Findings: Reported by Indiana 811; excavator’s response to initial notice was received on 2/4/2013. The excavator

Conclusion: There was a failure to maintain two (2) feet clearance.

Violation: IC 8-1-26-20(a)(2) Failure to maintain two (2) feet clearance with mechanized equipment.

INCIDENT ALERT/ ROOT CAUSE ANALAYISS

Department: Angola Gas C&M Address 10612 Tesoro Cove Fort Wayne, In.

Damage Facility: 2” Gas Main Date/Time of Incident: 9/24/2012 /10:30 am

Supervisor: Richard Williams/Jason Sprunger (260) 41302750 (260) 226-2330

Description of Incident: Employees were digging up gas main to install new gas service, striking 2”plastic gas main with backhoe bucket of trencher/digger.

Causal Factors: 1. Employee located 2” gas main with Metro Tech DX810 locator 2. Employee digging on top of locate mark with Vermeer 550 digger3. Employees were using Metro Tech DX 810 to get depth readings of gas main and stripping ground above gas main4. Metro Tech DX810 locator showed depth reading of 42”, but gas main was actually 12” shallower than expected5. Employees was taking One More Scoop before using shovel to spot gas main.6. Employee who was operating equipment was not familiar with this machine as it was the third time using it.7. The locate marks were within the 24 inch tolerance zone, missed the mark by 6 inches.

Root Cause; Employees were using mechanical equipment within the 24 inch no tolerance zone.

Corrective Actions: 1. Both C&M employees were suspended from operating mechanical digging equipment to spot facilities until root cause is

complete and any other corrective actions are identified and completed.2. Employees will locate the live 2" main in the MEO field at Nipsco’s training center, and each will have the opportunity to

expose the main while maintaining a 2 foot clearance between the cutting edge or point of the trencher bucket and the gas main.

3. If employees fail task # 2 they will need to attend and successfully pass the Mechanical Equipment Operators Class

In  response  to  the Notice  of  Preliminary  Determination  dated November  30, 2012,  as  detailed  above,  please  refer  to Northern  Indiana  Public  Service Company’s (“NIPSCO”)  facility  owner  response  in  Case  No.  3863.    All  relevant  documents, including  both  NIPSCO’s  operator  records  relevant  to  the  damage  as  well  as information that addresses the potential statutory violation by NIPSCO as an excavator are attached to that response.
