ManyofourareasofHealth-relatedlawoverlapwitheachother.Takingthemedicalwork,forexample,wespecialiseinallaspectsofpersonalinjuryandclinicalnegligence,medicaldisciplinary/regulatory,inquests,andhealthandsafety.Sotoowithpubliclaw,whichincludesCourtofProtectionandeducationcases,statutoryappealsfromregulatorybodies,andpublicinquiries.Theworkinthesefieldsisfairlyevenlysplitbetweenadvisoryandotherpaperwork,andadvocacy.Therearegoodopportunitiesforledwork,butalsoastrongemphasisonbuildingyourownpracticeandreputation.Theworkisalwaysinteresting,challengingandvariedandyoucanexpecttobeinvolvedinitfrompupillageonwards.Itwilltakeyoutocountycourts,coroners’courts,criminalcourts,tribunals,theQueen’sBenchandFamilyDivisions,theAdministrativeCourtandbeyond.

Pupillage at OTC: key facts ChambersisanApprovedTrainingOrganisation(ATO)andamemberoftheBarCouncil’sPupillage Gateway.

ForthepupillageyearcommencingSeptember2018,we’llbeofferinguptothreetwelvemonthpupillages,eachfundedbyanindex-linkedawardof£60,000p.a.,amongthehighestattheBar.Havingofferedtwopupillagesayearuntil2014,thiswillbethethirdyearwherewewillbeofferinguptothree,areflectionofChambers’commercialsuccessanditswishtoofferopportunitiestothemosttalentedindividualstojoinus.

Aproportionoftheaward(upto25%)isavailableforearlydrawdownduringtheBPTCyear.Theawardisn’taffectedbyanyotherfinancialassistanceyoumayreceive(e.g.fromyourInn).Forincometax-planningreasons,unlessyouwouldratherreceivetheawardinequalinstalmentsthroughouttheyear,weoffertwo-thirds(lessanysumsdrawndowninadvance)tobepaidmonthlythroughoutthefirstsix,andtheremainingthirdduringthesecondsix.Anyearningsactuallyreceivedonyourownaccountinthesecondsixaresetoffagainstthemonthlypupillageawardforthesecondsix.

Wehaveastrongpolicyoforganicgrowth,sothat,traditionally,wehaverecruitedourjuniortenants,firstandforemost,fromtheranksofthoseselectedforpupillage.Indeed,thequalityofourpupilshas

allowedustooffertenanciestovirtuallyeverytwelvemonthpupillagetrainee(26)thatwehaveacceptedsince2003.Wehavebeenabletoachievethisbecauseourselectionprocesshassuccessfullyidentifiedthosewiththepotentialtojoinusattheendofpupillageastenants.Westronglybelievethatitisimportantthatourpupilsdon’tfeelthattheyareincompetitionwitheachother-ifyourabilitiesandperformancemeetourstandards,youstandeverychanceofbeingtakenon.Welikeourpupilstosupporteachother,notfeelthattheyareincompetitionforlimitedspace.

How does it work?

OurPupillageCommitteeallocatespupilstosupervisorsatthebeginningofeachyear.Thisisbasedontheavailabilityofsupervisors,theoverridingneedtoprovideabalancedpupillagecoveringdifferentareasofChambers’workand,ifpossible,expressedpreferencesinspecificareas.Pupilscanexpecttositwithfourdifferentpupilsupervisorsineachofourmainareasofwork–threemonthswitheach–duringthepupillageyear.TheyarelikelytohavepupilsupervisorswhospecialiseinthefollowingfourcoreareasofChambers’work(innoparticularorder):

Asapupil,youwillalsobeofferedamentor,tenantswhoseroleistoprovideinformalsupportandassistanceifneeded.Wefindthatthereisaclosebond,nonetheless,betweenallthemostjuniortenantsandthepupils.

