A.- THE ENVIRONMENTAL CROSS-SECTIONAL VARIABLE IN COMMUNITY POLICIES In virtue of the introduction by the 1992 Maastricht Treaty of the EU of the principle of sustainable development as one of the EU objectives, and very particularly from the modification of article 6 of the European Community Treaty by the Amsterdam Treaty of 2nd October 1997: “Environmental protection requirements must be integrated into the definition and implementation of the Community policies and activities …, in particular with a view to promoting sustainable development”, the environmental factor has has become cross-sectional, and thus imbues all the Union’s policies. This principle is reiterated, in compliance with the above, by article 1 of (EC) Council Regulation nº 1260/1999, dated 21st June, lying down general provisions on the Structural Funds (SF) which, after announcing the priority aims of the action taken by the Community with the aid of the SF, the European Investment Bank (EIB) and the other financial instruments during the 2000-2006 period, lays down that “in pursuing these objectives, the Community shall contribute to the harmonious, balanced and sustainable development of economic activities, the development of employment and human resources, the protection and improvement of the environment, and the elimination of inequalities and the promotion of equality between men and women”. In this same respect, article 12 places the protection and improvement of the environment among the Community policies and action to which the operations co-financed by the funds must conform, meaning that this variable must necessarily be made part of all programmes. In the sphere of the GV (Generalitat Valenciana, regional autonomous Government of the Valencian Community), Structural Funds represent an essential source of funding to co-finance many of the measures designed and managed by Valencian Community authorities. In order to guarantee their proper management, it is thus essential not only to comply with the obligations imposed by Community regulations, but also for the Management Centres (MCs) or Implementing Bodies to be able to documentarily vouch for said compliance. One of these obligations is the integration of the environmental factor in the measures managed. Guaranteeing this integration of environmental requirements in all sectors of application of Community Funds from the standpoint of sustainable development is a priority aim of the Network of Environmental Authorities (NEA) of the Kingdom of Spain. This cooperation-seeking body, which is part of the European Network of Environmental Authorities of the Member States, brings the authorities responsible for the environment and those for programming EFs and Cohesion Fund together in Spain. The Network was set up in 1997 at the instance of the Commission, and it gathers up representatives of the GSA (General State Administration), SFMP (Spanish Federation of Municipalities and Provinces) and all the Autonomous Communities through their respective Environment, Economy and Treasury Departments. The technical coordination is handled by the Spanish Ministry for the Environment, since the responsibility of associating these authorities lies with the Member States. To further specify the foregoing, the set of obligations of an environmental nature covered by this Manual refers to the following SPECIFIC SPHERES:

A- For ERDF AND EAGGF MANAGEMENT CENTRES:

1- NATURA 2000 NETWORK (N2000N).

2- ENVIRONMENTAL IMPACT ASSESSMENT (EIA).

B.- AIM OF THE MANUAL AND MANAGEMENT CENTRES ATTACHED

OBLIGATION TO PROVIDE BASIC DOCUMENTS FOR CERTIFICATION OF EF ACTION

The Directorate General for the Economy is, in virtue of Valencian Government Decree 112/2003, the management centre which has to “Know of, spread, plan and control the European funds managed by Generalitat Valenciana Management Centres”. Exercising this competence, this Manual has been prepared in order to give Management Centres a practical guide to provide explanations and procedures required to comply with demands of Community cross-sectional environ-mental policy. It understands Management Centres (or Implementing Bodies) connected with performing the tasks involved to mean all the departments, bodies and other concerns of the GV that manage measures co-financed by the VCIOP 2000-2006 –whether these are executive bodies or departments under one of these -. THE ENVIRONMENTAL MANAGEMENT TASKS Management Centres are obliged to perform are:

A.- ERDF and EAGGF MANAGEMENT CENTRES (section D.1):

1- To give the Fund coordinator the information on “Environmental Impact” and “Natura 2000 Network”

(N2000N) for being transferred on to the “General data on projects” file of the “Funds 2000” database,

2- Preparation of the proposal for Declaration of the project not affecting the Natura 2000 Network.

3- Preparation of the document vouching for not requiring Environmental Impact Assessment (EIA) for the project when this does not need one.

The following chart flow sums up the overall circuit of relations between the different parties involved in these 3 tasks, which relate the ERDF/ EAGGF Management Centres with their respective coordinating body on the one hand (1st task), and with the Environmental Authority on the other (2nd and 3rd tasks):

B.- EUROPEAN SOCIAL FUND MANAGEMENT CENTRES (section D.2):

The managers of ESF training action have to meet the requirements of section D.2.-, referring to the ENVIRONMENTAL AWARENESS-RAISING MODULE. The ESF has a specific I.T. file (the UMS: UAESF Monitoring System) by means of which the DG for the Economy, the Intermediate Body coordinating the Fund at the GV, passes on the information about the projects co-financed by this Fund to the Administrative Unit of the ESF (UAESF) of the Ministry of Labour and Social Affairs. The data dumping is done from information supplied by the

ESF Management Centres at the GV, a list of which is given in ANNEX 8. The UAESF in turn passes this information on to the Commission. In the UMS fields, the environmental information refers to the Environmental Awareness-Raising Module, with the ESF being excluded from the obligations already stated for ERDF and EAGGF, due to the series of schemes co-financed by the ESF lacking any impact on the territory. Likewise, the control visits made up to now by the Commission have not required any information on the N2000N nor EIA for the ESF. The following chart flow sums up the circuit of relations between the ESF management centre and the coordinating body:

C.- For ALL MANAGEMENT CENTRES (ERDF, EAGGF, ESF) (section D.3):

The follow-up of the GUIDELINES FOR PREPARING THE ENVIRONMENTAL CONTENT OF THE ANNUAL IMPLEMENTATION REPORT given in section D.3.- of the Manual: As is stated in article 37 of Council Regulation (EC) nº 1260/1999, in the first six months of each year the managing authority of each Form of Intervention must submit an Annual Report on the previous year’s implementation to the Commission. In the VCIOP 2000-2006, the deadline for sending said report to the Commission tends to be put ahead to the end of April since the Monitoring Committees, which are held over the first six months, necessarily require a report with the same content in respect of the previous yearly periods. Consequently the bodies coordinating each Fund request those bodies implementing the different measures co-financed at the start of each financial year, along with the financial information on the previous period, for another type of qualitative information, which includes an environmental assessment and which basically consists in: 1.- Quoting the environmental regulation to be respected in each co-funded action in which the manager is involved.

2.- Making an assessment of the contribution to environmental policy of each co-financed measure.

3.- Listing the environmental consequences stemming from implementation of such measures. In the preparation of the last two points, to improve the qualitative information of the future annual reports in the environmental repercussions of the execution of the VCIOP 2000-2006, it is highly advisable for the manager to respect the Guidelines given by the Commission, which are duly detailed for each one of the Priorities and Measures of the VCIOP 2000-2006 in section D.3.- of the Manual (pages 27 and ff.).

1.- This Manual is subject to regular updates which will where applicable be passed on to the Management Centre. Any procedural doubts, as well as any possible suggestions and information updates should be sent by the MCs, depending on the type of Fund they run, to the following persons:

SPECIFIC RECOMMENDATIONS for ERDF AND EAGGF MANAGEMENT CENTRES: 2.- As material required for meeting the obligations dealt with in this Manual, it constitutes an ESSENTIAL requisite

for the ERDF and EAGGF Management Centres to know the precise geographical location on proper cartographic support for each project or action within their competence.

To make this possible the manager is advised to include cartographic support showing the location of the action in the calls for aid or base documents for the projects/measures within their competence. The recommendable cartographic scale is 1:100.000 or 1:50.000. This information is of vital importance, and without this it would not be possible to reply to the question in the “Funds 2000” form: “Is the project located on an N2000N site?”, nor to make the “analysis of repercussions on the Natura 2000 Network”. In this respect, the manager should right from the start grasp the ABSOLUTE DISTINCTION BETWEEN THE TASKS OF REPLYING TO THE FUNDS 2000 QUESTION (Section D.1.-, 1st Task), which merely consists in locating the project geographically AND THAT OF PREPARING THE PROPOSAL FOR THE PROJECT NOT AFFECTING THE NATURA 2000 NETWORK (Section D.1.-, 2nd Task), the latter not being based on whether the project lies inside or outside the Natura 2000 network, but on another kind of criteria (consult page 12, 2nd paragraph and page 17 and ff.). For the first, it is necessary UNDER ALL CIRCUMSTANCES to have the cartographic location of the project in the file, with no exceptions. For the second, assuming the existence of the previous one, the referral or not by the manager of said map support to the Environmental Authority along with its proposal for a Declaration of not affecting N2000N will be compulsory in the individual Declarations and only optional in the joint ones (consult pages 14 and 16). 3.- For any clarification on basic questions referring to the Natura 2000 Network and EIA Declarations, MCs should

consult the Environmental Authority of the GV, represented for this purpose by:

4.- We advise ERDF/EAGGF Management Centres to insert fields in their own project databases covering the

items connected with the tasks associated with this Manual. As regards EIA, the field should refer to whether the project requires this or not. As regards N2000N the following would be recommendable fields:

1- If the project is located or not in the N2000N and if affirmative, on which of its areas. 2- If the project already has the proposal for Declaration of Natura Network prepared by the Management

Centre, the data on this in terms of affecting the Network, whether this has been sent to the Environmental Authority (EA), if the latter has approved it or not and, in this case, if it is incorporated in the case file or not.

D.- ENVIRONMENTAL TASKS OF EF MANAGEMENT CENTRES IN VCIOP 2000-2006 D.1.- TASKS OF THE ERDF AND EAGGF MANAGEMENT CENTRES D.1.1.- 1st TASK: THE ENVIRONMENTAL VARIABLE IN THE “FUNDS 2000” DATABASE: FILLING IN THE “ENVIRONMENTAL IMPACT” AND “NATURA 2000 NETWORK” FIELDS IN

THE “GENERAL PROJECT DATA” FILE The “Funds 2000” database is, as regards the main form of Community intervention in the Valencian Community -the VCIOP 2000-2006-, the VEHICLE FOR CONVEYING from the GV to Community institutions the information required by these on projects co-financed by Structural Funds. In this I.T. support the Bodies Coordinating ERDF and EAGGF at the GV -DG Economy for ERDF and Secretariat General of the Valencian regional Department for Agriculture, Fisheries and Food (VDAFF) for EAGGF- must compulsorily load a number of fields from the information that they have to be supplied by the bodies implementing these Funds, whose measures are included in said VCIOP 2000-2006. The list of MCs and their measures is given in ANNEX 8 of the Manual. After compiling said information, the coordinating bodies convey this telematically to the European Commission, with “Fund 2000” acting as ESSENTIAL TOOL FOR JUSTIFYING that the payments certified in accounting entries meet and comply with all the requisites demanded. Until now, this system has only been operative for action within the VCIOP 2000-2006. Nevertheless, it is designed in the medium term to compile measures covered by the other forms of intervention –Community Initiatives and Innovative Actions-Technical Assistance-. The files for the projects/action which have to be kept by the manager of projects given accounting certification in Funds 2000 must contain a statement on paper of the information sent on to the Commission, for purposes of any possible control visits or other kinds of measure which may later on require exhaustive documentation on each project. This information and the co-financed project case file must be available and easily located for at least 10 years. In the “General Project Data” file this database contains two questions of environmental content that must be replied to: 1-) The first of these, known as “Impact”, asks whether the project requires Environmental Impact Assessment

(EIA). 2-) The second, with the denomination “Natura Network”, requires a reply to the question: “Is the project located

on a Natura 2000 Network site?”. For this purpose, the management centre responsible for the project will necessarily have to fill in the respective “Technical Form” available in ANNEX 1 (EDRF model/EAGGF model) and will send this to the Body coordinating the Fund along with the “certification of project encoding” financial information to be transferred on to the “Funds 2000” database. This whole information is required 3 times a year. In filling in the environmental content of this form, the manager will proceed as follows:

1-) DOES THE PROJECT REQUIRE ENVIRONMENTAL IMPACT ASSESSMENT?:

To reply to this question, the management centre must consult the Annexes on legislation on EIA in force. These give different lists with the cases in which certain projects require compulsory processing as a EIA. The applicable legislation is as follows:

Legislative Royal Decree 1302/1986, on EIA, modified by Act 6/2001: Annexes I (EIA in all cases) and II (Projects that will only be subject to EIA when this is decided by the environmental body in each case).

Decree 162/1990, dated 15th October, of the GV Government Council by means of which the Regulation for execution of the previous one is approved: Annexes I (EI Declaration) and II (EI Estimation).

Although, insofar as this last Decree develops and details the projects of Act 2/1989, it will be enough for operative purposes to consult the Annexes of Act 6/2001 and Decree 162/1990, given in this Manual ANNEX 11. Due to its compulsory nature, the reply to “Funds 2000” will thus help the Management centre to know which of the projects within its competence require the processing of an EIA and where affirmative, the compulsory referral to the competent authority (at the GV, the Area for Environmental Assessment, DG for Management of the Natural Environment – GV Department for Housing and Land Planning).

2-) IS THE PROJECT LOCATED ON A NATURA 2000 NETWORK SITE?:

From the GEOGRAPHICAL LOCATION OF THE PROJECT, a datum which MUST NECESSARILY BE STATED IN THE FILE , the manager will simply determine if the measure is covered or not by an N2000N site. To do this the management centre will take the following steps: 1st.- Consult ANNEX 7 of this Manual, which gives a list of all the municipalities of the Valencian Community

and the relationship of the municipality with the Natura 2000 Network, that is: if the whole municipal area is wholly Excluded (E) from an N2000N area, if it is Totally included in this (T) or if it is only Partially included (P). If the manager finds the codes “T” or “E” beside the name of the municipality in which the measure is located the reply to the question raised will already have been obtained.

2nd.- Only in the event of the municipal area being partially (P) in the Natura 2000 Network, thus requiring greater

specification as to the exact location of the project in the municipal boundary, the manager will proceed to compare the location of the project in question in the file with the cartography of Sites of Community Importance (SCIs) of the Valencian Community, since the other type of Natura Network areas –the Special Protection Zones for Birds (SPA)- has at present its whole surface included inside the perimeter of the SCIs in the VC.

The manager has the following material available for this purpose:

- The above is available in detail as a full paper version set at 1:100.000 scale, at the Secretariat General or

Directorate to which the relevant manager is attached.

- The manager also has a CD Rom containing the SCI forms in Word format which was provided at the talk on “Integration of the Environmental Factor in Projects Co-financed by the EU” which the MCs were called to on 31st May 2002 at what was then the GV regional Department for the Environment..

