Call to Order Chair Kennedy called the meeting to order at 4:03 p.m. 2. Public Comments There were no public comments. 3. Changes to the Agenda There were no changes to the agenda. 4. Accreditation Ms. Geisen indicated an accreditation training is scheduled at Allan Hancock College in Santa Maria on Friday, October 15, for the purpose of educating staff in preparation for a comprehensive site visit. 5. Approval of Minutes The August 20, 2014 Policy Committee meeting minutes were approved as presented. 6. Discussion

6.01 Discussion: Ventura County Community College District (VCCCD) Mission Statement - Board Policy 1200 Ms. Geisen provided an update regarding the draft status of BP 1200 Mission Statement. The Citizens Advisory Body members will have an opportunity to provide feedback at the meeting scheduled on October 16, 2014. There was discussion regarding inclusion of Bachelor’s Degree in the Mission Statement. Chair Kennedy suggested consideration should VCCCD be included in the SB 850 Pilot Program.

6.02 Discussion: Board Policy and Administrative Procedure 2745 Board Self Evaluation Ms. Geisen provided an update and indicated PACSS is reviewing BP 2745. There was discussion regarding meeting with Consultation Council members and Board Members about the Board self-evaluation and processes. Trustee Hernandez suggested elimination of the survey instrument. The item will be addressed at a future Consultation Council meeting. 6.03 Discussion: Board Policy and Administrative Procedure 2340 Board Agendas Ms. Geisen provided an update regarding Board agenda development. Ms. Geisen will revise the development process to allow advance notification of agenda items that may fall outside standard items and will help to determine information needs for the Board. 6.04 Discussion: Board Policy 7120 Recruitment and Hiring and Administrative Procedure 7120-B Recruitment and Hiring: College Presidents Trustee Hernandez requested Board inclusion in the hiring of Presidents as previously done in the past. Further discussion is needed. 6.05 Discussion: Future Policy Committee Meetings There is a need for a final meeting in November. A date will be determined and confirmed with Policy Committee members. The December 2014 Policy Committee will be cancelled. 7. Review of Board Policies and Administrative Procedures

7.01 The Policy Committee provides recommendations to the Board regarding policy for Ventura County Community College District. The Policy Committee reviews policies and administrative procedures to ensure uniform practice Districtwide and avoid impeding college operational effectiveness (Accreditation Standards III.A.3.a, III.A.4.c, IV.B.1.b-c; IV.B.1.e). This item presents for Policy Committee review of recommended changes.

7.02 Existing BP 2710 Conflict of Interest was recommended to move forward to the full Board as presented. Existing AP 2710 Conflict of Interest and revised AP 2712 Conflict of Interest - Form 700 were provided for information.

7.03 Existing BP 3560 Alcoholic Beverages was recommended to move forward to the full Board as a first reading. Revised AP 3560 Alcoholic Beverages was provided for information.

Introduction Criminal background checks will be conducted on all applicants selected for employment with the Ventura County Community College District. An applicant’s arrest and conviction history will be reviewed by the Human Resources Department to assist in the fair evaluation of each applicant.

The following employment guidelines will provide the District with standards on which to provide a full opportunity for employment to each applicant, while giving consideration to the District’s responsibilities for the welfare and safety of its faculty, students, and employees.

II. Guidelines

These guidelines will be followed when considering an applicant’s criminal history for employment with the District. The following lists of offenses are not exhaustive, and are intended to serve as guidelines for convictions not listed.

A Convictions for the following felony offenses (including attempt) shall be a complete and permanent bar to employment:

1. Assault 2. Conviction of a felony or of any crime involving moral turpitude under California

Education Code section 87732, subdivision (g) 3. Forcible Rape 4. Kidnapping 5. Mayhem 6. Murder 7. Offenses listed in California Education Code section 87010 (Sex Offenses) 8. Offenses listed in California Education Code section 87011 (Controlled Substance

Offense) 9. Or other serious felony offenses

Possession of a deadly weapon 13. Receiving stolen property 14. Robbery 15. Statutory Rape 16. Theft (Felony) 17. Or other serious felony offenses

C. Convictions for any of the following misdemeanor offenses will generally bar employment for five (5) years from the date of arrest.

1. Assault 2. Battery 3. Carrying a concealed weapon 4. Controlled Substances 5. Driving under the influence (if operating a vehicle is a condition of employment) 6. Gambling 7. Fraud/Forgery (Misdemeanor) 8. Obstructing a Police Officer 9. Prostitution (if a nexus exists to the position) 10. Receiving Stolen Property (Misdemeanor) 11. Resisting Arrest 12. Statutory Rape (Misdemeanor) 13. Theft 14. Or other serious misdemeanor offenses

III. Arrest Records Applicants who have been arrested but not convicted for offenses listed in Section I, II, or III shall not be considered for employment until a court of competent jurisdiction has disposed of the matter.

IV. Mitigating Factors Mitigating factors (e.g., reduction in charges, plea agreements, and multiple charges) will be considered for employment purposes. V. False Information on Application Applicants whose employment applications are subsequently discovered to contain false information may be deemed ineligible for employment.

Special elections shall be held if the office becomes vacant by reason of the resignation, recall, or disqualification of an elected student member, or by any other reason. Special elections shall be held within thirty (30) days after notice of the vacancy comes to the attention of the Chancellor.

Candidates for the position may nominate themselves or be nominated by others by the filing of an application at their campus of residence certifying that the candidate is eligible for service under the criteria set forth in California law and these policies. An election will be conducted at each college in accordance with Student Election Standard Operating Practices adopted by the college student elections, except that all members of the student body shall be permitted to vote for the student member. Each candidate from throughout the District who has qualified shall be listed on the ballot at each college. The successful candidate must receive a plurality of all votes cast. See Administrative Procedure 2105.

The student member shall be elected by a plurality vote of those voting in a regular election of the student body. All members of the student body may vote. Normally, the election will be conducted during the spring semester and will be completed in time for the student member to take office on June 1. Recall The student member may be recalled in an election conducted in the same manner as the election to office. An election will be called upon presentation to the Chancellor of a petition signed by at least 20 percent of the students enrolled at the time of filing the petition. No recall election will be held if the petition is received within 30 days of a regularly scheduled election for student member. Vacancy Upon notice to the Chancellor that a vacancy has occurred, the Chancellor shall, within 30 days, call a special election. No special election will be called if the vacancy occurs within 30 days of a regularly scheduled election for student member. VISION, MISSION, VALUES VENTURA COUNTY COMMUNITY COLLEGE DISTRICT

The Board of Trustees adopted the following Vision and Values on March 13, 2007. An updated Mission Statement was adopted by the Board on July 14, 2009. Vision The Ventura County Community College District will become the leader in development of high quality, innovative educational programs and services. Student Election Standard Operating Practices for Associated Students’ Positions and Student Trustee Position

The following student election standard operating practices are to be applied uniformly throughout Ventura County Community College District (VCCCD). Except where noted, the standard operating practices will apply to the Associated Students’ positions at Moorpark College, Oxnard College, and Ventura College, including Ventura College Santa Paula Site, and to the Student Trustee seated with the Board of Trustees. (Reference Education Code §72023.5, §76060 and §76061). Any student interested in running for an Associated Students’ position must complete and submit to an Associated Students Election Ad Hoc Committee Chairperson an Associated Students Election Application, which may be obtained from the Associated Students Office at each campus immediately following the “Call for Candidates” each election year. Election applications will be available for completion and submission during a specified time period defined in the Call for Candidates. Associated Students Election Applications must include a section notifying students of the option to run for the Student Trustee position and direct any interested student to contact the Associated Students Advisor or the Chancellor’s Office for a separate Student Trustee Election Application. Students advancing to candidacy may run for only one position on all ballots for one election period. A candidate’s “primary campus” is defined as the Ccollege campus where the student is enrolled in the majority of his or her units. All successful Associated Students’ candidates and the successful Student Trustee candidate will assume office on June 1 and serve through the following May 31.

SECTION I – CANDIDATE REQUIREMENTS A. Candidates for Student Trustee and Associated Students’ positions must:

1. Be at least 18 years of age prior to assuming office; 2. Be currently registered at Moorpark College, Oxnard College, or Ventura

College (including Ventura College Santa Paula Site); 3. Be continuously enrolled in 5 or more units when declaring candidacy and

during term in office (excluding summer and winter intersessions); 4. Hold and maintain during term of office a semester and cumulative Grade

Point Average (GPA) of 2.00 or higher; and 5. Be in good standing academically, not currently on academic or

disciplinary probation, have not violated the Student Conduct Code, andor

have not been expelled from a Ccollege-based Aassociated Sstudents’ position.

B. Additional requirements for candidates for Student Trustee and Associated

Students’ positions of President and Vice President:

1. Must have completed a minimum of 12 units taken at the candidate’s primary campus by the end of the current spring semester, and

2. Shall not hold the position of Student Trustee concurrently with that of an Associated Students’ position at any of the Ccolleges within the Ventura County Community College District.

C. Following a student’s submission of a completed Student Election Application

and Eligibility Verification, the Associated Students Advisor at each Ccollege will verify each candidate’s standing, unit requirements, and GPA standing with the Records and Admissions office before approval of candidacy. The Associated Students Advisor at each Ccollege will then forward Student Trustee candidates’ verifications to the Chancellor’s Office.

D. Verification of the elected Student Trustee’s and elected Associated Students’

continuing unit requirements and academic standing will occur at the end of each semester by the Chancellor’s Office for the Student Trustee and by the Associated Students Advisors for Associated Students. Failure to maintain academic standards and unit requirements, violation of the Student Conduct Code, or if placed on academic or disciplinary probation, will result in automatic removal from a position.

SECTION II – CANDIDACY

A. Election Calendar No later than the first week of February each year, the Chancellor’s Designee will

call together the Associated Students Advisor at each college to determine the Student Elections Calendar. The Election Calendar will then be provided at the Candidates Meetings in the Election Packet.

B. Candidates Meetings

All accepted potential candidates for Associated Students’ positions must attend one Candidates Meeting at the Ccollege where they will run for election. Candidates Meetings will be facilitated by the Associated Students Election Ad Hoc Committee at each Ccollege. Student Trustee Candidates will attend one Candidates Meeting at his/her primary campus facilitated by the Associated Students Election Ad Hoc Committee and attend one additional Student Trustee Candidates Meeting at the District Administrative Center facilitated by the Chancellor’s Designee. Student Election Standard Operating Practices will be reviewed at the Candidates Meetings, and all candidates will be responsible for knowing and adhering to Student Election Standard Operating Practices.

