removed even if the proposed variance is approved (see attached Patio-as-Built graphic).

The side yard walkway from the front of the house to a side pad (at the northeast side of the house) discussed in the Community’s Architectural Review Board letter is not part of this variance request.

The property abuts a common area and lake to the south. See attached correspondence from the Community's Architectural Review Board. Letters from neighbors were submitted and staff has not received any correspondence

in opposition to the variance. This item was reviewed by the Town’s Development Review Committee and there are

Analysis The following information is staff’s analysis (italic font) based on the criteria established in the Town of Davie’s Land Development Code, Section 12-309(B)(1) for variance applications:

1. There are special circumstances or conditions applying to the land or building for which the variance is sought, which circumstances or conditions are peculiar to such land or building and do not apply generally to land or buildings in the same district, and that said circumstances or conditions are such that the strict application of the provisions of this chapter would deprive the applicant of the reasonable use of such land or building for which the variance is sought, and that alleged hardship is not self-created by any person having an interest in the property;

There are no circumstances or conditions applying to the land to justify this variance.

2. The granting of the variance is necessary for the reasonable use of the land or building and that the variance as requested is the minimum variance that will accomplish this purpose;

The variance is not necessary for reasonable use of the land. The land is already being used with a single-family home.

3. That granting the variance will be in harmony with the general purpose and intent of this chapter and will not be injurious to the neighborhood or otherwise detrimental to the public welfare.

The surrounding properties consist of single-family homes with accessory uses within rear yards. The purpose of setbacks is to maintain distance separation between properties. There is a common area and lake behind the property. Other patios appear to meet the 5 ft. rear setback. The proposed encroachment will be in harmony with the neighborhood and does not appear to be detrimental to the public welfare.
