Discussion: Applicant is remodeling and updating the old Lutheran Sunday School building into a single family home to live in. Applicant requests a variance of 3’ of the side yard and 6 ft. of rear yard setback requirements of R1 Low Density Residential District. Applicant wishes to add 2 car garage.

Article XXVII, Section 1 of the Watford City Zoning Ordinance states the requirements that must be shown in order to grant a variance; “the applicant must show that his property was acquired in good faith and where by reason of exceptional narrowness, shallowness or shape of his specific piece of property at the time of the effective date of this zoning ordinance or where, by reason of exceptional topographical conditions or other extraordinary or exceptional circumstances, the strict application of the terms of this zoning ordinance actually prohibits the use of his property in the manner similar to that of other property in the zoning district where it is located. A yard regulation variance may not be more than one-half (50%) the required yard and shall not encroach upon the required setback for adjacent buildings.”

In granting a variance, the Planning Commission must satisfy itself, from the evidence heard before it that the granting of the variance will alleviate a clearly demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience sought by the owner. The planning Commission shall also find that the variance, if granted, is in harmony with the intended spirit and purpose of the zoning ordinance and does not constitute a direct and obvious amendment to the district regulations or district boundaries. Under no circumstances shall the Planning Commission grant a variance allowing a use within a district not permissible under the terms of this ordinance

The site is in the corporate limits of Watford City, therefore falls within the jurisdiction of the Watford City Planning and Zoning Commission.

The City of Watford City mailed the adjoining property owners notice regarding the Variance Application, none of the noticed property owners contacted the city regarding the application.

Reference: Watford City Municipal Code Chapter XV, Article X – Single-Family Dwelling Residential District, Section 3 – Conditional Uses

Request: Original application (2014) requested Conditional Use Permit (CUP) for a home-based small business named Sew Fine Embroidery that does custom embroidery for clients (individual, clubs, or business), and is capable of alterations, and custom sewing. This is a permitted Conditional Use zone R-1. The business is located in their shop attached to the newly constructed garage. The client traffic isvery minimal and does not cause a disturbance to neighbors.

Discussion: Adjacent property owners were mailed a notice regarding this CUP review, none of the notice property owners contacted the city regarding the application. The site is in the newly created Extra Territorial Area (ETA) and therefore falls within the jurisdiction of the Watford City Planning and Zoning Commission. The intent of the ETA is to regulate growth and development within one mile of the City but to not be restrictive in nature.

The City of Watford City mailed the property owners that hold an interest in the property and the adjoining property owners a notice regarding the annual review of CUP application. None of the noticed property owners contacted the city regarding the application.

The commission should carefully consider all of the possible implications associated with approving this Conditional Use. Chapter XV, Article XX of the City of Watford City ordinances require that “All required off-street parking areas, including access drives, shall be improved with asphalt, concrete or similar dust-free surface and all parking spaces shall be clearly marked.”

A Conditional Use Permit may be granted following compliance with the procedure set forth in this section if the conditional use is one set forth in the District Regulations, provided that no application for a conditional use shall be granted unless all of the following conditions are found to be present:

1. The conditional use will not be detrimental to or endanger the public health, safety or generalwelfare of community.

2. The existing permitted uses in the neighborhood will not in any manner be substantially impairedor diminished by the establishment of the conditional use;

3. The conditional use will not impede the normal and orderly development of the surroundingproperty for uses permitted in the district;

4. Adequate utilities, access roads, drainage and other necessary site improvements have been orare being provided;

5. Adequate measures have or will be taken to provide access and exit so designed as to minimizetraffic congestion in the public streets; and

6. The conditional use shall conform to all special provisions of the district in which it is located.

The Conditional Use Permit may be issued for a specified period of time, with automatic cancellation at the end of that time unless it is renewed, or conditions may be applied to the issuance of the Permit and periodic review may be required to determine if the conditional use has any detrimental effects on neighboring uses or districts. The Permit shall be granted for a particular use and not for a particular person or firm.

Recommendation: Staff recommends approval of this Annual Review/Renewal of Conditional Use Permit for home based occupation.