C. Each candidate will receive a Candidate Election Packet at a required

Candidates Meeting. No Candidate Election Packets will be available prior to the date of the Candidates Meetings at each campus. Upon receipt, each candidate will sign an Acceptance of Candidate Election Packet and Acknowledgement of Responsibility form and submit same to the Associated Students Election Ad Hoc Committee Chairperson. Student Trustee candidates’ documents will then be forwarded to the Chancellor’s Designee by the Associated Students Election Ad Hoc Committee Chairperson or Associated Students Advisor.

SECTION III – CANDIDATE ELECTION PACKET

A. The following documents for Student Trustee and Associated Students’ elections

are contained in the Candidate Election Packet. Candidates must meet the specific requirements contained in the Student Election Standard Operating Practices and complete and submit all required documents in the Candidate Election Packet prior to initiating any campaign activities.

SECTION IV – WRITE-IN CANDIDATES APPOINTMENTS A. ALL active write-in candidates must:

1. Meet the Candidate Requirements as stated in the Student Election

Standard Operating Practices; 2. Obtain, read, and review Student Election Standard Operating Practices

with an Associated Students Advisor; and 3. Complete and submit all required forms in the Candidate Election Packet

provided with the Student Election Standard Operating Practices (referenced in Section III above and provided in Appendix B) for the specified position to the Associated Students Advisor at the primary college of attendance by noon on the Thursday following the election.

Unfilled/vacant Associated Students’ positions following the election will be filled by appointment as determined by each College Associated Students’ organization and the Associated Students Advisor.

SECTION V – CAMPAIGNING A. VCCCD Administrative Relations will provide eEach cCollege with ill post student

election posters and/or flyers for posting on campus and on District/College websitesin a public place on campus and at the Ventura College Santa Paula Site.

B. A candidate may begin campaigning on the date and time specified on the

Election Calendar provided at the Candidates’ Meeting and after: 1. Completing the requirements set out in the Candidate Election Packet and

Student Election Standard Operating Practices;

2. Receiving official approval for candidacy in writing by the Chancellor for the Student Trustee position or an Associated Students Election Ad Hoc Committee for Associated Students’ positions;

3. Attending a Candidates Meeting at the campus of primary attendance; and 4. Attending an additional Student Trustee Candidate Meeting at the District

Administrative Center, if a candidate for the Student Trustee position. C. Candidates are responsible for all information distributed and reviewed at

the Candidates Meetings. Candidates are also responsible for the actions of individuals assisting with campaigns or campaigning on behalf of a Candidatetheir campaign managers/campaign assistants and are accountable for any violations by their managers and/or assistants of the Student Election Standard Operating Practices. campaign assistants must comply with Student Election Standard Operating Practices and College/District campus posting requirements.

D. Campaigning is defined as talking with students about the candidate, issues, or

campaign platforms; giving speeches; presenting recorded messages; making and distributing/posting signs/posters/flyers in approved areas on the Ccollege campuses or at the District Administrative Center, buttons, cards, or other campaign materials; and utilizing publicity, including paid advertisements in the online student newspaper. Campaigning involving inappropriate postings in any format, bullying, or personal attacks will not be tolerated and will result in automatic disqualification from the student elections.

E. A “slate” is a list of candidates running together for election to the various offices.

Candidates may not combine their campaigning activities to create “slates” of candidates, and campaign materials may contain only information on onemultiple candidates. The election ballot willmay not align or designate candidates as belonging to a specific “slate,.” however, students will have the opportunity to vote for individual candidates within the slate. However, cCandidates may support one another for various races and may designate each other as campaign assistants in order to enable each to campaign for the other.

F. Campaign literature posted at the Ccolleges is subject to the posting

requirements at each respective Ccollege. Posting of campaign materials is permitted ONLY on designated bulletin boards or other areas specified by campus posting requirements.

1. Candidates shall not “paper” any bulletin board, kiosk, or other specified

campaigning area (no more than two materials posted adjacent to the other or on any one side of a bulletin board, kiosk, or other specified campaigning area).

2. Posted or displayed campaign materials may be no larger than 11” x 17”. In a series of duplicate posters, the Associated Students Election Ad Hoc Committee, Associated Students Advisor, or designee must approve the original poster. Unapproved materials will be removed by the Election Ad Hoc Committee or Associated Students Advisor.

3. Candidates must obtain advance approval of an instructor to campaign in a classroom. The advance approval shall be submitted by the instructor by telephone or via email to the Associated Student Advisor for Associated Students’ candidates and to the Chancellor’s Designee for Student Trustee candidates. Unapproved classroom disruptions by candidates will not be tolerated and will result in automatic disqualification from the student elections.

4. Destruction and/or removal of a candidate’s publicity by another student, candidate, or campaign assistant are considered to be in violation of the Student Election Standard Operating Practices and subject to disqualification or disciplinary action. Continued destruction of candidates’

publicity will result in the removal of all candidates’ publicity for the remainder of the election.

5. No campaigning may take place within a 100-foot radius of a designated polling site at all times.

6. Candidate Platform Statements will be the only allowed campaign material at the polling site(s) at all times. Candidates are responsible for preparing their own Platform Statements for distribution and posting at the polling sites.

7. Candidates are responsible for removing all posted materials within 24 hours following the last day of student elections. Candidates failing to remove posted materials within the 24-hour time period may be charged with reasonable removal and clean-up costs.

SECTION VI – ELECTION AD HOC COMMITTEES (Applicable Only to Associated Students’ Positions at Each Campus)

A. Each campus Associated Students shall establish an Associated Students Ad

Hoc Election Committee of no less than three students, chaired by the student designated by their campus Associated Students Constitution/Bylaws.

1. No candidate may serve as a member of the Associated Students Election

Ad Hoc Committee. 2. No member of the Associated Students Ad Hoc Election Committee may

endorse a candidate or participate in campaign activities of any kind. 3. No individual member of the Associated Students Election Ad Hoc

Committee speaks for the entire committee. Decisions on election issues must be made by a quorum of the committee in a scheduled committee meeting.

4. Only the Election Ad Hoc Committees and the Associated Students

Advisors have the right to view the personal information of candidates provided within a candidate’s records.

B. The Associated Students Election Ad Hoc Committee at each Ccollege will:

1. Host a minimum of one Candidates Meeting at each campus to distribute Associated Students Election Packets and assist with the explanation of materials in the packets.

2. Assist candidates, if requested, in completing the required forms in the

Candidate Election Packet. 3. Advise candidates of their rights and responsibilities during the campaign

and election.

4. Administer the general election and any special or runoff elections needed in compliance with Student Election Standard Operating Practices.

5. Review content and oversee the posting of and distribution of any

campaign materials in compliance with the Ccolleges’ posting requirements.

6. Be responsible for all publicity regarding elections on campus, with the

exception of materials and ads paid for created/distributed by the District Administrative CenterOffice. Notification of the results of the election should be posted within 24 hours of the closing of the polls on the final day of each election whether regular, general, special, or runoff.

7. Staff the polls or recruit and assist a third party, with the approval of an

Associated Students Advisor. Two or more poll workers must staff each polling place at all times. Poll workers may not be running for any office or be campaigning on behalf of designated campaign assistants or campaign managers for any candidate.

8. Maintain order at the polls at all times. A candidate may designate a

campaign assistant to observe the polling process, but no campaigning may occur within the polling area at all times. No campaigning is allowed within a 100-foot radius of the polls at all times, and the radius must be clearly defined. Campus police may be used if security at the polls is considered an issue by the Associated Students Election Ad Hoc Committee.

9. Oversee the ballot tabulation for the Associated Students’ election and if

requested by the Chancellor or Chancellor’s Designee, the Student Trustee election.

10. Confirm the information contained in the “Statement of Accuracy”

regarding the tabulation of the ballots for the election. 11. Oversee the removal of all campaign materials from the campus, and cite

any candidate whose materials are not removed within 24 hours from the end of the polling period, unless a runoff or special election has been declared with a specific candidate still competing for the position.

SECTION VII – CAMPAIGN EXPENDITURES

A. Each candidate, whether successful or unsuccessful in his or her campaign,

must complete and submit a Campaign Expenditure Report listing all campaign expenditures. Student Trustee candidates submit the completed Campaign Expenditure Report to the Chancellor’s Office, and Associated Students’ candidates submit the completed Campaign Expenditure Report to the Associated Students Election Ad Hoc Committee at their primary Ccollege of attendance. The deadline for submitting Campaign Expenditure Reports is no

later than the close of polls on the final day of elections and also applies to any runoff elections.

B. Campaign expenditures for Student Trustee candidates shall not exceed $5300,

including any runoff election. Campaign expenditures for Associated Students’ candidates shall not exceed $2100, including any runoff election. Candidates may not combine funds with or receive any monetary or in-kind donation (goods or services) from another candidate.

C. Candidates may not utilize supplies or equipment belonging to VCCCD and the Ccolleges to prepare campaign materials.

D. Candidates may not use Associated Students’ funds, Ccollege funds, or VCCCD funds for campaign purposes.

E. With the exception of using Ccollege computer labs, all preparation of campaign materials will occur off campus, and all material preparation costs will be included on the Campaign Expenditure Report.

F. Candidates are responsible for the actions of their campaign managers individuals campaigning on their behalfand assistants during the preparation of campaign materials.

G. Candidates may use a translator in the preparation of campaign materials, which is not considered a campaign expenditure and need not be listed on the Campaign Expenditure Report.

SECTION VIII – CAMPAIGN ENDORSEMENTS

A. Candidates may solicit endorsements from students and members of student

organizations at Moorpark College, Oxnard College, Ventura College, and Ventura College Santa Paula Site. Candidates may use valid endorsements in their campaign materials at the discretion of the Election Ad Hoc Committees.

B. Soliciting, receiving, and/or utilizing an endorsement from faculty, staff,

administrators, outside community groups, or members of the Board of Trustees are a violation of the Student Election Standard Operating Practices. No member of the Election Ad Hoc Committees may endorse a candidate or participate in campaign activities of any kind. No current or previous Student Trustee may endorse any candidate.

SECTION IX – CANDIDATE FORUMS

A. A Candidate Forum is an event hosted by a student organization that permits

candidates to address or debate student issues relevant to the office they are seeking. Should an Election Ad Hoc Committee decide to host a Candidate Forum, all candidates will be notified by the Election Ad Hoc Committee to allow all candidates the opportunity to be heard.