After filling in the Annex 1 form (ERDF or EAGGF), the manager will send this to the coordinating body of the Fund along with the financial information that the latter requires of it for the periodical certifications about 3 times a year ( first, second and fourth four-month period) to be able to include this in the I.T. files of "Funds 2000". The documents must be covered by the signature of the person in charge of the respective management centre. For the ERDF MCs, in the event of the reply to both questions being negative in all the projects not previously submitted for certification, “none” should be stated in the box for “Name of project” of the ERDF Technical form of Annex 1. The following chart flow sums up the circuit of times and relationships existing in this task between the ERDF/EAGGF management centre and the relevant coordinating body:

D.1.2.- 2nd TASK: NATURA 2000 NETWORK

GUIDE FOR DRAWING UP THE PROPOSAL FOR DECLARATION BY THE AUTHORITY RESPONSIBLE FOR MONITORING THE NATURA 2000 NETWORK

D.1.2.1.- WHAT IS THE NATURA 2000 NETWORK? CONCEPT, REGULATION: DIRECTIVE 92/43/EEC, ON HABITATS, AND DIRECTIVE 79/409/EEC, ON CONSERVATION OF WILD BIRDS The Natura 2000 Network was created and defined by article 3 of Directive 92/43/CEE –its complete text can be consulted in ANNEX 10 of the Manual- as "coherent European ecological network of Special Areas of Conservation " (SACs), made up of: 1- Sites of Community Importance (SCIs): These are areas which contain types of natural habitats stated in Annex I

and habitats of species listed in Annex II of the Directive. 2- Special Protection Areas for Birds (SPAs), designated by the member states in accordance with the provisions of

Directive 79/409/EEC. The objective of this Network is to "enable the natural habitat types and the species' habitats concerned to be maintained or, where appropriate, restored at a favourable conservation status in their natural range”.

Insofar as SCIs are concerned, the Directive on Habitats lays down that it should be each Member State which proposes a list of sites in which there are habitats and species complying with the characteristics of Annexes I and II of the Directive. The reference for the Valencian Community is the list approved by an Agreement of the Consell (Valencian Government Council) on 10th July 2001, which, modifying the previous one of 24th December 1997, extends the list of SCI zones from the 39 original ones to the 94 currently listed, covering a total surface area of 685,862 Ha. (around 26% of the total surface area of the Valencian territory).

As regards SPAs, the present Proposal of the Government Council in the sphere of the VC was approved by an Agreement dated 9th May 2000, which extended the earlier proposal to a further 9 spaces and leaves the total surface area at 235,676 Ha, representing 11.6% of the territory of the Valencian Community.

The Community system was transposed to Spanish internal Law by means of RD 1997/1995, dated 7th December, "by means of which measures are established to contribute to guaranteeing biodiversity by means of conservation of natural habitats and wild fauna and flora", modified by RD 1193/1998.

D.1.2.2.- IMPLICATIONS FOR AN ERDF OR EAGGF MANAGEMENT CENTRE: WHAT FILES REQUIRE THE NATURA 2000 NETWORK DECLARATION?

The Network of Environmental Authorities has specified documentary requirements stemming from the previous regulation and, for proper standardisation and unification of criteria, has carried out detailed methodological proposals for the preparation of reports/certificates for coverage by the Natura 2000 Network. Hence, it stems from what was agreed at the 16th Plenary Meeting of the NEA on 14-12-2001 that any application for a project co-financed or possibly co-financed by ERDF/EAGGF must include in its documents “information available" as regards N2000N for the purposes of possible control visits or measure which may later require exhaustive documents on each project. This is made material in a Declaration in which the competent Environmental Authority declares the existence or not of repercussions on N2000N sites, regardless of the specific geographical location of the measure envisaged in the project. That is, this is a criterion connected with the material content of the measure, regardless of its location. For operative purposes, the processing by the Management Centres of the GV Administration of a project co-financed by ERDF or EAGGF entails the obligation to prepare a proposal of “Declaration of not affecting the Natura 2000 Network” for each project or group of projects –depending on the cases-, to be settled by the Environmental Authority of the GV. Given that this must be available in all co-financed projects, to give the procedure the required speed, the drafting of the relevant proposal for Natura 2000 Declaration pertains to the Management Centre responsible for the project. This proposal will be sent to the EA for its verification and signing. The N2000N Declaration (model in ANNEX 3) states one of the following alternatives, which correspond to two levels of analysis: A) “It was not considered necessary to make the analysis of possible adverse effects envisaged in article 6.3 of

Directive 92/43/EEC, since the project is not likely to have implications for areas included in the Natura 2000 Network for the following reasons ……….."

This first alternative arises when the Analysis of possible effects for the Natura 2000 Network is limited in its scope to the “Preliminary or abbreviated Natura 2000 Network Analysis”: Questions 1 and 2 (see point D.1.2.6, page 18) because:

- The plan or project has a direct relationship with the management of the site, - The plan or project is necessary for management of the site, - The plan or project, even whilst not having a direct relationship with the management of the site nor

being necessary for this, cannot have appreciable effects on the aforementioned sites.

B) "After making the analysis of possible effects required by article 6.3 of Directive 92/43/EEC, it has been concluded that the project will not have any appreciable negative effects on areas included in the N2000N"

This second option is the result of an Analysis of repercussions additional to the previous one (see point D.1.2.6, page 19, Full N2000N analysis: Question 3), that is, on the making of an NN Analysis of article 6.3 of the Directive on Habitats. These are cases in which the Manager considers that the plan or project, while not having a direct relationship on the management of the site nor being necessary for it, may appreciably affect said areas.

D.1.2.3.- WHEN SHOULD THE PROPOSAL FOR NATURA 2000 NETWORK DECLARATION BE MADE BY THE

MANAGEMENT CENTRE? It is inferred from the principle of prevention at source governing this matter that the proper procedural point for drawing up the proposal for Natura 2000 Network Declaration is in the stage for assessment of the project or application and before this starts to be implemented. The Management Centre will send the proposal for the Declaration, accompanied by its enclosed documents, to the DG for Spatial Planning, (c/ Francisco Cubells, 7 – 4ª planta, 46011 Valencia) for its examination and signing. After signing the resolution on the Declaration, said Directorate General will send this on to the Management Centre to have this definitively included in the respective case file.

D.1.2.4.- SHOULD THE NATURA 2000 NETWORK DECLARATION BE INDIVIDUALLY MADE PER PROJECT?: FORMS OF DECLARATION ACCORDING TO NUMBER OF PROJECTS INCLUDED

The Natura 2000 Network Declaration must be individually made for each plan or project. Nevertheless, in certain cases, the processing can be done jointly in a single Declaration, when this is a group of projects which lack any effect on the territory, that is, ones whose characteristics mean that they cannot have any repercussions on the natural environment. In this sort of measure it proves clear that there is not going to be the slightest effect on the environment, meaning that their nature and the aim of minimizing processing mean that a joint Declaration can be made. In this the Manager includes, with common justified grounds, multiple files considered as a whole, grouping these together by aid programme, by call, by locality ……

This is, for example, the case involved in granting scholarships or grants for professional practice, organising and giving courses, contracting technical assistance, aid for projects for equipment of premises when their characteristics make them inoffensive for the environment, acquisition of environmentally non-harmful machinery, of computer equipment, expenses for incorporation of certain businesses harmless for the environment, promotion and advertising expenses, patents and trade marks ….. In these projects, either due to their merely intellectual nature, or through involving the equipment of already existing facilities or on other grounds, it is clear that there is not to be the slightest external effect on nature, for which reason the proposal EXEMPTS THE MANAGER FROM PROVIDING THE ENVIRONMENTAL AUTHORITY WITH CARTOGRAPHY in which to locate the project, BUT NOT THAT OF HAVING THIS IN THE CASE FILE.

There is not a closed list in this type of action, meaning that this is an option to take according to the criterion of the Management centre and where applicable, of the EA. For example, if the aid is for payment of expenses involved in constituting a company or purchasing land for this, consistency requires that the project for new facilities should be verified as a whole, which is why the proposal for Declaration must be individualised.

Joint or “block” certification does not release the Management centre from the need to include, for the purposes of possible checks by the Commission, an authenticated individual copy of the joint Declaration in each of the files included in this, marking on the list the reference of the singular file to which this is incorporated (per beneficiary, per action, per project, per course …).

Nevertheless, one ought to mention the existence of a sub-species of cases, in which a Management centre settles

the assignment of funds – aid – to be made to certain beneficiary bodies (non-profit-making bodies, institutional concerns, publicly owned companies, foundations, Local Bodies or other administrative bodies...) which in turn intend these for rendering services to third party agents. In this case it is the Management Centre’s task to assess in the proposal for Natura 2000 Declaration, the repercussions which the programme, measure or overall action will have on the Network - the assignation of funds to the beneficiary applicant - and not the specific service granted to the user, it being sufficient to vouch for respect for the environmental variable in said programme, measure or action. As an example we could refer to the case of the European Business and Innovation Centres (BICs), non-profit-making associations benefiting from the aid granted by the Valencian Institute for Small and Medium-sized Industries (IMPIVA) which earmark some of these funds for rendering services to third party companies, concerns or projects. The Valencian Community Technology Institutes also come into this category. ANNEX 8 of this Manual gives a table of the VCIOP 2000-2006 action detailed for each executive body in which the Management centre will find guidance on the form of Natura 2000 Network Declaration applicable in theory to its action according to its specific type. The Management Centre nevertheless has a degree of independence required to readapt this to the particular specific traits of its own case, after consulting the Environmental Authority.

D.1.2.5.- WHAT DOCUMENTS DOES THE NATURA 2000 NETWORK DECLARATION PROPOSAL CONSIST OF THAT HAVE TO BE SENT TO THE ENVIRONMENTAL AUTHORITY?

The file that we could call the “Natura network dossier” which, for any project co-financed by European Funds, should be sent to the Environmental Authority, consists of 3 necessary documents: 1-TECHNICAL CARD with data that compulsorily has to be filled in by the relevant Management centre including a

brief description of the project (model in ANNEX 2). 2- The NATURA 2000 NETWORK DECLARATION (Taking up one sheet. Model in ANNEX 3). 3- The GEOGRAPHICAL LOCATION of the measure (See page 16).

1- TECHNICAL CARD FOR SENDING THE PROPOSAL FOR NATURA 2000 NETWORK DECLARATION AND ITS

ADJOINED DOCUMENTS TO THE ENVIRONMENTAL AUTHORITY OF THE GV WITH DATA IDENTIFYING THE PROJECT (Model in Manual ANNEX 2):

The document which for purposes of identifying the management centre and measure/s or project/s whose proposal for N2000N Declaration and adjoined documents are sent to the EA consists of a Technical Card to be filled in by the manager (Model in ANNEX 2) which contains data such as: management centre, type of Fund, Priority and Measure of the Programme in which the action is involved, person responsible for making the Declaration proposal, nº of case files included in this, title of the project/action, date on which this is sent to the EA for signing ….. Within the information required on the Technical Card, special importance is given to the “BRIEF DESCRIPTION OF THE PROJECT” section, which includes, as a summary, a number of data. The degree of detail varies (Annex 2 includes some practical examples): A) In cases in which the Declaration states the lack of need to make a full analysis of effects, the Brief

Description is restricted to the data defining the project (promoter, object and basic technical characteristics, geographical location of this and that of – where applicable – the work units).

B) On the other hand, when there has to be an analysis of effects required by article 6.3 of Directive 92/43/EEC

through the manager considering that the plan or project, while not having a direct relationship with the management of the area nor being necessary for this, may appreciably affect the aforementioned areas, the “brief description” will include, apart from what is required in the previous section, the list of the different phases of the project, of the work to be done, the urban classification of the ground on which this is located, the measure which will be involved by its execution, the description of the items of the environment which might be affected, any significant effects on this and any other further environmental aspects which the management centre considers could have a relationship on the project.

In joint Declarations, this “Brief Description of the project” will be made on the programme, call or measure considered as a whole. It is relevant to point out that the Card includes a form in which, as a questionnaire-summary, the management centre will fill in the boxes reflecting the steps it has taken in drawing up the proposal for Natura 2000 Network Declaration. 2- DECLARATION OF THE AUTHORITY RESPONSIBLE FOR MONITORING THE NATURA 2000 NETWORK: (Model in ANNEX 3) The Natura 2000 Network Declaration for the project/action, taking up one side of paper and a model of which is included as ANNEX 3 of this Manual, will contain one of the two alternatives stated above. In the case of this being a joint Declaration, if the number of projects prevents these from all being included in the Declaration itself, an adjoined list can be enclosed to give these, stating on the copy, after signing the Declaration, the one corresponding to the file of which this forms part.

3- GEOGRAPHICAL LOCATION OF THE ACTION:

The step to be taken prior to starting the Natura network analysis is geographically locating the action on the SCI cartography which the Management centre will have available since although the effects for Natura 2000 network are analysed as was seen above in material and not geographical terms, the proximity or distance to or from Natura 2000 Networks sites proves to be an essential variable in the analysis of these effects. For these purposes, and given that at the present time, as already pointed out, any SPA in the Valencian Community has its whole surface area included in the perimeter of an SCI, it will be sufficient for these purposes for the Management centre to compare the location of the action with the set of SCI cartography available to it, which will be supplied to it as material accompanying this Manual when this is given out. After being geographically located, the documentary statement will be different depending on whether these are:

a) Individualised declarations per project/action: This requires enclosing a photocopy (DIN A4/ DIN A3) of its geographical location, which will be taken either of:

1-) The cartographic location of the action that must be included in the file. 2-) Alternatively, and with a view to ensuring more appropriate and easier verification of the content of

the Declaration by the Environmental Authority before this is signed, the Manager can opt for replacing the above with a photocopy taken directly from the SCI cartography in which the action is located from the data given in the file, attempting to use as a reference the closest Natura 2000 site/s, whenever this is possible.

b) Joint declarations which include multiple action/projects: the aforementioned photocopy can be replaced by the list of municipalities where these are located, either in the Declaration itself or, if the large number prevents this, in an adjoined document. In any event a copy of the Declaration and/or of said adjoined list will have to be kept in each of the reference files after signing, stating on this the case file.

One or the other of these must compulsorily be provided as document adjoined to the proposal of Declaration when this is passed on to the Environmental Authority for its examination and signing.

D.1.2.6.- METHODOLOGICAL GUIDE TO BE IMPLEMENTED USED BY ERDF AND EAGGF MANAGEMENT CENTRES WHEN DRAWING UP THE PROPOSAL FOR NATURA 2000 NETWORK DECLARATION

The procedure for the management centre consists in taking three steps:

1- Locating the action geographically on a map, with a photocopy in the case of Declarations individually made for each separate project (see page 16).

2- Writing the “brief description of the project” (see page 15) in the Technical Card stated in ANNEX 2.

3- Following through this questionnaire with questions to be filled in on the Technical Card of ANNEX 2 , whose results will lead to stating one of the two options given in the proposal for Natura 2000 Network Declaration stated in ANNEX 3:

A) PRIOR ASSESSMENT ( or “Abbreviated or preliminary Natura Network Analysis”) prior to the possible execution of the Analysis of effects as

envisaged in Directive 92/43/CEE (or Full Natura 2000 Network Analysis):

1- Is the plan or project directly connected with the management of space for conservation of Nature or is it necessary for said management?:

Yes You may proceed to make the proposal for Declaration of no effects on the Natura 2000 Network and grant the authorisation.

No Go on to 2nd question

2- May the plan or project appreciably affect the site?: (Such effects are measured in material and not merely geographical terms)

No You may proceed to make the proposal for Declaration of no effects on the Natura 2000 Network and grant the authorisation.

Yes You must proceed to make the Analysis of effects required by art. 6.3 of Directive 92/43/EEC (Full N2000N Analysis 3rd question):

B) FULL ANALYSIS OF EFFECTS ON THE NATURA 2000 NETWORK as regards the repercussions for the conservation aims of the site:

3- Will the Plan or Project negatively affect the integrity of the site?:

No You may proceed to make the proposal for Declaration of no effects on the Natura 2000 Network and grant the authorisation.

Yes The executing body is not competent to carry out the Declaration proposal. The project must be sent on to the Environmental Authority.

