INTRODUCTION

This appeal concerns the rights of the Victims of the most

serious environmental crime ever committed in California—the Aliso

Canyon/Porter Ranch gas eruption—to restitution for their staggering

economic losses arising out of Defendant Southern California Gas

Company’s criminal conduct in releasing toxic substances into the air. In

contravention of its prosecutorial responsibilities, the Los Angeles County

District Attorney’s Office structured a plea agreement with the Gas Company

to deliberately avoid an order of direct restitution to the Victims. The trial

court also refused to issue a restitution order in violation of constitutional and

statutory mandates and controlling case authority. This Court should reverse

the order denying restitution and remand to the trial court with directions to

issue a restitution order.

Victims of crimes have constitutional and statutory rights to

restitution for economic losses arising from criminal conduct for which the

defendant is convicted. Here, the Gas Company pled no contest to a

misdemeanor violation of Health and Safety Code section 255101 for failing

to immediately report its release of methane, methyl mercaptan, butyl

mercaptan, benzene and butane into the Porter Ranch community where the

Victims reside. The release of these toxic substances is an element of

violating section 25510, and failing to report the release substantially caused

the Victims’ economic losses. Because of the Gas Company’s criminal

conviction, the Victims are entitled to restitution for their economic losses.

Additionally, the District Attorney’s Office charged the Gas

Company with violating section 41700 for the actual release of the same

toxic substances into the Porter Ranch community the Gas Company failed

to report. Because the release of the same toxic substances giving rise to the

dismissed count was also involved in the admitted count, the two counts are

transactionally related and the criminal conduct for which restitution must be

ordered includes the conduct charged in the dismissed count. The Victims

are entitled to restitution for their economic losses for this reason too.

Finally, in denying the Victims’ request for restitution, the trial

court abrogated the Victims’ constitutional rights. The prosecution may not

bargain away, limit, or waive victims’ restitution rights directly, nor can the

prosecution do so indirectly as here by deliberately designing a plea

agreement attempting to bar restitution. A sentence without an award of

victim restitution is invalid and may be corrected at any time. The District

Attorney’s Office’s attempted bargaining away of the Victims’ restitution

rights by plea agreement, and the trial court’s acceptance of that agreement

without ordering restitution, cannot stand.

This Court should reverse the order denying restitution and

remand to the trial court with directions to order the Gas Company to pay

restitution to the Victims.

II.

FACTS AND PROCEDURE

A. Since The 1970s, The Gas Company Has Falsely Represented To

The State That A Subsurface Safety Valve Was In Place On Well

SS-25

The Gas Company owns a massive natural gas storage field in

Aliso Canyon adjacent to the residential community of Porter Ranch. (1 CT

82.) Natural gas is not native to Aliso Canyon—it is transported through

pipelines and injected underground into high powered wells. For over 30

years, the Gas Company reported to state officials at the Division of Oil, Gas

& Geothermal Resources that the gas storage wells at their Aliso Canyon

facility were safe, and specifically reported that well SS-25 (drilled in 1953)

had a subsurface safety valve designed to prevent the release of any gases

into the surrounding community. (See 1 CT 66, 69-79.) Yet the Gas

Company knew the mandatory subsurface safety valve on well SS-25 had

failed in the 1970s and been deliberately removed. (1 CT 82-89.) For

decades, the Gas Company willfully concealed this information from state

safety inspectors, who instead received test reports showing an operational

subsurface safety valve in place. (1 CT 69-79.)

B. Not Surprisingly, Well SS-25 Fails And Without A Subsurface Safety Valve, Toxic Substances Spew Into Porter Ranch

On October 23, 2015, the casing in well SS-25 failed, causing

the largest gas blowout in the world’s history. Because the Gas Company

had removed the subsurface safety valve, well SS-25 spewed benzene,

hydrogen sulfide, methane, mercaptans, and numerous other toxic substances

into the atmosphere over Porter Ranch. (1 CT 1, 82-89, 110.) This spewing

of toxic substances continued for months. (1 CT 82-83.)

C. The Gas Company Keeps The Blowout Secret

For at least three days, the Gas Company kept the blowout a

secret, while over 30,000 residents in Porter Ranch, their homes, businesses

and schools were exposed to toxic gases. (1 CT 1, 82-89, 115-118.)

Specifically, the Gas Company failed to report the release of hazardous

material to the California Emergency Management Agency and to the Los

Angeles County Fire Department in violation of section 25510(a).

