Choosing The Right Adviser

The Jersey property marketLocal house prices appear to be static, although it may still be possible to negotiate a modest reduction over asking prices. Estate agents tell us that the year to date has remained steady, with the usual seasonal fl uctuations that always happen to coincide with school and bank holidays.

A high demand for rental accommodation suggests that many people, especially First Time Buyers are holding back on becoming property owners, due perhaps to lack of the necessary deposit, or with some it may be lack of confi dence in the future.

Because of this, the opportunities for Buy to Let investors remains high.

Local mortgage market activityWith the Brexit decision now behind us, it is possible that whilst Bank of England base rate might remain at 0.50%, there may now be scope for banks to further reduce mortgage product rates.

This presents the perfect opportunity for borrowers to lock in to a fi ve year fi xed rate, which could well be below the tracker options that are available. How long this opportunity will last is currently anybody’s guess.

When base rate will start to rise is also up for discussion, with many experts now predicting that nothing will happen until 2020.With rates where they are and set to remain low for the foreseeable future, this is an ideal time to take out a mortgage, or to consider a review of existing borrowings – don’t get left behind!

We spend a signifi cant portion of our lives in gyms in a laudable attempt to fi ght the fl ab and sculpt a Hollywood body.  At their best, gyms are a sanctuary from the travails of modern life; an air conditioned oasis, gentle music playing as you better yourself next to limber, beautiful people.  

BRINGING FITNESS HOME: BURN CALORIES, NOT CASH.

At worst, it’s a dank sweat-box, vying for 10 inches of fl oor space as beardy barbarians pump iron to powerful Dubstep.

If they have something in common, however, it’s that they are generally expensive. Why pay when you could have your own private gym in your property? 

It’s recommended you invest in a 14x10ft shed with a roof height of 7ft plus which should be ample for a general purpose gym. You can either buy a ready made shed or ask a professional carpenter to build one for you.

You’ll want to lacquer it with weatherproof paint, and to prevent your shed from rotting you’ll need to recoat once a year.

Next up, fl oor protection. You’re going to be dropping heavy weights onto the fl oor

so you’ll want heavy duty rubber fl oor mats in place. This will also help with thermal and sound insulation, so you can smash out a midnight gym session without the neighbours batting an eyelid.

So let’s warm up with some insulation to keep your gym warm in the winter and super cool in the summer. 

It’s really a job for a professional electrician to hook up your lighting, heaters, fan and iPod speakers. An extension cable from your house is not a quick fi x.

Now you’ve got the power, let’s talk ventilation. Your manly musk might get a bit oppressive after a while so it’s a good idea to install air vents on either side of the shed. One at the top to let out the warm moist air and one of the bottom for the cold air intake to keep it chill.

Buying share transfer property di� ers from buying fl ying freehold or freehold property in that the transaction does not have to be registered in the Royal Court of Jersey, by way of a Deed of Conveyance. 

With share transfer you are e� ectively buying shares in the company that owns the property and acquiring the specifi c shares that relate to the part of the property that you are purchasing, by way of a Share Vending Agreement. Ownership of the shares gives you exclusive occupation and use of that property.

A share transfer transaction is more involved because it involves not only checks on the property by way of title checks and survey, but also checks on the company to ensure that the books and records are in order and that the company is of good standing. This could hold up any potential sale if the books and records have not been kept up to date.  Not only can this result in a delayed sale, but in some cases, additional costs to get the books and records updated, or worst case scenario cause the purchaser to pull out of a sale.

By law, every company has to keep records detailing the names of shareholders, directors, company secretary and any decisions made by its shareholders and directors by way of minutes. Thus, the minute book, share register, share certifi cate book, registers of directors and secretaries and the fi nancial statements should be kept up to date so that any relevant issues can be identifi ed and if necessary updated and/or rectifi ed.

HELPFUL HINTS FOR VENDORS OF SHARE TRANSFER PROPERTYIf one of the shareholders is acting as Company Secretary, ensure that all books and records are kept up to date and that any minutes or special resolutions have been recorded correctly;

If the property is managed, ensure it is a reputable company who will carry out the work in a timely manner;

If there is a service charge on the property, ensure that all shareholders pay the relevant amount in a timely manner and that this is recorded accurately in the company books;

Highlight the items covered by the service charge such as buildings insurance, electricity in the communal areas, garden maintenance, car park maintenance, managing agent’s fees and/or company secretary fees, lift maintenance, possibly window cleaning and possibly water rates;

Ensure that any future works to be carried out are minuted and confi rm whether they are covered by a sinking fund, which is a fund paid into as part of the service charge to cover such future maintenance.