Going by the pattern seen in this questionnaire, two cases can be differentiated as a starting point:

A) Cases in which, after replying positively to question 1 or negatively to questions 1 and 2 of the questionnaire (see page 18: Prior assessment or preliminary or abbreviated NN Analysis, to distinguish this from the “Full Natura 2000 Network Analysis” which it will possibly precede and which corresponds to the one mentioned in article 6.3 of Directive 92/43/CEE), the procedure is to fill in the first box of the Declaration (“the project is not likely to have repercussions for areas included in the Natura 2000 Network for the following reasons....”):

B) Cases in which, after giving a negative and positive reply to Questions 1 and 2 of the questionnaire

respectively, the box to be ticked is “After making the analysis of possible effects required by article 6.3 of Directive 92/43/EEC, it has been concluded that the project will not have any appreciable negative effects on areas included in the Nature 2000 Network” (See page 19: Question 3, “Full Natura 2000 Network Analysis”).

It is important to take into account that in the proposal for Declaration each and all of the arguments involved to justify the Declaration of the project’s not affecting the Natura Network sites should be stated (ANNEX 3 offers some practical examples). In this respect it should be clearly understood that DRAWING UP THE PROPOSAL FOR THE PROJECT NOT AFFECTING N2000N IS NOT BASED ON THE PROJECT BEING INSIDE OR OUTSIDE THE NATURA N2000N NETWORK, but instead on other kinds of criteria (see page 18 and ff.). Hence the management centre, after locating the action in space, should respond to the questionnaire – summary which is given in the Technical Card of ANNEX 2 going by the following method:

A-) PRIOR ASSESSMENT or “Preliminary or abbreviated Natura Network Analysis”: Questions 1 and 2: 1st question: Is the plan or project directly connected with managing the space for conservation of Nature or is it

necessary for such management?: This would be the case, for example, of forestry action intended to conserve habitats (design and execution of fire breaks, forestry repopulation, scrub burning, pasture land in fire break areas.....), maintaining terraces and walls, traditional agricultural activities. The procedure varies depending on the answer given: Yes If the reply is affirmative, the manager can proceed to fill in the proposal for Declaration of not affecting the

Natura Network (model in ANNEX 3) by ticking the box “The project is not likely to have repercussions on areas included in the Natura 2000 Network for the following reasons....” giving as justification:

“Being an measure/activity connected with conservation of the environment” No If the reply to the question is negative, the Manager will proceed to the second stage, answering the

2nd Question: May the plan or project appreciably affect the site? (Remember that the effect is measured in material, not merely geographical terms):

Understanding “Site” to mean: 1) An SCI or SPA within whose perimeter the plan or project is located. 2) The closest SCI/s or SPA/s.

In cases in which the activity is not connected with conservation of the environment, it pertains to the Manager and later on to the EA to examine if the project would produce negative effects on this or not.

Making the “abbreviated” or “preliminary” analysis starts by checking if the measure envisaged meets the REQUISITES of all the SECTORIAL LEGISLATION which is applicable to it through the sector involved (Urban Development regulations, Rules on Qualified Activities, Waste......). Also the fact of being located in urban areas can be a determining factor if the project has no effect outside these.

In any event, as has already been stated, and with the qualifications to be seen below, the fact of the PROJECT BEING LOCATED INSIDE OR OUTSIDE A NATURA 2000 NETWORK SITE DOES NOT PROVE DECISIVE when justifying the possible lack of effects caused by this, since an external location does not always imply the automatic qualification of not affecting and, vice versa, the fact of being located inside the Natura Network does not imply in itself that the project has to affect the site. It is the manager’s task to examine the content of the action and decide whether, while not being in inside the Natura 2000 Network, this is sufficiently close to it to produce potential negative effects on it, or if, on the other hand, whilst being inside one, it lacks these.

In any event, the situation could arise that the project has to be subjected to an EIA through being an activity included in the Annexes of this regulation. In this case, the Declaration/Estimation of Environmental Impact itself is the document to assess how much the environment and consequently, the Natura Network site is affected, which simplifies the Management Centre’s work, which in the proposal for Natura 2000 Network Declaration will be restricted to marking the box for “After making the Analysis of effects....” and as justification of no negative effects it will allege:

The project has obtained a favourable Declaration/Estimation of Environmental Impact from the DG for Management of the Natural Environment of the GV on ..…., a copy of which is enclosed”

To be able to enclose this copy of the Declaration or Estimation of Environmental Impact, equivalent to the “Full Natura Network Analysis”, it will be necessary to request this from the promoter of the project or, as a subsidiary, from the issuing DG in the event of this not already being included in the file covered by the Red Natura Declaration.

For any Management Centres whose action can be certified jointly in a single Declaration, the Manager will

proceed to mark the Declaration box “The project is not likely to have effects on sites included in the Natura 2000 Network for the following reasons:…...” which could include such justifications as:

“Involving an activity/measure to do with ……. (teaching, intellectual, equipment for fitting out pre-existing

premises harmless for the environment ……..) to be carried out – where applicable – in the urban centre of the town or village and lying outside Natura 2000 Network sites”.

Or: “Involving an activity of (idem) nature not incompatible with conservation of the environment” (in the event

of the measure being intended to take place inside NN sites)

As a result of this whole “preliminary” or “abbreviated” Red Natura 2000 analysis a reply to the second of the questions asked will already have been obtained, that is:

CONTENT OF THE FULL ANALYSIS OF EFFECTS:

This Analysis, which according to RD 1997/1995 "is made in accordance with the regulations applicable, according to what is established in basic state legislation and in the further regulations for protection issued by Autonomous Communities", is actually the so-called "Environmental Impact Assessment" –although here without the same thoroughness-, according to the patterns that have been issued by the Environmental Authority itself. The Management centre will perform said Analysis from the STUDY OF EFFECTS submitted to it by the PROMOTER OF THE PROJECT which will have to be requested for this purpose. In this Study the project organiser responsible for determining the project’s impact on significant species and habitats should consider the information contained in the information files of each area of the Natura 2000 Network (SCIs/SPAs), for which purpose they should have available information about ecological requirements of species in said habitat. The Study of effects will have to contain the following items:

1- Description of the project: promoter, basic technical characteristics, phases, jobs to be done in the different construction phases, running and abandonment of the project (its scope, zones which will be affected, expected duration) and where applicable the work units, classification of the land on which this is located, activities which will be involved by its execution …

2- Aim and purpose of this. 3- Geographical location. 4- Description of the physical milieu. 5- Effect on the social and economic milieu in the zone.

6- Direct and indirect effects of the project on the physical milieu (on the significant natural values of the Site, which are the ones that gave rise to the declaration of the zone as Natura 2000 Network), both in its execution and its operation.

7- Possible spatial transmissions of the project located outside the N2000N to the closest site/s. 8- Corrective measures: These could either be proposed by the promoter or directly required by the competent

authority and could refer amongst others to the dates or execution schedule, the type of tools and activities, the access zones strictly prohibited in an area …….

9- Environmental monitoring programme. Specifically, the central element of the analysis is that of the direct and indirect effects of the project on the physical milieu (projects located inside the Natura 2000 Network) or of the spatial transmission of effects (projects located outside the Natura 2000 Network but likely to cause alterations to this). To value these repercussions, in accordance with article 6 of Directive 92/43/EEC, one must explicitly consider both the effects on the different types of habitats and species of the Annexes of this Directive as well as the accumulative effects and the synergies of the impacts, analysing both the ones that could arise directly and indirectly on an SCI or a SPA. “Significant natural values” are considered to be the ones that gave rise to declaration of the zone. For taxons1, these alone should not only be considered, but also the species which are closely associated with them and the habitats which support them for rearing, feeding, breeding … The study of effects ought to include an analysis of fragmentation, of the seriousness of the effects –considered separately for the species and for the habitats -, and of the state of conservation.

In the analysis of fragmentation, the proposal involves studying this at least for projects which include the building of linear infrastructures. Suggested indices in studying these are: the reduction of the number of polygons in the habitat inside the SCI or SPA, the increase of the average surface area of the habitat’s polygons, the relation between perimeter and surface area of the same, and the zone in which the effect takes place, distinguishing between perimeter zones and interior zones -.

The seriousness of the effect is measured with different indicators: some for habitats and others for species:

For the habitats of Annex I, the seriousness is to be measured with indices such as: Percentages of occupied surface area that has been destroyed by the project and the surface area affected in relation to that of the habitat inside the SCI, percentage of surface area affected in relation to the surface area of the habitat in the Autonomous Community affected, to the total surface area of the Autonomous Community, to the surface area of the habitat in the biogeographical region and the size of this region.

The seriousness of effects on the species in Annex II of the Directive is measurable by means of the following numerical indices: “Size of the population” -expressed as a number of specimens of each of the species -”priority or non-priority”– according to Annex II of the Directive- and the “percentages of populations affected in relation to the sizes of the population”, of the Autonomous Community involved and the population in biogeographical region, respectively. 1 Taxon: Group of any scientific classification

Other indices: Time scale over which the effect is to occur (short, medium or long term), persistence (temporary or permanent), reversibility (reversible/irreversible), possibility of recovery (recoverable/irrecoverable), regularity (regular or of irregular appearance), continuity (continuous/discontinuous), permeability (degree of permeability of an infrastructure or project to the passage of the fauna and the dispersion of the species of flora) In view of the Study on effects submitted by the promoter, THE MANAGEMENT CENTRE WILL ISSUE A REPORT ON THE EFFECTS, establishing three possible categories for the repercussions: a) No negative repercussions: The corresponding proposal for Declaration of no effects will be issued. b) Reasonable doubts about the repercussions: The Environmental Authority will be requested to give a specific

extended study of effects, acting according to the results of the same. c) Negative repercussions: The procedure established in article 6 of Directive 92/43/EEC will be observed, a task

which where applicable is to be done by the Environmental Authority.

In any event, one must take into account that in some of the cases in which, due to the scale of the repercussions on the environment, there has to be a full analysis of effects, the project will coincide with one of the sorts classified in the Annexes of the regulation on EIA, meaning that the EIA is once more equivalent to the full NN Analysis and the actual Declaration or Estimation of Environmental Impact issued by the Environmental Authority will be the document to appraise how much the environment and thus the Natura 2000 Network Site is affected. This simplifies the management centre’s work, which in respect of the Declaration will be restricted, as already stated to ticking the box “After making the Analysis of effects” of ANNEX 3 and as a justification of non-negative effects decision it will allege :

“The project has obtained a favourable Declaration/Estimation of Environmental Impact from the DG for

Management of the Natural Environment of the GV on ..…., a copy of which is enclosed”

What has already been stated for an identical case of the prior Assessment (pages 18 and 19) now applies in respect of the need for this to request the promoter of the project or, secondarily, the body which issued this –the DG for Management of the Natural Environment-, to supply a copy of the favourable Declaration/Estimation of Environmental Impact, in the event of this not already being included in the case file.

After making the “Full analysis of effects”, the reply to the third question asked will already have been obtained:

Will the Plan or Project negatively affect the integrity of the site?:

And depending on what the reply to this is, the next step will be:

D.1.3.- 3rd TASK: ENVIRONMENTAL IMPACT ASSESSMENT: JUSTIFYING NOT NEED OF EIA FOR PROJECTS IN CASE IT IS NOT REQUIRED

The EIA may be defined as “the administrative procedure intended to value the effect on the environment of certain public or private projects, consider their feasibility for environmental purposes and establish the determining factors required to guarantee this”. The cross-sectionality of the environmental variable which has imbued all Community policies since the Amsterdam Treaty and which has been implemented for the 2000-2006 period in all EF programmes by Council Regulation (CE) nº 1260/1999, dated 21st June, reaches its utmost expression in the sphere of the Environmental Impact Assessment, the main instrument in the appraisal and correction of the environmental repercussions of projects. In consistent application of this, the EF Management centre in the sphere of the GV must, after consulting ANNEX 11 of this Manual, which gives the lists of the projects submitted to EIA in accordance with legislation in force, proceed in a different way depending on whether these are: A) PROJECTS WHICH ACCORDING TO APPLICABLE LEGISLATION REQUIRE AN EIA TO BE MADE:

If the Management centre finds the project included in any of the categories of the Annexes referred to, it will check if this has already been given its compulsory EIA. If not, it will have to send the technical documents for the project (along with the necessary Study of Environmental Impact supplied by the promoter) to the competent administrative authority (Area for Environmental Assessment of the DG for Management of the Natural Environment - GV regional Department for Housing & Land Planning), for processing of the relevant EIA by this Area. This Study of Environmental Impact will have the content established for each case in articles 7 and 30 of Decree 162/1990 of the GV Government Council.

In this case, the same Declaration/Estimation of Environmental Impact stemming from the EIA processed will be the document, incorporated in the file, which vouches for the environmental variable having been taken into account in the valuation and implementation of this. Obviously, to accredit this it will be necessary to request a copy of the favourable Declaration/Estimation of Environmental Impact, in the event of this not already being included in the file, from the promoter of the project or as subsidiary, the DG for Management of the Natural Environment .

B) PROJECTS WHICH DO NOT REQUIRE AN EIA ACCORDING TO CURRENT LEGISLATION:

We should here distinguish between two forms of certification corresponding to two cases: 1.-) Cases in which the project is not included in any of the Annexes of applicable legislation. 2.-) Cases in which the project is included in the parameters of some of the Groups of projects envisaged

in Annex II of Act 6/2001, dated 8th May.

1.-) When the Manager has not found the project to be covered by any of the lists in ANNEX 11 of the Manual, it

will fill in the model for justificatory Document included in ANNEX 4. The documentary accreditation of the environmental variable having been taken into consideration thus consists of a declaration of the HEAD OF THE DIRECTORATE GENERAL to which each manager is responsible –IN THIS CASE THE ENVIRONMENTAL AUTHORITY IS NOT INVOLVED- in which it is justified that, contrasting applicable legislation, “the processing of the procedure for EIA for said project is not applicable through not falling under any of the cases given in Annexes of Legislative RD 1302/1986, of EIA, modified by Act 6/2001, by means of which Directive 85/337/EEC, in turn modified by Directive 97/11/EC is transposed, nor those of the applicable autonomous Community legislation (Act 2/1989 of the GV, on Environmental Assessment and Decree 162/1990, of the GV Government Council)”.

After being signed by the relevant director general, this justificatory Document SHOULD NOT BE SENT TO THE ENVIRONMENTAL AUTHORITY, but immediately be added to the case file as part of its documents. Joint processing is possible in this case, being able to include all the projects that, in the same call, programme or measure, do not require an EIA in a single document. As in the case of the joint Natura 2000 Network declarations, in each of the files contained in this there should be, after being signed, an authenticated individual copy, marking the reference of the particular file to which this is incorporated. If the large number of projects or municipalities in which these are located makes it impossible to list all the projects in the same Document –one page in length – this can be accompanied by an enclosed list which includes these, stating on the relevant copy the individual file to which this is incorporated.