Althoughweplacegreatemphasisonacloseworkingrelationshipbetweenpupilandsupervisor,wealsoencouragepupilstoundertakeworkforothermembersofChambers.YourpupilsupervisorwillbefullyawareofallworkundertakenforothermembersofChambers,toensurethatyoureceiveexposuretoawiderangeofworkbutarenotoverburdened.

Regular Feedback

Pupilsupervisorswriteashortreportoneachoftheirpupilsattheendofeachquarter.Thereportincludesthepupilsupervisor’sassessmentofthepupil’soverallperformance-writtenwork,potentialasanadvocate(particularlyinthesecondsix),andgeneralstrengthsandweaknesses.

ThatreportwillbediscussedwiththepupilbeforebeingsignedoffandissubmittedtotheHeadofPupillage,formingpartofthequarterlyreview-afacetofacelookatprogressoverthatquarterandadiscussionaboutwhatneedstobeachievedinthenextquarter,carriedoutindividuallywitheachpupilbytheHeadofPupillageandsupervisor.Webelievethattheseprogressreportsareavaluablepartofpupillagebecausetheyallowthepupilstoknowhowtheyareperformingandwhattheyneedtodotoimprove.Transparencyisparamountinourfeedbackandreviewprocess.Thereviewtakesaccountofallworkdone,withfeedbackincludedfromallwithwhomapupilhascomeintocontact,his/herownself-assessment,andareviewofrelevantchecklists.

Advocacy Training

Chambersrecognisesthecrucialimportanceofadvocacytraining.Inthefirstsix,pupilsundergoaseriesofbothunassessedandassessedadvocacyexercises.Theseexercisestaketheformofmockhearingsacrossarangeofareasoflaw.Theycoversubmissions(writtenandoral),witnesshandling

andgeneraladvocacytips.Theyserveasusefulrefreshersforcourtroomskillsduringasixmonthperiodwhichisotherwisefocusedonwatchingandlearningfromsupervisors.Theemphasisisfirmlyonconstructivefeedbackandbuildingconfidenceforthesecondsix.

Theinitialadvocacyexercisesareunassessed,intendedonlyastrainingexercises.TheyareconductedbyasinglememberofChambers(dependingontheareaoflaw)andattendedonlybypupilsandtheirsupervisors.

Afterafewunassessedexercises,pupilsprogressonto“advocacyappraisalexercises”.Thesearesimilartotheunassessedexercises,exceptthatthe“Judge”,amemberofChambers,willgiveoralfeedbackattheendandwriteashortreportforthePupillageCommitteesummarisingeachpupil’sperformance.AlongwiththequarterlyreviewreportsthisformspartofthematerialconsideredbyChamberswhenitcomestotenancydecisions.

OneotherdifferencebetweentheunassessedandtheappraisedexercisesisthatsomeoftheadvocacyappraisalexercisesareopentomembersofthePupillageCommittee,andthefinalsuchexercise,toallmembersofChambers.Don’tworry,thissoundsmoreintimidatingthanitreallyis–youwillfindthat,whenyouareinthemiddleoftheexercise,youwillbepayingcarefulattentiontoyourpapersandtheJudge,notthefewothers,sittingquietly(perhaps...)atthebackoftheroom.

The Second Six

Afterthatcomesthesecondsix.Youwillbenervous,butthisiswherethefunbegins.Nothingisquitethesameaspickingupthatfirstslimbundleofpink-ribbonedpapersfromyourpigeonhole.Pupilswillundertaketheirowncasesfromthestartofthesecondsix,aswellasassistingtheirpupilsupervisorswiththeirs.YouwillhaveyourownprofileonourChambersdiarysystemandwillbeabletoseewhentheclerksentercasesforyou.

Thetypicaldietduringthesecondsixcomprisesstraightforwardpersonalinjuryandemploymenthearings,anddon’tbesurprisedifyoufindyourselfinafar-flungmagistrates’court,infrontofaCoroner,ordoingyourbesttohelponeofoursilksfendoffanangryHighCourtJudge.Thebestwaytobecomeanexcellentadvocateiswithrealcases,realclients,realwitnessesandrealjudges.

