2. Bidders Obligations: 2.1 Eligibility Criteria Only bidders who satisfy the following criteria are eligible to submit an offer: 2.1.1 Qualifications of Electrician

The bidder shall provide, with his bid proposal, a detailed Curriculum Vitae of the Lead

Accredited Electrician to be assigned to this project. The Lead Accredited Electrician shall

have the following qualifications and registrations:

Proof of being a Qualified Electrician from an Accredited Institute;

5 years post-graduate experience; and

Wiremen Licence (proof to be submitted with tender).

3.2 Tests for Administrative Compliance

Bidders may be found non-compliant if, inter alia:

The bidder has failed to complete and sign and attach requested information to all Schedules not excluded in responsiveness criteria;

The bidder has failed to submit the MBD 2, MBD4, MBD 8 and MBD 9 forms; valid completed forms may be requested;

The bidder has failed to submit a municipal account of where the head office of the company is registered or in case where the premise is leased, the bidder has failed to provide a copy of the lease of the premise.

The bidder has failed to submit a valid original Tax Clearance Certificate an valid original certificate may be requested; and

The bidder has failed to submit a certified B-BBEE certificate, whereas points were claimed and a copy of certificate was supplied, a certified copy of the B-BBEE certificate may be requested.

SCOPE OF WORK

INTRODUCTION

The Directorate Technical Services in Theewaterskloof Municipality is responsible for the distribution of electricity in Caledon. The aim of this project is to provide costing for Maintenance and Repair work on official buildings in Caledon, Botrivier, Grabouw and Tesselaarsdal. LOCATION

The services are to be provided in the Caledon, Botrivier, Grabouw and Tesselaarsdal in Theewaterskloof Municipality area. SCOPE OF WORK

The scope of focus of this project is: Caledon, Botriver, Grabouw and Tesselaarsdal: (Accredited person certificate to be attached)

Maintenance on the electrical system of buildings and new alterations. General maintenance, installation of electricity distribution networks for low and medium voltage and pump stations. Proof of the accredited person certification had to accompany this quotation. COST MINIMIZATION AND PLANNING

The Service Provider must commit to a cost minimization approach at all times. Strategic interfacing with the Employer’s Electrical engineering support services is necessary from the commencement of the project to ensure agreement on equipment, specifications, risk acceptance etc. TIMEFRAMES

The response time must be two (2) hours from time of call-out. BRIEF

Additional Services

Act as the Employers agent in terms of the Occupational Health and Safety Act

The Service Provider, in submitting a tender for this professional services contract, shall be deemed to have acknowledged acceptance of the appointment as the client’s agent in terms of the Occupational Health and Safety Act, 1993 (Act No 85 of 1993) and the Construction Regulations, 2014, should the Employer accept the tender. The Service Provider shall, as such, execute all of the duties of the client as contemplated in the Construction Regulations.

If the Service Provider considers it necessary to employ the services of a safety specialist in order to execute the abovementioned duties, the cost thereof must be included in the fee tendered for this aspect of the project.

The Service Provider’s attention is also drawn to the responsibilities of the designer of a structure in terms of the Construction Regulations, and shall comply with all requirements in this regard.

The Service Provider shall, apart from conducting his own activities in compliance with the Occupational Health and Safety Act, 1993 (Act No 85 of 1993) and Construction Regulations, 2003, ensure that any sub-consultants/sub-contractors employed by the Service Provider also comply with the requirements of the Act and Regulations. The Service Provider shall enter into an agreement with the Employer in this regard before the commencement of any work related to this contract Implementation of a Quality/Risk Assurance System

The Service Provider shall develop and implement a Quality/Risk assurance system which will ensure that the final product meets the requirements of the Employer.

APPLICABLE NATIONAL AND INTERNATIONAL STANDARDS:

The Service Provider shall take cognizance of, and adhere to, all applicable national and international standards in the execution of his own work and when compiling specifications for construction works. International standards should only be used where no national standards exist, or where it is the norm to use or refer to international standards.

APPROVALS

The Service Provider shall be responsible for obtaining the following approvals:

Approval of the work plan and anticipated cash flow before commence of work from the employer.

Approval of the detail design, drawings and tender/contract document from the Employer,

Way leave approval from all service authorities,

Approval of the Engineers Representative from the Employer.

Notwithstanding any approval received from the Employer, the Service Provider shall remain responsible for all work carried out by the Service Provider in terms of this contract.

PROCUREMENT Sanctions Relating to Breaches of Referencing Conditions

Where a Service Provider is found guilty of misrepresenting any facts in respect of ownership, in a tender submission, in order to affect the outcome of a tender, either before or after the award of a contract, then that contractor shall be blacklisted for a period of 12 months. The effect of such blacklisting is that no further work will be awarded to the Service Provider for the duration of the blacklisting.

FORMAT OF COMMUNICATION

All requests for formal approval from the Employer, or any other body, shall be submitted in writing in hardcopy format. Interim payment claims shall be submitted in the same format, accompanied by an original tax invoice. Ad-hoc communication between the Employer and the Service Provider may be conducted per facsimile or in electronic format (e-mail).All plans and contract documents submitted for approval shall be in both hardcopy format and agreed electronic format.

KEY PERSONNEL

Should it become necessary to replace any of the key personnel listed at the time of tender during the course of this contract, they may only be replaced by individuals with similar or better qualifications and experience, who satisfy the minimum requirements and then only with the approval of the Employer.

MANAGEMENT MEETINGS

Other than attendance at at-least monthly site meetings once the construction contract is let, there are no requirements for a regular management meeting in respect of this project. The Service Provider shall however convene management meetings on an ad-hoc basis as and when necessary, and when called upon to do so by the Employer. The Service Provider shall be represented at these meetings by at-least one of the key personnel and will be responsible for all minutes and submission of such minutes within one week after the particular meeting.

CLAIMS FOR PAYMENT

The Service Provider may submit interim claims for payment (invoices) as the work in terms of this contract progresses, but not more frequently than at monthly intervals. An original tax invoice must accompany all interim claims. Payments will be made within 30 days of receipt of the invoice.

EMPLOYERS RIGHT TO RECOVER COSTS

The Employer reserves the right to recover, by way of a deduction from any amount due to the Service Provider, any additional cost which the Employer incurs arising out of non-performance of the Service Provider which inhibits the progress of the construction contractor and which leads to an extension of time with costs.
