2013 Quarter 3 Quarterly Environmental Enforcement Summary

The Quarterly Environmental Enforcement Summary for Q3 2013 outlines 4 Orders, 76 Administrative Sanctions, 757 Tickets, and 22 Court Convictions for a combined total of over $196,000 in penalties.

Notable Highlights this Quarter:

The Regional District of the North Okanagan (RDNO) was found guilty in court on charges under the Drinking Water Protection Act and the Water Act. The RDNO was charged along with three other parties for an incident that resulted in the contamination of a public water supply. While the other three parties (the District of Coldstream, Pan-O-Ramic Farms, and the farm’s owner Ernest Palfrey) pled guilty to the charges, the RDNO decided to fight the charges. The RDNO was sentenced to pay a total penalty of $18,540, with $14,400 of that being directed to the Habitat Conservation Trust Foundation. The judge did commend the RDNO employees for their emergency response which involved the mobilization of officials through the night to warn residents of the contamination.

A Pollution Abatement Order was issued to the Coalmont Energy Corporation following the spill of approximately 65,000 litres of coal tailings. The tailings escaped from an emergency holding pond and flowed down the Collin’s Gulch tributary into the Tulameen River, northwest of Princeton. Ministry of Environment, Ministry of Energy and Mines, and Interior Health Authority officials were onsite to sample water quality and assess the situation. The coal sediment in the Tulameen River was determined to be inert (not containing any metal contaminants) and was expected to disperse with the flow of the river. The mining company was required to hire a vacuum truck to clean up deposits of the spilled coal in the Collin’s Gulch tributary and install sediment fencing and settling basins. The company is also responsible for ongoing water quality monitoring and reporting.

Gordon Knight cut down a tree on his property that contained an active eagle nest. The BC Conservation Officer Service conducted an investigation into the cutting of this wildlife tree, and laid charges under the Wildlife Act. Mr. Knight accepted responsibility for his actions, pleading guilty to destroying protected wildlife habitat. The judge fined Mr. Knight $100 and ordered him to pay a further $10,000 penalty to the Habitat Conservation Trust Foundation to be used for raptor rehabilitation on Vancouver Island. A wildlife tree is any standing live or dead tree with characteristics that provide valuable habitat for the conservation or enhancement of wildlife. In British Columbia, more than 80 species of birds, mammals and amphibians depend on wildlife trees for their survival. Through its Wildlife Tree Committee, the province works to promote the conservation of wildlife trees and associated stand-level biodiversity in a safe and operationally efficient manner, in forest, park and urban environments. A Pollution Abatement Order was issued after a methamphetamine laboratory (meth lab) was discovered on a remote rural property in the southeastern Okanagan. Ministry officials were notified of a chemical spill after the RCMP raided the property. Sampling was undertaken to assess the contamination of the surrounding area, the nearby Kettle River and the domestic wells located on neighbouring properties. Testing results confirmed that the neighbouring wells were not affected by the contamination. The order outlines a number of requirements that the landlords must meet to remediate the land back to an acceptable state for residential or agricultural use.

After receiving an anonymous tip from the public about a bear that had been shot while feeding on garbage, the BC Conservation Officer Service conducted an investigation at a remote camp in northeastern British Columbia. Following interviews with the camp owner and the person directed to shoot the bear, an inspection was undertaken to evaluate the camp’s management of food attractants. The attending Conservation Officer issued tickets to Cimarron Camp Services for killing wildlife out of season and for failing to report the killing of wildlife for protection. A Dangerous Wildlife Protection Order was also issued with instructions to clean up the camp and remove all bear attractants within 30 days (the order has been complied with).

The Conservation Officer Service relies on tips from the public, especially in remote areas. The Report All Poachers and Polluters (RAPP) program is a toll free tip-line and web-based service for reporting known or suspected violations of fisheries, wildlife, or environmental protection laws – anonymously and without risk of confronting the offender. The order was issued in response to a spill and requires the following: (1) the company must abate and assess the impact of the coal washing effluent and tailings that flowed from the site into the Tulameen River; and (2) the company must immediately undertake interim sediment control measuresand install longer term measures if necessary. Work has already been done to construct settling basins, sediment fencing and a vacuum truck has been employed on the site to perform clean up.

The order was issued in response to the discovery of a methamphetamine laboratory (meth lab) discharging effluent to a residential septic system, which feeds into the Kettle River. The order requires the landlords to do the following: (1) retain a QP with documented experience in assessment and remediation of contaminants associated with illegal drug labs from the ministry's Roster of Approved Professionals; (2) ensure that all remediation work to address the contamination is overseen by the QP; (3) provide and maintain security to limit access by the public and wildlife and prevent exposure to the wastes on site; (4) maintain the septic system in a disabled state and maintain notices on site that the system is not to be used until complete clean up has occurred, or the QP has proposed a reconfigured system and received the approval of the ministry; and (5) instruct theQP to provide the ministry with bi-weekly updates until the property has been fully remediated.

The order was issued in response to ongoing compliance issues on the site, and requires the following: (1) the landfill owner(s) must submit a final closure report, prepared by a QP to the Director for approval upon completion of closure; (2) submit copies of all applicable local government permits required for the discharge of leachate to the sanitary sewer system; and (3) if the landfill has not been closed and a final landfill closure report has not been submitted, the landfill owner(s) must have financial security in place that meets the currently estimated closure and post-closure costs plus a reasonable contingency for any remediation which may be required.

Following the revocation of Graham Patterson's pesticide applicators certificate (fumigation category) and pesticide service licence, held under the name City Pest Control Ltd, an order was issued to clarify the conditions for operation during the period of revocation. The order specifies that Patterson:(1) must provide the ministry with a complete inventory and location of pesticides currently owned or in his possession for the three year duration of the licence revocation; (2) must not store any pesticideproducts in a vehicle for the three year duration of the licence revocation; and (3) must not purchase, use or transport any pesticides unless in accordance with strict conditions set by the ministry.
