1. Introduction
1.1 Background
Dhaka Electric Supply Company Limited (DESCO) has taken a project titled: “Augmentation and Rehabilitation of Distribution System in DESCO Area” for strengthening institutional capacity and efficient delivery of their services. In this project, out of twenty four (24) substations, there are sixteen (16) substations are constructed as new, five substations are augmented and three (3) substations are rehabilitated.
The objective of this project is to strengthen the institutional capacity of DESCO through the improvement of infrastructure in the distribution system due to the increased demand and efficient supply of electricity to the Dhaka City dwellers. For this project, the Asian Development Bank (ADB) is providing the financial support based on the loan covenant between the ADB and the Government of Bangladesh (GoB). These 24 substations (subprojects) within the DESCO service area are being implemented and are required to maintain environmental and social safeguard status according to the ADB’s social safeguard policy and the loan covenants between the ADB and the GoB.
In this aspect, social safeguard compliance monitoring was conducted as following of 4th monitoring report (June 2018 to December 2018). This is the 5th monitoring report with timeline from January 2019 to June 2019. CEGIS monitoring field conducted monthly monitoring field visit and this report is the combination of those monthly monitoring filed finding. This study has monitored the social safeguard status during the construction phase of this Project. Although, during this time, construction activities of some of the proposed locations have been completed, it was carried out nevertheless. Based on the prepared checklist, social safeguard monitoring (5th phase) has been completed through monthly field visits considering the social safeguard indicators according to the project activities. All social safeguard related monitoring indicators like Compensation, Livelihood and Living Condition, Community Health, Safety and Security, and Labor and Working Condition are monitored with their corresponding compliance statuses at the construction phase of this Project. This 5th social safeguard monitoring has been prepared based on the field findings. The social safeguard has been analysed and measures have been advised/ suggested on any non-compliance issues found with an aim to achieve higher compliance at the next phase of monitoring.
1.2 Project Locations
During this phase of the study, the implementations of activities of 24 substations have been visited and their compliance statuses have been monitored following a prepared checklist. The list of the substations visited in this social safeguard monitoring plan is given below in Table 1.1

1.3 Objectives of the Safeguard Monitoring
Broad Objective
The broad objective of this social safeguard status monitoring is to observe how the social safeguard indicators are complied with the ADB’s Safeguard Policy, the Environmental Management Plan (EMP) (i.e. social safeguard indicators), and the loan covenant between the ADB and the GoB in the construction phase of the project.
Specific Objectives
There are some specific objectives in relation to the aforesaid broad objective of this compliance monitoring. The specific objectives of the social safeguard compliance monitoring are to:
i. analyze the Environmental and Social Safeguarding laws and policies of the ADB and the GoB;
ii. monitor working condition and occupational health and safety during project implementation phase; and
iii. Provide suggestions and measures addressing the non-compliance issues.
1.4 Scope of the Social Safeguard Monitoring
In line with the aforementioned objectives the scope of the services should cover the following:
i. Review of social management and social monitoring plan suggested in the EIA report in line with the action plan proposed by ADB;
ii. Upgrade (if required) the social safeguard monitoring framework and work plan specifying the social indicators, methods, location, time, frequency of monitoring provided by the EMP of EIA report;
iii. Conduct monthly monitoring on the construction activities to see their compliance with national environmental and social regulations, and ADB’s performance standards on social sustainability.
iv. Assess that all mitigation measures through physical observation to confirm EMP and action plan;
v. Conduct monthly monitoring on socio-economic issues like community safeguard issues due to pollution, hazards and employment opportunity;
vi. Ensure social safeguard, regarding the national laws and policy. ;
vii. Keep close liaison with the project implementation office (Project Director), and EPC contractor;
viii. Provide a monitoring report (combination of monthly monitoring field visit) at the end of every six (6) months in line with the reporting requirement of ADB satisfying equator principles.