2.-) Cases in which the project is included within the parameters of some of the Groups of projects envisaged in

Annex II of Act 6/2001, dated 8th May: Annex II of Act 6/2001 covers a type of projects which, only when coming under the specific qualitative or quantitative parameters determined in this, have to subject to a report from the Environmental Authority (Area for Environmental Assessment) for this to decide if the processing of an EIA is applicable to the project or not. The decision, which has to be grounded and public, will adapt to the criteria established in annex III of Act 6/2001. For this reason, although the material of the project may coincide with one of the types given in Annex II, it cannot be taken to be covered by this if it does not fall within said qualitative or quantitative parameters, in which case the form of justification will be as seen in section A (page 22). If the Management Centre sees that the project is within said parameters, it will have to send this, along with all its complementary documents (characteristics and location of the project and characteristics of its potential environmental impact) to the Environmental Authority (Area for Environmental Assessment) for it to determine if it requires an EIA in the necessary report. After issuing this, and depending on its verdict:

If the environmental body decides that an EIA does not have to be made for the particular project –giving the reasons for this in the report– the documentary statement –in this case always individual– will consist in filling in the Declaration of the Environmental Authority, a model of which is given in ANNEX 5 by the DG FOR MANAGEMENT OF THE NATURAL ENVIRONMENT issuing the report itself and then sending this to the management centre. The Declaration will determine that “as the project is included in the cases of Annex II of Act 6/2001, dated 8th May, for modification of Legislative RD 1302/1986, dated 28th June, after making the particular study based on the criteria established in Annex III of the former and the reports of the technical services of this Directorate General, (for Management of the Natural Environment) it has been decided that the EIA does not need to be made due to the following circumstances:……….”

The statement of these circumstances in the Declaration –which will be based on the report- pertains to the DG for Management of the Natural Environment which issued this.

If the decision of the Environmental Authority consists in subjecting the project to EIA, it is obvious that the Declaration on non-requirement of the EIA is not applicable, instead being the same case as in Section A (page 22). This will be processed according to the established procedure and the Declaration/Estimation of Environmental Impact issued by the Area drawing up the report will be the document, adjoined to the case file, vouching for the environmental variable having been taken into account when valuing and implementing this.

D.2.- TASKS OF THE EUROPEAN SOCIAL FUND MANAGEMENT CENTRES: THE ENVIRONMENT IN ESF ACTION

In the specific sphere of the European Social Fund (ESF), the VCIOP 2000-2006 stresses, in line with what is laid down in article 1 of Regulation 1.784/1999, that through its status as a new source of employment, the environment constitutes a factor of economic and social cohesion and contributes to mitigating unemployment. Training is, in this context, an essential part of promoting the environmental sector, in order to develop people’s environmental awareness and responsibility as required for sustainable use of resources, improving and adapting professionals’ level of knowledge so as to thus better compete on a market with clear growth prospects.

D.2.1.- STRATEGIES: The Network of Environmental Authorities of the Kingdom of Spain has agreed on and proposes to tackle the following strategies in this domain:

1st STRATEGY: THE ENVIRONMENTAL AWARENESS-RAISING MODULE

This point is only meant for the CENTRES MANAGING NON-OFFICIALLY RUN TRAINING SCHEMES CO-FINANCED BY THE ESF IN THE VCIOP, and refers to the compulsory inclusion of what is known as the “Environmental Awareness-Raising Module” in all the courses co-financed by this Fund. The Module is cross-sectional, meaning that it must refer to the environmental implications of the business with which the course deals, its repercussions on the environment and the most correct behaviour in each situation. In line with this, the executors of the VCIOP 2000-2006 have been informed of the need for all the Vocational Training course schemes -and gradually also Continuous ones – co-financed by the VCIOP to include a basic environmental training module to be given in the 2000-2006 period, for which the NEA has set general aims and contents.

ITINERARIES proportional to the duration of the course have also been defined. These are as follows:

PARTICULARLY, WITH THE 5 SECTORS OF ACTIVITY COVERED BY THE 5TH COMMUNITY PROGRAMME OF POLICY AND ACTION IN RELATION TO THE ENVIRONMENT: AGRICULTURE, INDUSTRY, POWER, TRANSPORT AND TOURISM

The NEA proposes that for the 2000-2006 period the ESF action policy should include environmental training measures in the sphere of sectorial activities, particularly in the five priority sectors for which the 5th Environment scheme proposes special attention due to their major effects on development: agriculture, industry, power, transports and tourism. Apart from this, for the Continuous Training courses, the GV has developed Manuals of good environmental practice, which it makes available to any concern or company, there being 16 “Guides for Good Environmental Practice” published by the GV; which are to be found on the web page of the Department for Housing and Land

At this last address, the Department for Housing and Planning offers any interested parties the possibility of requesting an interactive CD-ROM through which the Good Practice Guide can be personalised as well as making a self-diagnosis of the business’s environmental effects. It facilitates analysis in each area of the business’s management and allows its environmental situation to be known. Its content is structured by sectors of activity. Based on the prior experience of Communities such as the Valencian or Galician regions, the Ministry of Labour and the National Employment Institute (NEI) have recently produced, in the “European Social Fund and the Environment” Work Group, 24 Manuals for Good Environmental Practice for the different professional families in which Vocational Training is arranged. These Manuals come about as a necessary complement to the Module for Environmental Awareness-Raising, giving this continuity and incorporating it in the courses, and its purpose is to go more deeply in a general way into the patterns of environmental conduct to be observed by workers, thus propitiating a change of attitudes in the performance of their professional work. D.2.2.- MONITORING WORK: The above strategies involve a monitoring system by means of forms, to be filled in by the management centre, which are different for every type of measure (see the table in ANNEX 6), depending on whether they deal with training action (form G1 or G2 and, where applicable, also K), or employment/ self-employment (form K):

Every time that the service of the ESF DG for the Economy requests a certification and justification of expenses, whether this is in the form of a partial or annual report, for each certification and for each measure undertaken, the management centre has to fill in financial implementation forms and physical implementation forms. The monitoring of physical indicators in which the environment and respect for this are considered is reflected in said physical implementation forms, whose models to be filled in by the manager are found, along with the relevant instructions for filling them in, in ANNEX 6 of the Manual: - Form G1, on the analysis of Training indicators per sector,

- Form G2, on the analysis of Training Indicators going by professional family. - Form K, on the analysis of Indicators of Work Centres, going by activity and size.

D.3.- COMMON TASK FOR ALL MANAGEMENT CENTRES: GUIDELINES FOR PREPARING THE ENVIRONMENTAL CONTENT OF THE ANNUAL IMPLEMENTATION REPORTS

This section deals with a number of guidelines given by the DG Environment of the European Commission with the aim of giving the environmental side of the annual implementation reports the due information quality. The implementing bodies of the VCIOP 2000-2006 thus have the appropriate reference for preparing said reports, which are regularly required of them by their respective coordinating body. These guidelines include a number of environmental indicators, which are grouped according to each Priority. The indicators of the same nature, as envisaged in the VCIOP 2000-2006 Complement, which are compulsorily to be replied by the implementing body, have been added to each of these Priorities. The cooperation between the authorities responsible for programming Community Funds and environmental authorities on a community, state, autonomous community and local level through the NEA has enabled the definition of initial documents for structural programming 2000-2006 –Plans, Community Support Framework, Single Programming Documents and Operational Programmes– to harmoniously integrate environmental considerations and establish the bases to guarantee assessment and monitoring, from the environmental standpoint, at the Committees set up for this purpose for execution of this programming. After having carried out the prior environmental assessment of the Plans and Programmes it is thus necessary for the environmental considerations that these contain to be materialised when executing the different tasks. The fact of having carried out an ex-ante environmental assessment of the Plans and Programmes does not mean that environmental policy has been complied with for the seven years of execution. It is precisely when undertaking the action that the recommendations of the assessment and materialisation of these take on meaning. In the execution phases it is thus necessary to carry out systematic monitoring, not only in order to check compliance with legislation and environmental policy, but also to maximise the benefits of positive interventions on the environment and where applicable to adapt and redefine certain measures. The action taken must remain consistent with the strategy covered in the Community Support Framework, which in environmental matters could be summed up as the integration of environmental considerations in all the Priorities of development, reflected in turn in the cross-sectional principle expressed in the document Commission Guidelines for obtaining sustainable development. In the first annual report for Implementation of the VCIOP for the 2000-2006 period, the European Commission has detected a shortage of information about the aspects on obtaining environmental objectives and environmental sustainability of the interventions, as well as on compatibility with Community policy and regulations on environmental matters. This fact is however understandable if one takes into account the particular circumstances involved in the programming process in which these were made. For this reason the following recommendations set out to be an indication for respecting the consistency of the texts approved in future reports. In order for future annual implementation reports to take up the basic recommendations given by the environmental authorities in the process of drawing up the Regional Development Plan and in turn covered and tangibly integrated in the Community Support Framework and different OPERATIONAL PROGRAMMES, the following proposal for environmental content of the annual implementation reports is made.

A.- General themes which have to be taken into account in all action: • Statement of the projects requiring an EIA through being covered by Directive 85/337/EEC, on the assessment of

the effects of certain public and private projects, modified by Directive 97/11/CE. • Verification of whether all the projects that were decided for eliminating or reducing as far as possible any

potential adverse effects were taken in projects affecting an area forming part of the Natura 2000 Network. • Statement of whether the projects of environmental nature form part of a global strategy on national, regional or

local level. There are different National Plans, some of purely environmental nature (National Waste Plans or the National Plan for Cleaning and Purification of Waste Waters) and other sectorial ones but which incorporate considerations of environmental type (Plan for Fostering Renewable Energies in Spain or the section on waters and waste of the National R+D+i Plan 2000-2003). This implies that the projects envisaged in said Plans must respect what is established there.

• Stating the consistency and coordination between the interventions with Structural Funds and the Cohesion Fund (mainly as regards water and waste).

• Systematic monitoring, by those responsible for the environment, of the environmental considerations covered in the compulsory form for Large-Scale Projects, as these are officially defined in the new period.

• Involvement of environmental authorities in the follow-up of the action. • Completion of the environmental indicators proposed. B.- General themes by Priorities which have to be covered in the annual reports in accordance with the CSF: Specifically analysing each of the Priorities of Development, a positive assessment must be made insofar as environmental considerations, established in the Community Support Framework, have reached a real cross-sectional approach by being present to a greater or lesser extent in each and all of these: PRIORITY 1: Improvement competitiveness and developing production This Priority took into account the important role that companies and SMEs in particular have in the real achievement of a model of sustainable development, considering the environment as an essential part of any modern and competitive business policy. Among the initial structural problems characterising the business fabric in Objective 1 regions is the insufficient integration of environmental considerations in the production process as a factor differentiating competitiveness. It would be desirable to have greater detail in the description of specific measures taken through the different plans and programmes approved. The annual implementation reports must contain, as regards this Priority, the degree of compliance of the following environmental objectives: • The degree to which companies are helping to promote competitiveness through improvement of the

environmental quality of production, as well as through technological and environmental audits. • Degree of adoption of environmental management systems at companies. • Specific projects of environmental production. • Favouring the inclusion of environmental criteria in the selection and evaluation of projects. • Planning environmental infrastructure facilities in industrial zones. • Promoting new jobs in relation with the environment. PRIORITY 3: The environment, Nature and Water Resources: Among the different Priorities for development proposed by the CSF one should stress as main innovation in respect of the previous programming period the existence of a specific Environment Priority, in turn subdivided into two sectors: One known as “Environment and Nature”, and the other called “Water resources”. As regards this last Priority, the services of the Commission have indicated that the annual implementation reports must detail, insofar as the measures for regeneration of beaches are concerned (measure 3.5) the aspects regarding environmental impact. Apart from this, greater detail in the description of Forestry measure (measure 3.9) would be desirable. PRIORITY 5: Local and Urban Development Urban zones focus a concentration of the effects of economic social and demographic changes, excessive consumption of power and natural resources and the generation of waste and contamination, and this is also where the inequalities in opportunities for access to work and social and cultural goods become most apparent. Economic prosperity and employment, social integration and protection of the environment must be objectives marking the strategies for action in the local and urban sphere. As regards this Priority, the annual implementation reports will have to determine the degree of compliance with the following environmental objectives: • Degree of conservation and improvement of the urban setting as a way to increase the quality of life. • Development and rational management of urban transport systems compatible with the environment. • Development and management of renewable energy sources. • Conservation of historic-artistic and cultural heritage. Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora THE COUNCIL OF THE EUROPEAN COMMUNITIES, Having regard to the Treaty establishing the European Economic Community, and in particular Article 130s thereof, Having regard to the proposal from the Commission(1), Having regard to the opinion of the European Parliament(2), Having regard to the opinion of the Economic and Social Committee(3), Whereas the preservation, protection and improvement of the quality of the environment, including the conservation of natural habitats and of wild fauna and flora, are an essential objective of general interest pursued by the Community, as stated in Article 130r of the Treaty; Whereas the European Community policy and action programme on the environment (1987 to 1992)(4) makes provision for measures regarding the conservation of nature and natural resources; Whereas, the main aim of this Directive being to promote the maintenance of biodiversity, taking account of economic, social, cultural and regional requirements, this Directive makes a contribution to the general objective of sustainable development; whereas the maintenance of such biodiversity may in certain cases require the maintenance, or indeed the encouragement, of human activities; Whereas, in the European territory of the Member States, natural habitats are continuing to deteriorate and an increasing number of wild species are seriously threatened; whereas given that the threatened habitats and species form part of the Community's natural heritage and the threats to them are often of a transboundary nature, it is necessary to take measures at Community level in order to conserve them; Whereas, in view of the threats to certain types of natural habitat and certain species, it is necessary to define them as having priority in order to favour the early implementation of measures to conserve them; Whereas, in order to ensure the restoration or maintenance of natural habitats and species of Community interest at a favourable conservation status, it is necessary to designate special areas of conservation in order to create a coherent European ecological network according to a specified timetable; Whereas all the areas designated, including those classified now or in the future as special protection areas pursuant to Council Directive 79/409/EEC of 2 April 1979 on the conservation of wild birds(5), will have to be incorporated into the coherent European ecological network; Whereas it is appropriate, in each area designated, to implement the necessary measures having regard to the conservation objectives pursued; Whereas sites eligible for designation as special areas of conservation are proposed by the Member States but whereas a procedure must nevertheless be laid down to allow the designation in exceptional cases of a site which has not been proposed by a Member State but which the Community considers essential for either the maintenance or the survival of a priority natural habitat type or a priority species; Whereas an appropriate assessment must be made of any plan or programme likely to have a significant effect on the conservation objectives of a site which has been designated or is designated in future; Whereas it is recognized that the adoption of measures intended to promote the conservation of priority natural habitats and priority species of Community interest is a common responsibility of all Member States; whereas this may, however, impose an excessive financial burden on certain Member States given, on the one hand, the uneven distribution of such habitats and species throughout the Community and, on the other hand, the fact that the "polluter pays" principle can have only limited application in the special case of nature conservation; Whereas it is therefore agreed that, in this exceptional case, a contribution by means of Community co-financing should be provided for within the limits of the resources made available under the Community's decisions; Whereas land-use planning and development policies should encourage the management of features of the landscape which are of major importance for wild fauna and flora; Whereas a system should be set up for surveillance of the conservation status of the natural habitats and species covered by this Directive; Whereas a general system of protection is required for certain species of flora and fauna to complement Directive 79/409/EEC; whereas provision should be made for management measures for certain species, if their conservation status so warrants, including the prohibition of certain means of capture or killing, whilst providing for the possibility of derogations on certain conditions; Whereas, with the aim of ensuring that the implementation of this Directive is monitored, the Commission will periodically prepare a composite report based, inter alia, on the information sent to it by the Member States regarding the application of national provisions adopted under this Directive; Whereas the improvement of scientific and technical knowledge is essential for the implementation of this Directive; whereas it is consequently appropriate to encourage the necessary research and scientific work; Whereas technical and scientific progress mean that it must be possible to adapt the Annexes; whereas a procedure should be established whereby the Council can amend the Annexes; Whereas a regulatory committee should be set up to assist the Commission in the implementation of this Directive and in particular when decisions on Community co-financing are taken; Whereas provision should be made for supplementary measures governing the reintroduction of certain native species of fauna and flora and the possible introduction of non-native species;

