Problems and Concerns
a) Negligence Denotes the conduct of practice is
lacking in due care
b) Malpractice Professional negligence by act or
omission of a health care providerin which care provided deviatesfrom accepted standards ofpractice
Elements must be established to
prove negligence or malpractice:
1. A duty has owed – legal duty exists whenever a hospital or health care provider undertakes care or treatment of a patient
2. A duty was breached – health care provider failed to conform to the relevant standard of care

3. The breach causes an injury – breach of duty was the proximate cause of injury
4. Damages – economic (lost earning capacity, medical expenses, etc.)and non-economic (physical and psychological)
› Removal of Board Member - Any member ofthe Board may be removed by the Presidentof the Philippines for neglect ofduty, incompetency, malpractice orunprofessional, unethical, immoral ordishonorable conduct after having been givenopportunity to defend himself in a properadministrative investigation; Provided, Thatduring the process of investigation, thePresident shall have the power to suspendsuch member under investigation and appointa temporary member in his place.

The Board may, after giving proper notice andhearing to the party concerned reprimand anerring medical technologist or revoke orsuspend his certificate of registration for thecauses mentioned in the next preceding sectionor for causes enumerated in section twenty-nine(29) of the Act, or for unprofessional conduct,malpractice, incompetency, or serious ignoranceor gross negligence in the practice of medicaltechnology
