He present- ed the council with a proposal for a formal theme (Art, History and Health) for Port Orford and North Curry County. He asked the council to give their contingent ap- proval so the Chamber can appoint a guideline committee to move forward. The committee will involve people from different organizations. The council con- sensus was to go for it. The Chamber will present monthly updates to the council on committee activities. The council considered two letters from people objecting to a street closure on Tenth Street from Washington part way up that street towards Jackson. The re- quest to close the street had come from the Port Orford Christian Center, which was planning to hold a youth festival at the church on the weekend. An owner of property and two renters of that property wrote letters and spoke at the council meeting as did representatives from the church. The people speaking against the street closure cited noise problems and the desire to live in a quiet neighbor- hood. The Christian Center’s new youth pastor Junior Childers said they could cut the outside activities off at 8:00pm on Friday night rather than the proposed 9:30pm. Councilor Jim Campbell made a motion to allow the closure of Tenth Street as long as no activities go on past 8:00pm and it passed 6-0. The council voted 5-1 on a motion by councilor Carl Eskelson to allow one poker table at Paula’s Bistro with $5.00 poker chips maximum. NCFCC Director Tere Tronson gave the council an update on the Community Building upgrade. She said they have finished Phase 1 as part of a plan to make the building a better performance space. She said they wanted to expand the stage out by eight feet to put on musicals and have more room for performers on the stage. The council discussed the recruitment process for a new police chief. City Ad- ministrator Ken Knight recommended the applications for police chief be in to the city by December 4 because of the amount of pre-screening they will re- quire. Councilor Campbell said people wouldn’t apply because they couldn’t meet the city specs. The advertisement for police chief as written by Ken Knight has been read to the council and public. It was printed in this paper last week but that ad was not correct. The council didn’t go along with the requirements as written by Knight and recommended the ad follow the job qualification require- ments used by the City of Dundee, Ore- gon. The Dundee requirements would open up the Port Orford police chief job to many more applicants. It eliminates the requirement “five years of progres- sively responsible administrative expe- rience in law enforcement in a position equivalent to sergeant or higher” from the job description. The Port Orford CityCouncil met a week agoon Monday night andheard from Chamber ofCommerce presidentJay Stoler. He present-ed the council with aproposal for a formal

Councilor Beck asked if the council coulddo a one-week process for an interimchief. Councilor Jim Auborn said thehiring process for an interim chief doesn’tneed to be as thorough as for the full timechief. The council decided to advertisefor two weeks for an interim police chiefand have the personnel committee re-view the applications.

Outgoing councilor Jim Campbell rec-ommended that when the City gets a newpolice chief that person needs to commu-nicate with the council more frequently.Campbell suggested four times a yearsfor a half hour before the monthly coun-cil meeting.

The council next tackled Measure 37,which is on the November 2 ballot. The

council considered Resolution 2005-07,which would put the council on record asopposing Measure 37. AdministratorKnight said there was much oppositionto Measure 37, which would cause gov-ernment agencies to compensate land-owners for their property use. Knightsaid Measure 37 eliminates zoning andused as an example that the city couldn’timpose erosion controls on propertyowners. Councilor Campbell disagreedand said it wouldn’t eliminate zoning.City Attorney Trew said the Resolutionwould express the sense of the council.Councilor Auborn made a motion for thecouncil to adopt Resolution 2005-07 andit passed a deeply conflicted city councilby a vote of 4-2 with Campbell and Beckvoting no and Auborn, Eskelson, Fran-cona and Jerry Steinhorst voting yes.

The council unanimously approved Res-olution 2005-08, which urges the Ore-gon Legislature and Governor to clarifythe Oregon Revised Statutes so cities can

maintain their water rights and obtainnew water rights.

The council passed Resolution 2005-09(Police Tax Levy Funds with a 6-0 yesvote. This resolution puts the council onrecord that, “if possible in law, and if thePolice Tax Levy, Ballot Measure 08-48passes on November 2, the funds fromthis tax received by the City will be usedfor a local Police Department.”

The council was presented with a requestfrom the Port Orford Public Library tosplit the cost of a new heating system forthe library. The library has offered to payhalf the estimated $3,449 cost and planson moving out into a new library in 2006the council was positive about the idea.Ken Knight said this is an unbudgeteditem. The council consensus was for theadministrator to look for the funds.

committee will meet convene and comeback with recommendations for the coun-cil at their December meeting.

Councilor Auborn made a motion to ap-prove the ORS 190 agreement with theCurry County Sheriff’s Department andit passed 6-0. This agreement provides a30-day period of supervision by the Sher-iff’s Department of Office Scott Halse.The correct ad for “interim” police chiefappears in another section of this paperthis week.