Whereas education and general information relating to the objectives of this Directive are essential for ensuring its effective implementation, HAS ADOPTED THIS DIRECTIVE: Definitions Article 1 For the purpose of this Directive: (a) conservation means a series of measures required to maintain or restore the natural habitats and the populations of species of wild fauna and flora at a favourable status as defined in (e) and (i); (b) natural habitats means terrestrial or aquatic areas distinguished by geographic, abiotic and biotic features, whether entirely natural or semi-natural; (c) natural habitat types of Community interest means those which, within the territory referred to in Article 2: (i) are in danger of disappearance in their natural range; or (ii) have a small natural range following their regression or by reason of their intrinsically restricted area; or (iii) present outstanding examples of typical characteristics of one or more of the five following biogeographical regions: Alpine, Atlantic, Continental, Macaronesian and Mediterranean. Such habitat types are listed or may be listed in Annex I; (d) priority natural habitat types means natural habitat types in danger of disappearance, which are present on the territory referred to in Article 2 and for the conservation of which the Community has particular responsibility in view of the proportion of their natural range which falls within the territory referred to in Article 2; these priority natural habitat types are indicated by an asterisk (*) in Annex I; (e) conservation status of a natural habitat means the sum of the influences acting on a natural habitat and its typical species that may affect its long-term natural distribution, structure and functions as well as the long-term survival of its typical species within the territory referred to in Article 2. The conservative status of a natural habitat will be taken as "favourable" when: - its natural range and areas it covers within that range are stable or increasing, and - the specific structure and functions which are necessary for its long-term maintenance exist and are likely to continue to exist for the foreseeable future, and - the conservation status of its typical species is favourable as defined in (i); (f) habitat of a species means an environment defined by specific abiotic and biotic factors, in which the species lives at any stage of its biological cycle; (g) species of Community interest means species which, within the territory referred to in Article 2, are: (i) endangered, except those species whose natural range is marginal in that territory and which are not endangered or vulnerable in the western palearctic region; or (ii) vulnerable, i.e. believed likely to move into the endangered category in the near future if the causal factors continue operating; or (iii) rare, i.e. with small populations that are not at present endangered or vulnerable, but are at risk. The species are located within restricted geographical areas or are thinly scattered over a more extensive range; or (iv) endemic and requiring particular attention by reason of the specific nature of their habitat and/or the potential impact of their exploitation on their habitat and/or the potential impact of their exploitation on their conservation status. Such species are listed or may be listed in Annex II and/or Annex IV or V; (h) priority species means species referred to in (g) (i) for the conservation of which the Community has particular responsibility in view of the proportion of their natural range which falls within the territory referred to in Article 2; these priority species are indicated by an asterisk (*) in Annex II; (i) conservation status of a species means the sum of the influences acting on the species concerned that may affect the long-term distribution and abundance of its populations within the territory referred to in Article 2; The conservation status will be taken as "favourable" when: - population dynamics data on the species concerned indicate that it is maintaining itself on a long-term basis as a viable component of its natural habitats, and - the natural range of the species is neither being reduced nor is likely to be reduced for the foreseeable future, and - there is, and will probably continue to be, a sufficiently large habitat to maintain its populations on a long-term basis; (j) site means a geographically defined area whose extent is clearly delineated; (k) site of Community importance means a site which, in the biogeographical region or regions to which is belongs, contributes significantly to the maintenance or restoration at a favourable conservation status of a natural habitat type in Annex I or of a species in Annex II and may also contribute significantly to the coherence of Natura 2000 referred to in Article 3, and/or contributes significantly to the maintenance of biological diversity within the biogeographic region or regions concerned. For animal species ranging over wide areas, sites of Community importance shall correspond to the places within the natural range of such species which present the physical or biological factors essential to their life and reproduction;

(l) special area of conservation means a site of Community importance designated by the Member States through a statutory, administrative and/or contractual act where the necessary conservation measures are applied for the maintenance or restoration, at a favourable conservation status, of the natural habitats and/or the populations of the species for which the site is designated; (m) specimen means any animal or plant, whether alive or dead, of the species listed in Annex IV and Annex V, any part or derivative thereof, as well as any other goods which appear, from an accompanying document, the packaging or a mark or label, or from any other circumstances, to be parts or derivatives of animals or plants of those species; (n) the committee means the committee set up pursuant to Article 20. Article 2 1. The aim of this Directive shall be to contribute towards ensuring bio-diversity through the conservation of natural habitats and of wild fauna and flora in the European territory of the Member States to which the Treaty applies. 2. Measures taken pursuant to this Directive shall be designed to maintain or restore, at favourable conservation status, natural habitats and species of wild fauna and flora of Community interest. 3. Measures taken pursuant to this Directive shall take account of economic, social and cultural requirements and regional and local characteristics. Conservation of natural habitats and habitats of species Article 3 1. A coherent European ecological network of special areas of conservation shall be set up under the title Natura 2000. This network, composed of sites hosting the natural habitat types listed in Annex I and habitats of the species listed in Annex II, shall enable the natural habitat types and the species' habitats concerned to be maintained or, where appropriate, restored at a favourable conservation status in their natural range. The Natura 2000 network shall include the special protection areas classified by the Member States pursuant to Directive 79/409/EEC. 2. Each Member State shall contribute to the creation of Natura 2000 in proportion to the representation within its territory of the natural habitat types and the habitats of species referred to in paragraph 1. To that effect each Member State shall designate, in accordance with Article 4, sites as special areas of conservation taking account of the objectives set out in paragraph 1. 3. Where they consider it necessary, Member States shall endeavour to improve the ecological coherence of Natura 2000 by maintaining, and where appropriate developing, features of the landscape which are of major importance for wild fauna and flora, as referred to in Article 10. Article 4 1. On the basis of the criteria set out in Annex III (Stage 1) and relevant scientific information, each Member State shall propose a list of sites indicating which natural habitat types in Annex I and which species in Annex II that are native to its territory the sites host. For animal species ranging over wide areas these sites shall correspond to the places within the natural range of such species which present the physical or biological factors essential to their life and reproduction. For aquatic species which range over wide areas, such sites will be proposed only where there is a clearly identifiable area representing the physical and biological factors essential to their life and reproduction. Where appropriate, Member States shall propose adaptation of the list in the light of the results of the surveillance referred to in Article 11. The list shall be transmitted to the Commission, within three years of the notification of this Directive, together with information on each site. That information shall include a map of the site, its name, location, extent and the data resulting from application of the criteria specified in Annex III (Stage 1) provided in a format established by the Commission in accordance with the procedure laid down in Article 21. 2. On the basis of the criteria set out in Annex III (Stage 2) and in the framework both of each of the five biogeographical regions referred to in Article 1 (c) (iii) and of the whole of the territory referred to in Article 2 (1), the Commission shall establish, in agreement with each Member State, a draft list of sites of Community importance drawn from the Member States' lists identifying those which lost one or more priority natural habitat types or priority species. Member States whose sites hosting one or more priority natural habitat types and priority species represent more than 5 % of their national territory may, in agreement with the Commission, request that the criteria listed in Annex III (Stage 2) be applied more flexibly in selecting all the sites of Community importance in their territory. The list of sites selected as sites of Community importance, identifying those which host one or more priority natural habitat types or priority species, shall be adopted by the Commission in accordance with the procedure laid down in Article 21. 3. The list referred to in paragraph 2 shall be established within six years of the notification of this Directive. 4. Once a site of Community importance has been adopted in accordance with the procedure laid down in paragraph 2, the Member State concerned shall designate that site as a special area of conservation as soon as possible and within six years at most, establishing priorities in the light of the importance of the sites for the maintenance or restoration, at a favourable conservation status, of a natural habitat type in Annex I or a species in Annex II and for the coherence of Natura 2000, and in the light of the threats of degradation or destruction to which those sites are exposed. 5. As soon as a site is placed on the list referred to in the third subparagraph of paragraph 2 it shall be subject to Article 6 (2), (3) and (4).

Article 5 1. In exceptional cases where the Commission finds that a national list as referred to in Article 4 (1) fails to mention a site hosting a priority natural habitat type or priority species which, on the basis of relevant and reliable scientific information, it considers to be essential for the maintenance of that priority natural habitat type or for the survival of that priority species, a bilateral consultation procedure shall be initiated between that Member State and the Commission for the purpose of comparing the scientific data used by each. 2. If, on expiry of a consultation period not exceeding six months, the dispute remains unresolved, the Commission shall forward to the Council a proposal relating to the selection of the site as a site of Community importance. 3. The Council, acting unanimously, shall take a decision within three months of the date of referral. 4. During the consultation period and pending a Council decision, the site concerned shall be subject to Article 6 (2). Article 6 1. For special areas of conservation, Member States shall establish the necessary conservation measures involving, if need be, appropriate management plans specifically designed for the sites or integrated into other development plans, and appropriate statutory, administrative or contractual measures which correspond to the ecological requirements of the natural habitat types in Annex I and the species in Annex II present on the sites. 2. Member States shall take appropriate steps to avoid, in the special areas of conservation, the deterioration of natural habitats and the habitats of species as well as disturbance of the species for which the areas have been designated, in so far as such disturbance could be significant in relation to the objectives of this Directive. 3. Any plan or project not directly connected with or necessary to the management of the site but likely to have a significant effect thereon, either individually or in combination with other plans or projects, shall be subject to appropriate assessment of its implications for the site in view of the site's conservation objectives. In the light of the conclusions of the assessment of the implications for the site and subject to the provisions of paragraph 4, the competent national authorities shall agree to the plan or project only after having ascertained that it will not adversely affect the integrity of the site concerned and, if appropriate, after having obtained the opinion of the general public. 4. If, in spite of a negative assessment of the implications for the site and in the absence of alternative solutions, a plan or project must nevertheless be carried out for imperative reasons of overriding public interest, including those of a social or economic nature, the Member State shall take all compensatory measures necessary to ensure that the overall coherence of Natura 2000 is protected. It shall inform the Commission of the compensatory measures adopted. Where the site concerned hosts a priority natural habitat type and/or a priority species, the only considerations which may be raised are those relating to human health or public safety, to beneficial consequences of primary importance for the environment or, further to an opinion from the Commission, to other imperative reasons of overriding public interest. Article 7 Obligations arising under Article 6 (2), (3) and (4) of this Directive shall replace any obligations arising under the first sentence of Article 4 (4) of Directive 79/409/EEC in respect of areas classified pursuant to Article 4 (1) or similarly recognized under Article 4 (2) thereof, as from the date of implementation of this Directive or the date of classification or recognition by a Member State under Directive 79/409/EEC, where the latter date is later. Article 8 1. In parallel with their proposals for sites eligible for designation as special areas of conservation, hosting priority natural habitat types and/or priority species, the Member States shall send, as appropriate, to the Commission their estimates relating to the Community co-financing which they consider necessary to allow them to meet their obligations pursuant to Article 6 (1). 2. In agreement with each of the Member States concerned, the Commission shall identify, for sites of Community importance for which co-financing is sought, those measures essential for the maintenance or re-establishment at a favourable conservation status of the priority natural habitat types and priority species on the sites concerned, as well as the total costs arising from those measures. 3. The Commission, in agreement with the Member States concerned, shall assess the financing, including co-financing, required for the operation of the measures referred to in paragraph 2, taking into account, amongst other things, the concentration on the Member State's territory of priority natural habitat types and/or priority species and the relative burdens which the required measures entail. 4. According to the assessment referred to in paragraphs 2 and 3, the Commission shall adopt, having regard to the available sources of funding under the relevant Community instruments and according to the procedure set out in Article 21, a prioritized action framework of measures involving co-financing to be taken when the site has been designated under Article 4 (4). 5. The measures which have not been retained in the action framework for lack of sufficient resources, as well as those included in the abovementioned action framework which have not received the necessary co-financing or have only been partially co-financed, shall be reconsidered in accordance with the procedure set out in Article 21, in the context of the two-yearly review of the action framework and may, in the maintime, be postponed by the Member States pending such review. This review shall take into account, as appropriate, the new situation of the site concerned. 6. In areas where the measures dependent on co-financing are postponed, Member States shall refrain from any new measures likely to result in deterioration of those areas.

Article 9 The Commission, acting in accordance with the procedure laid down in Article 21, shall periodically review the contribution of Natura 2000 towards achievement of the objectives set out in Article 2 and 3. In this context, a special area of conservation may be considered for declassification where this is warranted by natural developments noted as a result of the surveillance provided for in Article 11. Article 10 Member States shall endeavour, where they consider it necessary, in their land-use planning and development policies and, in particular, with a view to improving the ecological coherence af the Natura 2000 network, to encourage the management of features of the landscape which are of major importance for wild fauna and flora. Such features are those which, by virtue of their linear and continuous structure (such as rivers with their banks or the traditional systems for marking field boundaries) or their function as stepping stones (such as ponds or small woods), are essential for the migration, dispersal and genetic exchange of wild species. Article 11 Member States shall undertake surveillance of the conservation status of the natural habitats and species referred to in Article 2 with particular regard to priority natural habitat types and priority species. Protection of species Article 12 1. Member States shall take the requisite measures to establish a system of strict protection for the animal species listed in Annex IV (a) in their natural range, prohibiting: (a) all forms of deliberate capture or killing of specimens of these species in the wild; (b) deliberate disturbance of these species, particularly during the period of breeding, rearing, hibernation and migration; (c) deliberate destruction or taking of eggs from the wild; (d) deterioration or destruction of breeding sites or resting places. 2. For these species, Member States shall prohibit the keeping, transport and sale or exchange, and offering for sale or exchange, of specimens taken from the wild, except for those taken legally before this Directive is implemented. 3. The prohibition referred to in paragraph 1 (a) and (b) and paragraph 2 shall apply to all stages of life of the animals to which this Article applies. 4. Member States shall establish a system to monitor the incidential capture and killing of the animal species listed in Annex IV (a). In the light of the information gathered, Member States shall take further research or conservation measures as required to ensure that incidental capture and killing does not have a significant negative impact on the species concerned. Article 13 1. Member States shall take the requisite measures to establish a system of strict protection for the plant species listed in Annex IV (b), prohibiting: (a) the deliberate picking, collecting, cutting, uprooting or destruction of such plants in their natural range in the wild; (b) the keeping, transport and sale or exchange and offering for sale or exchange of specimens of such species taken in the wild, except for those taken legally before this Directive is implemented. 2. The prohibitions referred to in paragraph 1 (a) and (b) shall apply to all stages of the biological cycle of the plants to which this Article applies. Article 14 1. If, in the light of the surveillance provided for in Article 11, Member States deem it necessary, they shall take measures to ensure that the taking in the wild of specimens of species of wild fauna and flora listed in Annex V as well as their exploitation is compatible with their being maintained at a favourable conservation status. 2. Where such measures are deemed necessary, they shall include continuation of the surveillance provided for in Article 11. Such measures may also include in particular: - regulations regarding access to certain property, - temporary or local prohibition of the taking of specimens in the wild and exploitation of certain populations, - regulation of the periods and/or methods of taking specimens, - application, when specimens are taken, of hunting and fishing rules which take account of the conservation of such populations, - establishment of a system of licences for taking specimens or of quotas, - regulation of the purchase, sale, offering for sale, keeping for sale or transport for sale of specimens, - breeding in captivity of animal species as well as artificial propagation of plant species, under strictly controlled conditions, with a view to reducing the taking of specimens of the wild, - assessment of the effect of the measures adopted.