Althoughyourpupilsupervisorwillnotbecomingtocourtwithyouinthesecondsix,s/hewillbepayingverycarefulattentiontowhereyouareandwhatyouaredoing.Yoursupervisorsarethefirstportofcallforanydifficulties,unexpecteddevelopmentsand,ofcourse,forboastingaboutaglorioussuccess.Theywillbeexpectingyoutocallstraightawayifthingsstarttogoawry,andtheywillnotbetheonlyonestowhomyoucanspeak.Your

Aswiththefirstsix,yourpupilsupervisorwillwriteareportforthePupillageCommitteeattheendofthefirstthreemonthsofthesecondsix.TherewillalsobeaninterimreportprovidedbyyourfourthandfinalsupervisorforconsiderationatthetimeofthetenancydecisioninlateJune/earlyJuly.

Third Six Pupillages

Chambersoccasionallyrecruitsthirdsixpupils,whenitdeterminesthereisaneedtosupportanddevelopthepracticeareasofspecificteamsandinternalworkgroupsbyadvertisingspecificallyforapupilinaparticularareaofwork.SuchpupillageswillusuallybeadvertisedontheBarCouncil’swebsiteandChambers’ownwebsite.Thirdsixpupillagesapplythesamestandardsasthosefortwelvemonthpupillages.ThePupillageCommitteeisresponsibleforthemanagementofallsuchpupillages.ItisnotthepolicyofChamberstoofferthirdsixpupillage“withaviewtoatenancy”.Ifathirdsixpupilwishestobeconsideredforatenancy,thenhis/herapplicationwillbeconsideredonitsmeritsduringthecourseofthesecondthreemonthsofthesixmonthpupillage.ThePupillageCommitteewill,insofarasitispossibletodoso,adoptthesameproceduresandcriteriaasitdoeswithtwelvemonthpupilsbut,inaddition,willhaveinmindwhetherthereissufficientspaceand/orworkinChambersforanadditionaltenantaswellastheinterestsofChambers’juniortenantsanditstwelvemonthpupils.

Mini-Pupillages and Work Experience Placements

Weoffertwomini-pupillagecourseseachyear.Wetakeuptotencandidatesatatimeforaweekofcourtvisits,seminars,exercisesandcaseresearchtoprovideaninsightintolifeattheBar.CoursesareusuallyheldinJuneandDecember.Ourmini-pupillagesarenotassessedanditisnotarequirementthatthoseapplyingforpupillageneedtohavecompletedamini-pupillagewithus.Furtherdetails–includinganapplicationformandclosingdeadlines–canbeviewedwithintheCareerssectionofourwebsite.

Pupillage: our criteria for selection Transferring solicitors and other applicants in possession of exemptions from the Bar Standards Board (applying for pupillage to start in 2018)

Wewelcomeapplicationsforpupillagefrompractisingsolicitors,orthosecompletingtheirtrainingcontracttoqualifyasasolicitor,includingthosewithexemptionsfromtheBSBinrespectofpupillage.

WenormallyrequireallsuchapplicantstoapplytousthroughthePupillageGateway.However,exceptionalcandidateswithsubstantialrelevantexperienceinoneormoreofourspecialistpracticeareasandaBSBdispensationfromundertakingafulltwelvemonthpupillage,areinvitedtosubmitanapplicationformanddetailedcoveringlettertothePupillageCoordinator,MrShirazOshidar(E:[email protected]),alongwithacopyofanycorrespondencefromtheBSBconfirminganydispensationsfrompupillage.The deadline for such applications is 9 December 2016.Wewillreviewapplicationsreceivedandadvisecandidatesby7January2017ifwerequireanapplicationviathestandardPupillageGatewayprocess,orwhetheranalternativeprocessmaygoverntheapplication.