He is wellrespected and relates well to the peoplein the area. My next comment is about the City Char-ter. The Mayor should not be able to voteexcept in a tie. Look up your Rules ofOrder. That would give the Mayor a lotof unnecessary power. As most of youknow, I can not vote on anything in thecity as I live outside the city limits but Istill pay property taxes as I own propertyhere. I should have moved to my officelike a candidate for City Council did butthen I don’t need for my nose to grow anylonger.

My next comment is who is the bossaround our area? Approximately eightyears ago we had a City Administratorwho was dominating and it caused a lotof problems. The City Council, as statedin the Charter, made her aware that theywere the bosses and the Administratorwas relieved of her duties because acompromise could not be reached. Lookslike a power struggle is going on onceagain. At one of the prior meetings thecurrent Administrator stated that he wasthe one that did all the firing and hiring.How come the police liaison officer was

not informed of any of the goings on withChief Rush? Seems as if four councilmembers were the only ones that re-ceived complaints, they in turn told theAdministrator, and them must have alldecided which avenue to take to get ridour the Police Chief? They forgot to telltwo council members, Jim Campbell thepolice liaison, and Carl Eskelson. If thepolice levy fails I think we all know whohad a big hand in helping it sink. Theattitude towards hiring Mark Creightonby a city employee and the botched uphandling of the so called resignation ofChief Rush. Anyway, this is my opinionand like I said, time to wake up, myfriends.

Letter to the Editor,We buy land to obtain the right to use it.That is why our Constitution’s FifthAmendment says, in part: “...nor shallprivate property be taken for public usewithout just compensation.”

Unfortunately, this right is in danger.Land-use laws, regulations, and regula-tory decisions limit that right in any waythat suits the legislators or regulators.Court decisions have tended to upholdthem.

Measure 37 will tend to restore our land-owners’ prerogatives. If governmentalofficials forbid our using our own land,Measure 37 would force them to com-pensate us justly. Some officials haveprotested that making them pay so muchmoney would bankrupt them.

Maybe their protests betray their inten-tions.

[Editor’s Response: Gordon, I agree withyour basic position but not with yourconclusion that we should vote for Mea-sure 37. I see several problems with theway this measure is written. 1) The def-initions are too loose which will lead toa lot of expensive court cases, 2) Pay-ments will be required for actions thatwere taken by the state decades ago. If weare to enact such a law, it should applyonly to new actions and not those thattook place before we were born. 3) Themeasure provides no money to makesuch payments and that means highertaxes or still more money diverted fromschools, police, public health, and otherimportant departments. 4) Fair is fair. Ifthe government has to pay when theirrules decrease property value, why not

have the property owners pay when thevalue is raised? You don’t see that in thismeasure do you? This measure has all thesigns of being concocted by some greedylandowners who see a way to make aquick windfall at taxpayers expense. Ivoted NO on 37. – Valerie Kramer]

I regret I was unable to attend all of theforums the League of Women Voters puton. As many of you know, I live inRoseburg and am an early riser (4:30am)so I was unable to attend the consecutiveforums in Gold Beach, Port Orford, andBrookings.

Had I been able to attend, I would haveassured you that I am committed tobringing affordable health care to allOregonians, in part by working toeliminate the undue political influencewielded by the pharmaceutical industry,and by eliminating the exclusion of smallbusiness from the drug purchasing poollegislation passed by the House in thelast session. I will continue to push forimportation of medicine from Canada inspite of the roadblocks the pharmaceuticalcompanies have in place.

I am committed to increasing governmentefficiency; I look forward to reading theupcoming report on spending in theDepartment of Education and to hearingideas from state workers on how we caneliminate government waste.

I will also find ways to encourage businessto keep production in Oregon rather thanmoving facilities off shore. (It isunpatriotic to base a business in the

Bahamas just to avoid paying taxes;corporate boards that condone this kindof behavior should be ashamed ofthemselves.)

But we know now, that no WMD hadbeen produced in Iraq since the 1991Gulf War. We know now, that there wereno WMD in Iraq to pose an imminentthreat to America. We know now, thatIraq did not try to purchase uranium fromthe African nation of Niger for a nuclearweapons program.

We know now that there was noconnection between Saddam Hussein inIraq and Osama bin Laden’s Al Qaeda, 9/11 attack on the World Trade Center.

The CIA leaked a great deal of thisinformation to the American people, evenas ultra-conservatives in the Bush WhiteHouse Defense Policy Board werecrafting CIA intelligence to prepare the

nation for the invasion of Iraq. Hu-rrahfor the CIA. Then information begansurfacing from newspaper and wireservice reporters, then from insiders inthe Bush administration.

