two defence witnesses nominated for lawsuit against US citizen Mr John William
Yettaw, Daw Aung San Suu Kyi, Daw Khin Khin Win and Ma Win Ma Ma

Khin Khin Win and Ma Win Ma Ma filed an appeal case
No 333 (b)/2009 to Supreme Court (Yangon) in
dissatisfaction with Yangon Division Courts decree of
confirming Yangon North District Courts decree of
declining the nomination of defence witnesses U Win
Tin and U Tin Oo in Criminal Case 47/2009 filed against
US citizen Mr John William Yettaw, Daw Aung San
Suu Kyi, Daw Khin Khin Win and Ma Win Ma Ma.
After hearing the statements of U Kyi Win, the lawyer of
the defendants, Supreme Court (Yangon) accepted the
case on 17 June.
Final statements of both sides in the appeal case
were heard at Supreme Court (Yangon) at 10 am today.
Supreme Court Advocate U Nyan Win, defending
the applicants, said that at the district level, a decree wasdelivered to summon only lawyer U Kyi Win from
Labutta (whose licence was revoked), one of the four
witnesses nominated by the defendants, as a law expert,
without recording any specific reason of why the three
other witnesses were denied; that the decree was wrong
because it failed, disregarding the law, to give a reason
of why the three other witnesses should not be summoned;
that an appeal case was thus filed to Yangon Division
Court to amend the decree; that it is wrong that the judge
of Yangon Division Court in his judgment dated 9 June
said that it could not be assumed that the initial courts
failure to state the reason according to Section 257 (1)
was against the law, and it was carried out in accordance
with paragraph 1115 of the book Manual to Courts; that
the judge of the Division Court in his judgment said that
U Win Tin and U Tin Oo were nominated as witnesses
regarding character, and there was no need to argue as to
the character of Daw Aung San Suu Kyi; that he would
like to point out that the nomination of U Win Tin and U
Tin Oo was referred not only to the character the learned
judges were taking into consideration, but also to political
character; that English-Myanmar dictionary by Judson
says that the term character also means public
character; that therefore that should not be assumed in
a narrow-minded way; and that U Win Tin and U Tin Oo
should be examined in connection with the political
character of Daw Aung San Suu Kyi.
Director Daw Khin Cho Ohn from the Attorney-
Generals Office, on the side of the plaintiffs, said that
the case was filed under Section (22) of the Law to
Safeguard the State Against the Dangers of Those
Desiring to Cause Subversive Acts; that action is takenagainst the accused for their violation of the section;
that Daw Aung San Suu Kyi just has to produce
evidence that she did not oppose or violate the restriction
order (or) prohibition order, under which action is taken
against her; that it is stated in the application that the
purpose of the nomination of U Win Tin and U Tin Oo
is to refer to political character; that according to the
statement, the application is designed to have U Win
Tin and U Tin Oo examined as defence witnesses in
relation to political character of Daw Aung San Suu
Kyi; that the explanation of Section (55) of Evidence
Law says that the term character enumerated in
Sections 52, 53, 54 and 55 covers reputation and
disposition; that according to the sections, the term
character does not include the term political character;
that Evidence Law does not prescribe any provision
that the accused has the right to give evidence regarding
political character; that it can be deduced that the
appeal case applied to examine U Win Tin and U Tin
Oo as defence witnesses regarding political character
of Daw Aung San Suu Kyi is intended to disturb and
delay the trial at the court; that Section 257 (1) of Code
of Criminal Procedure says if the accused, after he has
entered upon his defence, applies to the Magistrate to
issue any process for compelling the attendance of any
witness for the purpose of examination or cross-
examination, or the production of any document or
other thing, the Magistrate shall issue such process
unless he considers that such application should be
refused on the ground that it is made for the purpose
of vexation or delay or for defeating the ends of
justice; that the court is not responsible for summoningall the witnesses nominated by the accused; that the
application for examination of U Win Tin and U Tin
Oo as defence witnesses should be declined according
to Section 257 (1) of Code of Criminal Procedure; and
that therefore the application for an appeal case should
be refused.
In hearing the final statements at Supreme Court
(Yangon), Supreme Court Advocates U Nyan Win, U
Hla Myo Myint and Daw Khin Htay Kywe were
present on the side of the applicants, and Daw Khin Cho
Ohn (Director, Attorney-Generals Office), U San Hla
Kyaw (Deputy Director, Attorney-Generals Office),
and U Ohn Myint (Assistant Director, Attorney-
Generals Office) on the side of the plaintiffs.
The Supreme Court (Yangon) will make the

