    undang (RUU) tentang Pengadaan Tanah untuk >> Pembangunan yang diajukan oleh Pemerintah Republik Indonesia dan saat ini >> sedang dalam proses

    pembahasan di Dewan Perwakilan Rakyat Republik >> Indonesia. Menurut hemat Kami, RUU ini tidak akan belaku efektif untuk >> menyelenggarakan

    pembangunan yang adil dan demokratis, karena sejumlah >> prasayarat belum tersedia, antara lain: 1) Pengakuan formal terhadap hak-hak >> masyarakat

    belum diberikan dan dilaksanakan secara penuh; 2) Penataan ruang >> belum dibuat partisipatif, integratif dan dilaksanakan secara konsisten; >> 3) akses

    masyarakat terhadap informasi pada badan-badan publik belum >> terpenuhi; 4) tidak adanya mekanisme keberatan yang dapat diakses publik >> dengan

    mudah; dan 5) belum terciptanya peradilan yang bersih dan independen. >> Pengesahan RUU ini akan semakin melanggengkan praktik-praktik pelanggaran

    >> HAM terhadap masyarakat, masyarakat adat, termasuk perempuan, yang >> merupakan kelompok rentan di dalam konstruksi jender patriarki yang masih

    >> berlaku di Indonesia. Keprihatinan Kami didasarkan pada berbagai alasan, >> antara lain: >> >> >> >> *Pertama*, Sebagian besar tanah-tanah

    masyarakat di Indonesia hanya >> sedikit yang memiliki dokumen hukum lengkap. Tahun 2004 tercatat, dari >> 85 juta bidang tanah (belum termasuktanah-tanah yang berada di kawasan >> hutan dan kawasan yang dikuasai oleh masyarakat adat), baru 26 juta bidang >> yang bersertifikat atau 30

    persennya. Pada tahun 20052008 bertambah 13 >> juta sertifikat, sehingga sampai dengan tahun 2008, masih 60 persen yang >> belum bersertifikat.

    Sedangkan, dasar ganti kerugian adalah bukti >> sertifikat. Keadaan ini jelas akan mempertajam potensi konflik agraria yang >> sudah banyak terjadi.

    Apalagi di dalam RUU tersebut tidak ada pengakuan yang >> hakiki atas hak masyarakat adat maupun tanah komunal atau tanah adat. Selain >> itu, RUU ini

    tidak mencantumkan ketentuan terkait perlindungan >> tanah-tanah produktif alih fungsi lahan, padahal Indonesia merupakan >> negara agraris. Dengan

    tidak adanya ketentuan ini maka sangat potensial >> sekali RUU ini nantinya mengkonversi atau mengusur tanah-tanah pertanian >> produktif milik rakyat

    atau petani kecil dengan dalih pembangunan >> kepentingan umum. Artinya RUU ini sama sekali tidak memiliki pertimbangkan >> analisis historis-sosiologis

    bahwa Indonesia adalah negara agraris yang >> rakyatnya hidup dari tanah-tanah pertanian. >> >> >> >> *Kedua*, Praktik pengadaan tanah di Indonesia

    masih banyak menyisakan >> persoalan dan konflik hingga kini. Data KPA, menunjukan sepanjang tahun >> 2010 terjadi 106 konflik agraria di berbagai

    wilayah Indonesia. Luas lahan >> yang disengketakan mencapai 535,197 hektar dengan melibatkan 517,159 KK yang >> berkonflik. Posisi sebagian besar

    rakyat yang tidak dilindungi hak atas >> tanahnya, mekanisme pembebasan tanah yang bersifat otoriter/memaksa, serta >> manipulasi makna kepentingan

    umum, merupakan catatan buruk pemerintah >> dalam pengaturan dan pengadaan tanah, karena selalu memakan korban. Berdasarkan >> data kasus LBH

    Jakarta, terkait penggusuran di wilayah perkotaan, terjadi >> kenaikan korban penggusuran dari 1883 KK pada 2006 menjadi 6000 KK pada >> tahun 2007.

    Sedangkan, data Komnas Perempuan tahun 2010 mencatat 395 >> perempuan yang menjadi korban penggusuran. Permasalahan di dalam praktik >>

    pengadaan tanah selama ini, antara lain adalah penggusuran paksa, praktik >> kolusi pertanahan terkait bukti hak atas tanah, inventarisasi dan >>

    identifikasi obyek pengadaan tanah secara sepihak, penetapan kompensasi >> secara sepihak, hingga tidak terlibatnya masyarakat terkena dampak dalam >>

    penetapan obyek pengadaan tanah. Sedangkan, pelanggaran HAM yang kerap >> terjadi dalam praktik pengadaan tanah di antaranya intimidasi,penganiayaan, >> penembakan, hingga penangkapan warga yang berujung pada kriminalisasi, >> dengan melibatkan aparat negara. Hal ini berdampak nyata

    terhadap hilangnya >> sumber-sumber kehidupan, dan ancaman terhadap keberlangsungan hidup >> masyarakat, khususnya perempuan, di mana

    perempuan lah yang kemudian harus >> memikirkan keberlanjutan rumah tangga, keluarga dan anak-anaknya, terkait >> tempat tinggal, penyediaan

    makanan, air bersih dan kebutuhan rumah tangga >> lainnya. Keberlanjutan praktik-praktik tersebut akan semakin memiskinkan >> masyarakat Indonesia.

    >> >> >> >> *Ketiga*, RUU ini merupakan bagian dari paket reformasi regulasi >> pembangunan infrastruktur di Indonesia bagi proses keterbukaan

    pasar dan >> pelibatan peran swasta, dengan konsep pengadaan tanah untuk pembangunan >> demi kepentingan umum dan kepentingan usaha swasta.

    Sedangkan, pengertian >> dan kriteria kepentingan umum tidak dijelaskan di dalam RUU tersebut. RUU >> ini seperti berdalih seolah-olah proyek yang

    didorong adalah untuk >> kepentingan umum, padahal proyek tersebut tidak lebih hanya untuk >> kepentingan swasta, seperti proyek infrastruktur yang

    sepenuhnya dibiayai, >> dimiliki, dikelola dan diperuntukan bagi kepentingan swasta, bahkan asing. >> Antara lain, proyek jalan tol, bendungan, pelabuhan,

    bandara, sarana dan >> prasarana telekomunikasi, transportasi, air minum, sampai pada pertanian >> skala besar seperti *Food Estate.* yang selama ini

    terbuka untuk swasta >> dan asing. RUU ini menjadi alat pendukung dari pengembangan investasi >> atas nama pembangunan, melalui eksploitasi sumber

    daya alam dan >> industrialisasi oleh swasta. Yang mana berbanding terbalik dengan semangat >> mengatasi perubahan iklim, karena berdampak pada

    percepatan pemanasan global >> akibat alih fungsi lahan dan industrialisasi. Kebijakan ini sekaligus >> dimaksudkan untuk memudahkan investor asing

    menguasai sektor-sektor >> strategis melalui pembangunan infrastruktur di Indonesia. Kebijakan ini >> dinilai tidak memihak kepada masyarakat yang justru

    bill will not be effective to conduct a fair and democratic >> development, because a number of prerequisite is not yet available, among >> others: 1) Theformal recognition of community rights have not been awarded >> and implemented in full; 2) The arrangement of space has not yet >> participatory,

    integrative and implemented consistently; 3) public access to >> information on public bodies have not been fulfilled; 4) the absence of >> objection
