    GENERAL INFORMATION

    Issue Date: February 14, 2011

    Project Title: Podcasts for Assessments Mini-Grant

    Issuing Entity: eTech Ohio

    eTech Ohio will receive proposals until 4:45 pm Eastern on March 14, 2011 for Ohio Public SchoolTeachers to prepare students to utilize podcasts for assessment. The students will demonstrate theirunderstanding of the curriculum and the ISTE National Education Technology Standards for Students(NETS-S) through the use of podcasts. If multiple teachers from an Ohio Public Local Education Agency(LEA) apply for a mini-grant, a maximum of two teachers per Ohio Public LEA will be selected.

    A Virtual Bidders Conference will be held on February 16, 2011 from 3:30-4:30 pm Eastern. Inquiries forinformation will occur during this time.

    A Letter of Intent, Appendix B, must be received by February 28, 2011 at 4:45 pm Eastern [email protected]. The Letter of Intent must be received in order for an Ohio Teacher to submit aproposal.

    No late applications will be accepted. Only applications submitted electronically will be accepted andreceived by the deadline March 14, 2011 at 4:45 pm Eastern. It is anticipated that approximately 50Ohio teachers will receive a mini-grant in the amount of $2,000 each.

    PURPOSEThis mini-grant was developed to generate a greater capacity for Ohio Public School Teachers topersonalize and individualize learning through the use of information and communication technologies(ICT) with students. This work is intended to provide professional development opportunities for OhioPublic School Teachers to use podcasts in their instruction and for students to demonstrate theirunderstanding of the curriculum (including Common Core, Ohio Academic Content Standards and OhioAcademic Technology Standards) and the ISTE NETS-S through podcasts as the product of anassessment. The overarching goals are to:

    Ensure elementary and secondary students are provided with opportunities to demonstrate theirunderstanding of the curriculum (including Common Core, Ohio Academic Content Standardsand Ohio Academic Technology Standards) and the ISTE NETS-S through the use of appropriateICT. With the use of NETS-S, in addition to the curriculum, the focus for students is to:

    o Demonstrate creativity and innovationo Communicate and collaborateo Conduct research and use informationo Think critically, solve problems and make decisionso Use technology effectively and productively1

    Build the capacity of Ohio teachers in using ICT in their classrooms appropriately and students inthe use of ICT.

    Expand the use of podcasts by students and teachers in the classroom.

    ELIGIBILITY REQUIREMENTS

    All Ohio teachers employed by an Ohio Public LEA are eligible. The teachermust be certified to teach in Ohio and work for an Ohio Public LEA. The licenseand employment with an Ohio Public LEA must be valid through the 2011-2012school year.

    GRANT REQUIREMENTS

    1. All materials developed, except those that would compromise data aboutstudents, by teachers and students will be used for best practice sharing acrossthe State of Ohio.

    2. Students must use podcasts to demonstrate their understanding of thecurriculum (including Common Core, Ohio Academic Content Standards andOhio Academic Technology Standards) and ISTE NETS-S during the 2011-2012school year. These podcasts will be uploaded to the eTech Ohio podcast serverand shared at the local school.

    3. Teachers must create a final document detailing their specific project; how thestudent work was shared with parents, teachers and the community withoutcompromising student data; what worked and what would be changed for the

    future.

    4. Teachers must participate in webinars hosted by eTech Ohio for the grantoverview and professional development in the use of the podcast server.

    5. Teachers must create a professional development plan in the use of podcastsand instructional strategies for both themselves and for students.

    6. Teachers must conduct a baseline assessment of content knowledge prior toinstruction.

    7. All lessons must be developed by August 15, 2011 and implemented during thefirst semester of the 2011-2012 school year.

    8. Teachers must elaborate how podcasts will be expanded upon and used in thefuture for students.

    9. Teachers will need to disseminate and parents or guardians will need to sign theAuthorization for the Release of Student Information, Appendix C.

    FUNDINGeTech Ohio is awarding approximately 50 grants for the Podcasts for Assessments Mini-Grant. Each recipient will receive $2,000 to conduct all activities related to this grant.