citizen Mr. John William Yettaw, Daw Aung San
Suu Kyi, Daw Khin Khin Win and Ma Win Ma Ma.
As the lawyers of the defendants submitted
the application for amendment related to the decree
on criminal case No. 47/2009 to the Yangon Division
Court, the court could not hear the final statement and
hearing of the cases were adjourned until 12 June.
In the criminal case No. 47/2009 of YangonNorth District Court against US citizen Mr. John
William Yettaw, Daw Aung San Suu Kyi, Daw Khin
Khin Win and Ma Win Ma Ma, defendants Daw
Aung San Suu Kyi, Daw Khin Khin Win and Ma Win
Ma Ma submitted the application for amendment to
Yangon Division Court on 2 June through their
lawyers U Kyi Win, U Nyan Win, U Hla Myo Myint
and Daw Khin Htay Kywe to amend the decree on
refusing their three witnesses ruled by the Yangon
North District Court. It was the criminal amendment
case No. 437/2009 of the Yangon Division Court.
After hearing the statement of Lawyer U
Nyan Win, Yangon Division Court accepted the
application for amendments to the decree and the
hearing was adjourned until 5 June.
The final arguments of both sides were heardat 3 pm today. In his statement, Lawyer U Nyan Win
said Daw Aung San Suu Kyi, Daw Khin Khin Win
and Daw Win Ma Ma presented four defence
witnesses. The four defence witnesses are U Tin Oo,
U Win Tin, U Kyi Win and Daw Khin Moh Moh. The
court stated that it would examine U Kyi Win, out of
four proposed witnesses, and examined U Kyi Win
on 28 May, he said. He assumed that three other
witnesses were rejected as the court did not summon
them to the court, he added. As they assumed that it
was injust and against the law, the applicants pleaded
for amendments to the decree. He continued to say
that it was against the law that in the daily records of
the court, only U Kyi Win would be summoned to the
court on 27 May and there is no decree related to other
defence witnesses. It was wrong for the court that it
did not issue a separate decree for other defence
witnesses without tangible reasons and the decision
of the members of the jury was biased, that the
Section 257 (1) of Code of Criminal Procedure says if the accused, after he
has entered upon his defence, applies to the Magistrate to issue any
process for compelling the attendance of any witness for the purpose of
examination or cross-examination, or the production of any document or

Yangon Division deputy law officer Daw
Khin Mar Kyi in her final argument said, in the
application for amendments, it was stated that in the
original court decree dated 27 May U Kyi Win alonewas to be examined as a witness; that refusing other
witnesses without any separate decrees was contrary
to the code of criminal procedure Section 257 (1);
that although it was verbally said that the decree was
issued in accord with the Section 257 (1) of the code
of criminal procedure, it was not kept on daily record;
and she added that according to the daily record of the
court dated 27 May, the decision was made as follows:
Daw Aung San Suu Kyi, Daw Khin Khin
Win and Daw Win Ma Ma (a) Ange Lay submitted
the list of witnesses, law experts U Kyi Win, Daw
Khin Moh Moh, U Win Tin and U Tin Oo with regard
to their character. There was no argument against the
character.
Competent lawyers who advise the clients in
the court have the rights to provide their arguments.
Our decision is that we will summon Advocate U Kyi
Win only to provide evidences in the arguments.
Of the four witnesses nominated by those who
apply for amendments, U Win Tin and U Tin Oo are
intended to provide some statements regarding the
characters of the applicants. Regarding the characters
of the applicants, the court has already made a decision
that there is no need to argue. Moreover, in the case
filed for Mr John William Yettaws entering the
house of Daw Aung San Suu Kyi, there has not been
any accusation against her for her characters.
Therefore, the decision not to call and question U
Win Tin and U Tin Oo, to say about the characters of
the applicants, is not against the law. The applicants
have submitted that they wish to hire Daw Khin Moh
Moh as a legal expert. Lawyers, who will give the
clients advice, have the rights to provide arguments
on legal affairs in the case. The court has summoned
U Kyi Win as a legal expert, so not calling and
questioning Daw Khin Moh Moh is not against the
law. Section 257 (1) of Code of Criminal Procedure
says, If the accused, after he has entered upon his
defence, applies to the Magistrate to issue any process
for compelling the attendance of any witness for the
purpose of examination or cross-examination, or the
production of any document or other thing, the
Magistrate shall issue such process unless he considers
that such application should be refused on the ground
that it is made for the purpose of vexation or delay or
for defeating the ends of justice. So, the court does
not need to summon all the witnesses the accused has
nominated. Apparently the witnesses the applicants
have nominated are the ones who are not needed to
present any evidences, so there is nothing more than
delay if they are summoned and examined. Therefore,
the courts decision not to call and examine those
witnesses complies with the law. Therefore, I would
say the amendments proposed by the applicants should
be dismissed.
Today, Supreme Court Advocates U Kyi Win, U
Nyan Win, U Hla Myo Myint and Daw Khin Htay
Kywe were on the side of the applicants; and Yangon
Division Deputy Law Officer Daw Khin Mar Kyi,