Article 15 In respect of the capture or killing of species of wild fauna listed in Annex V (a) and in cases where, in accordance with Article 16, derogations are applied to the taking, capture or killing of species listed in Annex IV (a), Member States shall prohibit the use of all indiscriminate means capable of causing local disappearance of, or serious disturbance to, populations of such species, and in particular: (a) use of the means of capture and killing listed in Annex VI (a); (b) any form of capture and killing from the modes of transport referred to in Annex VI (b). Article 16 1. Provided that there is no satisfactory alternative and the derogation is not detrimental to the maintenance of the populations of the species concerned at a favourable conservation status in their natural range, Member States may derogate from the provisions of Articles 12, 13, 14 and 15 (a) and (b): (a) in the interest of protecting wild fauna and flora and conserving natural habitats; (b) to prevent serious damage, in particular to crops, livestock, forests, fisheries and water and other types of property; (c) in the interests of public health and public safety, or for other imperative reasons of overriding public interest, including those of a social or economic nature and beneficial consequences of primary importance for the environment; (d) for the purpose of research and education, of repopulating and re-introducing these species and for the breedings operations necessary for these purposes, including the artificial propagation of plants; (e) to allow, under strictly supervised conditions, on a selective basis and to a limited extent, the taking or keeping of certain specimens of the species listed in Annex IV in limited numbers specified by the competent national authorities. 2. Member States shall forward to the Commission every two years a report in accordance with the format established by the Committee on the derogations applied under paragraph 1. The Commission shall give its opinion on these derogations within a maximum time limit of 12 months following receipt of the report and shall give an account to the Committee. 3. The reports shall specify: (a) the species which are subject to the derogations and the reason for the derogation, including the nature of the risk, with, if appropriate, a reference to alternatives rejected and scientific data used; (b) the means, devices or methods authorized for the capture or killing of animal species and the reasons for their use; (c) the circumstances of when and where such derogations are granted; (d) the authority empowered to declare and check that the required conditions obtain and to decide what means, devices or methods may be used, within what limits and by what agencies, and which persons are to carry but the task; (e) the supervisory measures used and the results obtained. Information Article 17 1. Every six years from the date of expiry of the period laid down in Article 23, Member States shall draw up a report on the implementation of the measures taken under this Directive. This report shall include in particular information concerning the conservation measures referred to in Article 6 (1) as well as evaluation of the impact of those measures on the conservation status of the natural habitat types of Annex I and the species in Annex II and the main results of the surveillance referred to in Article 11. The report, in accordance with the format established by the committee, shall be forwarded to the Commission and made accessible to the public. 2. The Commission shall prepare a composite report based on the reports referred to in paragraph 1. This report shall include an appropriate evaluation of the progress achieved and, in particular, of the contribution of Natura 2000 to the achievement of the objectives set out in Article 3. A draft of the part of the report covering the information supplied by a Member State shall be forwarded to the Member State in question for verification. After submission to the committee, the final version of the report shall be published by the Commission, not later than two years after receipt of the reports referred to in paragraph 1, and shall be forwarded to the Member States, the European Parliament, the Council and the Economic and Social Committee. 3. Member States may mark areas designated under this Directive by means of Community notices designed for that purpose by the committee. Research Article 18 1. Member States and the Commission shall encourage the necessary research and scientific work having regard to the objectives set out in Article 2 and the obligation referred to in Article 11. They shall exchange information for the purposes of proper coordination of research carried out at Member State and at Community level. 2. Particular attention shall be paid to scientific work necessary for the implementation of Articles 4 and 10, and transboundary cooperative research between Member States shall be encouraged. Article 19 Such amendments as are necessary for adapting Annexes I, II, III, V and VI to technical and scientific progress shall be adopted by the Council acting by qualified majority on a proposal from the Commission. Such amendments as are necessary for adapting Annex IV to technical and scientific progress shall be adopted by the Council acting unanimously on a proposal from the Commission. Committee Article 20 The Commission shall be assisted by a committee consisting of representatives of the Member States and chaired by a representative of the Commission. Article 21 1. The representative of the Commission shall submit to the committee a draft of the measures to be taken. The committee shall deliver its opinion on the draft within a time limit which the Chairman may lay down according to the urgency of the matter. The opinion shall be delivered by the majority laid down in Article 148 (2) of the Treaty in the case of decisions which the Council is required to adopt on a proposal from the Commission. The votes of the representatives of the Member States within the committee shall be weighted in the manner set out in that Article. The Chairman shall not vote. 2. The Commission shall adopt the measures envisaged if they are in accordance with the opinion of the committee. If the measures envisaged are not in accordance with the opinion of the committee, or if no opinion is delivered, the Commission shall, without delay, submit to the Council a proposal relating to the measures to be taken. The Council shall act by a qualified majority. If, on the expiry of three months from the date of referral to the Council, the Council has not acted, the proposed measures shall be adopted by the Commission. Supplementary provisions Article 22 In implementing the provisions of this Directive, Member States shall: (a) study the desirability of re-introducing species in Annex IV that are native to their territory where this might contribute to their conservation, provided that an investigation, also taking into account experience in other Member States or elsewhere, has established that such re-introduction contributes effectively to re-establishing these species at a favourable conservation status and that it takes place only after proper consultation of the public concerned; (b) ensure that the deliberate introduction into the wild of any species which is not native to their territory is regulated so as not to prejudice natural habitats within their natural range or the wild native fauna and flora and, if they consider it necessary, prohibit such introduction. The results of the assessment undertaken shall be forwarded to the committee for information; (c) promote education and general information on the need to protect species of wild fauna and flora and to conserve their habitats and natural habitats. Final provisions Article 23 1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive within two years of its notification. They shall forthwith inform the Commission thereof. 2. When Member States adopt such measures, they shall contain a reference to this Directive or be accompanied by such reference on the occasion of their official publication. The methods of making such a reference shall be laid down by the Member States. 3. Member States shall communicate to the Commission the main provisions of national law which they adopt in the field covered by this Directive. a. Las primeras repoblaciones forestales de más de 50 hectáreas, cuando entrañen riesgos de graves transformaciones ecológicas negativas.

b. Corta de arbolado con propósito de cambiar a otro tipo de uso del suelo, cuando no esté sometida a planes de ordenación y afecte a una superficie mayor de 20 hectáreas. No se incluye en este apartado la corta de cultivos arbóreos explotados a turno inferior a cincuenta años.

c. Proyectos para destinar terrenos incultos o áreas seminaturales a la explotación agrícola intensiva, que impliquen la ocupación de una superficie mayor de 100 hectáreas o mayor de 50 hectáreas en el caso de terrenos en los que la pendiente media sea igual o superior al 20 %.

d. Proyectos de gestión de recursos hídricos para la agricultura, con inclusión de proyectos de riego o de avenamientos de terrenos, cuando afecten a una superficie mayor de 100 hectáreas. No se incluyen los proyectos de consolidación y mejora de regadíos.

e. Instalaciones de ganadería intensiva que superen las siguientes capacidades: 1. 40.000 plazas para gallinas y otras aves.

2. 55.000 plazas para pollos. 3. 2.000 plazas para cerdos de engorde. 4. 750 plazas para cerdas de cría. 5. 2.000 plazas para ganado ovino y caprino. 6. 300 plazas para ganado vacuno de leche. 7. 600 plazas para vacuno de cebo. 8. 20.000 plazas para conejos.

Grupo 2. Industria extractiva.

a. Explotaciones y frentes de una misma autorización o concesión a cielo abierto de yacimientos minerales y demás recursos geológicos de las secciones A, B, C y D cuyo aprovechamiento está regulado por la Ley de Minas y normativa complementaria, cuando se dé alguna de las circunstancias siguientes:

1. Explotaciones en las que la superficie de terreno afectado supere las 25 hectáreas. 2. Explotaciones que tengan un movimiento total de tierras superior a 200.000 metros cúbicos/año. 3. Explotaciones que se realicen por debajo del nivel freático, tomando como nivel de referencia el más elevado entre las

oscilaciones anuales, o que pueden suponer una disminución de la recarga de acuíferos superficiales o profundos. 4. Explotaciones de depósitos ligados a la dinámica actual: fluvial, fluvio-glacial, litoral o eólica. Aquellos otros depósitos y

turberas que por su contenido en flora fósil puedan tener interés científico para la reconstrucción palinológica y paleoclimática Explotación de depósitos marinos.

5. Explotaciones visibles desde autopistas, autovías, carreteras nacionales y comarcales o núcleos urbanos superiores a 1.000 habitantes o situadas a distancias inferiores a 2 kilómetros de tales núcleos.

6. Explotaciones situadas en espacios naturales protegidos o en un área que pueda visualizarse desde cualquiera de sus límites establecidos, o que supongan un menoscabo a sus valores naturales.

7. Explotaciones de sustancias que puedan sufrir alteraciones por oxidación, hidratación, etc., y que induzcan, en límites superiores a los incluidos en las legislaciones vigentes, a acidez, toxicidad u otros parámetros en concentraciones tales que supongan riesgo para la salud humana o el medio ambiente, como las menas con sulfuros, explotaciones de combustibles sólidos, explotaciones que requieran tratamiento por lixiviación in situ y minerales radiactivos.

8. Explotaciones que se hallen ubicadas en terreno de dominio público hidráulico o en zona de policía de un cauce cuando se desarrollen en zonas especialmente sensibles, designadas en aplicación de las Directivas 79/409/CEE y 92/43/CEE, o en humedales incluidos en la lista del Convenio Ramsar.

9. Extracciones que, aun no cumpliendo ninguna de las condiciones anteriores, se sitúen a menos de 5 kilómetros de los límites del área que se prevea afectar por el laboreo y las instalaciones anexas de cualquier explotación o concesión minera a cielo abierto existente.

b. Minería subterránea en las explotaciones en las que se dé alguna de las circunstancias siguientes: 1. Que su paragénesis pueda, por oxidación, hidratación o disolución, producir aguas ácidas o alcalinas que den lugar a

cambios en el pH o liberen iones metálicos o no metálicos que supongan una alteración del medio natural. 2. Que exploten minerales radiactivos. 3. Aquéllas cuyos minados se encuentren a menos de 1 kilómetro (medido en plano) de distancia de núcleos urbanos, que

puedan inducir riesgos por subsidencia. En todos los casos se incluyen todas las instalaciones y estructuras necesarias para el tratamiento del mineral, acopios

temporales o residuales de estériles de mina o del aprovechamiento mineralúrgico (escombreras, presas y balsas de agua o de estériles, plantas de machaqueo o mineralúrgicas, etc.).

c. Dragados: 1. Dragados fluviales cuando se realicen en tramos de cauces o zonas húmedas protegidas designadas en aplicación de las

Directivas 79/409/CEE y 92/43/CEE, o en humedales incluidos en la lista del Convenio Ramsar y cuando el volumen extraído sea superior a 20.000 m3/año.

2. Dragados marinos para la obtención de arena, cuando el volumen a extraer sea superior a 3.000.000 de m3/año. d. Extracción de petróleo y gas natural con fines comerciales, cuando la cantidad extraída sea superior a 500 toneladas por día

en el caso del petróleo y de 500.000 metros cúbicos por día en el caso del gas, por concesión.

Grupo 3. Industria energética.

a. Refinerías de petróleo bruto (con la exclusión de las empresas que produzcan únicamente lubricantes a partir de petróleo bruto), así como las instalaciones de gasificación y de licuefacción de, al menos, 500 toneladas de carbón de esquistos bituminosos (o de pizarra bituminosa) al día. b. Centrales térmicas y nucleares:

1. Centrales térmicas y otras instalaciones de combustión con potencia térmica de, al menos, 300 MW. 2. Centrales nucleares y otros reactores nucleares, incluidos el desmantelamiento o clausura definitiva de tales centrales

y reactores (con exclusión de las instalaciones de investigación para la producción y transformación de materiales fisionables y fértiles, cuya potencia máxima no supere 1 kW de carga térmica continua). Las centrales nucleares y otros reactores nucleares dejan de considerarse como tales instalaciones cuando la totalidad del combustible nuclear y de otros elementos radiactivamente contaminados haya sido retirada de modo definitivo del lugar de la instalación. c. Instalación de reproceso de combustibles nucleares irradiados. d. Instalaciones diseñadas para cualquiera de los siguientes fines:

1. La producción o enriquecimiento de combustible nuclear. 2. El tratamiento de combustible nuclear irradiado o de residuos de alta actividad. 3. El depósito final del combustible nuclear irradiado. 4. Exclusivamente el depósito final de residuos radiactivos. 5. Exclusivamente el almacenamiento (proyectado para un período superior a diez años) de combustibles nucleares

irradiados o de residuos radiactivos en un lugar distinto del de producción. e. Instalaciones industriales para la producción de electricidad, vapor y agua caliente con potencia térmica superior a 300MW. f. Tuberías para el transporte de gas y petróleo con un diámetro de más de 800 milímetros y una longitud superior a 40 km. g. Construcción de líneas aéreas para el transporte de energía eléctrica con un voltaje igual o superior a 220 kV y una longitud superior a 15 kilómetros. h. Instalaciones para el almacenamiento de productos petrolíferos mayores de 100.000 toneladas. i. Instalaciones para la utilización de la fuerza del viento para la producción de energía (parques eólicos) que tengan 50 o más aerogeneradores, o que se encuentren a menos de 2 kilómetros de otro parque eólico.

Grupo 4. Industria siderúrgica y del mineral. Producción y elaboración de metales.

a. Plantas siderúrgicas integrales. Instalaciones para la producción de metales en bruto no ferrosos a partir de minerales, de concentrados o de materias primas secundarias mediante procesos metalúrgicos, químicos o elecrolíticos. b. Instalaciones destinadas a la extracción de amianto, así como el tratamiento y transformación del amianto y de los productos que contienen amianto: para los productos de amianto-cemento, con una producción anual de más de 20.000 toneladas de productos acabados; para los usos del amianto como materiales de fricción, con una producción anual de más de 50 toneladas de productos acabados; para los demás usos del amianto, una utilización anual de más de 200 tns. c. Instalaciones para la producción de lingotes de hierro o de acero (fusión primaria o secundaria), incluidas las instalaciones de fundición continua de una capacidad de más de 2,5 toneladas por hora. d. Instalaciones para la elaboración de metales ferrosos en las que se realice alguna de las siguientes actividades:

1. Laminado en caliente con una capacidad superior a 20 toneladas de acero en bruto por hora. 2. Forjado con martillos cuya energía de impacto sea superior a 50 kilojulios por martillo y cuando la potencia térmica

utilizada sea superior a 20 MW. 3. Aplicación de capas protectoras de metal fundido con una capacidad de tratamiento de más de 2 tns de acero bruto/hora

e. Fundiciones de metales ferrosos con una capacidad de producción de más de 20 toneladas por día. f. Instalaciones para la fundición (incluida la aleación) de metales no ferrosos, con excepción de metales preciosos, incluidos

los productos de recuperación (refinado, restos de fundición, etc.), con una capacidad de fusión de más de 4 toneladas para el plomo y el cadmio o 20 toneladas para todos los demás metales, por día.

g. Instalaciones para el tratamiento de la superficie de metales y materiales plásticos por proceso electrolítico o químico, cuando el volumen de las cubetas empleadas para el tratamiento sea superior a 30 metros cúbicos. h. Instalaciones de calcinación y de sinterizado de minerales metálicos, con capacidad superior a 5.000 tns/año de mineral procesado. i. Instalaciones para la fabricación de cemento o de clinker en hornos rotatorios, con una capacidad de producción superior a 500 tns diarias, o de clinker en hornos de otro tipo, con una capacidad de producción superior a 50 tns al día. Instalaciones dedicadas a la fabricación de cal en hornos rotatorios, con capacidad de producción superior a 50 tns/día. j. Instalaciones para la fabricación de vidrio, incluida la fibra de vidrio, con una capacidad de fusión superior a 20 tns/día. k. Instalaciones para la fundición de sustancias minerales, incluida la producción de fibras minerales, con una capacidad de fundición superior a 20 toneladas por día. l. Instalaciones para la fabricación de productos cerámicos mediante horneado, en particular, tejas, ladrillos, ladrillos refractarios, azulejos, gres o porcelana, con una capacidad de producción superior a 75 tns/día y/o una capacidad de horneado de más de 4 m3 y más de 300 kg por metro cúbico de densidad de carga por horno.

