HOW TO END A TENANCY AGREEMENTTenancy agreements end for various reasons and there are processes in place that must be followed to ensure that the agreement is ended in accordance with the Residential Tenancies and Rooming Accommoda-tion Act 2008. Here, we are going to cover the most common reasons a tenancy ends and the processes that must be followed.

1. The end date of the fixed term agreement is reachedIn the case of a fixed term agreement, the tenancy ends when the end date is reached and the tenant gives notice that they will be leaving (No-tice of Intention to Leave – Form 13) or the lessor gives the tenant notice to leave (Notice to Leave – Form 12). If neither the lessor nor tenant gives notice, the tenancy continues as a periodic agreement.

2. By mutual agreement in writing by both the lessor and tenantEither the lessor or the tenant can end a fixed term or periodic tenan-cy without giving a reason. However, a fixed term tenancy can only be ended prior to the end date of the agreement, if both parties agree. The lessor must give the tenant two months’ notice in writing. The tenant must give the lessor two weeks’ notice in writing.

3. Abandonment of the propertyIf the lessor has reasonable grounds to believe that the property has been abandoned by the tenant, they can give the tenant an Entry No-tice (Form 9). The Entry Notice gives 24 hours’ notice, after which, the property may be inspected. If it is confirmed that the property has been abandoned, the lessor can issue an Abandonment Termination Notice (Form 15) and the tenancy will end seven days after notice was given. Alternatively, the lessor can apply to the Tribunal to end the agreement and the end date can be determined by the Tribunal.

4. Sale of the propertyIn the case of a periodic agreement, the agreement can be ended if the lessor enters a contract to sell the premises with vacant possession. The lessor must give the tenant a Notice to Leave (Form 12). In the case of a fixed term agreement, the agreement cannot be ended prior to the end date of the agreement unless the tenant agrees.

5. Death of a sole tenantIf the agreement is with a sole tenant, and the sole tenant dies, the personal representative for the tenant can negotiate the end date with the lessor. If written notice is given to the lessor, the tenancy ends two weeks’ after notice is received. Both parties may negotiate the end date of the agreement, in which case, the tenancy will end on the agreed date. In the absence of any notice being given or any agreement being made, the tenancy will end one month after the death of the tenant.

6. Breaches of agreementIf the tenant or lessor breaks any condition of the agreement, this is a breach of agreement and a Notice to remedy form (Form 11) should be used. Breaches of agreement by tenant include non-payment of rent, property damage and illegal use of the property. Breaches of agreement by lessor include entering the property without the correct notice and not attending to issues highlighted by the tenant e.g. appliance breakdown. If two or more notices are given for the same breach within a 1 year pe-riod, the party can apply to QCAT on the third breach to end the tenancy.

What happens when a tenancy ends?When an agreement ends, the following should occur:

• All keys must be returned to the lessor

• The property must be left in the same condition as it was at the start of the tenancy (minus fair wear and tear)

• An Exit condition report (Form 14a) must be completed

• A Refund of rental bond report must be completed (Form 4)
