• Question: Do Jim Crow (segregation) laws violate the 14th Amendment - which guarantees that all citizens have equal protection of the laws?

• Decision of the Supreme Court: segregation does not violate the 14th Amendment if the separate facilities are equal in quality - “separate but equal”

• In reality, separate facilities were never equal.