B. A candidate may choose to utilize a translator for all or part of a Candidate Forum or while campaigning. The cost of utilizing a translator is not considered campaign expenditure and need not be listed on the Campaign Expenditure Report.

SECTION X – COMPOSITION OF BALLOTS

A. Candidates for the Student Trustee position and the Associated Students’

positions will be placed on separate ballots using a lottery process determined by the Election Ad Hoc Committees.

B. All ballots used for student elections will be scrantron or typed/computer-

generated ballots, marked by hand. Space will be provided on ballots for write-in votes. Student election ballots are electronic ballots that can be accessed online at the polling sites for voting purposes by VCCCD students with a valid student ID.

SECTION XI – VOTING A. The Election Ad Hoc Committees will oversee elections at the campuses and

Ventura College Santa Paula Site. The Associated Students Election Ad Hoc Committees may appoint a third party for assistance, upon approval by an Associated Students Advisor, to assist during all hours the campus polling site is open.

B. All voting students must present a valid photo ID to the poll worker who will verify the photo ID matches the likeness of the student.

C. Each voting student must verify his or her Ccollege ID number on the campus

Voter Registration List.

D. A student must be currently enrolled at VCCCD and can vote only one time. If a student is enrolled at more than one cCollege, he or she must vote at their primary campus, which is defined as the cCollege campus where the student is enrolled in the majority of his or her units.

E. The Ventura College Election Ad Hoc Committee must determine a system to

prevent duplicate voting at Ventura College Santa Paula Site. F. Each authorized voter will receive a ballot packet consisting of a ballot for the

Student Trustee position and a ballot for Associated Students’ positions. FG. Voting shall be by electronicsecret ballot using online/electronic voting. GH. Voters must vote in a booth at the polling location. Leaving the polling area with

a ballot is a violation of Student Election Standard Operating Practices, making the ballot(s) invalid.

HI. A member of the Election Ad Hoc Committees must receive a written, signed notification of any Student Elections Standard Operating Practices’ violation(s) no later than the close of the polls on the last day of voting.

IJ. Only members of the Election Ad Hoc Committees, an Associated Students

Advisors, or the Chancellor’s Designee, or VCCCD IT staff shall have access to the electronic ballotsmove the ballot boxes at the end of balloting.

SECTION XII – VOTE TABULATIONS

A. Tabulating the ballots for Associated Students’ positions:

1. The Associated Students Election Ad Hoc Committee at each Ccollege or

an appointed third party (i.e., League of Women Voters) is responsible for tabulating the ballots and posting results for Associated Students’ positions. Associated Students Advisors will oversee the process.

2. Ballot counting for Associated Students’ positions shall be completed by the Associated Students Election Ad Hoc Committee no later than 5:00 p.m. on the day following the final day of the election.

3. Only members of the Election Ad Hoc Committees or appointed third party

(i.e., League of Women Voters), Associated Student Advisors, and College Presidents or Presidents’ Designees may be present during tabulation of ballots.

4. The candidate receiving the majority of votes (plurality) for each position

will be the winner.

5. The Associated Students Election Ad Hoc Committee Chairperson or appointed third party (i.e., League of Women Voters) and the Associated Students Advisor will prepare and sign a “Statement of Accuracy” regarding the results of tabulated ballots for the Associated Students’ positions.

6. If a tie vote occurs, a one-day runoff election will occur during the following

week, as set forth in the Election Calendar, and the Associated Students Election Ad Hoc Committee, shall establish campaign standard operating practices for the runoff election. Associated Student Advisors will oversee the process.

B. Tabulating the ballots for the Student Trustee position:

1. The Associated Student Advisor at each Ccollege shall email the electronic election results hand deliver the election ballots for the Student Trustee position to the Chancellor’s Designee by noon on the day following the final day of the election or arrange to have the Chancellor’s Designee pick up the ballots.

2. Ballots for the Student Trustee position will be tabulated by the Chancellor’s Office.

3.2. The candidate receiving the majority of votes (plurality) will be the

announced winner by the Chancellor’s Designee. 4. The Chancellor’s Designee shall notify the Associated Students Advisors

of the results, and the Associated Students Advisors will oversee the posting of results.

5.3. If a tie vote occurs, a one-day runoff election will occur during the following

week, as set forth in the Election Calendar, and the Chancellor shall establish campaign standard operating practices for the runoff election.

SECTION XIII – APPEAL PROCESS

A. Violations of the Student Election Standard Operating Practices may result in the

disqualification of a candidate.

B. If an alleged violation of Student Election Standard Operating Practices occurs:

1. The Chair of the Associated Students Election Ad Hoc Committee (for Associated Students) or Chancellor’s Designee (for Student Trustee) must receive written, signed notification of any alleged violation of Student Election Standard Operating Practices by the close of polls on the last day of elections , regardless of the need for any runoff election. The complainant must submit a copy of same to the Associated Students Advisor on the campus where the alleged violation occurred (for Associated Students) or to the Chancellor’s Office at the District Administrative Center (for Student Trustee).

2. The Associated Students Advisor or Election Ad Hoc Committee Chairperson, if so designated, will notify any candidate charged with an alleged violation within 24 hours of receiving notification from the complainant.

3. The Election Ad Hoc Committees are authorized to enforce Student

Election Standard Operating Practices as the standard operating practices relate to Associated Students and Student Trustee elections. a. Each charge of an alleged violation shall be decided by a majority

vote of a quorum of the Election Ad Hoc Committee members with an Associated Students Advisor present. A candidate charged with a violation shall have an opportunity to refute the violation prior to a decision by the Election Ad Hoc Committee. The complainant has the burden of proof. The Election Ad Hoc Committee will provide its decision via email upon making its decision, excluding holidays and weekends, and with an Associated Students Advisor present.

The candidate charged with a violation of Student Election Standard Operating Practices may appeal a decision determined by the Election Ad Hoc Committee within 48 hours to the Associated Students Executive Board, or in the case of a Student Trustee violation, to the Chancellor. The appeal must be in writing, setting forth the alleged violation by the candidate, the section of the Student Election Standard Operating Practices alleged to have been violated, and the decision being appealed, with a copy of same provided to the Associated Students Advisor during the same time period. The candidate appealing a decision of the Election Ad Hoc Committee shall have an opportunity to participate in the appeal process. To conclude the appeal process, the Associated Students Executive Board of the Associated Students will provide its final decision via email upon making its decision, excluding holidays and weekends, and with an Associated Students Advisor present. The Associated Students Advisor will be present for all discussions related to the appeal, including the final decision on the appeal.

b. At any level of reviewing a Student Election Standard Operating Practices’ violation, the hearing body (i.e., Election Ad Hoc Committees, Associated Students Executive Board, or Chancellor) may determine:

i. The violation is considered minimal and does not require the

disqualification of the candidate, or ii. The violation is significant and requires disqualification of the

candidate.

4. If a candidate abandons an appeal at any time during the process, the candidate will be considered disqualified.

5.4. A candidate will be referred to the appropriate Administrator for violations of the Ccollege Student Conduct Code. The Administrator will implement guidelines appropriate to violations of the cCollege Student Conduct Code.

C. Challenged Candidates:

1. If a challenged candidate has not exhausted the appeal process prior to the start of voting, the challenged candidate’s name will appear on the ballot and voting will proceed as set forth on the Election Calendar.

2. If a candidate is challenged, or if a challenged candidate’s appeal is

completed after the voting, resulting in both a final decision against the challenged candidate and disqualification of the challenged candidate, all votes cast for the disqualified candidate will be voided. If the disqualified candidate would have won the election, the candidate with the next highest vote total shall be declared the winner.

3. If all candidates for a position are successfully challenged for violations of

the Student Election Standard Operating Practices, a new election will be held.

D. If a complaint is received alleging a violation of Student Election Standard

Operating Practices by the Election Ad Hoc Committees or other students or parties attempting to disrupt the election, the complaint must be made in writing, signed by the complainant, and delivered to the appropriate College President or Chancellor for review and resolution.

E. Any candidate may request one recount of the position sought by that candidate

in the election if such request is made in writing, signed by the candidate by noon the day following the election, and delivered to the Associated Students Election Ad Hoc Committee Chairperson or Chancellor’s Office. College Presidents or the Chancellor may request recounts of positions.

SECTION XIV – AUTHORITY

All candidates are bound by the contents of the Student Election Standard Operating Practices and Election Packet. Any language or items not addressed in the Student Election Standard Operating Practices or Election Packet will be interpreted or addressed by the Chancellor and Chancellor’s Designee in the case of a Student Trustee election, or by the Election Ad Hoc Committee of each Ccollege, with the approval of the Associated Students Advisor in the case of Associated Students’ elections.

1. Student Election Standard Operating Practices The Student Election Standard Operating Practices of Ventura County Community College District govern all aspects of the campaign and election for the Student Trustee position.

2. Verification

Once all potential candidate qualifications and applications have been checked, verified, and approved, the Chancellor’s Office will notify eligible candidates by telephone or email and notify, in writing, each Associated Students Advisor verifying the list of successful candidates for the Student Trustee position.

3. Campaigning

Associated Students Candidates who have been notified of their eligibility may begin campaigning provided he/she has attended a minimum of one mandatory Candidates Meeting provided at his or her primary Ccollege campus. Student Trustee Candidates must attend one Candidates Meeting at his/her primary campus and one additional Student Trustee Candidates Meeting at the District Administrative Center facilitated by the Chancellor’s Designee. All Candidates must have proof of verification/eligibility prior to campaigning.

4. Campaign Costs

The entire cost of the campaign (Student Trustee candidates - $3500 maximum), not including statements provided by Ventura County Community College District, will be the responsibility of the candidate, including such things as printing, postage, phone calls, mailings, etc. The use of a translator will not be charged to a candidate’s campaign.

Moorpark College Posting Requirements

The Student Business Office must approve all non-campus-sponsored flyers, posters, banners and advertisements posted on the Moorpark College campus.

You must provide your own tacks, tape (blue painter’s tape only) or staplers and staples. Flyers, posters and advertisements containing information written in any language other than English must

include full translation in English. Flyers, posters and advertisements may not be larger than 8.5x11 in size.

A maximum of 20 flyers, posters and advertisements from the same organization or advertising the same event will be approved for posting.