1.5 Monitoring and Policy Standard
This compliance monitoring report is prepared based on following ADB safeguard policy and ADB loan covenant.
1.5.1 ADB Safeguard Policy
The Safeguard Policy Statement 2009 (SPS 2009) of the ADB has been reviewed to understand the compliance and terms of partnership with the GoB. The GoB amended the ECR1997whereas the construction of substation is now under the Orange B category like the ADB categorization under their Social Safeguard Policy. However, for the compliance monitoring study, social safeguard indicators in EMP are considered as the measure of compliance which was prepared during the period of EIA study. In addition, the standards determined by this policy are followed during this study. The standards for social safeguard issues have been identified which would make this project socio-economic friendly. For this reason, this monitoring considers the risk of electrocution, safety measures within the construction site, emergency plan, livelihood challenges, restoration process, compensation process, whether any complaints from affected people would be noted and provide clear measures at the construction phase of the project. Thus, a standard checklist is prepared with an aim to qualify the social safeguard compliance issues through monthly field visits during the construction stage of the project.
1.5.2 ADB Loan Covenants with DESCO
According to the Loan Covenant Article (II), Section 2.01, DESCO should carry out the project with due diligence and efficiency and in conformity with sound administrative, financial, engineering, environmental and power sector practices. For the execution of the project, the following criteria should be followed. In this respect, social safeguard standard would be maintained in terms of occupational health and safety, employment opportunity, and community social safety due to the project implementation.
Implementation Arrangement
DESCO should ensure the project implementation in accordance with the detailed arrangements set forth in the Project Administration Manual (PAM). Besides, it is the responsibility of DESCO to ensure whether their project management staff have the related qualifications to undertake necessary tasks of procurement, construction, supervision, inspection, and testing of equipment, payments to contractors, monitoring and safeguard environmental and social implications with due diligence and reporting of progress relevant to the components through appropriate channel to the appropriate authorities.
Environment
DESCO should ensure that the preparation, design, construction, implementation, operation, and decommissioning of the project and all project facilities comply with;
• all applicable laws and regulations of the relating to environment, health and safety;
• the environmental safeguard policy;
• the Environmental Assessment and Review Framework (EARF);
• all measures and requirements set forth in the respective IEE and EMP and any corrective or preventive actions set forth in a safeguard monitoring report;

• Land Acquisition and Involuntary Resettlement1;
• all land acquisition and resettlement activities related compliances;
• compensation and other entitlements provided to affected people in accordance with the RP (if required); and
• a comprehensive income and livelihood restoration program established in accordance with the RP (if required).
Human and financial Resources to implement Safeguards Requirements
The DESCO should make available, or cause the project executing agency to make available, necessary budgetary and human resources to fully implement the EMP, the RP and any small ethnic community peoples planning framework.
Safeguards-related provisions in bidding documents and works and work contracts
The DESCO should ensure the following compliance in relation to contract or bidding during the project implementation.
• Comply with the measures and requirements relevant to the contractor set forth in the IEE, EMP and RP (if required) any small ethnic community peoples plan and any corrective or preventive actions set out in a safeguard monitoring report.
• Make available a budget for all such environmental and social measures
• Provide the borrower with a written notice of any unanticipated environmental, resettlement or small ethnic community peoples plan.
• Adequately record the condition of roads, agricultural land, and other infrastructure prior to starting to transport materials and construction
• Fully reinstate pathways other local infrastructure and agricultural land to at least their pre-project condition upon the completion of construction.
Safeguard Monitoring and Reporting
The DESCO should comply the following section:
• Submit semiannual safeguards monitoring reports to ADB and disclose relevant information from such reports to the affected person
• Any anticipated environmental and social as well as impacts arise during the construction, implementation, or operation of the project that were not considered in the IEE, the EMP or the RP promptly inform ADB of the occurrence of such risks and impacts with detailed description of the events and proposed corrective action plans.
• The Monitoring process should be verified by the external experts
• Reporting would be completed based on the any potential beach of compliance with the measures and requirements set forth in the EMP
Labor standards

Following labor standards should be followed as per AND loan covenants:
• Comply with all applicable labor law and related international treaty obligations of the borrower and do not employ child labor as defined under the Bangladesh law
• Provide Safe working condition for male and female workers
• Carry out HIV/Aids and human trafficking prevention and awareness campaigns in the campsites and corridor of influence
• Engage women workers as wage laborers depending on their skill and
• Provide equal wage for equal work between men and women.
Project Reviews
• The project progress would be reviewed by the ADB with necessary midcourse corrections
• The Assistance should be provided by the Executing Agency (i.e. DESCO).
The environmental monitoring will assess the compliance that has been suggested under the Bangladesh Govt. laws, policies and national standards (i.e. air, noise and water quality) and ADB loan covenants. As there is no involuntary resettlement and ethnic minority issues, therefore, this monitoring assess the environmental and social safeguard issues in accordance with the Govt. laws and ADB loan covenants like the above mentioned ways.
2. Approach and Methodology
2.1 Overall Approach of Safeguard Monitoring
A mixed approach is being followed for this monitoring study consisting of both quantitative and qualitative approaches. The social safeguard monitoring is being conducted by a multidisciplinary team led by a Sociologist. All of twenty four (24) substation locations have been visited and analyzed the compliance status applying different social techniques (i.e. questionnaire surveys, field observations, and group discussions) considering construction activities, impacts, safeguard policies, and the GoB and the ADB’s loan covenants. To achieve this, a study team consisting of experts from related fields of expertise had been formed