1. Conditional Use Permit shall be reevaluated after 1 year.

The commission should carefully consider all of the possible implications associated with approving this Conditional Use. Chapter XV, Article XX of the City of Watford City ordinances require that “All required off-street parking areas, including access drives, shall be improved with asphalt, concrete or similar dust-free surface and all parking spaces shall be clearly marked.”

A Conditional Use Permit may be granted following compliance with the procedure set forth in this section if the conditional use is one set forth in the District Regulations, provided that no application for a conditional use shall be granted unless all of the following conditions are found to be present:

1. The conditional use will not be detrimental to or endanger the public health, safety or general welfareof community.

2. The existing permitted uses in the neighborhood will not in any manner be substantially impaired ordiminished by the establishment of the conditional use;

3. The conditional use will not impede the normal and orderly development of the surrounding propertyfor uses permitted in the district;

4. Adequate utilities, access roads, drainage and other necessary site improvements have been orare being provided;

5. Adequate measures have or will be taken to provide access and exit so designed as to minimize trafficcongestion in the public streets; and

6. The conditional use shall conform to all special provisions of the district in which it is located.

The Conditional Use Permit may be issued for a specified period of time, with automatic cancellation at the end of that time unless it is renewed, or conditions may be applied to the issuance of the Permit and periodic review may be required to determine if the conditional use has any detrimental effects on neighboring uses or districts. The Permit shall be granted for a particular use and not for a particular person or firm.

Recommendation:

May 2017 City Council: Council Member Gravos moved to approve Conditional Use Permit Annual Reviews allowing for Employee Housing. Included in the motion was a recommendation for Planning and Zoning to begin phasing out Conditional Use Permit Annual Renewals for Employee Housing, bringing property into zoning compliance. Motion seconded by Council Member Devlin and carried by the following roll call vote: ayes: Sanford, Riely, Devlin, Beard, Gravos, and Liebel; nays: none.

Staff recommends Approval of the conditional use under the following conditions: 1) This site is 10.0 acres and per the ordinance will be allowed one (1) mobile unit (HUD) or two (2)

RV units (DMV) per acre, Ace in the Hole Construction currently has eight (8) Mobile Homes.2) Two parking spaces shall be provided per dwelling unit.3) A dust palliative shall be required on unpaved parking areas and drive aisles May through

October.4) Parking areas shall be surfaced with a minimum of 6” of crushed aggregate, not scoria. Scoria may

be used as a base course for the final surfacing.5) Conditional Use Permit reevaluated in 1 year

PLANNING & ZONING COMMISSION MEETING MINUTES June 26, 2017

The regularly scheduled monthly meeting of the Watford City Planning & Zoning Commission was held on Monday June 26, 2017 at 6:00 p.m. in the Heritage Room at City Hall. In attendance: Chairman Glen Beard, Commission Members: William (Billy) Carlson, Thomas Dwyer, Jesse Lawrence, and Gregg Schuetze. Also present: Principal Planner Mildred (Milli) Williams, Planning Assistant Becky Smith, Building Inspector Steven Williams, and City Attorney Wyatt Voll. Absent: Rick Holm and Jason Taylor. With the above mentioned present, the Public Hearing was called to order at 6:00 P.M. by Chairman Glen Beard.

Under consideration were the following:

1. Public Hearing to hear comment on Land Use Application for Zone Change- MammothProperties IP, Industrial Park to HI, Heavy Industrial.

Principal Planner, Milli Williams, explained that the applicant has requested a zone change from IP- Industrial Park toHI- Heavy Industrial. However, Milli explained, Planning Staff recommends denying the application based on the owners’intended use of the property. IP Zoning ordinance lists permitted uses acceptable for the owners intended use. The ownerswere in attendance and stated that they had a misunderstanding of the zoning requirements especially in regard to the differenceof impervious surface requirements between IP and HI. The owners are aware of the recommendation to deny the change.MOTION by W. Carlson, SECOND by G. Schuetze to recommend DENIAL to City Councilof the Land Use Application for Zone Change.Roll Call Vote:Ayes: G. Beard, W. Carlson, T. Dwyer, J. Lawrence, G. SchuetzeNays: None.MOTION Carried.