Flyers, posters, banners and advertisements for local restaurants or bookstores may not be posted on campus. Food and book vendors must go through the Civic Center process to reserve a table in the Quad if they wish

to distribute information about their business. Approved advertisements MAY only be posted in the following areas on campus: • On all general-use bulletin boards located on or inside campus buildings

Ventura College Catalog 2013-14 Appendix XX Publicity Code and Information Dissemination Students wishing to post, display, distribute, or otherwise make known an activity, event, or other piece of information should seek advance approval from Student Activities Office. This policy applies to all printed material distributed by students and all others on the Ventura College campus including, but not limited, to all petitions, circulars, leaflets, newspapers, and all materials displayed on bulletin boards, kiosks, signboards, or other such display areas. In no case should printed materials be placed on lamp poles, buildings, windows, doors, retaining walls, painted surfaces, sidewalks, plants, and other such places. All printed materials should be clearly designed to meet the needs of students, staff, and faculty; and the event, activity, or program should be of obvious benefit to members of the campus community. All posted materials must display the VCCCD college campuses approval stamp. Requests by off-campus individuals or agencies to disseminate materials on the VCCCD college campuses should be referred to the Student Activities Office. Such material must be of a high campus value and pre-approval is required. STUDENT TRUSTEE POSITION DESCRIPTION

California state law (Education Code 72023.5) requires the board of trustees of each community college district to have at least one non-voting student member recognized as student trustee. A student trustee has the same general responsibilities as all trustees to represent the interests of the entire community; however, they also provide a student perspective on issues facing the board. Student trustees are not necessarily advocates for specific student issues, just as other trustees are not advocates for single interests. Student trustees provide a student perspective to ensure that students will be served well. Student trustee responsibilities include, but are not limited to, preparing for and attending board meetings (generally one meeting per month at Ventura County Community College District, unless otherwise scheduled), becoming educated about board and district-wide issues, and participating as a contributing member of the board. A student trustee will receive orientation through the Chancellor’s Office.

Additional information related to the Student Trustee position will be provided at Candidates Meetings. Student Trustee candidates are required to attend two Candidates Meetings.

BOARD POLICY REGARDING STUDENT TRUSTEE POSITION VENTURA COUNTY COMMUNITY COLLEGE DISTRICT

BP 2015 STUDENT MEMBER Reference: Education Code Section 72023.5 The Board shall include one non-voting student member. The term of office shall be one year commencing June 1 – May 31. The shall be enrolled in and maintain a minimum of five (5) semester units in the District at the time of nomination and throughout the term of service. The student member is not required to give up employment with the District. The student shall be in good standing academically; shall maintain a 2.0 cumulative grade point average (GPA); not currently be on academic or disciplinary probation; or have been expelled from a college-based associated student government position; shall be eighteen years of age prior to assuming office; and shall have completed twelve (12) units as a student in this district prior to taking office as student trustee. The student member shall be seated with the Board and shall be recognized as a full member of the Board at meetings. The student member is entitled to participate in discussion of issues and receive all materials presented to members of the Board (except for closed session). The student member shall be entitled to any mileage allowance necessary to attend Board meetings and District events to the same extent as publicly elected trustees. On or before May 15 of each year, the Board shall consider whether to afford the student member any of the following privileges: • The privilege to make and second motions; • The privilege to attend closed sessions, other than closed sessions on personnel or collective bargaining matters; • The privilege to receive compensation for meeting; • The privilege to serve a term commencing on June 1 – May 31.

Board members shall not be financially interested in any contract made by the Board of Trustees or in any contract they make in their capacity as Board members.

A Board member shall not be considered to be financially interested in a contract if his or her interest is limited to those interests defined as remote under Government Code Section 1091 or is limited to interests defined by Government Code section 1091.5.

A Board member who has a remote interest in any contract considered by the Board shall disclose his or her interest during a Board meeting and have the disclosure noted in the official Board minutes. The Board member shall not vote or debate on the matter or attempt to influence any other Board member to enter into the contract.

A Board member shall not engage in any employment or activity that is inconsistent with, incompatible with, in conflict with, or inimical to his or her duties as an officer of the District. A Board member shall not simultaneously hold two public offices that are incompatible.

Upon leaving their positions, former members of the Board of Trustees and the Chancellor shall not, for a period of one year, act as an attorney, agent, or otherwise represent for compensation, others appearing before the Board.

In compliance with law and regulation, the Chancellor shall establish administrative procedures to provide for disclosure of assets of income of Board members who may be affected by their official actions, and prevent members from making or participating in the making of Board decisions that may foreseeably have a material effect on their financial interest.

Board members shall file Statements of Economic Interests with the filing officer identified by the Administrative Procedures.

Board members are encouraged to seek counsel from the District’s legal advisor in every case where any question arises.

In compliance with law and regulation, the Chancellor shall establish administrative procedures to address conflict of interest code reportable items for designated VCCCD employees as defined by the Political Reform Act of 1974, regulations of the Fair Political Practices Commission (2 Cal. Code Regs., § 18100 et seq.), and any amendments to the Act or regulations.

A Board member shall not be considered to be financially interested in a contract if his or her interest meetsthe definitions contained in applicable law (Gov. Code, § 1091.5). A Board member shall not be deemed to be financially interested in a contract if he or she has only a remoteinterest in the contract and if the remote interest is disclosed during a Board meeting and noted in the officialBoard minutes. The affected Board member shall not vote or debate on the matter or attempt to influenceany other member of the Board to enter into the contract. Remote interests are specified in GovernmentCode section 1091, subdivision (b); they include, but are not limited to, the interest of a parent in theearnings of his or her minor child.

No Employment Allowed (Ed. Code, § 72103, subd. (b)) An employee of the District may not be sworn in as an elected or appointed member of the Governing Boardunless and until he or she resigns as an employee. If the employee does not resign, the employment willautomatically terminate upon being sworn into office. This provision does not apply to an individual who isusually employed in an occupation other than teaching and who also is, at the time of election to the Board,employed part-time by the District to teach no more than one course per semester or quarter in the subjectmatter of that individual’s occupation (Ed. Code, § 72103, subd. (b)).

Financial Interest in a Decision (Gov. Code, § 87100 et seq.) If a Board member or designated employee determines that he or she has a financial interest in a decision,as described in Government Code section 87103, this determination shall be disclosed and made part of theBoard’s official minutes. In the case of an employee, this announcement shall be made in writing andsubmitted to the Board. A Board member, upon identifying a conflict of interest, or a potential conflict ofinterest, shall do all of the following prior to consideration of the matter.

Publicly identify the financial interest in detail sufficient to be understood by the public;Recuse himself or herself from discussing and voting on the matter; andLeave the room until after the discussion, vote, and any other disposition of the matter is concludedunless the matter is placed on the agenda reserved for uncontested matters. A board member may,however, discuss the issue during the time the general public speaks on the issue.

Gifts (Gov. Code, § 89503) Board members and any employees who manage public investments shall not accept from any singlesource in any calendar year any gifts in excess of the prevailing gift limitation specified in law. Designated employees shall not accept from any single source in any calendar year any gifts in excess ofthe prevailing gift limitation specified in law if the employee would be required to report the receipt of incomeor gifts from that source on his/her Statement of Economic Interests. The above limitations on gifts do not apply to wedding gifts and gifts exchanged between individuals onbirthdays, holidays and other similar occasions, provided that the gifts exchanged are not substantiallydisproportionate in value. Gifts of travel and related lodging and subsistence shall be subject to the above limitations except asdescribed in Government Code section 89506. A gift of travel does not include travel provided by the District for Board members and designatedemployees. Board members and any employees who manage public investments shall not accept any honorarium,which is defined as any payment made in consideration for any speech given, article published, orattendance at any public or private gathering (Gov. Code, §§ 89501 & 89502).

Designated employees shall not accept any honorarium that is defined as any payment made inconsideration for any speech given, article published, or attendance at any public or private gathering, if theemployee would be required to report the receipt of income or gifts from that source on his or her Statementof Economic Interests. The term “honorarium” does not include:

Earned income for personal services customarily provided in connection with a bona fide business,trade, or profession unless the sole or predominant activity of the business, trade or profession ismaking speeches.Any honorarium that is not used and, within 30 days after receipt, is either returned to the donor ordelivered to the District for donation into the general fund without being claimed as a deduction forincome tax purposes.

Representation (Gov. Code, § 87406.3) Elected officials and the Chancellor shall not, for a period of one year after leaving their positions, act asagents or attorneys for, or otherwise represent for compensation, any person appearing before that localgovernment agency.

A code so amended or adopted and promulgated requires the reporting of reportable items in a manner substantially equivalent to the requirements of Article article 2 of Chapter chapter 7 of the Political Reform Act, Government Code section 81000 et seq. The requirements of a conflict of interest code are in addition to other requirements of the Political Reform Act, such as the general prohibition against conflicts of interest contained in Government Code section 87100, and to other state or local laws pertaining to conflicts of interest. Section 1. Definitions The definitions contained in the Political Reform Act of 1974, regulations of the Fair Political Practices Commission (2 Cal. Code Regs., § 18100 et seq.), and any amendments to the Act or regulations, are incorporated by reference into this conflict of interest code. Section 2. Designated Employees The persons holding positions listed in the AppendixSection 13 are designated employees. It has been determined that these persons make or participate in the making of decisions which may foreseeably have a material effect on economic interests. Section 3. Disclosure Categories This code does not establish any disclosure obligation for those designated employees who are also specified in Government Code section 87200 if they are designated in this code in that same capacity or if the geographical jurisdiction of this agency is the same as or is wholly included within the jurisdiction in which those persons must report their economic interests pursuant to article 2 of chapter 7 of the Political Reform Act, Government Code section 87200 et seq. In addition, this code does not establish

any disclosure obligation for any designated employees who are designated in a conflict of interest code for another agency, if all of the following apply:

A. The geographical jurisdiction of this agency is the same as or is wholly included within the jurisdiction of the other agency;

B. The disclosure assigned in the code of the other agency is the same as that required under

article 2 of chapter 7 of the Political Reform Act, Government Code section 87200; and

C. The filing officer is the same for both agencies.[1] Such persons are covered by this code for disqualification purposes only. With respect to all other designated employees, the disclosure categories set forth in the AppendixSection 13 specify which kinds of economic interests are reportable. Such a designated employee shall disclose in his or her Statement of Economic Interests those economic interests he or she has which are of the kind described in the disclosure categories to which he or she is assigned in the AppendixSection 13. It has been determined that the economic interests set forth in a designated employee's disclosure categories are the kinds of economic interests which he or she foreseeably can affect materially through the conduct of his or her office.

Section 4. Statements of Economic Interests Place of Filing. The code reviewing body shall instruct all designated employees within its code to file Statements of Economic Interests with the agency or with the code reviewing body, as provided by the code reviewing body in the agency's conflict of interest code.[2] Maintenance and management of Statement of Economic Interest forms will be administered through the Chancellor’s Office. Section 5. Statements of Economic Interests Time of Filing.