2.2 Data Collection Methods
a) Physical Observation
The site specific physical observation was occurred during the field work at twenty four (24) substations. With the physical observation, working condition, use of safety tools, sanitation and drinking water statuses, labor shed condition, kitchen waste management status, food quality, status of pollution (e.g. air and noise) were monitored and related compliance statuses were observed and recorded. The non-compliance issues were identified which were discussed with the relevant stakeholders through Key Informant Interviews (KII) and Group Discussions.
b) Key Informant Interview
During the project implementation, some key personnel from DESCO and Siemens were responsible to monitor the work progress. The site engineers from Siemens and Health and Safety officer from contractor were considered as the Key Informants (from each site) and were interviewed for understanding work progress and status of different social safeguard issues with the project implementation.
The non-compliance issues addressed during the field visit were shared with the PDs and concerned personnel and outlined the guidelines based on their suggestion for

implementation. In addition, any difficulties faced in relation to conducting the study were addressed through such consultations and were included with the overall study findings.
c) Group Discussion
During the field visit, group discussions were held with construction labors, site engineers, supervisors, concerned personnel from DESCO to update the construction status and compliance status of relevant issues. During the consultation, non-compliance issues were also identified and discussed how to address them within the duration of project implementation.

2.3 Study Mobilization
A comprehensive checklist on social compliances was prepared. The checklist (Appendix B) is prepared based on the suggested recommendations incorporated in the Environmental Management Plan (EMP) of EIA for the Augmentation and Rehabilitation of Distribution System Project in DESCO area.
2.4 Study Team Mobilization
For the commencement of this study, a contract agreement between DESCO (the Project Authority) and CEGIS (the Monitoring Consultant) was signed on 9 May, 2017. Since then, a multidisciplinary team is being mobilized based on the work plan to monitor the social aspects in relation to the study objectives and the selected monitoring indicators.
The consultant (CEGIS) started work under the overall supervision of the Project Director, DESCO and maintained close liaison with DESCO offices (both field and head office) throughout the study period. A Team Leader, assigned within the study team, supervised the study and guided multidisciplinary team members to achieve the goal of the study. The progress of the study was reviewed in weekly progress review meeting held in CEGIS Office in Dhaka.
3. Specific Social Safeguard Management Plan
The site specific Environmental Management Plan is prepared and given to the consultant by the EPC contractor (i.e. SIEMENS) and the compliance, though there was no variation on work activity. At this construction stage, it was found that they had EMP to guide their works for these twenty four (24) substations locations. In their plan, SIEMENS should manage all social safeguard issues during the construction phase of the project. As a part of the plan tool box meeting is held before starting of daily construction work and workers are briefed about the risks and use of personal protective equipment (PPE) and safety measures for avoiding risks. Based on the following Table 3.1, SIEMENS started the construction work at the project locations whereas the construction activities continued based on this specific environmental management plan.

Regulate traffic congestion, especially at the entry point of the substation site and camp area.

At least 1.5m height wall including barbed wire on the top of wall will be constructed around the project area of substation, worker camp and construction yard areas.
Confirm public awareness building/information.
Warning signs will put where applicable at surrounding the construction site.
Ensure physical safety to the surrounding natives and strangers.
Notification (signboard, billboard, etc.) and/or announcement to the community will be done at reasonable time, if any construction event/plan would result inconvenience to the natives.

Occupational health and safety
(H&S)2
Ensure occupational safety measures3 for the workers.
Only trained/certified and experienced workers will be recruited to work specially with any electrical equipment. Safe/quality equipment will be provided to the workers to work with. PPE for all workers will be provided and use of it will be mandatory through official order.
Ensure accidental safety measures for the employees.
A sickbay/place will be made available at a suitable location for combating emergency situation. First aid box (with supply of medicine and other aid materials) will be made available over there.
Ensure traffic safety measures for the employees4.
Provide official order/instruction (written, verbal, signboard) to drivers and flagman for keeping speed limit of vehicles within 10 Km/Hour in the camp and construction areas. If necessary pedestrian-safe access routes will be provided inside the construction and camp areas.
2Educate all construction workers on the following issues but not limited to them: firearm possession, traffic
regulations, illegal logging and collection of non-timber forestry products, non-disturbance of resettlement communities, hunting and fishing restrictions, waste management, erosion control, health and safety issues, all prohibited activities, the Code of Conduct requirements and disciplinary procedures, and general information on the environment in which they will be working and living. In addition, educate workers on the identification of occupational expose to Electro Magnetic Field (EMF) levels and hazards.