Onceyoumakethetransitionfrompupiltotenant,you’llstarttobuildyourownpractice.Youcanexpectamixofadvisoryandadvocacywork,ofasimilarvarietyasinthesecondsix,whilstaccommodatinganyparticularpreferencesyoumighthave.Ourfriendlyandcommittedclerkingandadministrativestaffwillplayanimportantroleinhelpingshapeandsupportyourpracticeinthedirectionyouwishtotakeit.

AsaChambers,wehaveinrecenttimesbeenabletosendanumberofourjuniortenantsonsecondmentswithsolicitorsorotherbodies,suchastheFinancialConductAuthority(FCA),experienceswhichhavebeenproductiveandworthwhileforallpartiesinvolved.

Guaranteed Earnings Scheme

Althoughwefindthatjuniortenantearningsareusuallysufficient,thereisanadditionalsupportmechanismprovidedforalltenantsintheirfirsttwoyearsofpractice.

Theguaranteedearningsschemeisaninterest-freeloanfromChamberstotop-upearningseachmonthtoasetamount,equivalenttothepro-rataamountofthestandardtwelvemonthpupillageaward.IfatenantearnsmorethanthesetamountthereisnocontributionfromChambers.Iftheyearnless,Chambersloansthedifference.Thecalculationiscumulativethroughouttheyear,sothatthetotalincomereceivedover(say)thefirstsixmonthsiscomparedtosixmonthsofguaranteedearnings.Thetenantwillonlyreceiveatop-upiftheguaranteedearningsarehigherthanactualincomeatanypointinthefinancialyear.

Anytenantintheirfirsttwopost-pupillageyearsofpracticeiseligibletobenefitfromthescheme,providingthattheymakethemselvesavailablefor,andarecommittedto,full-timework.Tenantswhoareonmaternityleaveduringthisperiodwillbeeligibleforadditionalmonthstocoverthematernityleaveperiod.Insigningontothescheme,thetenantundertakestorepaytheloanafterthefirsttwoyearsoftenancy.Intheeventthathe/shemovestoanothersetorretiresfromtheBarforanyreason,thejuniorwillneedtorepayalloutstandingmonieswithinonemonthofresigningfromChambers.

Thejuniorcanopttopayofftheoutstandingsuminonepayment,ortheloanwillberecoupedfromanymonthlyincomereceivedinexcessofthemonthlyequivalentofthecurrentpupillageaward.

Chambersisseekingtorecruitoutstandingcandidates.Overthepastfewyearswe’vetakenonnewtenantseachyear,andintendtodosofortheforeseeablefuture.

WenormallytakeourdecisionsontenancyinlateJune/earlyJulyeachyear.Ourpupilsareinformedoftherelevanttimingsinadvance.RecommendationsaremadebythePupillageCommitteetotherestofChambers,andthereforeChambersasawholehasthefinalsay.ThePupillageCommitteebasesitsrecommendationsonallofthematerialavailabletoitandwillincludethefollowing:

casesanditisgratifying.FromprobonoinqueststounfairdismissalclaimsintheEmploymentTribunal,theclerksmanagetokeepmeverybusy.AparticularhighlightformewasappearingagainstoneofthenewtenantsintheEmploymentTribunalandwinning!

Itcanbeeasysometimestogetboggeddowninfearsaboutassessmentsandretentionrates(althoughOuterTemple’sretentionratefor12monthpupilsisexcellent).However,Ithinkthemostimportantthingtoconsideriswhetheryoucanseeyourselffittingin.Ifyou’recomfortableinChambersandyouknowyoucanturntosomeoneifthingsstarttogowrong,therestoftherequirementsofpupillagenolongerseemsoinsurmountable.OuterTemplehasbecomethatsafehavenforme.

Imogen read law at the University of Nottingham, and has significant experience of client care, having worked part-time as a barrister’s assistant with responsibility for managing direct access clients.