2. Public Hearing to hear comment on Division of Land Application for Simple Lot Split –Mammoth Properties.

Principal Planner Milli Williams explained that this Simple Lot Split is proposed to create two lots from one large parentparcel. Milli explained that Staff recommends approval of the split but there is still one major question regarding the access tothe property. Mammoth’s engineer Matt Beard was in attendance and explained the difference between platting the lots with apublic vs private access road. McKenzie Electric Cooperative’s (MEC) new building is located on property to the south ofMammoth’s. MEC was permitted through the County. MEC improved the access road by paving a 24’ wide section leading totheir property. MEC’s access gives two 12’ driving lanes as well as a widened area designated for their overnight truck parkingalong the frontage of their property. If requiring Mammoth to follow City Standards, the road will need to be further improved toprovide two 12’ driving lanes with a 13’ turning lane in the center. Also in attendance, Larry Sorenson who owns adjacentproperty. Larry explained that when they bought their property, they were given a 99 year easement for the access road andwould like to keep the road private. All property owners adjacent to the road must be in agreement so that the private easementdoes not prohibit access to their property.

MOTION by G. Schuetze SECOND by J. Lawrence to recommend APPROVAL to CityCouncil of the Division of Land Application for Simple Lot Split. Approval is contingentupon the following conditions:

1. Site Development Plan Application and generalized building plans must be submitted, reviewed, andapproved before any development is started on this property. In order to obtain Final Inspection/Certificate of Occupancy, 23rd Ave NE road build-out must be completed.

2. Mammoth Properties will be required to build-out existing 23rd Ave NE road to the City Standard of “UrbanIndustrial”. Build-out of the road will be required across the frontage of Lot 2 from Hwy 1806 to the eastedge of Lot 2 property line.

3. Bonding, in the amount established by an Engineers Estimate, will need to be in place prior to therecordation of this Simple Lot Split plat.

4. A Subdivision Improvement, Maintenance, and Warranty Agreement (SIA) is required to be recorded withthis Simple Lot Split.

5. All future divisions of land on this parcel will be subject to Subdivision platting requirements accordingto Watford City Municipal Code of Ordinances, Chapter XV-Zoning Ordinance, Article XXX, andSubdivision Regulations.

3. Public Hearing to hear comment on Division of Land Application for Simple Lot Split- J&O RealEstate, LLC.

Principal Planner Milli Williams explained that this is a simple lot split to create a sellable lot from a larger parentparcel. New lot has an existing house on the property and the rest of the land is undeveloped.

MOTION by T. Dwyer, SECOND by J. Lawrence to recommend APPROVAL to City Councilof the Division of Land Application for Simple Lot Split. Approval is contingent upon thefollowing conditions set forth within the Planning Department Staff Report:

1. Submitted Simple Lot Plat meets all requirements per the Watford City Municipal Code of Ordinances,Chapter XV, Article XXX-Subdivision Regulations.

2. Any future development on this parcel will require a Site Development Plan Application along with Building Plans and Permit Applications to be submitted to the Planning Department for further review.

1. Follow up with Rolfson Oil’s Conditional Use Permit: Chairman Glen Beard would like Rolfson to verify if their newly installed pit liner is impervious to petroleum. Verify regulations on location of their well to pond- Health Department issue, not City.July is Rolfson’s deadline to have all corrective actions complete. Glen was hired by Triangle Electric for inspection ofRolfson property. Glen’s inspections were not performed on behalf of the City, The City will perform own inspections.

2. Pole building at old Dakotan Restaurant location: Building Inspector Steven Williams stated that he instructed contractor,Mark Campbell to get a building permit. A permit has not been issued as of date of this meeting. Principal Planner, MilliWilliams explained that Mark Campbell had submitted a Site Development Plan application but did not have all necessarydocuments in order for the City to begin review process. Steve also explained that it was his understanding from a previousconversation with City Administrator/Planner, Curtis Moen, that the purpose of the building was to only be temporary toprevent thievery and will be fully dismantled by the end of July. Milli recommended Glen discuss the issue directly with Curt.

3. Chairman Glen Beard brought up the need for sidewalk improvements in town. Grant(s) available to help costs?