D. After The Public Learns Of The Eruption, The Gas Company Misrepresents The Imminent Threat

Once the public learned of the well’s eruption, the Gas

Company claimed the well was so far away, the natural gas would dissipate

before it reached Porter Ranch, and there was no public health threat: “[T]he

leak does not pose an imminent threat to public safety. The well is located

in an isolated, mountain area more than a mile away from and more than

1,200 feet higher than the closest home or public area…. In outdoor locations

such as this, natural gas quickly dissipates into the air, greatly reducing the

possibility for ignition and further diluting the gas as it reaches the public.”

(1 CT 92.)

Environmental groups and the attorneys for the Victims

obtained an infrared camera to film the blowout and capture evidence of

natural gas, noxious odors, hazardous chemicals, and toxic pollutants rolling

in a plume down the hill and into Porter Ranch. (1 CT 99, 105.)

The Gas Company also identified an oily mist emanating from

the Aliso Canyon facility, but after initial concerns, the Gas Company

affirmatively misrepresented to the Victims that “the mist would not travel

beyond the facility.” (1 CT 99.) The Gas Company further told residents

“there was no reason to stay indoors.” (Id.) The oily mist could not be seen

with the naked eye and took several weeks before evidence started building

up on homes, cars, and in playgrounds. (1 CT 99, 105, 123-124.) Children,

vulnerable people, and pets breathed in the oily mist from the blowout for

weeks before they knew the mist had traveled outside of the facility.

E. The Gas Company Misrepresents The Nature And Danger Of The Gas Exposure

The Gas Company misrepresented to the Victims that the only

gas to which residents were being exposed was methane along with

mercaptans (a toxic substance added to natural gas so people will detect gas

leaks and leave dangerous areas). (1 CT 92-96.) The Gas Company’s blatant

misrepresentations were made knowing that the community was also being

exposed to benzene, hydrogen sulfide, and various other toxic substances. (1

CT 1, 110.) The Gas Company further misrepresented to the community

these gases were harmless. (1 CT 92, 99.) Reporters broke the news of the

misrepresentations on the levels of toxins released by the Gas Company. (1

CT 115-118.)

More than 114 Gas Company wells in Aliso Canyon did not

meet rudimentary safety requirements. (1 CT 84.) These wells were ordered

shut down until the Gas Company complied with minimum safety standards.

(1 CT 134-145.) The Gas Company was also ordered to plug old wells to

prevent gases from rising into the community. (Id.)

F. The Gas Company Refuses To Assist Residents To Relocate To Avoid Adverse Health Consequences

Based on the Gas Company’s intentional conduct, thousands

of Porter Ranch residents suffered catastrophic health consequences,

including death. (1 RT 34-51; 1 CT 34.) The County of Los Angeles ordered

the Gas Company to relocate these families [1 CT 102], but the Gas Company

refused, necessitating a court order. (1 CT 322.) Thousands of Porter Ranch

residents had to stay in their homes while their neighbors and pets began to

die, and their children became sicker. (1 RT 34-51; 1 CT 34.) Porter Ranch

homes soon redefined the word “uninhabitable.” (Id.)

G. The Los Angeles County District Attorney Files A Misdemeanor Complaint Against The Gas Company

1. Count 1 Alleges A Failure To Report Release Of Hazardous Materials Violating Health And Safety Code Section 25510

Count 1 alleged a violation of section 25510(a), based on the

Gas Company’s failure to report the leak for three days. The complaint

stated, “On or about October 23, 2015 to October 26, 2015, in the County of

Los Angeles, the crime of FAILURE TO REPORT RELEASE OF

HAZARDOUS MATERIAL, in violation of HEALTH AND SAFETY

CODE SECTION 25510(a), a Misdemeanor, was committed by

SOUTHERN CALIFORNIA GAS COMPANY, which failed, upon

discovery, to immediately report a release or threatened release of hazardous

material, to wit: NATURAL GAS OR ITS COMPONENTS (including, but

not limited to, METHANE, METHYL MERCAPTAN, BUTYL

MERCAPTAN, BENZENE AND BUTANE) to the California Emergency

Management Agency and to the unified program agency.” (1 CT 1.)

Section 25510(a) provides in part: “[A business that handles

hazardous materials] shall, upon discovery, immediately report any release

or threatened release of a hazardous material to the unified program agency,

and to the [L.A. County Fire Department], in accordance with the regulations

adopted pursuant to this section.”

2. Count 4 Alleges Discharge Of Air Contaminants Violating Health And Safety Code Section 41700

Count 4 alleged a violation of section 41700(a), based on the

Gas Company’s release of toxic substances. “On or about October 23, 20l5

to the present, in the County of Los Angeles, the crime of DISCHARGE OF

AIR CONTAMINANTS, in violation of HEALTH AND SAFETY CODE

SECTION 41700(a), a Misdemeanor, was committed by SOUTHERN

CALIFORNIA GAS COMPANY, which discharged air contaminants and

other materials, to wit: NATURAL GAS OR ITS COMPONENTS

(including, but not limited to, METHANE, METHYL MERCAPTAN,

BUTYL MERCAPTAN, BENZENE AND BUTANE) that caused injury,

detriment, nuisance or annoyance to any considerable number of persons or

to the public, or that endangered the comfort, repose, health, or safety of any

of those persons or the public, or that caused or had a natural tendency to

cause, injury or damage to business or property.” (1 CT 3.)

