person or entity, and that the consent of no other party is required for the Company to exercise its rights hereunder. Unless the Consent on Behalf of Minor form below has been signed, I hereby warrant that I am of full age and have the right to contract in my own name. I have read this Publicity Release prior to its execution, and I am fully familiar with its contents. This Publicity Release shall be binding upon me, my heirs, legal representatives and assigns.