Grupo 5. Industria química, petroquímica, textil y papelera.

a. Instalaciones químicas integradas, es decir, instalaciones para la fabricación a escala industrial de sustancias mediante transformación química, en las que se encuentran yuxtapuestas varias unidades vinculadas funcionalmente entre sí, y que se utilizan para: 1. La producción de productos químicos orgánicos básicos.

2. La producción de productos químicos inorgánicos básicos. 3. La producción de fertilizantes a base de fósforo, nitrógeno o potasio (fertilizantes simples o compuestos). 4. La producción de productos fitosanitarios básicos y de biocidas. 5. La producción de productos farmacéuticos básicos mediante un proceso químico o biológico. 6. La producción de explosivos.

b. Tuberías para el transporte de productos químicos con un diámetro de más de 800 mm y una longitud superior a 40 km c. Instalaciones para el almacenamiento de productos petroquímicos o químicos, con una capacidad de, al menos, 200.000 tn d. Plantas para el tratamiento previo (operaciones tales como el lavado, blanqueo, mercerización) o para el teñido de fibras o productos textiles cuando la capacidad de tratamiento supere las 10 toneladas diarias. e. Las plantas para el curtido de pieles y cueros cuando la capacidad de tratamiento supere las 12 toneladas de productos acabados por día. f. Plantas industriales para: 1. La producción de pasta de papel a partir de madera o de otras materias fibrosas similares. 2. La producción de papel y cartón, con una capacidad de producción superior a 200 toneladas diarias. g. Instalaciones de producción y tratamiento de celulosa con una capacidad de producción superior a 20 toneladas diarias.

Grupo 6. Proyectos de infraestructuras.

a. Carreteras: 1. Construcción de autopistas y autovías, vías rápidas y carreteras convencionales de nuevo trazado. 2. Actuaciones que modifiquen el trazado de autopistas, autovías, vías rápidas y carreteras convencionales preexistentes en una longitud continuada de más de 10 kilómetros. 3. Ampliación de carreteras convencionales que impliquen su transformación en autopista, autovía o carretera de doble calzada en una longitud continuada de más de 10 kilómetros.

b. Construcción de líneas de ferrocarril para tráfico de largo recorrido. c. Construcción de aeropuertos con pistas de despegue y aterrizaje de una longitud de, al menos, 2.100 metros. d. Puertos comerciales, pesqueros o deportivos. e. Espigones y pantalanes para carga y descarga conectados a tierra que admitan barcos de arqueo superior a 1.350 tns f. Obras costeras destinadas a combatir la erosión y obras marítimas que puedan alterar la costa, por ejemplo, por la construcción de diques, malecones, espigones y otras obras de defensa contra el mar, excluidos el mantenimiento y

la reconstrucción de tales obras, cuando estas estructuras alcancen una profundidad de, al menos, 12 metros con respecto a la bajamar máxima viva equinoccial.

Grupo 7. Proyectos de ingeniería hidráulica y de gestión del agua.

a. Presas y otras instalaciones destinadas a retener el agua o almacenarla permanentemente cuando el volumen nuevo o adicional de agua almacenada sea superior a 10.000.000 de metros cúbicos. b. Proyectos para la extracción de aguas subterráneas ola recarga artificial de acuíferos, si el volumen anual de agua extraída o aportada es igual o superior a 10.000.000 de metros cúbicos. c. Proyectos para el trasvase de recursos hídricos entre cuencas fluviales, excluidos los trasvases de agua potable por

tubería, en cualquiera de los siguientes casos: 1. Que el trasvase tenga por objeto evitarla posible escasez de agua y el volumen de agua trasvasada sea superior a

100.000.000 de metros cúbicos al año. 2. Que el flujo medio plurianual de la cuenca de la extracción supere los 2.000.000.000 de metros cúbicos al año y el

volumen de agua trasvasada supere el 5 % de dicho flujo. 3. En todos los demás casos, cuando alguna de las obras que constituye el trasvase figure entre las comprendidas en

este anexo I. d. Plantas de tratamiento de aguas residuales cuya capacidad sea superior a 150.000 habitantes-equivalentes. e. Perforaciones profundas para el abastecimiento de agua cuando el volumen de agua extraída sea superior a 10.000.000 m3

Grupo 8. Proyectos de tratamiento y gestión de residuos.

a. Instalaciones de incineración de residuos peligrosos definidos en el artículo 3.c) de la Ley 10/1998, de 21 de abril, de Residuos, así como las de eliminación de dichos residuos mediante depósito en vertedero, depósito de seguridad o tratamiento químico (como se define en el epígrafe D9 del anexo HA de la Directiva 75/442/CEE, del Consejo, de 1 5 de julio, relativa a los residuos). b. Instalaciones de incineración de residuos no peligrosos o de eliminación de dichos residuos mediante tratamiento químico (como define el epígrafe D9 del anexo HA de la Directiva 75/442/CEE), con una capacidad superior a 100 tns diarias. c. Vertederos de residuos no peligrosos que reciban más de 10 toneladas por día o que tengan una capacidad total de más de 25.000 toneladas, excluidos los vertederos de residuos inertes.

Grupo 9. Otros proyectos.

a. Transformaciones de uso del suelo que impliquen eliminación de la cubierta vegetal arbustiva, cuando dichas transformaciones afecten a superficies superiores a 100 hectáreas. b. Los siguientes proyectos correspondientes a actividades listadas en el anexo I que, no alcanzando los valores de los umbrales establecidos en el mismo, se desarrollen en zonas especialmente sensibles, designadas en aplicación de la Directiva 79/409/CEE, del Consejo, de 2 de abril, relativa a la conservación de la aves silvestres, y de la Directiva 92/43/CEE, del Consejo, de 21 de mayo, relativa a la conservación de los hábitats naturales y de la fauna y flora silvestres, o en humedales incluidos en la lista del Convenio de Ramsar: 1. Primeras repoblaciones forestales cuando entrañen riesgos de graves transformaciones ecológicas negativas. 2. Proyectos para destinar terrenos incultos o áreas seminaturales a la explotación agrícola intensiva que impliquen la ocupación de una superficie mayor de 10 hectáreas. 3. Proyectos de gestión de recursos hídricos para la agricultura, con inclusión de proyectos de riego o de avenamiento de terrenos, cuando afecten a una superficie mayor de 10 hectáreas. 4. Transformaciones de uso del suelo que impliquen eliminación de la cubierta vegetal cuando dichas

transformaciones afecten a superficies superiores a 10 hectáreas. 5. Concentraciones parcelarias. 6. Explotaciones y frentes de una misma autorización o concesión a cielo abierto de yacimientos minerales y demás

recursos geológicos de las secciones A, B, C y D, cuyo aprovechamiento está regulado por la Ley de Minas y normativa complementaria, cuando la superficie de terreno afectado por la explotación supere las 2,5 hectáreas o la explotación se halle ubicada en terreno de dominio público hidráulico, o en la zona de policía de un cauce.

7. Tuberías para el transporte de productos químicos y para el transporte de gas y petróleo con un diámetro de más de 800 milímetros y una longitud superior a 10 kilómetros.

8. Líneas aéreas para el transporte de energía eléctrica con una longitud superior a 3 kilómetros. 9. Parques eólicos que tengan más de 10 aerogeneradores.

10. Plantas de tratamiento de aguas residuales. c. Los proyectos que se citan a continuación, cuando se desarrollen en zonas especialmente sensibles, designadas en aplicación de las Directivas 79/409/CEE y 92/43/CEE o en humedales incluidos en la lista del Convenio de Ramsar:

1. Instalaciones para la producción de energía hidroeléctrica. 2. Construcción de aeródromos. 3. Proyectos de urbanizaciones y complejos hoteleros fuera de las zonas urbanas y construcciones asociadas, incluida la construcción de centros comerciales y de aparcamientos. 4. Pistas de esquí, remontes y teleféricos y construcciones asociadas. 5. Parques temáticos. 6. Vertederos de residuos no peligrosos no incluidos en el grupo 8 de este anexo I, así como de residuos inertes

que ocupen más de 1 hectárea de superficie medida en verdadera magnitud. 7. Obras de encauzamiento y proyectos de defensa de cursos naturales. 8. Instalaciones de conducción de agua a larga distancia cuando la longitud sea mayor de 10 kilómetros y la

capacidad máxima de conducción sea superior a 5 metros cúbicos/segundo. 9. Concentraciones parcelarias.

Nota: el fraccionamiento de proyectos de igual naturaleza y realizados en el mismo espacio físico no impedirá la aplicación de los umbrales establecidos en este anexo, a cuyos efectos se acumularán las magnitudes o dimensiones de cada uno de los proyectos considerados.

ANEXO II: Proyectos contemplados en el apartado 2 del artículo 1: “Los proyectos públicos o privados, consistentes en la realización de las obras, instalaciones o de cualquier otra actividad comprendida en el anexo II de este Real Decreto legislativo sólo deberán someterse a una evaluación de impacto ambiental en la forma prevista en esta disposición, cuando así lo decida el órgano ambiental en cada caso. La decisión, que debe ser motivada y pública, se ajustará a los criterios establecidos en el Anexo III”:

Grupo 1. Agricultura, silvicultura, acuicultura y ganadería.

a. Proyectos de concentración parcelaria (excepto los incluidos en el anexo I). b. Primeras repoblaciones forestales cuando entrañen riesgos de graves transformaciones ecológicas negativas

(proyectos no incluidos en el anexo I). c. Proyectos de gestión de recursos hídricos para la agricultura, con inclusión de proyectos de riego o de avenamiento de terrenos cuando afecten a una superficie mayor de 10 hectáreas (proyectos no incluidos en el anexo I), o bien proyectos de consolidación y mejora de regadíos de más de 100 hectáreas. d. Proyectos para destinar áreas seminaturales a la explotación agrícola intensiva no incluidos en el anexo I. e. Instalaciones para la acuicultura intensiva que tenga una capacidad de producción superior a 500 tns/año. Grupo 2. Industrias de productos alimenticios.

a. Instalaciones industriales para la elaboración de grasas y aceites vegetales y animales, siempre que en la instalación se den de forma simultánea las circunstancias siguientes:

1. Que esté situada fuera de polígonos industriales. 2. Que se encuentre a menos de 500 metros de una zona residencial. 3. Que ocupe una superficie de, al menos, 1 hectárea.

b. Instalaciones industriales para el envasado y enlatado de productos animales y vegetales. Instalaciones cuya materia prima sea animal, exceptuada la leche, con una capacidad de producción superior a 75 toneladas por día de productos acabados, e instalaciones cuya materia prima sea vegetal con una capacidad de producción superior a 300 toneladas por día de productos acabados (valores medios trimestrales).

c. Instalaciones industriales para fabricación de productos lácteos, siempre que la instalación reciba una cantidad de leche superior a 200 toneladas por día (valor medio anual). d. Instalaciones industriales para la fabricación de cerveza y malta, siempre que en la instalación se den de forma simultánea las circunstancias siguientes: 1. Que esté situada fuera de polígonos industriales.

2. Que se encuentre a menos de 500 metros de una zona residencial. 3. Que ocupe una superficie de, al menos, 1 hectárea.

e. Instalaciones industriales para la elaboración de confituras y almíbares, siempre que en la instalación se den de forma simultánea las circunstancias siguientes: 1. Que esté situada fuera de polígonos industriales. 2. Que se encuentre a menos de 500 metros de una zona residencial. 3. Que ocupe una superficie de, al menos, 1 hectárea. f. Instalaciones para el sacrificio y/o despiece de animales con una capacidad de producción de canales superior a 50 tns/día. g.Instalaciones industriales para la fabricación de féculas, siempre que se den de forma simultánea las circunstancias siguientes:

1. Que esté situada fuera de polígonos industriales. 2. Que se encuentre a menos de 500 metros de una zona residencial. 3. Que ocupe una superficie de, al menos, 1 hectárea.

h. Instalaciones industriales para la fabricación de harina de pescado y aceite de pescado, siempre que en la instalación se den de forma simultánea las circunstancias siguientes:

1. Que esté situada fuera de polígonos industriales. 2. Que se encuentre a menos de 500 metros de una zona residencial. 3. Que ocupe una superficie de, al menos, 1 hectárea.

i. Azucareras con una capacidad de tratamiento de materia prima superior a las 300 toneladas diarias.

Grupo 3. Industria extractiva.

a. Perforaciones profundas, con excepción de las perforaciones para investigar la estabilidad de los suelos, en particular: 1. Perforaciones geotérmicas. 2. Perforaciones para el almacenamiento de residuos nucleares. 3. Perforaciones para el abastecimiento de agua. b. Instalaciones industriales en el exterior para la extracción de carbón, petróleo, gas natural, minerales y pizarras

bituminosas. c. Instalaciones industriales en el exterior y en el Interior para la gasificación del carbón y pizarras bituminosas.

Instalaciones de desalación o desalobración de agua con un volumen nuevo o adicional superior a 3.000 m3/día f. Instalaciones de conducción de agua a larga distancia cuando la longitud sea mayor de 40 kilómetros y la capacidad máxima de conducción sea superior a 5 metros cúbicos/segundo (proyectos no incluidos en el anexo I). g. Presas y otras instalaciones destinadas a retener el agua o almacenarla, siempre que se dé alguno de los ss supuestos: 1. Grandes presas según se definen en el Reglamento técnico de seguridad de presas y embalses, cuando no se encuentren incluidas en el anexo I. 2. Otras instalaciones destinadas a retener el agua, no incluidas en el apartado anterior, con capacidad de almacenamiento, nuevo o adicional, superior a 200.000 metros cúbicos. Grupo 9. Otros proyectos. a. Pistas permanentes de carreras y de pruebas para vehículos motorizados. b. Instalaciones de eliminación de residuos no incluidas en el anexo I. c. Depósitos de Iodos. d. Campamentos permanentes para tiendas de campaña o caravanas. i. Parques temáticos (proyectos no incluidos en el anexo I). j. Recuperación de tierras al mar. k. Cualquier cambio o ampliación de los proyectos que figuran en los anexos I y II, ya autorizados, ejecutados o en proceso de ejecución que puedan tener efectos adversos significativos sobre el medio ambiente, es decir, cuando se produzca alguna de las incidencias siguientes:

1. Incremento significativo de las emisiones a la atmósfera. 2. Incremento significativo de los vertidos a cauces públicos o al litoral. 3. Incremento significativo de la generación de residuos. 4. Incremento significativo en la utilización de recursos naturales. 5. Afección a áreas de especial protección designadas en aplicación de las Directivas 79/409/CEE y 92/43/CEE, o a

humedales incluidos en la lista del Convenio Ramsar. l. Los proyectos del anexo I que sirven exclusiva o principalmente para desarrollar o ensayar nuevos métodos o productos y que no se utilicen por más de dos años. Nota: el fraccionamiento de proyectos de igual naturaleza y realizados en el mismo espacio físico no impedirá la aplicación de los

umbrales establecidos en este anexo, a cuyos efectos se acumularán las magnitudes o dimensiones de cada uno de los proyectos considerados.