    The funding may be used for any activity related to the grant and there are no limits toexpenditures. A final expenditure report (FER) will be completed by each LEA at the endof the grant. The LEA will serve as the fiscal agent for the mini-grant.

    To leverage state resources, eTech Ohio will provide the podcast server and contentstorage. Each applicant will not need to budget for this expense.

    APPLICATION GUIDELINES

    1. All Ohio Public School Teachers applying for the Podcasts for Assessments Mini-Grant must address the six criteria below.

    2. Each Ohio Public School Teacher interested in applying for the mini-grant, mustsubmit a letter of intent, Appendix B, by February 28, 2011, 4:45 pm [email protected].

    3. All applications, including the cover page, narrative and budget, must besubmitted via email by March 14, 2011, 4:45 pm Eastern [email protected] cover page, narrative, budget and Appendix A General Terms and Conditions will be submitted as an attachment.

    4. eTech Ohio may reject any application that is not in the required format or doesnot address all the requirements of this mini-grant.

    GRANT CRITERIA1. Explain how the project aligns to the eTech Ohio Commissions Strategic Goal:

    by 2015, increase the daily use of educational technology within K-12 classroomsby 80% to support standards based instruction.

    2. Demonstrate how the project will ensure elementary and secondary students areprovided with opportunities to demonstrate their understanding of the curriculum(including Common Core, Ohio Academic Content Standards and OhioAcademic Technology Standards), sound assessment principles and the ISTENETS-S through the use of appropriate ICT, including how the student work willbe shared with parents, teachers and the community without compromisingstudent data.

    3. Detail what professional development plan will be followed to learn the use of the

    tools and instructional strategies to support individualized and personalizedlearning and the use of podcasts for assessments for students.

    4. Explain the specific student learning outcomes and strategies that will beemployed for using the podcasts for assessments.

    5. Discuss what criteria will be used to measure the success of the project.6. Explain how students and teachers will use podcasts after the project is

    complete.7. Provide a detailed budget and narrative for all expenditures relating to the

    project.

    EVALUATION OF APPLICATIONS

    The evaluation process may consist of up to three distinct phases:1. An initial review of all applications for defects;2. The evaluation committees evaluation of the applications; and3. Request for more information (interviews, presentations, and/or

    demonstrations).

    The mini-grant administrator will review all responses for their format and completeness.The mini-grant administrator may reject any incomplete or incorrectly formattedresponse, through he or she may waive any defects or allow an applicant to submit acorrection. In addition, any application by a non-Ohio Public School Teacher will berejected.

    The mini-grant administrator will forward all timely, complete, and properly formattedresponses to an evaluation committee, which the grant administrator will chair.

    eTech Ohio may decide whether phase three is necessary. eTech Ohio has the right toeliminate or add phase three at any time in the evaluation process. eTech Ohio also may

    add or remove sub-phases to phases two through three at any time if eTech Ohiobelieves doing so will improve the evaluation process.

    During the evaluation process, eTech Ohio may request clarifications from any applicant

    under active consideration and may give any applicant the opportunity to correct defectsin its application if eTech Ohio believes doing so does not result in an unfair advantagefor the applicant and it is in eTech Ohios interests. Any clarification response that isbroader in scope than what eTech Ohio has requested may result in the applicantsapplication being disqualified.

    Not all applications will receive awards.

    EVALUATION CRITERIAIn the application evaluation phase, the evaluation committee will rate the applicationssubmitted in response to this mini-grant based on the following criteria:

    In the application evaluation phase, the committee will rate the applications submitted inresponse to this mini-grant based on the predetermined criteria. If the application meetsthe mandatory requirements, the applicants response will continue through theevaluation process.

    The evaluation will result in a point total being calculated for each application. At the solediscretion of the committee, any application, in which the applicant received a significantnumber of zeros for sections of the evaluation, may be rejected. Those applicantssubmitting the highest-rated applications may be scheduled for the next phase. Thenumber of application forwarded to the next phase will be within the committeesdiscretion, but regardless of the number of applications selected for the next phase, theywill always be the highest rated applications from this phase, with the exception that amaximum of two applications from a single Ohio Public LEA has the potential to receivean award.

