• PopCatcher records the music from a radio transmission• Artists are paid when music is broadcasted• Making copies for private use of radio transmissions is legal.

LegalitiesBackground

PopCatcher’s patented technology automatically records broadcasted music. PopCatcher is not a device or computer but rather a technology, which is paired with existing technologies and implemented into products radio receivers, such as FM, AM, DAB, HD etc.

Legislation, Digital Rights Management, copyright and management of Digital Content varies in different parts of the world, so we have chosen to look at the legislation in the USA. In our view it is here that most of the discussions take place and views are expressed from a wide range of actors.

PopCatcher Record RadioPopCatcher is not a computer and there is no need for a computer to use PopCatcher technology, hence PopCatcher is not a tool for downloading from internet. The technology only records radio broadcasts.

Audio Home Recording ActSince PopCatcher is a recording technology. The Audio Home Recording Act of 1992 (AHRA) regulates such devices, particularly chapter 10, which addresses "Digital Audio Recording Devices and Media".

LegalitiesAHRA States

The statutory definition states: A "digital audio recording device" ("DARD") is any machine or device of a type commonly distributed to individuals for use by individuals, whether or not included with or as part of some other machine or device, the digital recording function of which is designed or marketed for the primary purpose of, and that is capable of, making a digital audio copied recording for private use.”

The AHRA contains a provision for the consumer electronics industry and consumers, section 1008, a "Prohibition on certain infringement actions:"

"No action may be brought under this title alleging infringement of copyright based on the manufacture, importation, or distribution of a digital audio recording device, a digital audio recording medium, an analog recording device, or an analog recording medium, or based on the noncommercial use by a consumer of such a device or medium for making digital musical recordings or analog musical recordings."

ConclusionIt is clear that US law and EU directives permits the manufacture, distribution and sale of equipment that digitally records broadcasted material for personal use, given that all levies and statutory license have been paid.Besides, Nokia already have devices with FM Recording function on the market.