TRANSCRIPTION OF SPANISH LEGISLATION: DECREE 162/1990, DATED 15TH OCTOBER, OF THE GV GOVERNMENT COUNCIL, BY MEANS OF WHICH THE REGULATION FOR EXECUTION OF ACT 2/1989, DATED 3RD MARCH ON ENVIRONMENTAL IMPACT IS APPROVED (DOGV Nº 1412 DATED 20.10.1990) ANNEXES I PROJECTS SUBJECT TO EI DECLARATION) AND II (PROJECTS SUBJECT TO EI ESTIMATION) ANEXO I: (Proyectos sometidos a Declaración de Impacto Ambiental): Especificaciones relativas a las obras,

instalaciones o actividades comprendidas en el anexo de la Ley de la Generalitat Valenciana 2/1989, de 3 de marzo, de impacto ambiental:

1. Agricultura y zoología

a) Planes y proyectos de colonización rural.

a.1. Concentraciones parcelarias de terrenos de cultivo en secano, con superficie superior a 100 hectáreas. a.2. Reparcelaciones y asentamientos de colonos. a.3. Transformaciones de secano a regadío, en superficie superior a 100 hectáreas.

b) Proyectos de transformación a cultivo de terrenos seminaturales, naturales o incultos, cuando la superficie a transformar sea superior a 25 hectáreas o a 10 hectáreas en pendiente igual o superior al 15 por 100.

c) Repoblaciones forestales. Se entenderá por repoblaciones todas las plantaciones o siembras de especies forestales sobre suelos que durante los últimos cincuenta años no hayan estado sensiblemente cubiertos por árboles de las mismas especies que las que se trate de introducir, y todas aquellas que pretendan ejecutarse sobre terrenos que en los últimos diez años hayan estado desarbolados.

d) Intervenciones sobre suelos y vegetación que no estén directamente asociadas con su conservación y mejora a medio y largo plazo o con el ordenado aprovechamiento que garantice la persistencia del recurso. e) Planes de corrección hidrológico-forestal. f) Núcleos zoológicos: zoos y safaris. g) Piscifactorías y otros cultivos acuáticos, siempre que tengan más de 100 toneladas de carga. h) Proyectos de instalaciones ganaderas en las que concurran algunas de las siguientes circunstancias:

- Instalaciones de ganado vacuno con capacidad superior a 175 plazas de vacuno mayor, de aptitud cárnica o lechera. - Instalaciones con capacidad superior a 300 plazas de vacuno de engorde. - Instalaciones de ganado caprino u ovino con capacidad superior a 1.000 plazas. - Instalaciones de ganado porcino con capacidad superior a 350 plazas de reproductores en ciclo cerrado, o cebaderos de más de 800 plazas. - Instalaciones avícolas o cunícolas con capacidad superior a 20.000 plazas. i) Construcción de caminos rurales, de nuevo trazado, cuando hayan de discurrir por terrenos naturales, seminaturales o

incultos, situados en zonas boscosas o en laderas de montes. j) Instalaciones de industrias agroalimentarias. - Mataderos con capacidad superior a 1.000 toneladas/año. - Instalaciones de descuartizamiento de animales con capacidad superior a 4.000 toneladas/año. - Tratamiento de cuerpos, materias y despojos de animales en estado fresco con vistas a la extracción de cuerpos grasos. k) Proyectos de transformaciones a campos de golf de terrenos seminaturales, naturales o incultos., l) Transformaciones de uso del suelo que impliquen eliminación de la cubierta vegetal arbustiva o arbórea y supongan riesgo

potencial para las infraestructuras de interés general de la Nación y, en todo caso, cuando dichas transformaciones afecten a superficies superiores a 100 hectáreas.

2. Energía.

a) Extracción, preparación y aglomeración de combustibles sólidos (hulla, antracita y lignito) y coquerías. b) Extracción de crudos del petróleo. c) Refino de petróleo. d) Extracción y depuración de gas natural. e) Extracción de pizarras bituminosas. f) Producción de energía hidroeléctrica, termoeléctrica y nuclear, con excepción de la producida con grupos electrógenos. g) Transporte y distribución de energía eléctrica cuando el transporte no salga del territorio de la Comunidad Valenciana y el aprovechamiento de su distribución no afecte a cualquier otra Comunidad Autónoma,

siempre que concurra alguna de las circunstancias siguientes: - Cuando la tensión nominal entre fases sea igual o superior a 132 kv. - Cuando se trate de líneas de alta tensión que atraviesen en todo o en parte Parques o Parajes

Naturales, u otros Espacios Naturales Protegidos mediante Decreto de la Generalitat Valenciana. 3. Extracción y transformación de minerales no energéticos y productos derivados. Industrias químicas. a) Extracción y preparación de mineral de hierro y metálicos no ferrosos. b) Producción y primera transformación de metales.

- Siderurgia integral. - Del aluminio, cobre y otros metales no ferrosos.

c) Extracción de minerales no metálicos ni energéticos. c.1. Materiales de construcción (sustancias arcillosas, rocas y pizarras, elaboración de áridos por machaqueo, yesos,

rocas ornamentales). c.2. Amianto, así como su tratamiento y transformación y la de los productos que contienen amianto, siempre que concurra alguna de las siguientes circunstancias:

- Para los productos de amianto-cemento, una producción anual de más de 20.000 toneladas de productos terminados.

- Para las guarniciones de fricción, una producción anual de más de 50 toneladas de productos terminados. - Para otras utilizaciones de amianto, una utilización de más de 200 toneladas por año. c.3. Sales potásicas, fosfatos y nitratos. c.4. Sal común (sal marina y de manantial y sal gema). c.5. Piritas y azufre. c.6. Turbas. d) Industrias de productos minerales no metálicos.

- Fabricación de cementos. e) Instalaciones químicas integradas.

4. Industrias transformadoras de los metales

a) Fundiciones. b) Construcción de vehículos automóviles. c) Construcción de buques.

5. Otras industrias manufactureras:

Fabricación de pasta papelera. 6. Recuperación y/o eliminación de productos y su almacenamiento

a) Instalaciones de tratamiento y/o eliminación de desechos y residuos sólidos urbanos. b) Plantas depuradoras de aguas, de nueva construcción y sus modificaciones, situadas en terrenos seminaturales, naturales o

incultos clasificados como suelo no urbanizable, cuando se proyecten para más de 100.000 habitantes equivalentes, así como el sistema de colectores correspondiente, salvo en los casos que desarrollen características y trazado recogidos en instrumentos de ordenación del territorio con DIA positiva.

Emisarios submarinos y su ampliación. c) Desguace y/o almacenamiento de chatarra. d) Instalaciones de eliminación y/o tratamiento de residuos tóxicos y peligrosos por incineración, tratamiento físico y/o químico, o almacenamiento en tierra. e) Plantas de almacenamiento y/o tratamiento de residuos radioactivos.

7. Transportes por tubería (acueductos, oleoductos y gaseoductos) de nueva construcción, cuyo itinerario transcurra

íntegramente en el territorio de la Comunidad Valenciana, cuando discurran por terrenos seminaturales, naturales o incultos clasificados como suelo no urbanizable, salvo en los casos que desarrollen trazados recogidos en instrumentos de ordenación del territorio con Declaración de Impacto Ambiental positiva.

8. Proyectos de infraestructura.

a) Construcción de autopistas, autovías, carreteras, vías públicas o privadas de comunicación y líneas de ferrocarril de nueva

planta cuyo itinerario se desarrolle íntegramente en el territorio de la Comunidad Valenciana, salvo en los casos que desarrollen trazados y características recogidos en instrumentos de ordenación del territorio o en Estudios Informativos de

carreteras con Declaración positiva de Impacto Ambiental, y en los casos de construcción de líneas de tranvía cuyo trazado discurra íntegramente por suelo urbano.

b) Construcción y/o ampliación de aeropuertos y helipuertos que no sean de interés general y aeropuertos de uso particular. c) Construcción y/o ampliación de puertos de refugio, deportivos y de pesca que no sean de interés general, siempre que la

ampliación exceda de su delimitación actual y suponga una ganancia de terrenos al mar superior al 5% de su superficie actual, salvo en los casos que desarrollen actuaciones contempladas en Planes de Ordenación con Declaración positiva de Impacto Ambiental.

Planes de Ordenación de las zonas de servicio de los puertos, cuando contemplen obras descritas en el párrafo anterior. Vías navegables cuyo itinerario discurra íntegramente en el territorio de la Comunidad Valenciana. d) Realización de obras de regeneración y defensa de la costa. e) Presas y embalses de riego, siempre que concurra alguna de las siguientes circunstancias:

- Que su capacidad de embalse sea superior a cincuenta mil metros cúbicos. - Que la altura de muros o diques sea superior a seis metros desde la rasante del terreno.

f) Obras de canalización y/o regularización de cursos de agua, cuando discurran en terrenos seminaturales, naturales o incultos, clasificados como suelo no urbanizable, salvo en los casos que desarrollen trazados recogidos en instrumentos de ordenación del territorio con Declaración positiva de Impacto Ambiental o cuando constituyan conservación o mejora de las actualmente existentes, sin modificar su trazado.

g) Instrumentos de ordenación del territorio: Planes de Ordenación del Territorio, Planes de Acción Territorial, Programas de Ordenación del Territorio y Proyectos de Ejecución del Plan de Ordenación del Territorio de Coordinación. Planes Generales Municipales de Ordenación Urbana y Normas Complementarias y Subsidiarias del Planeamiento,

así como sus modificaciones y revisiones que afecten a suelos no urbanizables o supongan alteración o implantación de uso global industrial en suelo urbanizable. 9. Cualquier otro proyecto o actividad que mediante Decreto del Consell de la Generalitat Valenciana se considere que directa o indirectamente pueda tener efectos sobre la salud, el bienestar humano o el entorno. ANEXO II: Actividades sujetas a Estimación de Impacto Ambiental 1. Agricultura y zoología a) Planes y proyectos de colonización rural.

a.1. Concentraciones parcelarías de terrenos de cultivo en secano, con superficie comprendida entre 25 y 100 Has. a.2. Transformaciones de secano a regadío, con superficie comprendida entre 25 y 100 hectáreas.

b) Proyectos de transformación a cultivo de terrenos seminaturales, naturales o incultos, cuando se refieran a superficies comprendidas entre 5 y 25 hectáreas y en cualquier caso en pendientes iguales o superiores al 15 por 100. c) Proyectos que desarrollen sectorial o puntualmente planes globales que hayan sido objeto de Declaración Ambiental positiva. d) Piscifactorías y otros cultivos acuáticos, que tengan entre 25 y 100 toneladas de carga. e) Proyectos de instalaciones ganaderas en las que concurran las siguientes circunstancias:

- Instalaciones de ganado vacuno con capacidad comprendida entre 75 y 175 plazas de vacuno mayor, de aptitud cárnica o lechera.

- Instalaciones de ganado vacuno de engorde con capacidad comprendida entre 100 y 300 plazas de vacuno de engorde.

- Instalaciones de ganado ovino o caprino con capacidad comprendida entre 500 y 1.000 plazas. - Instalaciones de ganado porcino con capacidad comprendida entre 200 y 350 plazas de reproductores en ciclo

cerrado, o cebaderos con capacidad comprendida entre 400 y 800 plazas. - Instalaciones avícolas o cunícolas con capacidad comprendida entre 10.000 y 20.000 plazas.

f) Instalaciones de industrias agroalimentarias. - Instalaciones de descuartizamiento de animales con capacidad comprendida entre 1.000 y 4.000 toneladas/año. - Cervecerías y malterías. - Azucareras. - Fabricación de harina de huesos y gluten de pieles. - Producción de harina de pescado y extracción y tratamiento del aceite del pescado. - Fabricación de piensos compuestos.

2. Energía Transporte y distribución de energía eléctrica cuando el transporte no salga del territorio de la Comunidad Valenciana y el aprovechamiento de su distribución no afecte a otra Comunidad Autónoma, siempre que se dé alguna de las circunstancias siguientes:

- Que la tensión nominal entre fases esté comprendida entre 66 y 132 Kv. - Que se trate de líneas de alta tensión que atraviesen en todo o en parte bosques o masas de arbolado. 3. Proyectos de infraestructura.

a) Proyectos que desarrollen sectorial o puntualmente planes globales que hayan sido objeto de Declaración Ambiental positiva. b) Actuaciones en materias de vías de comunicación, exceptuadas las de conservación y mantenimiento, para las que se exija

información pública en su legislación sectorial. c) Presas y embalses de riego, siempre que concurra alguna de las circunstancias siguientes:

- Su capacidad esté comprendida entre 20.000 y 50.000 metros cúbicos. - La altura de diques o muros esté comprendida entre 4 y 6 metros.

d) Depósitos de agua de nueva construcción, siempre que se dé alguna de las circunstancias siguientes: - En los superficiales, que su capacidad sea superior a 9.000 metros cúbicos y que estén situados en terrenos naturales,

seminaturales o incultos, clasificados como suelo no urbanizable. - En los elevados, que su capacidad sea superior a 5.000 metros cúbicos, con altura superior a 9 metros, y que estén

situados en terrenos naturales, seminaturales o incultos, clasificados como suelo no urbanizable. e) Plantas depuradoras de aguas de nueva construcción así como el sistema de colectores correspondientes, cuando se proyecten para unos parámetros comprendidos entre 10.000 y 100.000 habitantes equivalentes. f) La instalación, ampliación o reforma de industrias o actividades generadoras o importadoras de residuos tóxicos o peligrosos o manipuladoras de productos de los que pudiera derivarse residuos del indicado carácter. g) Instalaciones de tratamiento y eliminación de residuos inertes, así como su ampliación. h) Proyectos de urbanización de planes parciales de uso industrial, que desarrollen Planes Generales de Ordenación Urbana o Normas Subsidiarias y Complementarias del Planeamiento no sometidos a Evaluación o Estimación de Impacto Ambiental. 4. Instrumentos de ordenación del territorio. a) Instrumentos de ordenación urbanística que desarrollen planeamiento de rango superior cuando así lo exija éste expresamente. b) Salvo en suelo urbano, Planes Especiales Autónomos y sus modificaciones. c) Planes Especiales de conservación de bellezas naturales, de protección del paisaje, de conservación y mejora del medio rural, y de protección de huertas, cultivos y espacios forestales.