Section 41700(a) provides: “[A] person shall not discharge

from any source whatsoever quantities of air contaminants or other material

that cause injury, detriment, nuisance, or annoyance to any considerable

number of persons or to the public, or that endanger the comfort, repose,

health, or safety of any of those persons or the public, or that cause, or have

a natural tendency to cause, injury or damage to business or property.”2

H. The District Attorney’s Office Promises The Victims That Any Plea Agreement Will Include Restitution

A few days after the District Attorney filed this case, attorneys

representing many of the Gas Company’s Victims, including attorneys from

the Parris Law Firm representing more than 7,000 Victims, put the District

Attorney’s Office on notice that the Victims sought restitution under the

California Constitution for their economic losses. (1 CT 45.) These losses

included cleaning costs, lost livelihood, unreimbursed relocation expenses,

and damage to, and diminution in the value of, the Victims’ property. (1 RT

35-52, 83.) The District Attorney’s Office assured the Victims’ attorneys no

plea agreement would be entered that did not include full restitution to the

Victims for the Gas Company’s criminal acts. (1 CT 45.) The Gas Company

was arraigned and pleaded not guilty on February 17, 2016. (1 CT 7-8.)

On June 14, 2016, an attorney from the Parris Law Firm

appeared for a pre-trial hearing and advised deputies district attorney, who

were meeting with Gas Company attorneys, that he represented the Victims,

who sought restitution from the Gas Company. (1 CT 47.) He was asked to

leave and no proceedings were held in open court that day. (Id.) The parties

and their counsel met in chambers. (1 RT 28-29.) The minute order reflects

that the prosecution and defense counsel conferred in chambers and does not

reflect the presence of the Victims’ counsel. (1 CT 12.)

I. The District Attorney’s Office Reneges On Its Promises To The Victims And Agrees The Gas Company May Plead No Contest To Failure To Immediately Report The Leak Without Any Probation Or Victim Restitution

On September 13, 2016, the District Attorney’s Office

announced in open court it had entered a plea agreement with the Gas

Company. (1 CT 45.) None of the Victims of the Gas Company’s criminal

acts were notified or consulted about the plea agreement in advance. (1 CT

45, 48.) Neither the District Attorney’s Office, nor the Department of

Probation, ever contacted the Victims or their representatives regarding the

plea agreement and the Victims’ right to restitution. (1 RT 82-83.) The

settlement was presented to the trial court as a fait accompli with no notice

to, or input from, the Victims. (1 RT 26, 82-83.) The plea agreement is silent

on direct victim restitution. (1 CT 17-20.)

Under the agreement, the Gas Company pleaded no contest to

one misdemeanor count of failing to immediately notify the California Office

of Emergency Services and the L.A. County Fire Department of the leak that

began on October 23, 2015 (Count 1). (1 CT 17.) Under the plea, the Gas

Company would receive a non-probationary sentence, including fines,

response costs, and remediation. (1 CT 17-19.) The other three counts would

be dismissed. (1 CT 19.) The agreement includes no requirement for direct

restitution of the Victims’ economic losses. (1 CT 17-20.) The agreement

also includes no requirement for a probation report, which would have

resulted in notice to the Victims and an opportunity for the Victims to submit

restitution claims.

On September 13, 2016, again with none of the Victims or their

counsel present, the Gas Company pleaded no contest to Count 1 under the

plea agreement and the trial court accepted the plea. (1 RT 1-21.) The trial

court set the matter for sentencing on November 29, 2016. (1 RT 20.)

J. The Victims Request Direct Restitution Of Their Economic Losses From The Gas Company

On October 18, 2016, the Victims moved to request their

constitutional direct restitution rights, a restitution hearing and that the trial

court retain jurisdiction over restitution. (1 CT 25-43.) The Victims’ motion

was based on the lack of notice and direct restitution. (Id.) The Victims’

motion was supported by declarations and a request for judicial notice. (1

CT 45-59.)

