PREVENTATIVE MAINTENANCE PLANS – TERMS AND CONDITIONS: Heating Receive a 23-point annual check-up which includes; check operation of thermostat, check operation of safety limit controls, lubricate fan & motor bearings as required, check blower operation, check condition, tension and alignment of fan belt and adjust if necessary, clean burners and set for proper combustion & ignition, examine vent connector, clean pilot, check gas pilot safety system, remove debris from chimney “clean out”, check gas piping to furnace, replace/instruct customer on filter maintenance, clean equipment exterior, leave continuous pilot turned on, clean motor and fan in the fan compartment, check pressure switches and power vent system, check operation of venter blower, check condition of horizontal vented systems including exhaust & intake terminals, check spark ignition, check condition of condensate line, check temperature. In addition, cleaning of your “heating unit” including a safety test for carbon monoxide. “Flushing of the heat exchanger” or “additional cleaning” that is required due to insufficient maintenance is excluded fromcoverage and will be charged to you at our standard labour rate plus HST. Boiler system drainage and refill are excluded from any Heating/Cooling Maintenance Plan coverage. Cooling Receive a 12-point annual check-up which includes; amp draw for belted motor, Freon level, clean condenser coil, check furnace filter, (replacement not included), inform customer to take off air scoops & shut off basement supply grills, check breaker and/or fuses, inspect drain set-up, check thermostat, inspect low voltage wiring, open or close humidifier by-pass damper (as required), check temperatures and inspect for code or installations infractions. We will diagnose and replace any defective parts which have caused a refrigerant leak including refrigerant recovery, vacuuming and refill. Additional cleaning that is required due to insufficient maintenance is excluded from coverage and will be charged to you at our standard labour rate plus HST. Although we may attempt to remind you from time to time of any annual check-up or cleaning to which you may be entitled, we are not obligated to do so and you are responsible for contacting us to arrange any such annual check-up or cleaning at a mutually convenient time. We will not be responsible for any annual check-up or cleaning that is not provided due to you failing to contact us.

As a Contract Holder, you will receive a 10% Discount off the price of parts at all times. We will treat any of you Emergency Calls with the utmost priority and will respond within 12 to 24 hours.

1.The Customer agrees to:

a) Move any stock, fixtures or partitions to facilitate workers. b) Notify the technician of any unusual operating conditions. c) Employ only Lloyd HVAC Services Inc. or persons authorized by Lloyd HVAC Services Inc. to work

on HVAC equipment.

2. Lloyd HVAC Services Inc. will not be held liable for loss or damage, consequential or direct, arising from operation or failure of equipment and its controls, or for delays of service.

3. All work to be performed in workmanlike manner according to standard practice.

4. This agreement contingent upon strikes, accident or delays beyond our control. Owner to carry fire, windstorm and other necessary insurance.

5. Our workers are insured by the Workplace Safety and Insurance Board (WSIB).

6. Discounted rates do not apply to recommendations that were ignored or refused by customer.

Preventative Maintenance Contract - TERMS & CONDITIONS General Coverages: 1.Each piece of equipment receives an annual seasonal inspection and written tune-up report. 2.Contract holders have top priority when they need service. When you call for service you get a guaranteed appointment window.

- Maintenance scheduled at any time - Priority response guaranteed within 24 hrs- No overtime service Charges -Preferred pricing on purchase of new equipment Equipment Covered - Contracts are available for gas & electric furnaces, central air conditioners, ductless air conditioners, high velocity air conditioners, heat recovery ventilators, HEPA air filters, humidifiers and ultraviolet lights - Thermostat replacement with similar type if original fails Exclusions - Boiler heating sections, Firebox/combustion chamber, Complete unit replacement, Unit casings, Work required to bring units up to good operating condition at commencement of Contract, Gas supply piping, manual shut off valves, ductwork, diverter and venting systems and water piping, Turn on or off of equipment, Balancing of systems, Bleeding of radiators, Boiler system drainage and refill, Electrical wiring and breakers, Consumables, including but not limited to UV lights, steam bottles, custom filters, and media filters are excluded, Equipment serving more than one dwelling unit is not eligible for coverage. TERMS & CONDITIONS Please read carefully. Understanding of these terms and conditions is important so you obtain maximum benefits from your Contract. 1. To maintain the validity of this agreement the customer must:

- Operate the equipment according to its manufacturer's instructions. - Move anything that has to be moved to facilitate the work of personnel. - Employ only Lloyd HVAC Services Inc. personnel or those authorized by Lloyd HVAC Services Inc. to work on the equipment. - We will not reimburse you for work performed by others. - Promptly notify Lloyd HVAC Services Inc. of anything that happens to affect the equipment's working conditions. 2. Any material and work in addition to that promised by this Agreement will be furnished only on the customer's authorization and will be charged to the customer at prevailing rates. 3. Lloyd HVAC Services Inc. alone is the judge of how to best perform repairs and service under this Agreement. 4. The only service provided by this Agreement are those described on the Agreement for the equipment listed. No person is authorized to claim otherwise. 5. Contract coverage applies only to single family houses, town houses, condominiums and apartments. 6. We reserve the right to discontinue the Contract at any time. 7. Repairs to equipment covered under the Extended Warranty Program are governed by the terms of that program.

Billing and Payment 1. You agree to pay the amounts shown at the intervals on the face of the Agreement. HST will be added to all invoices. 2. All amounts are billed in advance and are due by the due date shown on the invoice. 3. Annual payments can be made by cheque or credit card (Visa or MasterCard) or via your Enbridge bill as outlined on contract.4. Overdue payments will be charged at a rate of 2% compounded monthly (24% annually). 5. If payments are not up to date, service may be refused. 6. Except as specifically stated in this Agreement, your payments are non-refundable.

Coverage Period & Renewal 1. Your Contract coverage comes into effect 10 working days after acceptance byLloyd HVAC Services Inc..2. The Contract is in effect for one year. Notification of any change in the terms or price will be forwarded within 30 days of the anniversary date. You have the right to cancel with written notice no later than 30 days before your anniversary date. 3. Lloyd HVAC Services Inc. may also cancel this Contract by providing written notice prior to the anniversary date.

Warranty 1. We are not liable for losses or damages resulting from misdiagnosis or delays in completing repairs. 2. Labour warranty is 90 days from the date of repair. 3. Parts warranty is one year from the date of repair. 4. We will not, under any circumstances, be liable for indirect, consequential or economic damages.5. Lloyd HVAC Services Inc. is not the manufacturer or supplier of the equipment to be serviced and as such we make no representations, warranties or conditions as to the performance of the equipment. 6. All parts replaced become our property and you agree to assign to Lloyd HVAC Services Inc. any assignable warranties available from the manufacturer or supplier of the part.

Cancellation 1. If you move, the Contract will remain in effect for the new owner or tenant for the balance of the coverage year. 2. At our option, we may credit the remaining balance of your Contract to a Contract at your new residence.

Personal Information 1. We collect and use personal information about you in order to establish and manage our business relationship with you. 2. Lloyd HVAC Services Inc. does not sell, rent or lease its customer lists to third parties. 3. You agree to promptly notify us of any change to your mailing address at least 30 days in advance of such change.

Exclusions 1. Diagnostic service, repair or replacement of items due to a manufacturer's part recall. 2. Diagnostic service, repair or replacement of items not covered under the Contract. 3. Repairs needed because of design faults or faults which existed before your Contract became effective. 4. Repairs needed as a result of abuse, vandalism, tampering, alterations or repairs by persons other than Lloyd HVAC Services Inc.5. Repairs required due to accidental or deliberate damage, theft, freezing weather conditions, structural repairs, lightening, explosion, earthquake, flood, storms, acts of war or other insurable risks. 6. The problem relates to improper sizing or application of equipment. 7. Renovation related work. 8. The heating/cooling equipment has been turned off. 9. The costs of redecoration and/or restoration required as a result of any work performed in connection with the Contract, including drywall, plaster, tile, cabinetry, paint, wallpaper and landscaping. 10. Loss or damage to property caused by drains breaking down. 11. Repairs needed if we previously advised you of permanent repairs to keep the system in good working order. 12. Removal of asbestos in conjunction with any service work under your Contract. 13. Repairs or relocation of equipment that is located in places that are unsafe to the service technician.

The problem relates to improper sizing or application of equipment. 7. Renovation related work. 8. The heating/cooling equipment has been turned off. 9. The costs of redecoration and/or restoration required as a result of any work performed in connection with the Contract, including drywall, plaster, tile, cabinetry, paint, wallpaper and landscaping. 10. Loss or damage to property caused by drains breaking down. 11. Repairs needed if we previously advised you of permanent repairs to keep the system in good working order. 12. Removal of asbestos in conjunction with any service work under your Contract. 13. Repairs or relocation of equipment that is located in places that are unsafe to the service technician.