Now America needs to heal from themass hysteria based upon craftedintelligence that Bush used to galvanizesupport for the invasion of Iraq, post 9/11. No one misses Saddam Hussein, butGeorge Bush has torn apart Iraq andAmerica and we will now face theconsequences of this President’s terriblelegacy.

Instead of a five trillion dollar projectednational budget surplus, in just four yearsof George Bush we have a projectedthree trillion dollar national deficit.

If you add to that debt the fact that ournation has lost more jobs during thisPresidency than during any time in our

nation’s history, you will realize Bushhas put this nation in economic recession.

We need to heal. We need to restoreinternational diplomatic relations withforeign countries severed during the Bushadministration. America needs a jobsprogram. We need to tax untaxed US off-shore corporations and raise the taxespaid by Americans with incomes higherthan $200,000.00. John Kerry and JohnEdwards will do that, but they will notraise taxes on middle America.

In America today, more Americans areuninsured and need affordable health-care than at any time in our nationshistory. But Bush refuses to help America.

Bush tried to buy off America with taxrebates while inflation in the cost ofliving, the cost of unemployment benefits,the rising cost of health care premiumsand the national deficit have walked awaywith our wallets, as well as social securityand Medicare funding. He has stolen thefunding for our children’s futures andthe funding necessary to maintain thephysical infrastructures of our nationscities. His administration has initiatedthe rollback of more than 200 majorenvironmental laws reducing clean airand water standards for corporate profits,in a program of polluter protection.

Chamber of Commerce NewsThe Chamber has been busy the lastweek. On Monday evening the city coun-cil consensually approved Phase One ofputting together a committee to imple-ment guidelines for the theme of Art,History and Healthy Recreation. Thechamber is seeking a committee com-prised of a cross section of communitymembers. See this publication for theofficial advertisement.

On Thursday Chamber members had apresentation from Joe Schweinhart ofAssociated Oregon Industries in Salem,a 20,000 member strong organization ofOregon businesses. Schweinhart’s pre-sentation covered the ballot measures inthe upcoming elections and looked at thereasoning behind them. AOI presentsworkshops and seminars to chambersand community groups all over Oregon.

La Bonte worked with State Parks toacquire 35 acres at Agate Beach for anew state park. La Bonte has had previ-ous experience in Port management atGold Beach and Brookings and is anactive member of the Oregon CoastalZone Management Association. Sincefishing is the number one job producer inPort Orford it’s a good business to havea commissioner on board with her Portexperience.

There hasn’t been a county commission-er from North Curry County since 1986.La Bonte is the closest we’ve come tohaving local representation. Let’s keepher on the job for another four years.

Letter to the Editor,We have a few people on the city councilwho are up for reelection – Francona,Auborn, and Eskelson. I am voting forand supporting only one – Carl Eskel-son. During the sewer rate debates Iattended all the workshops and meet-ings. All three said good things about therates being unfair and the need to some-thing for the residents especially work-ing and elderly families.

They did absolutely nothing to aid usexcept put us on a long path of increasesevery year, both base and commodity.The only one who tried to help us wasCarl. He wanted the people of Port Or-ford to decide their future, but at everymeeting he was voted down by Franco-na, Auborn and others.

Savannah Georgia TremmelSavannah Georgia Tremmel was born in1933 and raised in Red Star, Arkansas.She moved to the state of Washington in1946. Savannah met and married Will-iam Tremmel in 1969. They set up housein Washougal, Washington. Savannahwas a loving, caring mother to her fivedaughters and one stepdaughter.

Savannah was an excellent homemakeras well as working outside the homewhile raising her family. Her love of theocean led her and Bill to retire on thesouth coast of Oregon buying their re-tirement home here in Port Orford in1999. She was an active volunteer at thePort Orford Senior Center and she en-joyed her membership with the localchapter of the Red Hat Society. Savan-nah enjoyed exercising by walking herdogs around town and on local beaches.She also loved to travel and go shoppingand did so fairly often when she visitedwith her children who live in the state ofWashington.

I want someone on the city council whofights for the regular residents of PortOrford; the ones who live in modesthomes and live on modest incomes.

I support and will vote for Carl, SteveAbbott, and Milton Finch.

This question hit me when I readthat the Chamber of Commerce is “put-ting together a committee to create im-plementation guidelines for the theme”..... “along the Hwy 101 downtown area.”Second, where will that downtown areabegin and end?