K. Both The Gas Company And The District Attorney’s Office Oppose The Victims’ Restitution Request

Both the Gas Company and the District Attorney’s Office filed

oppositions to the Victims’ requests. (1 CT 255-274; 2 CT 403-418.) The

Gas Company argued the Victims could not have restitution because it had

pleaded no contest only to a failure to report and had not been placed on

probation. (1 CT 270.) The Gas Company also argued it paid relocation

expenses to some residents, including for interior cleaning, and since a civil

action was pending, direct restitution was unnecessary. (1 CT 263.) Finally,

the Gas Company argued the prosecution had agreed to dismiss the only

count for which restitution might have been ordered. (1 CT 267.)

The District Attorney’s Office argued the Victims could not

recover diminution in property value as restitution and the Victims were not

entitled to restitution for the failure to report charge to which the Gas

Company had pleaded no contest. (2 CT 412-413.)

L. The Victims’ Reply

In reply (2 CT 434-447),3 the Victims argued they were

entitled to restitution for the failure to report, because “[t]he failure to report

an emission of toxic gases cannot occur unless there are emissions.” (2 CT

438.) They also argued economic loss was a broad concept that encompasses

diminution in property values. (2 CT 442-443.)

Liaison Counsel for Plaintiffs in the coordinated civil actions,

declared that he had been contacted by a deputy district attorney on

September 11, 2016, to set up a conference call, but the deputy district

attorney told him that none of the Victims’ other attorneys (including the

Parris Law Firm) could participate. (2 CT 431.) The next day, Liaison

Counsel spoke to two deputies district attorney, who told him only that a

preliminary settlement of the criminal charges had been reached, with no

discussion of the terms (including restitution), other than that the terms were

confidential until disclosed publicly. (2 CT 431-432.) The District

Attorney’s Office refused to give Liaison Counsel a copy of the settlement

agreement. (2 CT 432.)

The Parris Law Firm received no notice. (1 RT 82-83.)

Liaison Counsel stated in his declaration he would discuss the matter with

the Plaintiff Steering Committee Co-Leads, but did not state he ever actually

discussed the agreement with any of the Victims’ other attorneys. (2 CT

432.)

The trial court accepted the Gas Company’s no contest plea on

September 13, 2016—the very next day—with no representatives of the

Victims present or mention of the Victims. (1 RT 1-21.)4

M. The Trial Court Holds A Sentencing Hearing

The case was called for a sentencing hearing on November 29,

2016. (1 RT 22-23.) The Victims’ counsel were present. (Id.) It was unclear

whether just the Victims’ motion, or the restitution hearing and sentencing

were to be heard, so only a few Victims were present. (1 RT 34-35, 46.) The

trial court stated at the hearing it set aside the entire day for all aspects of the

case. (1 RT 34-35.) The few Victims present were allowed to testify. (1 RT

35-52, 83.)

The Victims’ counsel argued the Victims were improperly

excluded from plea negotiations and received inadequate notice of the plea

agreement: “[M]any victims and lawyers made requests to be heard before

any sentence or before any plea agreement was entered into. There was

written communication. There [were] verbal guarantees to Mr. Parris by the

District Attorney’s Office that the Victims would have a say. We went to

meetings. We showed up in court.” (1 RT 28-29.) The Victims’ counsel

also argued the District Attorney’s Office had improperly bargained away

the Victims’ constitutional restitution rights: “We were shut out of all these

proceedings, never had notice as required.” (1 RT 29, 31.) And, the Victims’

counsel argued the Victims were entitled to full restitution of economic

losses pursuant to the Gas Company’s plea, and those losses were calculable.

(1 RT 30.) Alternatively, restitution was due for the Victims’ economic

losses caused by the three-day delay in reporting. (1 RT 77.)

The District Attorney’s Office and the Gas Company were

aligned to oppose the Victims’ request for restitution. (1 RT 61-76.) A

deputy district attorney argued the Victims could not have restitution for

Count 1 and disputed the necessity for direct restitution to the Victims. (1

CT 64.) Despite the Victims’ entitlement to full restitution of their economic

losses, the deputy district attorney claimed the settlement with the Gas

Company and money the Gas Company spent to relocate some Porter Ranch

residents was sufficient restitution. (1 RT 66-67, 69.) The deputy made these

representations despite testimony from Victims recounting their

uncompensated economic losses, including house cleaning, lost livelihood,

unreimbursed relocation expenses, damage to, and diminution in value of,

their property, and even the cost of an ambulance relocating one couple’s

son, who died during the blowout. (1 RT 35-52.) The deputy also argued

the Victims could not have restitution for the diminution in value of their

properties. (1 RT 65-66.) The Gas Company argued primarily that its failure

to report the emission of toxic substances was not transactionally related to

the emission of those toxic substances. (1 RT 75-76.)

The trial court noted concerns with the large number of Victims

entitled to restitution and the pendency of a civil action. (1 RT 25-26.)