A. Initial Statements. All designated employees employed by the agency on the effective date of this code, as originally adopted, promulgated and approved by the code reviewing body, shall file statements within 30 days after the effective date of this code. Thereafter, each person already in a position when it is designated by an amendment to this code shall file an initial statement within 30 days after the effective date of the amendment.

B. Assuming Office Statements. All persons assuming designated positions after the effective date

of this code shall file statements within 30 days after assuming the designated positions, or if subject to State Senate confirmation, 30 days after being nominated or appointed.

C. Annual Statements. All designated employees shall file statements no later than April 1.

D. Leaving Office Statements. All persons who leave designated positions shall file statements

within 30 days after leaving office. Section 5.5. Statements for Persons Who Resign Prior to Assuming Office Any person who resigns within 12 months of initial appointment, or within 30 days of the date of notice provided by the filing officer to file an assuming office statement, is not deemed to have assumed office

or left office, provided he or she did not make or participate in the making of, or use his or her position to influence any decision and did not receive or become entitled to receive any form of payment as a result of his or her appointment. Such persons shall not file either an assuming or leaving office statement.

A. Any person who resigns a position within 30 days of the date of a notice from the filing officer shall do both of the following:

1. File a written resignation with the appointing power; and

2. File a written statement with the filing officer declaring under penalty of perjury that during

the period between appointment and resignation he or she did not make, participate in the making, or use the position to influence any decision of the agency or receive, or become entitled to receive, any form of payment by virtue of being appointed to the position.

Section 6. Contents of and Period Covered by Statements of Economic Interests

A. Contents of Initial Statements. Initial statements shall disclose any reportable investments, interests in real property and business positions held on the effective date of the code and income received during the 12 months prior to the effective date of the code.

B. Contents of Assuming Office Statements. Assuming office statements shall disclose any

reportable investments, interests in real property and business positions held on the date of assuming office or, if subject to State Senate confirmation or appointment, on the date of nomination, and income received during the 12 months prior to the date of assuming office or the date of being appointed or nominated, respectively.

C. Contents of Annual Statements. Annual statements shall disclose any reportable investments,

interests in real property, income and business positions held or received during the previous calendar year provided, however, that the period covered by an employee's first annual statement shall begin on the effective date of the code or the date of assuming office, whichever is later.

D. Contents of Leaving Office Statements. Leaving office statements shall disclose reportable

investments, interests in real property, income and business positions held or received during the period between the closing date of the last statement filed and the date of leaving office.

Section 7. Manner of Reporting Statements of Economic Interests shall be made on forms prescribed by the Fair Political Practices Commission and supplied by the agency, and shall contain the following information:

A. Investments and Real Property Disclosure. When an investment or an interest in real property[3] is required to be reported,[4] the statement shall contain the following:

1. A statement of the nature of the investment or interest;

2. The name of the business entity in which each investment is held, and a general

description of the business activity in which the business entity is engaged;

4. A statement whether the fair market value of the investment or interest in real property

exceeds two thousand dollars ($2,000), exceeds ten thousand dollars ($10,000), exceeds one hundred thousand dollars ($100,000), or exceeds one million dollars ($1,000,000).

B. Personal Income Disclosure. When personal income is required to be reported,[5] the

statement shall contain:

1. The name and address of each source of income aggregating five hundred dollars ($500) or more in value, or fifty dollars ($50) or more in value if the income was a gift, and a general description of the business activity, if any, of each source;

2. A statement whether the aggregate value of income from each source, or in the case of a loan, the highest amount owed to each source, was one thousand dollars ($1,000) or less, greater than one thousand dollars ($1,000), greater than ten thousand dollars ($10,000), or greater than one hundred thousand dollars ($100,000);

3. A description of the consideration, if any, for which the income was received;

4. In the case of a gift, the name, address and business activity of the donor and any intermediary through which the gift was made; a description of the gift; the amount or value of the gift; and the date on which the gift was received;

5. In the case of a loan, the annual interest rate and the security, if any, given for the loan and the term of the loan.

C. Business Entity Income Disclosure. When income of a business entity, including income of a sole

proprietorship, is required to be reported,[6] the statement shall contain:

1. The name, address, and a general description of the business activity of the business entity;

2. The name of every person from whom the business entity received payments if the filer's pro rata share of gross receipts from such person was equal to or greater than ten thousand dollars ($10,000).

D. Business Position Disclosure. When business positions are required to be reported, a designated

employee shall list the name and address of each business entity in which he or she is a director, officer, partner, trustee, employee, or in which he or she holds any position of management, a description of the business activity in which the business entity is engaged, and the designated employee's position with the business entity.

E. Acquisition or Disposal during Reporting Period. In the case of an annual or leaving office

statement, if an investment or an interest in real property was partially or wholly acquired or disposed of during the period covered by the statement, the statement shall contain the date of acquisition or disposal.

Section 8. Prohibition on Receipt of Honoraria

A. No member of a state board or commission, and no designated employee of a state or local government agency, shall accept any honorarium from any source, if the member or employee would be required to report the receipt of income or gifts from that source on his or her Statement of Economic Interests. This section shall not apply to any part-time member of the governing board of any public institution of higher education, unless the member is also an elected official. Subdivisions (a), (b) and (c) of Government Code section 89501 shall apply to the prohibitions in this section.

B. This section shall not limit or prohibit payments, advances, or reimbursements for travel and

related lodging and subsistence authorized by Government Code section 89506. Section 8.1. Prohibition on Receipt of Gifts in Excess of $420440

A. No member of a state board or commission, and no designated employee of a state or local government agency, shall accept gifts with a total value of more than $420 440 in a calendar year from any single source, if the member or employee would be required to report the receipt of income or gifts from that source on his or her statement of economic interests. This section shall not apply to any part-time member of the governing board of any public institution of higher education, unless the member is also an elected official.

Subdivisions (e), (f) and (g) of Government Code section 89503 shall apply to the prohibitions in this section.

Section 8.2. Loans to Public Officials

A. No elected officer of a state or local government agency shall, from the date of his or her election to office through the date that he or she vacates office, receive a personal loan from any officer, employee, member, or consultant of the state or local government agency in which the elected officer holds office or over which the elected officer's agency has direction and control.

B. No public official who is exempt from the state civil service system pursuant to subdivisions (c),

(d), (e), (f) and (g) of Section 4 of Article VII of the Constitution shall, while he or she holds office, receive a personal loan from any officer, employee, member, or consultant of the state or local government agency in which the public official holds office or over which the public official's agency has direction and control. This subdivision shall not apply to loans made to a public official whose duties are solely secretarial, clerical, or manual.

C. No elected officer of a state or local government agency shall, from the date of his or her election to office through the date that he or she vacates office, receive a personal loan from any person who has a contract with the state or local government agency to which that elected officer has been elected or over which that elected officer's agency has direction and control. This subdivision shall not apply to loans made by banks or other financial institutions or to any indebtedness created as part of a retail installment or credit card transaction, if the loan is made or the indebtedness created in the lender's regular course of business on terms available to members of the public without regard to the elected officer's official status.

D. Loans made by a public official's spouse, child, parent, grandparent, grandchild, brother, sister, parent-in-law, brother-in-law, sister-in-law, nephew, niece, aunt, uncle, or first cousin, or the spouse of any such persons, provided that the person making the loan is not acting as an agent or intermediary for any person not otherwise exempted under this section.

3. Loans from a person which, in the aggregate, do not exceed five hundred dollars ($500) at any given time.

4. Loans made, or offered in writing, before January 1, 1998. Section 8.3. Loan Terms

A. Except as set forth in subdivision (B), no elected officer of a state or local government agency shall, from the date of his or her election to office through the date he or she vacates office, receive a personal loan of five hundred dollars ($500) or more, except when the loan is in writing and clearly states the terms of the loan, including the parties to the loan agreement, date of the loan, amount of the loan, term of the loan, date or dates when payments shall be due on the loan and the amount of the payments, and the rate of interest paid on the loan.

B. This section shall not apply to the following types of loans:

1. Loans made to the campaign committee of the elected officer. 2. Loans made to the elected officer by his or her spouse, child, parent, grandparent,

grandchild, brother, sister, parent-in-law, brother-in-law, sister-in-law, nephew, niece, aunt, uncle, or first cousin, or the spouse of any such person, provided that the person making the loan is not acting as an agent or intermediary for any person not otherwise exempted under this section.

3. Loans made, or offered in writing, before January 1, 1998.

C. Nothing in this section shall exempt any person from any other provision of Title 9 of the Government Code.

Section 8.4. Personal Loans

A. Except as set forth in subdivision (B), a personal loan received by any designated employee shall become a gift to the designated employee for the purposes of this section in the following circumstances:

1. If the loan has a defined date or dates for repayment, when the statute of limitations for

filing an action for default has expired. 2. If the loan has no defined date or dates for repayment, when one year has elapsed from

the later of the following:

a. The date the loan was made. b. The date the last payment of one hundred dollars ($100) or more was made on

the loan. c. The date upon which the debtor has made payments on the loan aggregating to

less than two hundred fifty dollars ($250) during the previous 12 months.

B. This section shall not apply to the following types of loans:

1. A loan made to the campaign committee of an elected officer or a candidate for elective office.

2. A loan that would otherwise not be a gift as defined in this title. 3. A loan that would otherwise be a gift as set forth under subdivision (A), but on which

the creditor has taken reasonable action to collect the balance due. 4. A loan that would otherwise be a gift as set forth under subdivision (A), but on which

the creditor, based on reasonable business considerations, has not undertaken collection action. Except in a criminal action, a creditor who claims that a loan is not a gift on the basis of this paragraph has the burden of proving that the decision for not taking collection action was based on reasonable business considerations.

5. A loan made to a debtor who has filed for bankruptcy and the loan is ultimately discharged in bankruptcy.

C. Nothing in this section shall exempt any person from any other provisions of Title 9 of the

Government Code. Section 9. Disqualification No designated employee shall make, participate in making, or in any way attempt to use his or her official position to influence the making of any governmental decision which he or she knows or has reason to know will have a reasonably foreseeable material financial effect, distinguishable from its effect on the public generally, on the official or a member of his or her immediate family or on:

A. Any business entity in which the designated employee has a direct or indirect investment worth two thousand dollars ($2,000) or more;

B. Any real property in which the designated employee has a direct or indirect interest worth two thousand dollars ($2,000) or more;

C. Any source of income, other than gifts and other than loans by a commercial lending institution in the regular course of business on terms available to the public without regard to official status, aggregating five hundred dollars ($500) or more in value provided to, received by or promised to the designated employee within 12 months prior to the time when the decision is made;

D. Any business entity in which the designated employee is a director, officer, partner, trustee, employee, or holds any position of management; or

E. Any donor of, or any intermediary or agent for a donor of, a gift or gifts aggregating $420 440 or more provided to; received by, or promised to the designated employee within 12 months prior to the time when the decision is made.

