Order

By this Order, the commission names two new members to

the One Call Center Advisory Committee (“Committee”), one each

representing the water utility and the wastewater utility

industries, pursuant to Act 95, Session Laws of Hawaii 2006

(“Act 95”)

I.

Background

Chapter 269E, Hawaii Revised Statutes (“HRS”), calls

for, among other things, the establishment of a One Call Center

to coordinate the location of subsurface installations and to

provide advance notice to subsurface installation operators of

proposed excavation work.’ By Order No. 21221, filed on

August 6, 2004, in Docket No. 04-0195, the commission initiated a

proceeding to establish the Committee, consisting of fifteen (15)

members to represent the state’s underground facility operators.

Pursuant to HRS § 269E-4, the Committee advises the commission on

implementing HRS chapter 269E. By Order No. 21456, filed on

November 9, 2004, in Docket No. 04-0195, the commission formally

established the Committee and appointed certain ‘members of the

Committee in accordance with HRS chapter 269E.

On May 11, 2006, Act 95 was signed into law, which

amended HRS § 269E-4 by mandating the addition of two commission-

appointed members to represent the water and wastewater

industries.2

II.

New Committee Members

By letter filed with the commission on September 14,

2006, Mark K. Maetani was nominated by the Honolulu Board of

Water Supply to fill the newly created water utility position on

the Committee. Upon review of his qualifications and

experience,3 the commission finds that Mr. Maetani has the

requisite knowledge and expertise necessary to advise the

commission on the implementation of HRS chapter 269E.

Accordingly, we conclude that Mr. Maetani should be approved,

and, unless otherwise ordered, should serve as a duly appointed

voting member on the Committee representing the water utility

industry, in accordance with HRS chapter 269E, as amended.

By letter filed on November 20, 2006, Lee A. Mansfield

‘was nominated by Leonard K.P. Leong, Vice President of

Royal Contracting Co., Ltd. and current member of the Committee

representing the General Contractors Association, to fill the

newly created wastewater industry position on the Committee.

Upon review of Mr. Mansfield’s educational and professional

background,4 the commission finds that Mr. Mansfield has the

requisite knowledge and expertise necessary to advise the

commission on the implementation of HRS chapter 269E.

Accordingly, we conclude that Mr. Mansfield should be approved,

and, unless otherwise ordered, should serve as a duly appointed

voting member on the Committee representing the wastewater

industry, in accordance with HRS chapter 269E, as amended.

III.

Orders

THE COMMISSION ORDERS:

1. Mark K. Maetani ±5 approved as a representative of

the water utility industry, and unless otherwise ordered, shall

serve as a duly appointed voting member of the Committee.

2. Lee A. Mansfield is approved as a representative

of the wastewater industry, and unless otherwise ordered, shall

serve as a duly appointed voting member of the Committee.