N. The Trial Court Denies The Victims’ Restitution

At the conclusion of the hearing, the trial court denied the

Victims’ requests for the court to order direct restitution and to retain

jurisdiction to accomplish restitution. (See 1 RT 84-88.) The trial court

distributed a written opinion with this denial. (2 CT 489-503.)

The trial court concluded the Victims had standing to be heard,

but could not intervene. (2 CT 489.) The trial court also concluded

restitution could be ordered in a non-probationary context only for crimes of

which the defendant had been convicted. (2 CT 494-496.) The trial court

concluded restitution was not recoverable for the count to which the Gas

Company had pleaded no contest. (2 CT 501-502.) Additionally, the trial

court concluded the prosecution had reasonably notified the Victims and

legally exercised its discretion in entering the plea agreement. (Id.) The trial

court accepted the plea, sentenced the Gas Company to a non-probationary

sentence and dismissed the remaining counts. (2 CT 502; 1 RT 88-90.)

O. The Victims Petition This Court For A Writ Of Mandate And Concurrently File A Notice Of Appeal

On December 28, 2016, the Victims timely filed a notice of

appeal from the judgment and the order denying their request for restitution.

(2 CT 555-556.) On December 29, 2016, the Victims timely petitioned this

Court for a writ of mandate. (2 CT 559-586.)

On January 5, 2017, the Court denied the Victims’ petition on

the ground they had “an adequate remedy at law via their direct appeal from

the order denying restitution.” (4 CT 975.)

III.

LEGAL ARGUMENT

A. Standard Of Review

As this Court already concluded, the Victims may appeal from

the trial court’s order denying restitution. (4 CT 975; see also Cal. Const.,

art. 1, §28(c)(1); Code Civ. Proc., §902.) “[W]hen the propriety of a

restitution order turns on the interpretation of a statute, a question of law is

raised, which is subject to de novo review on appeal.” (People v. Williams

(2010) 184 Cal.App.4th 142, 146.) The question is whether the Victims

suffered economic losses because of criminal activity forming the basis of

the Gas Company’s conviction for failure to report the gas leak, entitling the

Victims to restitution under the California Constitution and Penal Code.

Therefore, review is de novo.

B. The Victims Have A Constitutional Right To Restitution

In California, crime victims have a constitutional right to

restitution for losses a defendant inflicts on them. (People v. Martinez (2017)

__ Cal.5th __ (May 25, 2017, S219970) slip opn. at p. 5 (Martinez).)

California Constitution, article 1, §28(b)(13) states in part: “[T]o preserve

and protect a victim’s rights to justice and due process, a victim shall be

entitled to … restitution. (A) It is the unequivocal intention of the People of

the State of California that all persons who suffer losses as a result of criminal

activity shall have the right to seek and secure restitution from the persons

convicted of the crimes causing the losses they suffer. (B) Restitution shall

be ordered from the convicted wrongdoer in every case, regardless of the

sentence or disposition imposed, in which a crime victim suffers a loss.”

Crime victims also have the constitutional right to enforce their

restitution rights. “A victim, the retained attorney of a victim, a lawful

representative of the victim, or the prosecuting attorney upon request of the

victim, may enforce the rights enumerated in subdivision (b) in any trial or

appellate court with jurisdiction over the case as a matter of right. The court

shall act promptly on such a request.” (Cal. Const., art. 1, §28(c)(1); see also

Cal. Const., art. 1, §28(f) [referring to “enumerated rights provided in

subdivision (b) that are personally enforceable by victims as provided in

subdivision (c)”].)

To implement a victim’s constitutional right to restitution, the

Legislature enacted Penal Code §1202.4, which states in part: “(a)(1) It is the

intent of the Legislature that a victim of crime who incurs an economic loss

as a result of the commission of a crime shall receive restitution directly from

a defendant convicted of that crime.” Penal Code §1202.4(a)(3) requires the

trial court to order the defendant to pay restitution “to the victim.” This

judicial obligation is reiterated in Penal Code §1202.4(f): “[I]n every case in

which a victim has suffered economic loss as a result of the defendant’s

conduct, the court shall require that the defendant make restitution to the

victim or victims in an amount established by court order, based on the

amount of loss claimed by the victim or victims or any other showing to the

court. If the amount of loss cannot be ascertained at the time of sentencing,

the restitution order shall include a provision that the amount shall be

determined at the direction of the court. The court shall order full

restitution.” Penal Code §1202.4(f)(3) describes restitution order

requirements: “To the extent possible, the restitution order shall be prepared

by the sentencing court, shall identify each victim and each loss to which it

pertains, and shall be of a dollar amount that is sufficient to fully reimburse

the victim or victims for every determined economic loss incurred as the

result of the defendant’s criminal conduct,” including the value of damaged

property and attorneys’ fees and costs.