Section 9.3. Legally Required Participation No designated employee shall be prevented from making or participating in the making of any decision to the extent his or her participation is legally required for the decision to be made. The fact that the vote of a designated employee who is on a voting body is needed to break a tie does not make his or her participation legally required for purposes of this section. Section 9.5. Disqualification of State Officers and Employees In addition to the general disqualification provisions of section 9, no state administrative official shall make, participate in making, or use his or her official position to influence any governmental decision directly relating to any contract where the state administrative official knows or has reason to know that any party to the contract is a person with whom the state administrative official, or any member of his or her immediate family has, within 12 months prior to the time when the official action is to be taken:

A. Engaged in a business transaction or transactions on terms not available to members of the public, regarding any investment or interest in real property; or

B. Engaged in a business transaction or transactions on terms not available to members of the public regarding the rendering of goods or services totaling in value one thousand dollars ($1,000) or more.

Section 10. Disclosure of Disqualifying Interest When a designated employee determines that he or she should not make a governmental decision because he or she has a disqualifying interest in it, the determination not to act may be accompanied by disclosure of the disqualifying interest. Section 11. Assistance of the Commission and Counsel Any designated employee who is unsure of his or her duties under this code may request assistance from the Fair Political Practices Commission pursuant to Government Code section 83114 or from the attorney for his or her agency, provided that nothing in this section requires the attorney for the agency to issue any formal or informal opinion.

Section 12. Violations This code has the force and effect of law. Designated employees violating any provision of this code are subject to the administrative, criminal and civil sanctions provided in the Political Reform Act, Government Code sections 81000 - 91015. In addition, a decision in relation to which a violation of the disqualification provisions of this code or of Government Code sections 87100 or 87450 has occurred may be set aside as void pursuant to Government Code section 91003.

Appendix Section 13. Designated Positions and Disclosure Requirements

1. The persons occupying the following positions manage public investments. They shall file a full Statement of Economic Interests pursuant to Government Code section 87200 et seq. These persons shall file their statements electronically with the Clerk of the Board of Supervisors of the County of Ventura:

• Members of the Board of Trustees (including Student Trustee) • Chancellor • Vice Chancellor, Business and Administrative Services

All other designated positions shall file their Statements of Economic Interests with the VCCCD filing officer. The Chancellor shall appoint the VCCCD filing officer.

2. Disclosure Categories: The disclosure categories listed below identify the types of investments,

business entities, sources of income, or real property which the designated employees must disclose for each disclosure category to which he or she is assigned.

Category 1: All investments and business positions and sources of income from business entities that do business with the District or own real property within the boundaries of the District, plan to do business or own real property within the boundaries of the District within the next year, or have done business with or owned real property within the boundaries of the District within the past two (2) years.

Category 2: All interests in real property which is located in whole or in part within, or not more than two (2) miles outside, the boundaries of the District.

Category 3: All investments and business positions in, and sources of income from, business entities that are engaged in land development, construction or the acquisition or sale of real property within the jurisdiction of the District, plan to engage in such activities within the jurisdiction of the District within the next year, or have engaged in such activities within the jurisdiction of the District within the past two (2) years.

Category 4: All investments and business positions in, and sources of income from, business entities that are banking, savings and loan, or other financial institutions.

Category 5: All investments and business positions in, and sources of income from, business entities that provide services, supplies, materials, machinery, vehicles or equipment of a type purchased or leased by the District.

Designated Positions, and the Disclosure Categories assigned to them, are as follows:

* Consultants must be included in the list of designated employees and must disclose pursuant to the broadest disclosure category in this Code subject to the following limitation: The Chancellor or designee may determine in writing that a particular consultant, although a “designated position,” is hired to perform a range of duties that are limited in scope and thus is not required to comply fully with the disclosure requirements described in this Section. Such written determination shall include a description of the consultant’s duties and, based on that description, a statement of the extent of disclosure requirements. The Chancellor’s determination is a public record and shall be retained for public inspection in the same manner and location as this Conflict of Interest Code. [1] Designated employees who are required to file Statements of Economic Interests under any other agency's conflict of interest code, or under article 2 for a different jurisdiction, may expand their Statement of Economic Interests to cover reportable interests in both jurisdictions, and file copies of this expanded statement with both entities in lieu of filing separate and distinct statements, provided that each copy of such expanded statement filed in place of an original is signed and verified by the designated employee as if it were an original. See Government Code section 81004. Nonresident students shall be charged nonresident tuition for all units enrolled.

No later than February 1 of each year, the Chancellor shall bring to the Board for approval an action to establish nonresident tuition for the following fiscal year. The fee shall be calculated in accordance with guidelines contained in applicable state regulations and/or the California Community College Attendance Accounting Manual.

The Chancellor shall establish procedures regarding collection, waiver, and refunds of nonresident tuition.

The Chancellor is authorized to implement a fee to be charged only to persons who are both citizens and residents of foreign countries pursuant to existing law to students who are not residents of California, including persons who are classified as international students. The Board finds and declares that this fee does not exceed the amount expended by the district for capital outlay in the preceding year divided by the total FTES in the preceding fiscal year.

Students’ self-certification may serve as proof of high school attendance and graduation (or its equivalent). No later than February 1 of each year, the Chancellor shall bring to the Board for approval an action to establish international student tuition for the following fiscal year. Students who would otherwise be charged this fee shall be exempt if they demonstrate that they are a victim of persecution or discrimination in the county of which they are a citizen and resident, or if they demonstrate economic hardship. Students shall be deemed victims of persecution or discrimination if they present evidence that they are citizens and residents of a foreign country and that they have been admitted to the United States under federal regulations permitting such persons to remain in the United States. Students shall be deemed to have demonstrated economic hardship if they present evidence

1. Nonresident Tuition

The nonresident and capital outlay surcharge fees will be set by the VCCCD Board of Trustees no later than February 1 of each year. The calculation will reflect the expense of education in the preceding fiscal year according to the Budget and Accounting Manual and it shall reflect non-resident tuition in contiguous districts.

Students who are not residents of California, including persons who are classified as international students, will be charged nonresident tuition and a capital outlay surcharge at the Board-approved rate per semester unit unless they are exempted by statute. All nonresident students must pay nonresident tuition in addition to the California Community College mandatory fees.

2. Reclassification to California Resident

A student may be considered for reclassification to California resident status if they have resided in California for no less than one year and one day immediately preceding the term for which residency is requested; and are able to present verifiable documentation to support the actions they have taken to establish California residency.

A student previously classified as a non-resident may be reclassified as of any residence determination date upon submission of a Request for Residency Reclassification and adequate documentation to support that California residency has been established in accordance with AP 5015.

3. Exemptions from Payment of Nonresident Tuition

Non-residents students who are U.S. citizens and who reside in a foreign country:

Will be exempt from nonresident tuition if they meet all of the following requirements:

• Demonstrate a financial need for the exemption.

• Has a parent or guardian who has been deported or was permitted to depart voluntarily under the federal Immigration and Nationality Act.

• Moved abroad as a result of the deportation or voluntary departure. • Lived in California immediately before moving abroad. • Attended a public or private secondary school in California for three or more years. • Upon enrollment, will be in his or her first academic year as a matriculated student in

California public higher education. • Will be living in California and will file an affidavit with the community college stating

that he or she intends to establish residency in California as soon as possible. • Documentation shall be provided by the student as required by the statute as specified in

Education Code section 76140(a)(5). • Students receiving this exemption do not receive resident status for the purpose of tuition

or financial aid. Rather they are exempt from nonresident tuition under this law. Application for this exemption is initiated at the Admissions and Records Office on the student’s primary campus.

Special admission students who are determined to be non-residents:

May be exempt from paying nonresident tuition per California Ed. Code section 76141.

• The term “special admission student” refers to concurrently enrolled K-12 students who have been recommend by the principal of the pupil’s school and have parental permission to attend a community college during any session or term and who enroll in 11 or fewer units per semester, in accordance with Education Code section 76001. • The exemption does not apply to full time special admissions students. • This exemption does not apply to categories of students who would be precluded from

qualifying for AB540 nonresident tuition exemption; i.e., a) students who reside outside of CA and enroll via Distance Education and b) students on most nonimmigrant visas.

• T and U nonimmigrant visas are eligible for this exemption. • Students receiving this exemption do not receive resident status for the purpose of tuition

or financial aid. Rather they are exempt from nonresident tuition under this law. Application for this exemption is initiated at the Admissions and Records Office on the student’s primary campus

Military Exemption:

Military personnel on active duty in California (except those assigned for educational purposes) are granted a waiver of nonresident tuition until they are discharged from their military services. Dependents of active duty military personnel are granted a waiver for a period of one year from the date they enter California. Upon expiration of the waiver, evidence must be provided as to the date the student surrendered his/her out-of-state residence to become a resident of California. Any student who does not submit adequate evidence that California residency has been

established will be classified as a nonresident and charged nonresident tuition until such time as California residency has been established.

California High School Attendance and Graduation Exemption (AB540):

Students without lawful immigration status and U.S. citizens who are not residents of California may be entitled to exemption from nonresident tuition if they meet all of the following criteria:

• attended high school in California for three or more years, and

• graduated from a California high school or attained the equivalent, and

• filed an affidavit stating that they have filed or will file an application to legalize their

immigration status as soon as possible.

• Verifiable documentation shall include the self-certifying affidavit required by the California Community Colleges’ Chancellor’s Office, and may include high school transcripts or other acceptable documents verifying attendance and graduation.

Nonimmigrant alien students (students who are present in the U.S. on a nonimmigrant visa) are not eligible for this exemption.

Eligibility for an AB540 exemption does not result in the student being classified as a California resident.

September 11, 2001 Exemption:

If an individual who was killed in the terrorist attacks on the World Trade Center in New York City, the Pentagon in Washington, D.C., or the crash of United Airlines Flight 93 was a resident of California on September 11, 2001, or if their dependent was a resident on that date and if they meet the financial need requirement for the Cal Grant A Program, the dependents of this individual may be exempt from nonresident tuition. If the dependent is a spouse, the exemption applies until January 1, 2013. If the dependent is a child, the exemption applies until the person reaches the age of 30.