During her time in the FRU London office, Imogen represented clients in unfair dismissal, wages, whistleblowing, direct and indirect discrimination claims, on a pro-bono basis. Imogen is most proud of the re-engagement order granted to one of her pro-bono clients. She started her formal 1st six pupillage based at Outer Temple in March 2016.

She has been, and remains, dedicated to pro bono work.

AsthecurrentFRU/OuterTempleChamberspupil,Istronglyrecommendtheschemetoanyonewhomaybeconsideringit.ThefirstsixmonthsspentatFRUweresomuchfunandgavemeinvaluableexperienceofadvocacyandclienthandling.Theapplicationprocessisaninnovativeone;itisassessedalmostcompletelyblindwithonlytheanswerstolegalquestionsandashortexplanationoftheircommitmenttoprobonoworktoassesscandidates.Theaimistofindthemostablecandidates.

Foranyone,gainingapupillageisasignificantachievementandsomethingtobeexcitedabout.However,beforeIstartedpupillage,Icouldn’tshakethatnervous“firstdayatanewschool”feeling.Fortunately,itdidn’tlasttoolong.WhatmoststandsouttomeaboutOuterTempleishowfriendlyeveryoneis.Theclerks,thereceptionistsandthebarristers,alldotheirverybesttoputyouatease.

That’snottosaythatpupillageatOuterTempleiseasy–itisn’t(andyouwillbeexpectedtoworkhard).However,itisextremelyrewarding.SinceanOuterTemplepupillageissplitintothreemonthchunks,eachwithadifferentpupilsupervisorandinadifferentpracticearea,Ihavegainedsomuch.Havingthought,beforeIstarted,thatIwasdefinitelygoingtobeanemploymentpractitioner,IwassubsequentlysurprisedbyhowmuchIenjoyed(andsometimesexcelledin)otherpracticeareas.

Nowinmysecondsix,Iamstruckbyhowmuchtrustisplacedinpupilsfromanearlystage.Afteryearsoftheoryandstudy,Iambeinggivenmyown

DuringmypupillageIwasinstructedtorepresentaclaimantina7daydiscriminationcase,IwasledintheCourtofAppealbyaseniorjuniorinchambers,Idraftedopinionsandpleadingsincasesrangingfromprofessionalnegligencetofinancialservicestopersonalinjury,andthroughoutIwassupportedbybarristersinChamberswhohadseenitallbefore.

Asidefromthepleasantandsupportiveatmosphere,IwasmostdrawntoOuterTemplebythebreadthofworkandtheopportunityforpupilsandjuniortenantstodosomuchworkontheirowncases.Fromthefirstweekofthesecondsix,Iwasonmyfeetexperiencingahugevarietyofwork,frommulti-daydiscriminationtrialstotelephonehearings.Iwasabletoappearinanarrayofdifferenttribunals,fromtheCountyCourttotheEmploymentAppealTribunal.Therecannotbemanysetswhere,inthecourseofaday,youmightfindyourselfprovidingadviceabouttheregulatoryimplicationsofrestructuringanoff-shoreinvestmentfirm,thelikelydamagesforacoupleelectrocutedinahot-tubwhilstonholiday,andtheprospectsofsuccessfullybringingawhistle-blowingclaimagainstamajornewspaper.

Before starting pupillage, Stephen studied law at Jesus College, Cambridge.

He then worked for a firm of solicitors in London on a variety of cases including assisting to organise a group litigation claim brought by several thousand claimants against a major bank.

Duringapplicationseason,rumoursatBPTCprovidersabound.Onehearswhisperingsofbeingrequiredtoworkridiculoushoursforunreasonablesupervisors,ofaggressivecompetitionovertediouswork,andofthewholesalereplacementofsolidfoodwithcaffeine.Iwasafraidthatpupillagewouldbeanunpleasantexperience.Iwaswrong.