The trial court must order restitution for the victim’s losses

arising out of the “criminal conduct for which the defendant has been

convicted.” (People v. Walker (2014) 231 Cal.App.4th 1270, 1274 (Walker),

internal quotations omitted.) Put another way, the trial court must order

restitution for “those losses arising out of the criminal activity that formed

the basis of the conviction.” (People v. Woods (2008) 161 Cal.App.4th 1045,

1049; see also People v. Percelle (2005) 126 Cal.App.4th 164, 179-180

(Percelle).) The victim’s loss must have been caused by the criminal conduct

for which the defendant was convicted. (People v. Lai (2006) 138

Cal.App.4th 1227, 1249.) Restitution in a non-probation context is

authorized unless the defendant’s only relationship to the victim’s loss is a

crime for which the defendant was not convicted. (Percelle, supra, 126

Cal.App.4th at p. 180.)

To determine the conduct for which a defendant stands

convicted, courts examine the elements of the crime to determine whether

the conduct is encompassed in the crime. (Walker, supra, 231 Cal.App.4th

at pp. 1274-1275; Martinez, supra, slip opn. at pp. 8-9, 16 fn. 3 [unless

defendant’s criminal conduct caused the accident, being involved in an

injury-producing accident is not part of the criminal conduct involved in

fleeing the scene in violation of Veh. Code, §20001(a).)

Conduct encompassed in the crime includes conduct

“transactionally related” to the facts that formed the basis of the count for

which the defendant was convicted. (People v. Harvey (1979) 25 Cal.3d 754,

758-759.) A dismissed count is transactionally related if “some action of the

defendant giving rise to the dismissed count was also involved in the

admitted count.” (People v. Beagle (2004) 125 Cal.App.4th 415, 421-423

[weapon charge not transactionally related to drug charge]; People v. Walker

(2016) 6 Cal.App.5th Supp. 38, __, 211 Cal.Rptr.3d 829, 833-835 [restitution

not limited to harm directly caused by criminal conduct of contractor

working without a license, but instead transactionally related to all

compensation for unlicensed work]; see also People v. Klaess (1982) 129

Cal.App.3d 820, 823-824 [accessory after the fact transactionally related to

crime for which defendant is an accessory]; People v. Guevara (1979) 88

Cal.App.3d 86, 92-94 (Guevara) [possession of shotgun was involved in

kidnapping and thus proper aggravating factor].)

In determining whether the victim’s economic loss occurred

because of the defendant’s criminal conduct, tort principles of causation

apply. (People v. Holmberg (2011) 195 Cal.App.4th 1310, 1321

(Holmberg).) Economic loss occurs from a defendant’s criminal conduct if

that conduct was a substantial factor in causing the victim’s loss. (Id. at p.

1322.) There can be more than one cause of loss. (Ibid.) For example, in

Holmberg the defendant was not convicted of the burglary during which the

victims’ property was stolen, he was convicted of receiving the victims’

stolen property. (Ibid.) The defendant’s act of concealing the stolen property

was a concurrent cause with the burglary in depriving the victims of their

property’s use. (Ibid.) The defendant was properly ordered to pay restitution

for the victims’ economic loss in replacing the stolen property. (Id. at pp.

1323-1324.) “[B]y holding on to the equipment, knowing it was stolen,

defendant’s conduct was a concurrent cause of the victims’ losses and a

substantial factor in causing their damages.” (Id. at pp. 1323-1324.)

A “cause in fact is something that is a substantial factor in

bringing about the injury.” (People v. Foalima (2015) 239 Cal.App.4th

1376, 1396 (Foalima).) The substantial factor test should not be narrowly

applied. (Id. at p. 1397.) “The test, put simply, is whether [the victim] would

have incurred damages had there been no [crime for which the defendant was

convicted].” (Ibid.) If the defendant’s criminal conduct (including

transactionally related conduct) was a substantial factor and proximate cause

of the victim’s damages, the victim is entitled to restitution. (Ibid.) When a

defendant was convicted of murder but acquitted of arson, the trial court

properly awarded restitution for a victim’s loss of clothing and household

goods burned after the victim died, because the murder was a substantial

factor in the destruction of the victim’s property. (Ibid.)

C. The Victims Have A Right To Restitution Arising Out Of The Gas Company’s Conviction

The Gas Company pled no contest to violating §25510(a). The

elements are: (1) discovery by a storer of hazardous materials (2) of the

release of those hazardous materials into the environment and (3) failing to

immediately report the release to the L.A. County Fire Department. It is

undisputed that the Gas Company stored hazardous materials, released those

hazardous materials into Porter Ranch and failed to immediately report the

release. It is similarly undisputed that the Gas Company’s release of these

hazardous materials resulted in catastrophic health consequences, including

death, massive disruption, temporary relocation, cleaning costs, lost

livelihood, damage to property, and diminution of the Victims’ property

values.