Other Exemptions

Other limited exemptions from non-resident tuition may be authorized. Eligibility for exemption shall be approved as permissible under California Education Code and/or California Title 5 Administrative Code by the campus Vice President of Business Services or his or her designee.

Fees including Non-resident tuition must be paid in full at the time of registration, or payment arrangements must be made using the district-approved payment plan option. International Student application fee applies.

5. Refunds

Courses must be dropped by the refund deadlines for each semester/session to generate a fee credit or refund. No fee credits or refunds are issued for withdrawals that occur after the deadline date.

The following VCCCD Athletic Philosophy Statement shall serve as a foundation supporting District Athletic Program policies, procedures, and performance. VCCCD Athletic Philosophy VCCCD believes intercollegiate athletics contributes significantly to the development of participating students by encouraging fair and competitive play while providing opportunities for personal growth and fulfillment of individual and team potential. Authority for developing, implementing and monitoring these procedures is vested in the president of each college, with the assistance of the athletic program dean and athletics director. Recruitment Athletic recruitment will follow the procedures established by the Commission on Athletics/California Community College Athletic Association (COA/CCCAA) Bylaw 2 and its subsections, and covering: athletic recruiting; representatives and agents; first contact; contact from outside a district’s recruiting area; out-of-state recruiting; high school data; out of recruiting area evaluation of athletes; dissemination of recruitment bylaw; all-star contests and competition; coaches speaking or attendance requests; subsidizing, inducements and special privileges; and use of internet web pages. Eligibility Athletic eligibility will follow the procedures established by the COA/CCCAA Bylaw 1 and its subsections, and covering: amateurism; residence; academic eligibility; eligibility certification; season of competition; eligibility for continuing competition; number of seasons of competition; illness or injury; multi-college district competition; transfer; crossgender participation; freelance participation; club team participation; junior varsity and reserve team participation; competition/participation of individuals; mandatory service; dropped sports; and emerging sports. • An Admissions & Records staff member will attend the first team meeting to oversee the completion of eligibility paperwork and answer questions.

• Student athletes will be required to submit official high school and college transcripts before being certified as eligible to participate in a sport.

• Admissions & Records staff members will compare athletic eligibility paperwork to the application for admission and high school/other college transcripts to verify

accuracy and consistency of information required to determine both athletic eligibility and residency status for enrollment fee purposes.

Reporting Athletic teams will comply with the reporting requirements of the COA/CCCAA and will provide any data reports that may be required by the District Board of Trustees. Program Review Student-athlete standards of academic progress will follow the procedures established by the COA/CCCAA governing academic eligibility. Specifically, the student athlete must be continuously and actively enrolled and attending class in a minimum of 12 units during the season of sport. Of the 12 units, at least 9 shall be attempted in courses counting toward remediation, career technical education/certificate courses, associate degree requirements, transfer/general education, and/or lower division major preparation courses as defined by the college catalog and/or articulation agreements. Athletic programs in the district will participate in systematic program review as defined both by their respective colleges and by the rotating schedule established by the COA/CCCAA. Funding and Fiscal Oversight All athletic funds shall be collected by and/or deposited with the College’s Business Office. No individual, other than the district Vice Chancellor, Business and Administrative Services may open any bank account for any purpose. All financial records are to be maintained through the District’s central financial management system (Banner) and are subject to annual audit. The receipt of funds is to be handled in accordance with procedures established by the District. All funds shall be expended in accordance with procedures as established by the District and are subject to the approval of the district Vice Chancellor, Business and Administrative Services or designee, the college Vice President, Business, or designee; and the college Athletic Director. Approval shall be obtained each time before any funds may be expended.

No such purchase shall exceed the amounts specified bySection 20651 of the California Public Contract Code as amended from time to time, without going through theformal bid process. No officer or employee, except as designated by the Chancellor, may obligate the District for any expenditure offunds without prior approval. Attendance at meetings, conferences, and conventions will be authorized when such attendance bears a direct benefit to the District. Evidence should be presented at the time of the request with respect to the manner in which the District would be benefited as the result of such attendance. Employees are expected to exercise prudent judgment in incurring travel expenses for official District business. Only necessary expenses will be approved and reimbursed. The number of employees attending a particular meeting should be those necessary consistent with the benefit to be derived therefrom. The itinerary of an employee shall be planned to eliminate unnecessary travel in the performance of work assignments. Whenever possible, employees should pool rides when traveling on official District business. It is the District's policy to reimburse employees out-of-pocket and direct expenses incurred while traveling on official District business. Expenses will be reimbursed, in accordance with this procedure, that are evidenced by itemized receipts with the exception of meal receipts (must include date of transaction and vendor name). No reimbursement will be made for the expenses of spouses or family members. All travel requests, including summer travel, must be approved in advance by the appropriate College President or designee, or the Chancellor or designee for the District Administrative Center. The Chancellor, or his/her designee in his/her absence, shall approve the Presidents' travel requests. Such approval is sought through the completion of a VCCCD Travel Request form (form 14001). All copies of the approved Travel Request form will be forwarded to the District Business and Administrative Services Division for processing no later than 15 days prior to date of travel or payment deadlines.

Reimbursements Reimbursement for expenses incurred on official business shall be on an actual expense basis, or per diem depending upon the expense typefor meals within established District guidelines. Reimbursement for meals consumed as part of travel, meetings, or business related meals, shall be based on actual costs, and limited to $25 per meal with a maximum daily limit of $55, and evidenced by an itemized receipt (must include date of transaction and vendor name). No reimbursement for alcohol is allowed. When reimbursement for lodging is authorized, the actual cost shall be allowed as evidenced by an itemized receipt. Meals may be included on the lodging receipt and will be reimburse up to the per diem meal or daily limit. Movies, entertainment or other hotel services with the exception of parking should not be included on the lodging receipt and are generally not reimbursable. Reimbursement shall not be allowed for expenses paid by another agency who is reimbursing the employee directly.

Per Diem

Expenses for meals consumed as part of travel are limited to $25 per meal with a daily maximum of $55. Employees should only seek reimbursement for the actual expenses and cost of meals consumed during travel. Air Travel Air transportation shall be by the least expensive class. The District is not responsible for payment of ticket penalties when cancellations or change of trip occurs through no fault of the District. Travel by non-commercial airplane shall not be permitted. Travel for Convenience of Employee No reimbursement for lodging or meals shall be paid to an employee for extra travel time incurred if they travel to, or return from a destination for their own convenience in advance of the necessary time. Travel Expense Advances Upon timely request, the District will provide travel advances for anticipated reimbursable expenses. Pre-payment of registration fees, lodging and commercial carrier travel is available if an authorized VCCCD Travel Request (form 14001) form is received by the District Administrative Center at least 15 days in advance of the date of travel or payment deadline. All other allowable costs will be reimbursed upon the employees' return to their official work site and the proper completion and submission of an approved VCCCD Travel Request form. Claims must be submitted to the District Administrative Center no later than 15 calendar days following the completion of travel. Governing Board travel Governing Board members' travel shall be subject to the same conditions as employee travel. International Travel The Ventura County Community College District recognizes the need for international travel and related expenses in connection with District/College business, training, instruction or presentations. International travel covers all destinations outside the Continental United States.

The purpose of International travel must clearly support and be directly linked to the requester’s role at VCCCD and should result in a benefit to students or programs authorized by the College. Completion of the VCCCD Authorization for International Travel (form 14041) form must be submitted no later than 90 business days prior to making travel arrangements, this allows for appropriate approval of the College President, Chancellor, and Board of Trustees. If District funds are being utilized for the International Travel, employee must also submit District-wide Form No. 14001, VCCCD Travel Request form. Employees who obtain approval for international travel, must not travel to countries for which a travel advisory has been issued by the State Department of the United States. It is the employee’s responsibility to contact the State Department to obtain a list of current advisories at http://travel.state.gov. Complying with Policies and Regulations The employee authorized to travel is responsible for complying with state statutes, laws, regulations, policies and procedures and IRS guidelines and is responsible for accurately completing all required forms for reimbursement of authorized official business travel expenses. SELECTION PROCEDURES FOR PART-TIME FACULTY

A. NOTIFICATION OF VACANCY/POSTING NOTICES

Upon receipt of formal notification of a current or anticipated vacancy, the Human Resources Department does the following:

• Reviews the recommended position announcement template to ensure accuracy of minimum qualifications, appropriateness of supplemental questions, if any, and content/procedural accuracy.

• Determines the announcement closing date in consultation with the college’s needs and policy/contract requirements.

• Sends the hiring committee forms to the dean.

B. ANNOUNCEMENT/ADVERTISING

Following input of the department and/or division faculty representatives, the Human Resources Department prepares the vacancy announcement that includes a description of duties and responsibilities, qualifications, and application procedures. Ongoing recruitment pools are advertised and maintained for disciplines with frequent hiring activity. For positions in disciplines that are not advertised on an ongoing basis, the closing date for the announcement will ensure sufficient time to recruit a diverse pool of well-qualified applicants. Recruitment, identification of advertising sources and applicant targets, ad placement, and web posting is the responsibility of the Director of Employment Services or designee.

Vacancy announcements, at a minimum, will be distributed to the community colleges in California. Additionally, advertisements will be placed in appropriate print and online periodicals and databases, in consultation with the department and/or division representatives, as well as the California Community College Registry, HigherEdJobs.com, EdJoin.org, and VCCCD.edu.

C. COMMITTEE COMPOSITION AND APPOINTMENTS

The academic administrator responsible for supervising the position(s) and serving as the administrative co-chair of the screening committee, in consultation with the department chair or coordinator, is responsible for making appointments to the screening committee. Colleges may use academic employees within the discipline from other colleges within VCCCD to maintain discipline expertise, diversity, and to provide a districtwide perspective. The following guidelines should be followed when composing a committee:

• The screening committee shall consist of a minimum of three members. At least two members of the committee must be faculty within the discipline. When faculty members within the discipline are not available, faculty members from a related discipline may be substituted for the faculty in the discipline. A related discipline is one that is listed as a qualifying degree in the Minimum Qualifications for Faculty and Administrators in California Community Colleges for that discipline. If a related discipline is not listed, exceptions to this composition may be authorized by the Director of Employment Services.

• The composition of the committee should reflect diversity in, but not be limited to, the areas of gender, age, ethnicity, and culture of the community.