MypupillageatOuterTemplewasgenuinelyenjoyable.Fromthefirstday,weweretoldthatwewerenotincompetitionwitheachother.Wewouldbeassessedagainstanobjectivestandard,notagainsteachother,andeveryone–fromQCsandjudgestofirstyeartenants–seemeddeterminedtohelpustoreachthatstandard.Iwasstruckbythenumberofpeoplewhowerepreparedtogiveuptheirtimetohelpustolearnandtosucceed,eitherinorganizedadvocacyexerciseortalksorinconversationsoveracupofcoffeeoronthephone.OneseniorQCwasparticularlyinsistentthatItakehismobilenumberwithmesothatIcouldringhimovernightforadvice.Hisadviceoverthephoneinresponsetoaslightlypanickedcallfrommeinafarflungtribunalearlythenextmorningwasrepresentativeofthesupportandguidancewhicheveryonewasalwayshappytogive.

Ofcourse,itishardworkandsometimesthereisaneedtoworklonghours,butthereisadefiniteefforttomaketheprocessasmanageableandsupportiveaspossible.Myfirstsupervisorwouldregularlykickmeoutofhisroom(supportively,Ithink)atsixo’clockandinsistthatIdidn’tworkagainuntilnineo’clockthenextmorning.

Ifoundthemainselectionprocesstobetransparentandefficient:lastingjustoneweekend.

ThetwelvemonthpupillagestartedatthebeginningofSeptember,amonthearlierthanmostothersetswhichstarttheirpupillageinOctober.Ispentmyfirstthreemonthsbeingthrustintoemploymentlaw,followedbythreemonthsinclinicalnegligence,thenpubliclawworkandfinallypensions.Ihadadifferentsupervisorforeachpracticearea.Attheendofeachofthethreemonthsmypupillagesupervisorgavemeareportonmyperformance.Thiswasfollowedbyaconstructivereviewmeetingwithallthepupillagesupervisors.OnehelpfulpracticaltipIreceivedfromasupervisorwastotakethesidestaircaseinthemornings,asthisenabledmetoseetheclerksandgettoknowthembetter!

Istartedmypupillagewithtwootherpupils.Weallgotonextremelywellandsupportedeachotherthroughouttheyear.Itmadeatremendousdifference.Myadvicetoallfuturepupils:makeeveryefforttogetonwithyourfellowpupils!Noonewillunderstandthechallengesyouareexperiencinginquitethesamewayastheywill.

Bianca has a BCL from Lincoln College, University of Oxford, and a first-class law degree from the University of Manchester. She is a former solicitor having qualified at the Magic Circle law firm Slaughter and May in 2012.

Prior to starting pupillage she was a judicial assistant to the Lord Chief Justice, Lord Thomas, at the Court of Appeal. She was a research assistant at the Law Commission in the Common Law and Commercial Team in 2013 to 2014.

“Whyareyoualwayssohappy?”Thisquestion,askedofmebyafrienddoingpupillageatanotherset,isagoodindicatorofhowIfoundmyfirstsixmonthsofpupillageatOuterTemple.Ihadbeenwarnedbyvariouspeoplethatthiswasgoingtobethemoststressfulsixmonthsofmylifeandthatpupillagewouldbe“likeacontinuousinterview”,howeverthishasnotbeenthecaseatall.Onthecontrary,twohelpful,interestingandfriendlysupervisorsinadditiontogeneralsupportfromtherestofChambershavemadethisfirstsixmonthsbothenjoyableandengaging.Assoonaspupillagebegan,itwasmadeveryclearthatifyouaregoodenoughyouwillbekeptonasatenant–somethingwhichinevitablyreducedstresslevelsandensuredthatIbecamegoodfriendswithmyco-pupil,ratherthanrivals.

