TITLE OF THE PROJECT:

INSANITY DEFENCE

AIM: The objective of my project is to study the law relating to the treatment and care of mentally ill persons, to make better provision with respect to their property and affairs and for maters connected therewith or incidental thereto. And to also see in what type of cases court has given defense of insanity to the criminals or mental patients and on what ground this defense has been given.

INTRODUCTION TO THE TOPIC: Allowing a criminal defendant to plead not guilty by reason of insanity reflects a fundamental belief that a civilized society should not punish people who do not know what they are doing or are incapable of controlling their conduct. Thus, on occasion, the state must tell the victims friends and family that even though it abhors the defendants acts, some offenders do not deserve punishment. Before it can do that, however, a judgment about whether such persons were responsible for their actions must be made.

METHODOLOGY: I will make my project by going through various techniques and tools like books relating to foreignsic psychology, books or articles relating to forensic assessment in criminal cases: Insanity and Competency, Mental Health Act 1987, referring various cases where court has taken into consideration insanity defense as ruling or principle while delivering the judgments.

ANALYSIS OF THE TOPIC: In this project, I will go through these things- Rationale for the Insanity Defense Difficulty in determining Insanity The MNaghten Rule: An early Attempt to Insanity Defense The John Hinckley Trial The Jeffrey Dahmer Trial The ALI Standard, or Brawner Rule The Insanity Defense Reform Act Famous trials and the use of Insanity Plea Trials in which Insanity Plea Failed Trials in which Insanity Plea Succeeded Revision and the Reforms of the Insanity Defense

CONCLUSION: Conclusion, Current Criticisms of the Insanity Defense will be given in the final project.