We are already known as the “OldestTownsite on the Oregon Coast”, “Thetown where the trees meet the ocean”,“The Gateway to America’s Wild RiversCoast” say nothing of our reputation forFishing, Art and History. Extensive ad-vertising has been given to each of theabove themes. Sooooo, again I ask, whydo we need another theme? I can see theintention behind a theme for our down-town area. But is that really what wewant? A theme town?

I think we would be much better servedto build and develop on our History, wehave pictures to guide us. Our historyand the present also include, very impor-tantly, the Fishing and Art in our won-derful little town. These are destinationattractions and should not be overlookedjust for the sake of a new theme. History,Fishing and Art in the Oldest Townsiteon the Oregon Coast.

October Port MeetingBy Jane Cramer

All commissioners – Gifford Barnes, EdDowdy, Dave Knapp, Evan Kramer andGeorge Welch - as well as Port ManagerGary Anderson were present at the Octo-ber 19 regular meeting of the Port Com-mission.

As there was no public comment, thecommission proceeded directly to OldBusiness with a report from Dowdy onthe recent DEQ Assessment of the site at

Fifth Street and Harbor Drive. The reportshows that the contamination goes deep-er in some places than previously thought.Soil removed would have to be hauledaway to a specifically designated site ineastern Oregon at a cost of $430 per ton.Estimated minimal cost could be $30,000to $50,000 to remove, but could go ashigh as $90,000 to $100,000. Jane Cram-er asked about the possibility of usingbiological methods such as insects toremove the contamination instead of haul-ing it away. Dowdy said he would checkinto the possibility. He also said therewas a possibility of leaving the site as is,bringing in 2’ of fill and capping it withasphalt or pouring a concrete slab overthe top with the footings outside thepresent building footprint. Dowdy men-tioned there might also be a chance of anEPA grant for cleanup, particularly if abusiness was interested in leasing theproperty.

There has been no specific progress onthe problem of liability insurance forcontractors working on dock projects.Dowdy made a motion that the commis-sioners establish a policy that no work-man works on the dock unless they haveliability insurance. The motion waspassed unanimously.

Commissioners also reviewed a letterfrom Senator Smith to Port ManagerAnderson in which the Senator acknowl-edges the importance of dredging forshallow draft ports.

Under New Business Commissionersvoted unanimously to accept the 2002-03 Auditor’s report.

Commissioners also agreed that Ander-son should write a letter to the OregonDepartment of Fish and Wildlife (ODFW)about the groundfish closure and weighin with the Port’s recommendations onthe groundfish regulation problem.

Commissioners reviewed a letter fromODFW about additional pre-season softshell testing to be done this year.

Commissioners decided there was toomuch involved in review and acceptanceof the Strategic Plan to be handled at aregular meeting. A special meeting ded-icated to review of the Strategic Plan willbe at 7:00pm on Thursday, November 4in the Gable Council Chambers. Thepublic is invited to attend and offer com-ments. The Plan will be available in thePort Orford Public Library and the PortOffice for members of the public to re-view.

Commissioners also discussed the ideaof a community based fish managementplan that could be implemented if thePort were to buy up permits to lease out.They agreed that Leesa Cobb should beinvited to speak to the commission onthis issue at a future meeting.

The last item of New Business concerneda survey needed for application for aCommunity Development Block Grant.Since the Library District and the PortDistrict cover the same areas, they couldshare the cost of the survey, which wouldbe good for ten years. Anderson willcheck into getting a grant to pay for thesurvey and will report back to the com-mission.

Review of the Manager’s Report showedthat the Port is down to 30 boats on thedock. Problems with the pump in thediesel tank, status of the freezer repairsand work on the roof of the electricalbuilding were also covered. Andersonhas attended a grant writing class as wellas an ODFW sport goundfish public in-put session.

The Port has applied for a beautificationgrant from the city for $2,000 to buyspray for the gorse and some plants to goalongside the dock road.

After a brief review of the financial re-port the meeting was adjourned.

Port ReportThis past week had a few tense momentswith three vessels moored in the harbor.The Shenanagen operated by Rob Ash-down, was too large to lift. Even with theanchor out and three mooring blocks tiedto it the boat continued to move towardsshore. Rob was forced to drag the moor-ing blocks tight up under the jetty andride out the storm on the boat.

The second boat, the Cumulus from Dar-win Australia was on his way to SanFrancisco when he was forced into ourport on Monday night. He sat on one ofthe locally owned moorings until Thurs-day morning when he left for Brookings.

The third boat, the La Frigata owned byJohn Ott, wasn’t so lucky. Early Tues-day morning it broke free of it’s mooringand went to the beach where the centerhull was holed. John determined that thehole was too substantial to save the boatand so salvage began. Late in the after-noon a call was made to the DEQ re-questing permission to burn the vessel asit was a hazard to the public because ofit’s shifting in the surf. Permission wasgiven and about 5pm Tuesday the vesselwas burned.