IwasattractedtoOuterTempleinthefirstplacebecauseoftheirexcellentreputationacrossthebroadrangeofworktheydo.Thefirstsixmonthsofpupillagehaveallowedmetoseeawidevarietyofthiswork,inadditiontomyfocusonpersonalinjury/clinicalnegligenceandemploymentworkwithmysupervisors.AswellasobservingmysupervisorsandothermembersofChambersincourt,conferencesandnegotiation,theconstructivefeedbackonwrittenworkandadvocacyassessmentshasgivenmetheinsightandconfidencenecessarytostandonmyowntwofeetinmysecondsix.

Myadvicetoprospectivepupils:don’tbelievethescarestories,butdochooseyourchamberscarefully!

At time of writing the above, Paul was instructed as Junior Counsel to the Independent Jersey Care Inquiry alongside Patrick Sadd and Harriet Jerram. The Inquiry investigated the abuse of children in Jersey’s care system over many years and began hearing evidence in July 2014.

He studied law at the University of Cambridge where he

received a Senior Honorary Exhibition.

Stephen has a degree in History from Oxford University, completed his Graduate Diploma in Law with Distinction, achieved an Outstanding grade in the Bar Professional Training Course, being awarded the Lord Denning & Hardwicke Scholarships from Lincoln’s Inn.

Stephen has recently returned to Chambers having previously been instructed as Junior Counsel to the Independent Jersey Care Inquiry, which was investigating the physical and sexual abuse of children from 1945 to 2014, and allegations of political interference in relation to the prosecution of alleged offenders.

He has a particular interest in financial services and commercial

work.

AtsomepointeveryBarstudentencountersthedauntingtaskofwhittlingdozensofchambersofferingpupillagedowntoonlytwelve.Itisperhapsunfortunatethatthisprocessalltoooftenculminatesinacaffeine-drivensprinttothefinishonGatewaydeadlinenight,butafteryearsofhardworkandCVbuildingitcannotbeoverstatedhowimportantitistochoosethosetwelvecarefully.

ThereasonIchoseOuterTemplewasthevarietyandqualityofworkthatseemedtobeonoffertotheirmostjuniortenants.Breadthofpracticeisencouragedintheformativeyearsoftenancyandtheopportunitytogetstuckinanddevelopasanadvocatebygoingtocourtregularlyappealedtome.WhatalsomadeOuterTemplestandoutwasthattheirapproachtopupillageseemedtobegearedtowardsestablishingasuccessfuljuniorpracticeforeverycapablepupil,ratherthanpittingthemagainsteachotherinascrapfortenancy.Fromdayonemyco-pupilandIweregiventheclearimpressionthateveryonewantedustosucceedandthathascertainlybeenmyexperienceeversince.ThisapproachalsohastheupshotofcreatingafriendlyatmosphereatOuterTemplewhereeveryoneiskeentochatwithpupilsandFridaydrinksprovideagreatplatformforabsorbingtheadviceofjuniortenants.

HavingheardnumerousharrowingstoriesaboutpupillagefrommypeersIfearedtheworst.I’mpleasedtosaythatmyfirstsixmonthsatOuterTemplehavebeenanenjoyableexperiencewhereIhavebeenexposedtoawidevarietyofinteresting

Theysaythatifyouputafrogintoboilingwaterthenitjumpsstraightout,butthatifyouturnuptheheatgraduallythenthefrogstaysthere‘happily’,untilitisnicelycooked.Thesamemaybetrueofpupillage-butinamorepositiveway!

Itwasn’tuntilImetthenewpupilsforlunch,onmyfirstdayasatenant,thatIrealisedhowfarI’dcomeduringthepreviousyear.Theyearisasteeplearningcurveandthereisboundtobesomepressureandstressinvolved,becauseyourfuturecareerisatstake.Thatistrueofpupillageanywhere.