Section 25510 is part of Chapter 6.95 of Division 20, entitled

“Hazardous Materials Releases Response Plans and Inventory.” Article 1,

of which §25510 is part, expressly declares the legislative purpose “to protect

the public health and safety and the environment” and “to prevent or mitigate

the damage to the health and safety of persons and the environment from the

release or threatened release of hazardous materials into the workplace and

environment.” (§25500(a).) The provisions regulate “business[es]” that

“handle” hazardous materials. (§25501(c), (m).) “Handl[ing]” includes

storage of hazardous materials. (§25501(l).) “Hazardous materials” are

those that pose “a significant present or potential hazard to human health and

safety or to the environment if released into the workplace or the

environment.” (§25501(n)(1).)

Unlike the hit and run defendant who did not cause the accident

from which he fled in Martinez, supra, slip opn. at p. 9, here the Gas

Company was convicted of criminal conduct including the criminal release

into the environment of hazardous materials stored by the Gas Company in

Aliso Canyon—there can be no failure to notify of a criminal release by a

storer without the release. Thus, the Victims are entitled to restitution for the

economic losses they suffered arising out of the criminal activity that formed

the basis of the crime for which the Gas Company was convicted. (See

Walker, supra, 231 Cal.App.4th at pp. 1275-1276 [defendant convicted of

driving under the influence causing injury properly ordered to pay restitution

to all victims of eight-car collision, even those unnamed]; People v. Walker,

supra, 211 Cal.Rptr.3d at pp. 833-835 [defendant convicted of contracting

without a license properly ordered to pay restitution for all money victim

paid for unlicensed work.)

The Victims also are entitled to full restitution for the

economic losses resulting from the criminal activity for which the Gas

Company was convicted, because failing to report the release of hazardous

materials was a substantial factor in the economic losses the Victims

suffered. (See Holmberg, supra, 195 Cal.App.4th at pp. 1321-1322.) Had

the Gas Company truthfully, accurately and immediately reported the release

and nature of these toxic substances, the economic losses suffered by the

Victims could have been lessened by immediate relocation out of the affected

area. Like the defendants in Holmberg and Foalima, the Gas Company is

not relieved of its restitution responsibility simply because there may have

been more than one cause of the Victims’ economic losses, as there is a

causal connection between those losses and the Gas Company’s failure to

immediately report the release of the toxic substances.

The Victims are entitled to restitution for their economic losses

incurred from the Gas Company’s three-day delay in reporting the gas leak

and the transactionally related ongoing leak described in Count 4. As the

Victims’ counsel argued at the hearing, the Victims’ economic losses began

with the Gas Company’s attempt to keep the blowout secret and continued

with its efforts to minimize the dangers following the eruption of toxic

substances: “I want to be absolutely clear on the record. We are not

conceding that there is no restitution for the three days. Presumably the

requirement that you report to the regulatory agencies, the release of these

substances requires a truthful, an[d] accurate report as to what’s being

released. If the Victims of Porter Ranch had known immediately that

benzene, fluorocarbons, [etc.] that were ultimately disclosed as being

released in those three days, I can tell you that there’s nobody in this

courtroom that wouldn’t have packed up their children and left immediately.

These are known carcinogens. There is no safe amount. There was hydrogen

sulfide that was put onto these homes, if nothing else.” (1 RT 77.)

The Victims’ counsel also stated: “During those three days,

there’s a consequence. The extent of that economic consequence[] is

something the court has to decide. But a good argument can be made for the

fact that had they done their duty, had they followed the law, had they

reported exactly what they released into the environment, all of this damage

would have been prevented because I think the health department would

come in and say—they would red tag all those houses. It was that

dangerous.” (1 RT 77.)

Under any test, the Gas Company should have been ordered to

pay the Victims restitution for the economic losses arising out of the criminal

activity for which the Gas Company was convicted, because that criminal

conduct was indisputably a substantial factor in causing those losses. (See

Martinez, supra, slip. opn. at p. 16 [where defendant’s flight from accident

scene leads to delay in obtaining medical care exacerbating victim’s injuries

or requires tracking defendant down, victim entitled to restitution for those

costs].)