    At any time during this phase, the committee may ask an applicant to correct, revise or

    clarify any portions of its application.

    BIDDERS CONFERENCEThe Bidders Conference for the Podcasting for Assessments mini-grant will be virtual. Itis a time set aside to learn more about the mini-grant, gain clarification and ask anyquestions. The Bidders Conference will be recorded and posted to the eTech OhioWebsite if you are unable to attend.

    SUBMISSION OF APPLICATIONeTech Ohio may reject any applicant response that are received after the deadline. Onlyemail applications to [email protected] will be accepted. The cover page,narrative, budget and Appendix A - General Terms and Conditions will be submitted as

    an attachment. Only applications that have submitted a letter of intent by the deadlinewill be read.

    eTech Ohio will not be liable for any costs incurred by an applicant in responding to thisRFP, regardless of whether eTech Ohio awards the applicant through this process.

    By submitting an application, the applicant acknowledges that it has read this mini-grant,understands it, and agrees to be bound by its requirements. eTech Ohio is notresponsible for the accuracy of the information regarding this mini-grant that wasgathered through a source different form the inquiry process described in this mini-grant.

    An applicant may not be compensated for damages arising from inaccurate orincomplete information in the mini-grant specifications or from inaccurate assumptionsbased upon the specifications.

    All applications and other materials submitted become the property of eTech Ohio andmay be returned only at eTech Ohios option. Any information provided may becomesubject to Ohios Public Records Act (ORC 149.43, et.seq.)and thus may be a publicrecord.

    AMENDMENTS TO THE MINI-GRANT

    If eTech Ohio revises this mini-grant before the mini-grant due date, amendmentswill be announced and Grantees will be notified.

    When an amendment to this mini-grant is necessary, eTech Ohio may extend thedue date through an announcement and notification to all applicants. Amendmentsmay occur any time before 5:00 p.m. on the day before the mini-grant due date.

    Amendments occurring after the mini-grant due date will be distributed only tothose applicants whose responses are under active consideration. When eTechOhio makes an amendment to the mini-grant after mini-grants have beensubmitted, eTech Ohio will permit applicants to withdraw their responses within 10business days after notification of the amendment. This withdrawal option willallow any applicant to remove its response from active consideration should theapplicant feel that the amendment changes the nature of the transaction so much

    that the applicants response is no longer in its interests. Alternatively, eTech Ohiomay allow applicants that have responses under active consideration to modifytheir responses in response to the amendment, as described below.

    Whenever eTech Ohio makes an amendment after the mini-grant due date, eTechOhio will advise all applicants whose responses are under active considerationwhether they have the option to modify their responses in response to theamendment. If the applicants are allowed to modify their responses, eTech Ohiomay limit the nature and scope of the modifications. Unless otherwise stated ineTech Ohios notice, modifications and withdrawals must be made in writing andmust be submitted within the deadline given.

    APPENDIX A: GENERAL TERMS AND CONDITIONS

    Upon an award, the awardees will be required to sign a Memorandum of Understanding (MOU) inorder to received funds. The following general terms and conditions will be comprised in the

    MOU.

    1. ENTIRE MOU

    The MOU constitutes the entire understanding between the parties hereto with reference to thematters contained herein, there being no conditions, warranties or representations other thanthose contained herein. This MOU supersedes any and all previous agreements, whether writtenor oral, between the parties.

    2. AVAILABILITY OF FUNDS

    It is expressly understood and agreed by the parties that none of the rights, duties, and

    obligations herein shall be binding on either party until all of the following conditions have beenmet: (i) all Ohio statutory provisions of the Ohio Revised Code have been complied with,including ORC 126.07; (ii) all necessary funds are available or encumbered by the appropriatestate agencies; (iii) if required, approval of expenditure of funds is given by the Controlling Boardof the State of Ohio; (iv) if eTech Ohio is relying on federal or third-party funds for this MOU, thatsuch funds have been made available, and (v) this MOU has been fully executed.

