General Information
1 What action are you requesting from the Board
To proclaim this date in honor of those who have died become III or been victimized as a
result of homelessness in Josephine County2 Provide sufficient background information for the board and public to understand this
issue
Each year since 1990 on or near the first day of winter and the longest night of the year
National Coalition for the Homeless NCH National Consumer Advisory Board
N AB and the National Health Care for the Homeless Council NHCHC has co
sponsored National Homeless Persons Memorial Day to bring attention to the tragedyof
homelessness
In an effort to maximize the impact of the day in our community the Homelessness Task
Force of Josephine County is developing a project for a very brief memorial service on
the longest night of the year December 21St outside the court house with candlelight vigiland tolling of bells from Newman Methodist Church This is to honor those
who have
died become ila or been harmed as a result of homelessness in our community
We honor all citizens who have been affected by the tragedies related to homelessness
and we are bringing this awareness to prepare for our annual requirement through OHCS
to conduct an accurate One Night Homeless Count in late January This annual activity
helps define the population affected by homelessness and sets direction for potentialfunds to be received by agencies dedicated to housing and developing self sufficiency for
the poor of our community

WHEREAS it is the intent of the Josephine County Board of Commissioners to record in
its Journal the Boards official actions regarding the public roadway described as follows
Elmer Nelson Lane extension a Rural Residential Road 3535 located in the Southeast
Quarter SE14 of Section 22 and in the Northeast Quarter NE14 of Section 27 Township36
South Range 6 West of the Willlamette Meridian Josephine County Oregon Saidroad is more
particularly described as beginning at its intersection with HubbardLane at engineers centerline
station 000 and running West for approximately 820 feet to engineers centerline station 820
WHEREAS said road which is 60 feet wide has been determined to be constructed
consistent with the Josephine County Rural Residential Road standards and
WHEREAS the Josephine County Engineer has recommended the action taken hereby
now therefore
IT IS HEREBY ORDERED pursuant to ORS 368 0162c and 368 0412 that the
road as described above is accepted as a county road and the county shall maintain said road
as a county road for the use benefit and service of the public andcommunities served by said
road

As we have previously discussed in December 2008 the City completed the acquisition of theTerBest property adjacent to the Nlerlin Landfill ie 2255 Camp Joy Road assessors map350627 0 Tax Lot 500 This acquisition completes the Citys acquisition of all of the lands
immediately surrounding the landfill and complies with the purchase obligations imposed upon theCite bN the State L epartrnent of Fnviron mental Quality as part of the remedial issues necessitatedby contamination leaching from the landfill The City now owns 2451 Camp Jov Road 350627001002 21255 Camp Joy Road 35062700500 1749 Merlin Road 35062700400 1749Merhn Road 35062710901 1749 Iderhn Road 36062710900 Illerhn Road 350627001011 and 20210 Merlin Road 350627AO801
Though the City has completed the mandated property acquisition one item remains to beaddressed in irder to further assure the Citys ability to preclude public contact with anycontamination located on the acquired property That item is to secure the vacation of the Nlerhn
Landfill Rad 1s you pan see from the above listed properties the City now owns all of the landsurrounding The entire length of the Nlerhn Landfill Road
A you rn it recall the read in question see Attachment AMap was probably created prior to1972 but a at the N ert least accepted by the County as a County maintained road by Board Order
of September 18 1972 recorded that same day at Vol 28 Page 907 Josephine County Records seeAttachment B1 and B2 It is interesting to note that the Countv Commission in accepting the
illerhn Landfill Road as i County maintained road also provided that that acceptance wouldterminate without furthcr acoon of the Board of Countv Commissioners at such time as the Merhnlandfill is no longer used as a public disposal site I think that the quoted language is insightful asto the intent of the Comnussioners that being that the road was to exist only so long as the landfill
continued in operation However despite that language it is not entirely clear that further action isnot required to fully vacate the road and thereby help assure the Citys ability to effectively isolatethe contammation and assure public safety As an aside First American Title in issuing the Cite its
title insurance polio as part of the acquisition of the TerBest property construed that language tobe inadequate in terms of allowing F 1TCO to delete the exception of the road from the interest tobe insured b them in the title pohcN j even though the landfill ceased operations some years ago

intc a franchise agreement with Grants Pass Sanitation Inc for operationand mainte

Acceptance of a Resolution to initiate proceedings to effect the vacation as statedabove
2 Provide sufficient background information for the board and public to understand this
issue
The Department of Environmental Quality DEQ has identified contamination leaching
from Merlin Landfill which is property owned by the City of Grants Pass The City of
Grants Pass also owns all surrounding parcels Although the landfill ceased operations some
years ago the County road to the site is still available for public use Asa matter of public
safet it is recommended that the road be vacated in order to ensurethat no recorded public
access to the area exists Following vacation the City of Grants Pass will install signage and
take other steps to warn the public of the potential dangers and prohibit physical entryto the
area