• Although not required, members from other colleges and community members may be selected to serve on committees.

• The academic administrator and the department chair/coordinator or designee will serve as the co-chairs of the screening committee.

• In order to ensure consistency in the process, each screening committee member should be available for all committee meetings and must be present for all applicant interviews.

D. ORGANIZATIONAL MEETING

The administrative co-chair downloads from HR Tools all materials to be used during the screening process.

The co-chairs coordinate with the screening committee to accomplish the following:

• The co-chairs review hiring procedures, timelines, forms, the confidentiality agreement, and diversity sensitivity issues. The screening committee is provided with confidentiality policies and notified that all applicant files are considered confidential and must be maintained and reviewed in a manner to ensure the

candidates’ identities are not revealed. Each member reads and signs a confidentiality agreement.

• The screening committee establishes dates, times, and locations for the prescreening, application screening, application tally, oral interviews, and the oral interview tally.

• The screening committee creates and discusses application screening criteria based upon the job announcement, creates oral interview questions and criteria to aid in preparation of the Academic Oral Interview Record form, discusses the basis of questions in relationship to the job announcement, determines the format of the interview procedure, finalizes any details pertaining to the teaching/skills demonstration for the oral interview, and discusses the final weighting for the questions listed on the Academic Oral Interview Record form. All criteria and questions must be based upon the requirements listed in the vacancy announcement.

• Following the creation of the application screening criteria and oral interview questions during the organizational meeting, the co-chairs develop the Academic Application Screening Evaluation form, the Academic Oral Interview Record form, and the Academic Application Screening Tally and Academic Oral Interview Tally sheets using the templates available on HR Tools.

• The screening committee establishes a prescreening committee consisting of at least one co-chair and one faculty member in the discipline.

E. AFTER CLOSE OF FILING (THE HUMAN RESOURCES DEPARTMENT NO LONGER ACCEPTS APPLICATIONS)

The co-chairs are responsible for copying all forms needed for the committee’s use.

The following actions shall occur in the order listed below:

1. Districtwide Equivalency

Following the close of filing, the Human Resources Department forwards requests for equivalency to the appropriate districtwide equivalency committee no later than two working days following the closing date of the position and prior to releasing the pool of applicants to the screening committee. The districtwide equivalency committee meets within five working days following the closing date. The Human Resources Department will not forward files for applicants who are not requesting an equivalency or for applicants who request in their application that an equivalency be considered but fail to attach the Supplemental Questionnaire for Equivalency.

The districtwide equivalency committee reviews requests for equivalency and provides recommendations to the Human Resources Department.

2. Release of Candidate Information

The Human Resources Department provides a username and password to the co-chairs for the purpose of accessing candidates’ information. AP 7120-E Recruitment and Hiring: Part-Time Faculty

The Human Resources Department forwards all recommended equivalencies to the co-chairs for review along with all other completed application materials not provided in Online Requisition and Application Processing (ORAP).

3. Prescreening

All members of the prescreening committee confer and determine which applicants meet minimum qualifications or should be forwarded for further consideration based on anticipated completion of a qualifying degree.* The results of these deliberations are forwarded to the Human Resources Department at the conclusion of the screening process. Applicants recommended for an equivalency are automatically forwarded for further consideration. The Human Resources Department deactivates those who fail to meet minimum qualifications.

*Applicants who do not currently meet minimum qualifications may be forwarded for consideration based on the anticipated completion of a qualifying degree. These applicants must meet the minimum qualifications as listed in the job announcement and consistent with the current Minimum Qualifications for Faculty and Administrators in California Community Colleges prior to the first day of employment. The Human Resources Department will confirm that the required degree has been conferred prior to beginning employment.

Committee members may review any applicant in ORAP who was determined to be unqualified during the prescreening based on minimum qualifications or equivalency determination.

4. Screening

Upon completion of the prescreening process, all committee members screen applications in accordance with the predetermined application screening criteria. The committee members complete the Academic Application Screening Evaluations and ensure the following:

• Academic Application Screening Evaluations must reflect the level of desired criteria and written comments in support of the overall recommendation.

• Academic Application Screening Evaluations must document a recommendation for oral interview (5 – Highly Recommend for Interview, 3 – Recommend for Interview, 2 – Consider for Interview, 0 – Do Not Recommend).

• Screening committee members sign and date the Academic Application Screening Evaluations.

• Screening committee members screen the application materials independently and submit their results to the co-chairs.

F. APPLICATION SCREENING TALLY MEETING

All committee members shall be present at the application screening tally meeting and shall have completed their screening of the applicants. The following shall occur during the application screening tally meeting:

1. The co-chairs tally the application screening results.

2. The committee as a whole determines which applicants will be called for interviews. The determination is based on the scores and not the individual’s identity. “Natural breaks” in the tally total should be the determining factor.

3. The committee determines if additional candidates are to be interviewed in the event interview invitations are refused by the selected candidates. Additional candidates will be considered for interview based on their ranks and may be considered only if invitations are refused by the original invited candidates.

4. The co-chairs assign dates and times for oral interviews taking into consideration distance and time of travel of the applicants.

5. The co-chairs or the administrative co-chair’s administrative assistant sends out invitations to the candidates.

G. ORAL INTERVIEW

Oral Interview Meeting (30 minutes before first interview)

The co-chairs discuss the guidelines pertinent to the interview process, including appropriate follow-up questions, guidelines for written comments on the Academic Oral Interview Records, the District’s diversity policy, and procedures for discussion following each candidate’s interview. The screening committee reviews each question and discusses, in general, an appropriate answer.

Oral Interview

At the beginning of the interview, one of the co-chairs welcomes and introduces the candidate, introduces each committee member, and advises the candidate about the process of the interview. The introduction includes the approximate length of the interview, number of questions, roles of the committee members and the fact that the committee will be taking notes, and length of the teaching demonstration.

At the oral interview, follow-up questions may be asked and should be based on information presented by the applicants. All follow-up questions must be for purposes of clarification and expansion of an applicant’s response. Follow-up questions may not deviate from the original questions.

At the close of each interview, a co-chair thanks the candidate and advises him/her of the next step in the process.

The co-chairs ensure all interviews are conducted within the allotted amount of time.

Oral Interview Discussion and Rating

At the conclusion of each oral interview, the co-chairs facilitate a discussion of the candidate. The following guidelines shall be adhered to during the discussion:

1. Each committee member shall share a brief summary of each applicant’s strengths and limitations. Generally, the discussion will consist of:

• Clarification of technical questions asked during the interview.

• The manner in which the candidate responded to questions asked during the interview.

• Strengths and weaknesses of each candidate, including professional impact.

Among those items which are inappropriate for discussion are the following:

• Advocacy or opposition for a particular candidate based on information obtained outside the interview process.

• Comments based on rumor or unsubstantiated knowledge of a candidate.

• Any comment not related to specific interview information is inappropriate, such as comments on race, gender, age, sexual orientation, and physical characteristics.

2. The Oral Interview Record Form is used for rating candidates during the initial interview. Each committee member rates each candidate (4 - Highly Recommend, 3 - Recommend, 0 - Do Not Recommend). The committee reviews the ratings to consider high/low discrepancies. The discussion shall focus on information provided in the interviews as well as information provided in the candidates’ applications. Any committee member may change or keep their original rating after considering the information discussed.

All ratings must be supported by clearly written comments. Overall ratings should be representative of the candidates' performance across all questions and the teaching demonstration.

Oral Interview Tally

The co-chairs tally the oral interview ratings and display the ratings to the entire committee with the names of the candidates redacted for the purpose of determining the natural break in ratings.

After determining the natural break, the names of the candidates are displayed to the committee for the purpose of determining which candidates have sufficiently demonstrated they are qualified to perform the duties of an adjunct (part-time) faculty member.

H. RECORD OF INTERVIEW AND CANDIDATE SELECTION PROCESS

1. The co-chairs complete the Record of Interview and Candidate Selection Process form indicating which applicants were not invited to oral interviews, which applicants received oral interviews, and the candidates eligible for hire.

2. Candidates recommended for hire are eligible for employment for up to four semesters from the original semester of consideration provided a more recent selection process was not initiated. For example, a candidate interviewed for a fall 2014 vacancy is eligible for “future hire” through fall 2016.

3. The co-chairs forward all screening files, forms, and related notes and records to the Human Resources Department.

4. The co-chairs notify all candidates who were invited to the oral interview of their status.

I. CANDIDATE SELECTION, REFERENCE CHECKS, AND OFFER OF EMPLOYMENT

1. The academic administrator or department chair conducts reference checks on the individuals identified for immediate hire in accordance with the VCCCD reference checking procedure. The academic administrator and sends the reference check documentation and the Part-Time Faculty Hiring Authorization to the college president and the executive vice president for approval/signature.

2. Upon approval by the college president, the academic administrator forwards the signed Part-Time Faculty Hiring Authorization(s) and reference check documentation to the Human Resources Department.

3. Upon review of candidates' references and any other pertinent material, the Director of Employment Services notifies the academic administrator that he or she is authorized to extend an offer of employment.

4. The academic administrator extends the offer of employment and upon acceptance of the offer, notifies the Human Resources Department of the acceptance and the anticipated start date.

5. When appropriate, the Human Resources Department schedules a new employee orientation.

J. EMERGENCY HIRE PROCESS

In the event there is a need to expeditiously hire an instructor due to unforeseen circumstances and provided there are fewer than 15 working days before the instructor shall begin working, the Director of Employment Services may authorize a waiver to the hiring procedure as described above and allow the committee to exercise one of the following options:

A. The committee gives selective consideration to current District faculty hired in the discipline at the other colleges without giving consideration to other applicants.

B. In the event a pool exists for the discipline, the committee considers the applicants in the order of the date a completed application was submitted until a suitable applicant is found. The committee accomplishes this through one of the following processes:

1. The committee identifies preferred qualifications and reviews applicants in the order in which they applied until a suitable number of applicants who meet the minimum and preferred qualifications have been identified. The committee interviews the selected applicants and, if the committee does not recommend anyone for hire, the committee invites the next group of applicants who meet the preferred qualifications to an interview. The committee determines how many applicants to invite at a time. The committee documents the preferred qualifications by which the applicants were screened and who was invited to an interview.

2. The committee interviews the applicants who meet minimum qualifications in the order they applied without consideration of preferred qualifications until a suitable applicant is selected for hire.

3. The committee develops screening criteria, screens the applications, and interviews the most qualified applicants in the order they applied.

The Director of Employment Services may approve modifications to the above processes on a case-by-case basis.