    3. INTELLECTUAL PROPERTY: RIGHTS IN DATA, PATENTS AND COPYRIGHT

    eTech Ohio shall have unrestricted authority to reproduce, distribute and use (in whole or in part)any reports, date or materials prepared by applicant pursuant to this MOU. Grantee agrees thatall deliverables hereunder shall be made freely available to the general public to the extentrequired by law.

    Neither the Grantee nor any of the Grantees employees, agents, subcontractors or assigns shallmake a disclosure for the purpose of securing a patent, copyright, trademark or service mark inthe United States or any other country for any of the reports, data or material prepared by theGrantee pursuant to this MOU unless such disclosure is approved in writing by eTech Ohio priorto the application. In the event that such a patent, copyright, trademark or service mark isobtained, the Grantee shall, at the request of eTech Ohio, provide eTech Ohio writtenauthorization for eTech Ohio and any other person, agency or instrumentality contributingfinancial support to the work covered by this MOU to make use of the subject of said patentdisclosure without payment therefore.

    The Grantee warrants that the services provided pursuant to this MOU will not infringe upon anyUnited States or foreign letters, patents, trademarks, copyrights or other proprietary rights, andthe Grantee agrees to defend, protect and hold harmless eTech Ohio, its employees, agents,

    successors, assigns, customers and users of such items, against any and all causes of actionand from all damages and expenses including attorneys fees resulting from claims and demandsfrom actual or alleged infringements of any patent, trademark, copyright or any right by reason ofthe sale or use of the material covered hereby. eTech Ohio reserves the right to participate inany such action brought against eTech Ohio at Grantees expense.

    To the extent that the work performed pursuant to this MOU includes any work of authorshipentitled to protection under the copyright laws, the work shall be deemed a work made for hire tothe greatest extent permitted by law. eTech Ohio shall be the sole author of the work and anywork embodying Grantees work according to the United States Copyright Act. To the extent that

    the work is not properly characterized as a work made for hire, Grantee shall grant eTech Ohio allrights, title and interest in the work, including all copyright rights, in perpetuity and throughout theworld.

    Grantee agrees to return to eTech Ohio within thirty (30) days of the effective date of terminationof this MOU any information set forth in reports, documents, lists, or other materials given to,prepared or assembled by Grantee pursuant to this MOU.

    4. TERMINATION

    This MOU may be terminated only as follows:

    4.1 By eTech Ohio with or without cause upon thirty (30) days written notice to the Grantee.4.2 By mutual written consent of all parties.4.3 eTech Ohio may immediately terminate this MOU if the Grantee has breached any

    provisions of this MOU. The following events shall be deemed to be a breach by theGrantee of its obligations hereunder provided, however, said list shall not be deemed allinclusive:4.3.1 Failure by the Grantee to timely perform his/its obligations hereunder.4.3.2 Grantee ceases doing business.4.3.3 Grantee files for protection under any state or federal bankruptcy, or similar laws,

    during the term of this MOU.4.3.4 If Grantee or any of its subcontractors perform services under this MOU outside

    of the United States.4.4 By eTech Ohio at the end of the current biennium which is June 30, 2011.

    If the Ohio General Assembly fails at any time to continue funding for the payments and otherobligations set forth herein, eTech Ohios obligations under this MOU are terminated as of thedate the funding expires and eTech Ohio shall have no further obligations hereunder. If eTechOhio discovers or is notified of the discontinuation of funding for this MOU, then eTech Ohioagrees to notify Grantee of said discontinuation as soon as is practicable. The Grantee shall notperform any work under the MOU after receiving such notice.

    5. NON DISCRIMINATION

    Grantee agrees that it, any subcontractor, and any person acting on its or such subcontractorsbehalf, shall not discriminate against , intimidate, or retaliate against any employee hired for theperformance of work under this MOU, on the basis of race, color, national origin, sex, religion,age, ancestry, military status, or disability, in compliance with Ohio Revised Code 125.111.

    6. DRUG FREE WORKPLACE

    Grantee shall comply with all applicable federal, state and local laws regarding smoke free anddrug free work places and shall make a good faith effort to ensure that any of its employees or

    permitted subcontractors engaged in the work being performed hereunder do not purchase,transfer, use or possess illegal drugs or alcohol or abuse prescription drugs in any way.