D. The Victims Have A Right To Restitution Because The Gas Company’s Conviction On Count 1 Is Transactionally Related to Count 4

Section 41700(a) prohibits the discharge of air contaminants

that cause injury to a considerable number of persons, endanger the health

and safety of those persons or the public, or that have a tendency to cause

injury or damage to business or property. The Gas Company was charged

with violating this statute in Count 4. In Count 1, the Gas Company was

convicted of failing to report the same release of contaminants into the air

that constituted the violation of Count 4. That is because the Gas Company’s

conduct giving rise to the dismissed Count 4 (discharge of methane, methyl

mercaptan, butyl mercaptan, benzene and butane into the air) was also

involved in the admitted Count 1 (failure to report its release of methane,

methyl mercaptan, butyl mercaptan, benzene and butane). Thus, the two

crimes were transactionally related and the trial court should have ordered

restitution for the Victims’ economic losses for this reason as well. (See

Guevara, supra, 88 Cal.App.3d at pp. 92-94 [possession of shotgun was

involved in kidnapping and thus proper aggravating factor].)

E. The Trial Court Violated The Victims’ Constitutional Right To Restitution

Victims have a constitutional right to reasonable notice and to

reasonably confer with the prosecutor regarding any pretrial disposition.

(Cal. Const., art. 1, §28(b)(6).) Victims of crimes have a due process right

to be heard in proceedings concerning the punishment of the criminals that

victimized them. (In re Vicks (2013) 56 Cal.4th 274, 309-310.) The

California Constitution seeks “to ensure that crime victims are treated with

dignity.” (Id. at p. 310.) Here, the Victims were afforded no such dignity.

The District Attorney’s Office filed a four-count misdemeanor

complaint against the Gas Company, then without notice or conferring with

the Victims of the county’s largest natural gas disaster in history, the District

Attorney’s Office entered into a plea agreement with the Gas Company

deliberately attempting to preclude direct victim restitution to the thousands

of Victims who suffered economic loss because of the gas eruption that

began on October 23, 2015. Lest there be any doubt that the plea agreement

was intended to attempt to preclude direct victim restitution, when the

Victims filed their motion requesting restitution, both the District Attorney’s

Office and the Gas Company opposed it, stating there was no restitution for

the count they chose in the plea agreement.

The District Attorney’s Office also deliberately agreed to make

this a no-probation case, knowing a trial court’s ability to award restitution

would be more expansive under a probationary sentence, and that a referral

to the probation department would have triggered inquiry into restitution.

(Pen. Code, §1203(b)(2)(D), (d), (g) [probation officer’s pre-sentence

investigation report must include information and recommendations

pertaining to victim restitution].)

The Victims’ attorneys had no way to foresee the Gas

Company and the District Attorney’s Office’s attempt to short circuit the

Victims’ constitutionally-guaranteed restitution rights. Shortly after the

complaint was filed, the Victims’ attorneys told the District Attorney’s

Office the Victims wanted restitution, and received assurances that no plea

agreement would be reached that did not include restitution.

Having been frozen out of any restitution discussion before the

plea was taken on September 13, 2016, the Victims turned to the trial court

for relief from this unconstitutional denial of restitution. But the trial court

concluded restitution could not be ordered for the Gas Company’s conviction

and declined to take any other measures to safeguard the Victims’

constitutional right to restitution, including rejecting the plea agreement,

requiring probation as a condition for accepting the agreement, requiring a

Harvey waiver as a condition for accepting the agreement, or retaining

jurisdiction to award restitution at a later time.

Although a trial court ordinarily loses jurisdiction over a

defendant upon sentencing, it must nevertheless retain jurisdiction to impose

and enforce a restitution award. Penal Code §1202.46 provides:

“Notwithstanding Section 1170, when the economic losses of a victim cannot

be ascertained at the time of sentencing pursuant to subdivision (f) of Section

1202.4, the court shall retain jurisdiction over a person subject to a restitution

order for purposes of imposing or modifying restitution until such time as the

losses may be determined. Nothing in this section shall be construed as

prohibiting a victim, the district attorney, or a court on its own motion from

requesting correction, at any time, of a sentence when the sentence is invalid

due to the omission of a restitution order….”

In denying the Victims’ restitution, the trial court abrogated the

Victims’ constitutional rights. The right to restitution “cannot be bargained

away or limited, nor can the prosecution waive the victim’s right to receive

restitution.” (People v. Gross (2015) 238 Cal.App.4th 1313, 1318 (Gross);

see also People v. Brown (2007) 147 Cal.App.4th 1213, 1226 (Brown).) Not

only can the prosecution not bargain away the victim’s right directly, it

cannot do so indirectly as done here by deliberately designing a plea

agreement to foreclose restitution. A “sentence without an award of victim

restitution is invalid.” (Brown, supra, 147 Cal.App.4th at p. 1225.) “Indeed,

on the motion of a victim, a court may at any time correct a sentence that is

rendered invalid due to the omission of a restitution order.” (Gross, supra,

238 Cal.App.4th at p. 1318.) The District Attorney’s Office’s attempt to