NAY PYI TAW, 29 MayThe judges ofYangon North District Court, the district law officers
and defence lawyer U Khin Maung Oo together with
Mr. John William Yettaw yesterday at about 1.30 pm
inspected the scene to make it clear how Mr John
William Yettaw entered and left the house compound
of Daw Aung San Suu Kyi through Inya Lake inaccordance with the Code of Criminal Procedure
Article 539 b. (1) and provisions of the article 621 ofcourt manual.
At the scene, Mr. John William Yettaw
stated that he entered the house compound of Daw
Aung San Suu Kyi in the first time on 30 November
2008 and in the second time from 3 to 5 May 2009.
Both times he entered the compound through the
underground culvert placed across at the corner of
University Avenue and Inya Myaing Road and then
stepped over the fence the height of which was about
over two feet only from the back of the house via
Inya Lake. It was found that in the first time he left
the house taking the route he entered but in the
second time he left the house heading for the US
counsellor's house compound that shares the fence
with the Kanthaya Hospital.

party of the Myanmar Police Force at about 5.30 am on
6 May was one-minute swimming distance, about 30
yards from the residence of the US counsellor.

In the incident, they found two empty five-
litre drinking water bottles, two small bags, a camera
thoroughly wrapped up in plastic, a pair of pliers, a
screw driver, a pair of folding pliers with laser, six
memory cards, a torch light with dry cells, 28
separate dry cells, a hat, a white shirt with long
sleeves, a pair of trousers, seven paper sheets with
written English words, two paper sheets with printed
words, two envelopes, an American passport statingthe name of Yettaw, two 100-US dollar notes, 93
1000-kyat notes, two 10-US dollar notes, one 50-
US dollar note and 10 visiting cards. The memory
cards in the camera featured pictures of Bogyoke
Aung San, a fighting peacock and a bookshelf.
On 6 May morning, the items confiscatedfrom the room of Mr. John William Yettaw at
Beauty Land (2) Hotel in Kyauktada Township
were one small Sony Model DCR SR 45 video
camera, one night vision Bushnell 3x40 binoculars,
one Vocal Translator, one mobile phone with Nokia
3110-C card, Gjt brand battery charger, one VideoCamera Sony brand charging cable, one Nokia
phone charging cable, one 4 GB Memory Stick
(black), a pair of scissors made in Pakistan for four
purposes, the map published by Myanma Tourism
Service and four paper sheets of hotel directory,totalling 61.
The confiscated items that remained at the
residence of Daw Aung San Suu Kyi after
Mr. John William Yettaw left were two black
chadors usually worn by Muslim women, two black
headscarves, two long skirts, one red torch light,six colour stencil pencils in a plastic bag, three
pairs of sunglasses, two signal lights, a pair of
swimming glasses, one two-pin plug, two pieces of
circuit wire, one recharger, a set of headphones, a
black bag with a zip in it that was used to keep the
apparatuses , a plastic bag with a zip in it, two pairsof grey stockings, five parts of an English book and
a bag with pieces of torn paper sheets in it.
According to his statement, Mr. John
William Yettaw was a member of the US Army and
was in battle nearly two years during the war in
Vietnam. He entered Myanmar through Maesot andMaesai and visited Maetaw Clinic in Maesot about
ten times. During the visit, he met with Bo Kyi of
Assistance Association for Political Prisoners-
AAPP.
The trial against Mr. John William Yettaw
continues at Yangon North District Court after thelaw suit was filed against him for entering secretly
the house compound of Daw Aung San Suu Kyi, for
violating the prescribed rules and regulations though
he arrived on a tourist visa, for breaching the
restriction on swimming in Inya Lake imposedaccording to the YCDC Water Supply and Sanitation
Rules (41).

