Quarterly Environmental Enforcement Summary

The Quarterly Environmental Enforcement Summary for the 2nd Quarter of 2017 includes environmental enforcement actions from April 1st – June 30th 2017: 14 Orders, 49 Administrative Sanctions, 531 Tickets, three Administrative Penalties, 13 Court Convictions, and one Community Environmental Justice Forum. Penalties for this Quarter total $571,402. Notable Highlights this Quarter:

Since new off road vehicle laws came into effect in November 2015, violation tickets under the Off-Road Vehicle Act (ORVA) have come to represent a large portion of the tickets issued by the Conservation Officer Service. In the first two quarters of 2017 (January 1 - June 30), 200 tickets have been reported under ORVA. By comparison, a total of 113 tickets under ORVA were reported in all of 2016. This increase in enforcement follows a transitionary period focused on education and compliance promotion. Note that only tickets deemed guilty are reported. Information about off road vehicle safety and regulations is available online. To date, all Administrative Penalties issued under the Environmental Management Act (EMA) and the Integrated Pest Management Act have been paid. During the second quarter of 2017, three Administrative Penalties were issued for contraventions of EMA or its regulations:

• Under the Recycling Regulation, producers of “Bluebox” recyclables are required to take responsibility for the life-cycle management of their packaging and printed paper products. DAVIDs TEA received a $22,000 Administrative Penalty for not meeting these requirements.

• Domtar Inc. and Seaspan ULC received a $35,000 Administrative Penalty for failure to comply with a Remediation Order regarding

a high-risk contaminated site.

• Rio Tinto Alcan Inc. received a $10,500 Administrative Penalty for failure to comply with permit requirements which impose effluent discharge limits regarding toxicity and dissolved aluminum levels.

In July 2014, five bighorn sheep were found dead at Teck Coal Ltd.’s Greenhills steelmaking coal facility near Elkford. It was determined that the sheep ingested blasting materials. Maxam Explosives Inc. was the supplier of the explosives. Teck and Maxam were each found guilty of introducing business waste to the environment. Teck was sentenced to pay a total of $200,000, with $195,000 of that going to the Habitat Conservation Trust Foundation (HCTF). Maxam was sentenced to pay a total of $150,000, with $145,000 of that to the HCTF. The court directed for the HCTF funds to be used for the environmental enhancement and restoration of the Sparwood and Fernie area. A Community Environmental Justice Forum was held in May 2017 in response to multiple black bear killings at a farm in the Lower Mainland. Caspian Apiaries Inc. agreed to make $40,000 in upgrades to their operations to deter bears, and undertook a number of community-focused restorative actions in compensation.

A Stop Work Order was issued for the unauthorized deposition of fill material for the purpose of amending soil on a property that is within the ALR. The Order requires the cessation of the unauthorized deposition of fill on the property.

A Stop Work Order was issued for the unauthorized deposition of fill taking place on a property that is within the ALR. The Order requires the cessation of the unauthorized deposition of fill, soil, clay or anyother like material on the property.

A Stop Work Order was issued for the failure to obtain permission for a non-farm use of a property that is within the ALR, including the completion of agri-tourism accommodations. The Order requires the cessation of any preparation, construction, and installation of structures and works that will be used for agri-tourism. The Order also requires the submission of a site plan for the proposed structures and works to determine if requirements will be met or exceeded.

A Stop Work Order was issued in response to unauthorized stockpiled fill material and scrap material on a property that is within the ALR. The Order requires the cessation of the deposition of fill, soil, clay,construction and scrap metal materials.

A Stop Work Order was issued for the unauthorized deposition of fill material on a property that is within the ALR. The Order requires the cessation of the unauthorized deposition of fill, soil, clay, construction material and any like material on the property.

A Stop Work Order was issued in response to the unauthorized deposition of fill material and stripped top soil on a property that is within the ALR. The Order requires the cessation of the deposition of rock, gravel, or other fill-like material on the property and removal of soil on the property.

A Remediation Order was issued in response to the unauthorized placement of fill for the construction of cranberry bogs, dikes, and a reservoir on a property that is within the ALR. The Order requires that no more fill material be brought on the property for the construction of any berms, dikes or bogs, that fill material associated with the above-ground reservoir be removed, and that a conventional in-ground reservoir be installed. The Order also requires that the site be returned to its original agricultural capability, including the submission of a rehabilitation plan for the property.

A Remediation Order was issued in response to continued non-compliances and for the failure to submit an environmental screening assessment report. The Order requires the removal and disposal of all fill material imported and allowed to accumulate on the property, an assessment of soil condition,and the installation of fencing and gating to prevent the dumping of materials. The Order also requiresthe submission of copies of all reports and remediation activities on a bi-weekly basis throughout the remediation and restoration of the property.

A Remediation Order was issued in response to the continuation of an unauthorized commercial truckparking business, the exceedance of the allowed number of residential dwelling units, and for the failure to remove unauthorized fill from a property that is within the ALR. The Order requires the removal of all fill and for the decommissioning of non-permitted residences on the property and to return them to their original state.

An Order to Cease was issued for failure to comply with a condition of the Wolverine Mine Project's Environmental Assessment Certificate which requires that coal from the mine be transported by rail from a loadout facility adjacent to the site. The Order requires the cessation of the hauling of coal by truck from the Project.

A Pollution Prevention Order was issued in response to the likely release of wood waste leachate that will cause pollution to Waterfall Creek and groundwater from a wood processing facility. The Order requires the cessation of the generation of wood waste until a Wood Waste Handling and Disposal Plan is prepared and implemented. The Order also requires the development and submission of a siteassessment on the impact of surface water runoff to nearby waterbodies and groundwater. Lastly, theorder requires the cessation of the use of a sawdust blower system until appropriate permits are in place.

A Pollution Abatement Order was issued in response to the burning of wood waste, used railway ties, used tires, and other construction materials. This resulted in the ongoing discharge of smoke and particulate matter from the property, in a manner capable of injuring health, damaging property, and interfering with visibility. The Order requires that all open fires at or near the property are immediately extinguished, and that any further burning of waste is ceased. The Order also requires the removal and disposal of all used railway ties and ash resulting from the burning of waste.

A Water Sustainability Act Order was issued in response to the unauthorized extraction of groundwater from water wells that have been impacted by the intrusion of saline groundwater, sea water or contaminated water due to excessive pumping from the aquifer. The Order requires limiting the use of the wells unless the water quality meets specified requirements as well as the ongoing sampling and monitoring of the wells. The Order also requires the development of a strategy to manage operations of the wells and the development of a contingency plan.

A Water Sustainability Act Order was issued in response to an unauthorized excavated hole on the bank of Okanagan Lake. The Order requires the restoration of the lake bed and for a qualified professional to oversee and monitor the filling operation to ensure that no impacts occur to the Lake, the aquatic ecosystem, or other property.

As a result of the forum, the company agreed to make $40,000 in upgrades to their operation toensure that bears are deterred, and to fund a portable e-fence for WildsafeBC. Further, they agreed to speak to the Katzie Nation youth on bee husbandry and apiaries co-existing with bears, and offer training to members of the BC BeekeepersAssociation on proper prevention measures. The company also agreed to make a public apology in a local newspaper.