ButIcanhonestlysaythatOuterTempledotheirbesttomaketheyearrunassmoothlyaspossible.Myco-pupilandIweretold,fromdayone,thatwewouldbothbetakenonifweweregoodenough(sotherewerenoBabyBaristastylemachinationstoworryabout).Mysupervisorswerefair,straightforward,andhuman(!)-IreallyknewwhereIstoodattheendofeverythreemonthquarter,andaftereachadvocacyexercise.Thejuniorjuniorswerefriendlyandsupportive;Iperhapslearntmoreaboutsecondsixworkfromthem,overlunchorinformalFridaynightdrinks,thanIdidfrommysupervisors.And,overall,throughouttheyearIgenuinelyfeltthatChamberswantedustosucceed,ratherthantocatchusout.

And,ifyouareluckyenoughtobeabletochoosewheretodopupillage-whyOuterTemple?

Theanswerissimple-thequalityandbreadthofthework,andthechancetotakeonyourowncasesfromdayoneofthesecondsix.Unlikemanychambers,inthesecondsix(andtheearlyyears

oftenancy)youactuallygettogotocourt,inyourownright,andon“proper”casestoo.Therewasnoendlessdevillingwiththehopeofabriefasasecondorthirdjunioratsomepointinthedistantfuture.Norwerethereconstant,repetitive,smallclaimshearings.Justgoodqualitywork,andthechancetobuildapracticefromdayone.

That’swhyI’mhere,andwhyeveryoneelseishere–fromonetoforty-somethingyearscall.

Tom joined Outer Temple Chambers as a pupil in September 2011 and as a tenant in September 2012. He is a former solicitor, having qualified at Magic Circle firm Slaughter and May in 2010 before transferring to the Bar.

Before starting pupillage Tom was a Judicial Assistant to Arden LJ at the Court of Appeal.

Luckily,throughouttheyear,youhavesomeonenexttoyouinthesameboat,whosharesthelimelightduringassessments,hastojumpthesamehurdlesandwhocanhelpmaketheyearalotmorefun.Beforeyouknowit,theJulyvoteisaroundthecornerand,fingerscrossed,youhavetherestofthesummertocelebratetenancy.

Prior to coming to the Bar, Miranda was an EU competition law associate at Stibbe law firm in Amsterdam for three years, where she represented multinationals in EU Commission cartel investigations, merger notifications and litigation before the EU General Court.

Before her stint at Stibbe law firm, she was a Middle Temple Bristow scholar at the European Commission Legal Service, going later to the European Court of Justice as a stagiaire, working in the chambers of Advocate General Sharpston and Judge Forwood on a wide variety of preliminary references and Article 263 TFEU challenges.

Miranda’s practice now straddles financial services, employment and EU/competition law which provides a balanced mix of advocacy and advisory work.

Paradoxically,pupillageisatthesametimeoneofthemostdesirableandmostfearedexperiencesknowntoBarstudents.Happily,onceitstartedIrealisedthatnobodybites,nobodywaswaitinginambush,andtherewasnomagnifyingglasstrainedovermyheadthroughoutthe12months.Infact,it’squitetheopposite-Chambersactuallywantsyoutosucceedandwilldoeverythingtoensurethatyoudo.

The12monthsstartamonthearlierthanusualinSeptemberandaresplitintothreemonthperiodswhichyouspendwithfourpupilsupervisors.TheirpracticesnearlycoverthebreadthofChambers’work-typicallycatastrophicpersonalinjury/clinicalnegligence,employment,pensions/commercial,andcriminal/disciplinarywork.Thisisanunusualopportunitytoexperiencethedifferentlegaltradesandtogainaninsightintothewayoflifethatgoesalongwitheacharea.

Chambershasaverystructuredapproachtoassessment,whichmakesiteasiertoprepareforpracticallyandmentally.Informaladvocacytrainingstartsinyourfirstsixandtheformalexercisesgraduallybuildincomplexity;detailedfeedbackhelpsyoutohoneyourperformance.Therearewrittenexercisestooforwhichyouaregivensufficienttimetoresearchanddraft.Althoughthegoinginevitablygetstough,yougettoughertoo.