communicated with the person concerned; that he said
so, because the phrase of Article 3 (a) of Chapter II
definition of expressions law 1973 said that the definition
of the expressions stated in the provisions shall be the
same as their everyday use; that that was why he stated
that the 1974 constitution was no longer effective; that
Mr John William Yettaw entered the restricted house
twice and if security members allowed him they too
could be considered to have violated the law; that if
action was not taken in that case, it had to be considered
that he was legally allowed to do so and he was innocent;
and that the host who had allowed him to get into the
house would be legally allowed to do so.
Mr John William Yettaws lawyer U Khin Maung
Oo, cross-questioning defence witness U Kyi Win, said
that if asked which sections could be applied to take
action against Mr John William Yettaw for his entering
the restrited house at night, action could be taken against
him under Articles 451/452 of the Code of Criminal
Procedure; that it would be right if action could be taken
against him only under Article 456 of the Code of
Criminal Procedure for his entering the house at night;
that if it was said that the restricted building was Daw
Aung San Suu Kyis current property, it was the States

Officer, defence witness U Kyi Win said that it was
likely that he happened to reply to the questions of Mr
John William Yettaws lawyer by referring to wrong
article of law; that he did not know the fact that one who
wants to enter the house compound of Daw Aung SanSuu Kyi prohibited by authorities must do so only after
asking permission from her; that it was true that once,
the request of Mr Gambari himself to meet Daw Aung
San Suu Kyi was turned down by her; that according to
the Article 456, although a person secretly enters a
house, it does not mean that he commits a crime if his
entry is approved by the host; that whether the intruder
Mr John William Yettaw committed the crime of
intruding the house, it does not mean that he did so
because he was given shelte r by Daw Aung San Suu Kyi
herself; that whether Mr John William Yettaw made
contacts with her, according to the restrictions law, it
does not mean that he did so as he gave her books and
documents and left the house carrying photos and video
documents with him on the way back; if the 1974
constitution was the existing one or the one still in force,
it was null and void; that it was said so according to the
Notification No 1/90; that according to the Declaration
No 6/88 of State Law and Order Restoration Council, it
was true that all the existing laws were valid so long as
the SLORC abolished and revoked them when it assumed
State duties on 18 September 1988; that the constitution
was not applicable; that it was true that the Law to
Safeguard the State Against the Dangers of Those
Desiring to Cause Subversive Acts had not been
abolished; that he did not know that Daw Aung San Suu
Kyis lawyers U Kyi Win and U Hla Myo Myint claimed
the right to defend in the appeal form dated 9 October
2008 submitted to the government referring to Article
23 and Article 167(B) of the 1974 constitution; that he

examined as a defence witness or a law expert, he
helped to ensure fair and justice both as a defence
witness and a law expert.
Then, Mr John William Yettaw from Criminal Case
48/2009 was examined. He stated that he entered the
house compound of Daw Aung San Suu Kyi in the
morning of 4 May 2009; that it was at about midnight on
5 May that he left Daw Aung San Suu Kyi's residence
and that he went to her house of his own accord.Then, when the district law officer, prosecutor,
cross-examined Mr John William Yettaw, he stated that
he applied for a visa to visit Yangon in November, 2008,
and in May, 2009. He also stated that, in applying for the
visa, it was true that he had to sign to pledge that he
would abide by the existing laws of Myanmar and the
particulars of visa rules and regulations during his stay
in Myanmar, that, in entering Daw Aung San Suu Kyi's
house twice, it was true that he secretly entered the house
at night without asking for permission, that he knew
Daw Aung San Suu Kyi's house was guarded by security
members and it was a restricted area where outsiders
were not allowed to enter, that he had to wade through
water in entering the house twice, and that, if by doing so
it amounted to breaking the immigration law of Myanmar
and the law of Yangon City Development Committee, he
did not mean to breach those laws.
Mr. John William Yettaw said his statement for thelawsuit filed against him under the Criminal Case No.48/2009
was the same as his statement for the Criminal Case No. 49/
2009 filed against him under the Yangon Municipal Act 28.
Later, in accordance with the Code of Criminal
Procedure Article 539 b. (1) and provisions of the article
621 of court manual, members of the jury at Yangon
North District Court, law officers and Lawyer U Khin
Maung Oo, went to the residence of Daw Aung San Suu
Kyi to inspect how Mr. John William Yettaw entered
and left the residence.
The proceedings are adjourned until 10 am on 1 June
to hear the final proceedings of the trial against US
citizen Mr. John William Yettaw, Daw Aung San Suu
Kyi, Daw Khin Khin Win and Ma Win Ma Ma.MNA