    7. REPRESENTATIONS AND WARRANTIES

    Each party that has executed this MOU through its undersigned authorized representative, andeach representative so executing, hereby warrants and represents to the other party that theundersigned representative has full authority to execute this MOU on behalf of the party for whomsaid authorized representative purports to act.

    Grantee, any subcontractor or person acting on behalf of Grantee, in the execution of duties andobligations hereunder, agrees to comply with all applicable federal, state and local laws, rules,regulations and ordinances.

    8. AUDIT

    All records relating to this MOU shall be retained and made available to either party for audits bythe Auditor of the State or other authorized auditors in compliance with applicable laws. If an auditis initiated during this period, the parties shall retain such records until the audit is concluded andall issued resolved.

    9. PUBLIC RECORDS AND CONFIDENTIALITY

    9.1 Grantee shall maintain any and all records associated with the subject of this MOU inaccordance with any applicable state and federal laws, including but not limited to theOhio Revised Code, and the Family Educational Rights and Privacy Act of 1974, asamended.

    9.2 It is expressly understood by the parties that eTech Ohio is a state agency and is subjectto the Ohio Public Records Act, ORC 149.43, et seq., and that any record kept by eTechOhio that is deemed a public record is subject to release if a proper request is made.

    9.3 All information submitted to eTech Ohio will be considered public information not exemptfrom disclosure unless identified as a trade secret, as defined by 18 U.S.C. 1839. Anyassertion of trade secrets information must be clearly identified and the basis for theassertion must be included. eTech Ohio will make the determination as to whetherGrantee has adequately demonstrated the information was a trade secret.

    9.4 In the event of an asserted trade secret, Grantee must indemnify and hold eTech Ohioharmless and defend against all actions or proceedings that may ensue (includingattorneys fees), which seek to order eTech Ohio to disclose the information.

    10.GENERAL

    10.1 ASSIGNMENT OR SUBCONTRACT: This MOU shall not be assigned or subcontractedwithout prior written consent of eTech Ohio.

    10.2 BINDING EFFECT, AMENDMENTS OR MODIFICATION: This MOU shall bind theparties hereto, their respective assigns, successors, receivers, and representatives of

    any type whatsoever, and shall not be amended or modified unless done so in writingsigned by both parties.

    If eTech Ohio's governing Ohio statutes shall subject it to new or differing statutory

    requirements affecting MOUs, this MOU shall be subject to and conditioned uponcompliance with such requirements, unless otherwise provided by Ohio law.

    10.3 NO WAIVER:The failure of any party to exercise or enforce, in any respect, any right orprovision provided for in this MOU shall not be deemed a continuing waiver of any suchright or provision.

    10.4 DRAFTING OF MOU: All parties hereto shall be deemed to have participated equally inthe drafting of this MOU, and the choice of language, terms, and conditions containedherein, including, but not limited to, any and all exhibits and/or schedules, createdcontemporaneously herewith or for the purpose of being attached hereto. For thepurpose of enforcement, construction, and interpretation all such documents, language,terms, formulas, exhibits, conditions, and covenants, shall be deemed to be equal workproduct of each party.

    10.5 SEVERABILITY: The provisions of this MOU are severable and independent, and if anysuch provision of this MOU shall be determined to be invalid, illegal, or unenforceable, inany respect, said provision shall be severed. The remaining provisions and any partiallyenforceable provisions shall not in any way be affected or impaired unless suchseverance would cause this MOU to fail of its essential purpose.

    10.6 HEADINGS: The headings herein are for reference only. They are not intended andshall not be construed to be a substantive part of this MOU or in any other way to effectthe validity, interpretation, or effect of any of the provisions of this MOU.

    10.6.1 GOVERNING LAW: This MOU and the rights of the parties hereunder shall be governedby the laws of the State of Ohio.

    In the event a disagreement over the application of the terms of this MOU should occur,the Executive Director of eTech Ohio and the MOU shall meet and attempt to resolvesuch disagreement. If after meeting, the parties are unable to resolve such disagreement,either party may terminate this MOU as expressed in this MOU.