The first draft of the Port’s strategic planhas arrived and there is a copy in theLibrary as well as the Port office. Publiccomment is being sought and there willbe a special board meeting, to which thepublic is invited, Thursday Nov. 4 at7:00pm at City Hall to review the plan.

Letter to the Editor,The City of Port Orford Charter Ordi-nance 276 was adopted September 9,1975. There have been no additions orsubtractions to the text of the Charterover the intervening years.

Therefore the 1975 Charter until changedreflects the laws the City of Port Orfordmust abide by.

Nowhere in the entire Charter is mentionmade of a City Administrator or thatfunctions are delegated to him.

How then can Ken Knight assume theauthority of hiring and firing employeesof the City? Or be instrumental in eject-ing our police chief?

Also in the same vein this controversywhereby he has preselected a law en-forcement officer to replace Chief Rushis out of his purview.

Mentors SoughtBridges Advocacy and Outreach Cen-ter’s Mentoring Program “Friends forYouth” is seeking qualified volunteersto assist youth and young adults withdisabilities ages 16 -24. BAOC volun-teers are people who care deeply aboutyouth and young adults. The youth andyoung adults helped by BAOC volun-teers are in great need of social skills, jobskills and most importantly need a“Friend” a “Mentor”. BAOC Mentorsprovide friendship, positive role model-ing and goal setting.

To volunteer as a mentor in Coos andCurry counties, applicants must be ableto attend a one-hour training session.Applicants will be screened through in-terviews and reference checks. The Men-toring program is accepting applicationsand will conduct training WednesdayOct. 27 from 6-7:00 pm at the NewmarkCenter in room 228. For more informa-tion, contact Julie Miles at 297-7328.

Until the new 2005 Charter is adopted bya vote of the people the only body thatcan participate in the above mentionedareas are the city council members, cityattorney, and resident input.

Why Mayor Doran has allowed the CityAdministrator to violate the parametersof his jurisdiction is mystifying.

As a consequence of administrative in-terference a valued retired law enforcer,Mark Creighton, who resides in PortOrford and bears all the qualifications ofserving as chief officer of the City hasbeen shunted aside primarily, as I previ-ously said, because Ken Knight had pre-selected his man for the police chief.

I would like Mayor Doran to explain whythe City Administrator is permitted to sitat his side during council meetings act-ing as an advisor and influencing theboard’s decisions.

Letter to the Editor,I don’t mind paying taxes. I wish I didn’thave to pay so much, but taxes are theway we collectively pay for public safetyand health, education, roads and bridges,and other necessary public services. Butwhat really angers me is that some are notpaying their fair share, and the burden offunding government is falling more andmore on the shoulders of those of us whoearn a paycheck. Big corporations andlarge commercial landowners have shift-ed their responsibilities to support pub-lic services over to us in the past severalyears.

Wayne Krieger seems to think this is anOK arrangement. He opposed raising theminimum Oregon corporate income taxfrom $10.00 (almost one half of corpora-tions paying state taxes paid this mini-mum) to a measly $25.00. And he op-posed eliminating the “Hummer” taxbreak for folks who buy these super-sized SUV’s but aren’t doing construc-tion, agriculture or logging, the very kindsof operations that may require this kindof vehicle.

That’s why am voting for Dr. CharlieHochberg to represent me in OregonHouse District 1. He told me he wouldwork very hard in Salem to re-equalizethe cost of supporting essential govern-

ment services. He said everyone needs topay their fair share and that Krieger mustthink that the fat cats should be able toskate.

Why even have a city government if youfavor mob rule?

One faction in town is determined topromote their “favorite son” at all costsbecause he is “from here”. Do they planto use “their” chief to browbeat the restof the residents?

The silent majority in town may have no

other option to stop this steamroller thanto vote “no” on the upcoming policelevy.

city charter was congenial. We all be-haved ourselves, the gist was, it will failbut they will keep trying to get it through.

I don’t like personal attacks, because theissues are more important, such as enter-prise zones and charter re-writes. I didthink Jim Auborn a little premature, think-ing his election, running unopposed wasa no brainer. Surprise, Mark Creightonwill now be running as a write in candi-date for Mayor. This could well be a firsttime event that a write in takes the elec-tion. The balance of power in our citygovernment would again be restored. Allwe need then is to get a couple of thosecandidates who lost in ’98 to run again aswrite-ins for city council and, who knows,we could get a meaningful discussiongoing. Our charter is our bible, they saidit, I didn’t, and you don’t mess with thebible now do you?