Social Issues Proposed Mitigation Measures Implementation Plan by Siemens
Ensure personal safety measures of workers and employees at workplace.
Strict order/instruction (written, verbal, signboard) and engage supervisor for prohibited smoking in the workplace and also drinking alcohol in camp area by workers and employees will be provided. Site personnel will only allow smoking in designated smoking areas. Carry of any illegal substances, weapons and firearms in camp or construction area will be strictly prohibited. Site supervisors, team leader will continuously monitoring and counseling to ensure personal safety measures of workers and employees over there.
4. Monitoring Results
For the commencement of the project implementation, Dhaka Electric Supply Company Limited (DESCO) has made a Contract Agreement with SIEMENS in consortium with the SIEMENS Bangladesh to Design, Supply, and Install & Commission 24 (twenty four) 33/11kV Substations in Turnkey Basis in DESCO area under the Dhaka and Gazipur districts against Bid No. IFB 01/2016, Package-C1 of Lot-3 under ADB Loan No.: 3087- BAN: under “Power System Expansion and Efficiency Improvement Investment Program” (Trench 2). As the follow up study, the result of Social Safeguard Compliance status based on the selected in this section, at the same time the non compliance issues also identified and described in this chapter. A brief status substation specific project activity is given below:

4.1 Status of Social Safeguard Compliance
The compliance status is monitored for ensuring the better project implementation regarding the occupational health and safety, Impact of health and safety due to the construction and other social issues. The community health and safety issues regarding the aspect of air, and noise pollution are also observed under the compliance monitoring. In this context, people’s condition living closed to the project sites were found better for proper management of the project at the stage of construction. The safety and security due to the movement of vehicles movement monitored to avoid in accidental case in this phase of construction. The prepared checklist based on the selected indicators worked here as guidelines and identified non –compliance issues were considered and suggested measures for further improvement of compliance status during the phase of project implementation.
In this section, the result of social safeguard monitoring following the social safeguard indicators analyzed and presented in the following ways:
Compensation
Compensation status was cross-checked mandatorily whether any case is found or not. As a part of compliance monitoring it is checked again and again. However no issues were found regarding compensation. During consultation with local people and project proponent it is assured that most of the cases land was procured through proper way and cash was paid by DESCO. However it is assured once again that no complexity is found regarding compensation under this project.
Livelihoods and Employment
The monitoring team found that most of the workers are hired from different part of Bangladesh named Rangpur, Chapai Nawabganj, Sherpur, Mymensingh etc. and some of the labors are recruited from locality or adjacent to the locality. Basically these labors are used for manual works. Most of the cases technical Labors are hired from different engineering firm, hired by EPC contractor. During field visit contractor informed that due to unavailability of local manual labours they had to hire these labors from different regions of the country.
These manual labors are recruited mostly on daily basis and they are paid BDT 300-500/day based on their working experience and skill. But for the purpose of food and other cost BDT 300 / day has been given to the workers which have been reimbursed during the payment. The labors are supervised and guided by a foreman whose salary is higher than the labors, usually a foreman got 800-1000 BDT/per day. Manual labours ensured that they got their payment timely and EPC contractor and personnel from PMU monitored the payment schedule of the labors, along with this they closely monitor the other issues of labors e.g.; labour shed, sanitation etc.
Occupational Health and Safety
The EPC contractor Siemens India is aware of occupational health and safety and trying their level best to maintain standard and sound occupational health and safety for all working in the project location. Monitoring team found labours are working wearing PPE (gloves, shoes, helmet etc) in every site. Though it is found that sometimes labors are reluctant of wearing those PPE. EPC contractor trying to ensure that safety equipment while working on project site and site

engineer ensured that wearing PPE for every worker is mandatory and they monitor the workers as well. However, it is found that the quality of the PPE (gloves, helmet, shoes, and safety belt) is poor in some project location. SIEMENS ensures that they informed their head office and trying to update these within shortest time. A safety equipment named earmuff is missing to every substation, informing the key personnel from EPC contractor they informed that now a days it is happening due to unavailability of those product and they are still aware of those and commit to ensure this equipment within the shortest possible of time. Moreover Siemens India also ensured that they conduct regular tool box meeting every day morning before starting work and brief them about the task informing risks and the way how the risks be mitigated. They also have the emergency response plan in case of critical situation; SIEMENS informed that they have the preparation for ambulance service to carry the injured person to nearest hospital (within closest hospital to the project location). However no accidental issues are found till June 2019. Safety tool box is mandatory for every location and monitoring team also found well organized first aid box. But fire protection system is not well organized in these locations though every location has adequate fire extinguisher but in many cases it is found that these are not functioning.
Labor and Working Condition
During monitoring field visit it is found that most of the labours are well trained about safety issues. However EPC contractor conduct daily brief about the assigned task and safety measures and make aware the local labours. Though PPE (hand gloves, safety shoes, helmet etc) are provided however due to habitual fact local labours are reluctant of wearing those. But the EPC contractor is trying to make them habituated and made regular sessions to make them much oriented with those safety equipments. All substations have appointed Health and Safety engineers who made various sessions in which labor’s condition regarding the aspect of working environment would be well and contributed more to retain them during this phase of construction. The assessment of EPC contractor and monitoring relatively improved the situation, in this aspect, the compliance status become positive in comparison with the previous condition.
EPC contractors ensure availability of safe drinking water in the project locations along with a labour shed so that outsider labours (come from different region) can be accommodated. In some cases while labour shed cannot be built contractor arrange rented room for labors. During monitoring field visit some labour shed found congested in compare to number of labours residing there, key personnel from contractor ensure that due increase of number of labours it happened.
Labours usually take daily meal on their own cost. There is no more available facilities for refreshment by the cost of EPC contractor but with their own cost labours take refreshment by their own arrangement.
Each and every substation location has sanitation facilities; EPC contractors construct temporary sanitation places at construction site. Usually these sanitary latrines are regularly maintained except in Tongi, Kazipara Switching Station, Uttara Sector 14, Uttarkhan (Promy) substation location. However, EPC contractor promised to construct better environment for the workers. Those who come from adjacent local area they do not reside in the labour shed they live in their own places.

5. Institutional Arrangement and Grievance Redress Mechanism
5.1 Institutional Arrangement
The organogram (provided by the DESCO) is responsible to monitor social safeguard compliance during the project construction phase. The assistant engineer (electrical), assistant manager, and sub assistant engineer are working under the supervision of the deputy project director for monitoring of augmentation, rehabilitation of distribution system in DESCO area. The project director is responsible to supervise and guide the whole work following the prepared checklist on the compliance status. The following Figure 5.1 shows the institutional arrangement those who are responsible to ensure monitoring and compliance in accordance with government laws, rules regulations and ADB’s loan covenants.

5.2 Grievance Redress Mechanism
a) At this stage, there a Sub Assistant Engineer stays at the project sites to understand any complain related issues. The Sub-divisional Engineer will work as the field officer and would be responsible to arrange consultation for people’s awareness at the respective project sites.
b) Presently, with the starting of construction activities, a Sub-assistant Engineer is playing key role to understand the people’s problems (if any related to the project activity) and visited twenty four substations.
c) In addition, phone number attached in each station to get compliant and emergency response during the construction activities.

6. Conclusions and Recommendations
6.1 Conclusions
The social safeguard monitoring team has completed conducting field visit at 24 substation locations and monitored the overall progress and compliance status regarding social safeguard based on ADB’s safeguard policy, EMP provided in EIA, Bangladesh government and ADB loan covenant.
In this study, compliance status in terms of like occupational health and safety, workers’ wellbeing have been observed through site specific field visit (monthly) and following the indicators stated in the checklist. In addition, compliance status has been provided to make it clear indications based on the status during the construction phase of the project activity. This compliance status is combination of monthly monitoring field visit. Finally, Corrective Action Plan (CAP) is prepared regarding the monitoring result following the social safeguard indicators.
6.2 Recommendations
Based on the observation and monitoring field visit the environmental and social monitoring team suggested recommendations would be followed by the workers and the EPC contractors to make this compliance more satisfactory during the construction phase of the project.
To make the process more smooth and efficient, the following recommendations are proposed by the study team to be followed with immediate effect:
• Construction materials (i.e. sand, cement etc) should be covered by polythene and accumulated within the project boundary.
• Ensuring quality PPE (hand gloves, safety shoes, helmet etc) to the workers;
• Earmuffs need to be available for the reduction of hearing damage of working laborers;
• It is required to make labors habituated to use PPEs.
• Proper sanitations should be ensured for labors and labor shed needs to be modified having proper ventilation facilities;
• Some mobile toilets are required when the number of workers increased (where required
• The first aid boxes should be available with required medicines.
• Fire drilling exercise needs to be ensured for all labors.
• There was no dustbin or specific waste disposal site in any of the project location. Hence, a particular place for waste disposal should be earmarked for maintaining ambient environmental neatness.
• The level of safety for workers must be enhanced with comprehensive enforcement on PPE usage, and regular (at least four times a day) health and safety supervision should be carried out.
