Physical Therapy Advisory Committee

Minutes

The Physical Therapy Committee of the Board of Medical Licensure and Supervision met on October 2, 2020, in accordance with the Open Meeting Act. The meeting was held virtually in accordance with the amendments to the Open Meeting Act, 25 O.S.2011, § 301 et seq, signed into law by Governor Stitt on Wednesday, March 18, 2020. (See: SB661, 2020 O.S.L. 3, §3.) Advance notice of this open meeting was transmitted to the Oklahoma Secretary of State on October 10, 2019, and posted on the Board's website on September 28, 2020, at 3:37 p.m. in accordance with Title 25 O.S. § 311.9. Members participating via the Cisco Webex Meetings platform:

Ms. Berry left the meeting due to technical issues. Following Committee review, Ms. Lawrence moved to approve the minutes of May 15,

2020, as written. Ms. Mason seconded the motion and the vote was unanimous in the affirmative. The Committee then considered nominations for officers. Ms. Ball moved to nominate Ms. Berry to serve as vice-chair. Ms. Mason seconded the motion and the vote was unanimous in the affirmative. Ms. Ball moved to self-nominate herself to serve as Chair. Ms. Lawrence seconded the motion and the vote was unanimous in the affirmative. Ms. Berry rejoined the meeting. TOMMY JENKINS appeared remotely in support of his application for re-entry of his Physical Therapist Assistant licensure. In January, due to his use of CBD for rheumatoid arthritis, he got into an argument with Dr. Stout, the Medical Board Secretary. He became so tired of arguing with Dr. Stout that he let his license expire. The applicant advised that he presented evidence regarding the safety and use of CBD oil to Dr. Stout a year ago. The

materials showed that CBD is not the same as smoking marijuana and it is virtually impossible to get a high from CBD oil. Mr. Jenkins stated that Dr. Stout accused him of using CBD to hide the fact he was actually smoking marijuana. He said Dr. Stout never reviewed the information provided. Mr. Schneider stated that, at times, CBD will cause a specimen to test positive for marijuana, but that does not mean a person is impaired. Mr. Schneider further advised that CBD is not a controlled dangerous substance. Mr. Jenkins stated he would like to return to work at a skilled nursing facility in Ponca City. Ms. Ball moved to recommend approval of the application of TOMMY JENKINS for re-entry pending completion of the file to include obtaining 60 hours of CEUs, with one-half of those being Category A and three hours being ethics, for the compliance period ending 2021, and successfully completing 16.5 days of direct onsite supervision with an adequate performance evaluation provided to the Board from the supervising physical therapist. Ms. Berry seconded the motion and the vote was unanimous in the affirmative. MICHELLE WILLIAMS appeared remotely in support of her application for re-entry of her Physical Therapist Assistant licensure. She did not get in all of her CEUs in the previous compliance period due to a family illness. She wants to work in skilled nursing. Following Committee discussion, Ms. Ball moved to recommend approval of the application of MICHELLE WILLIAMS for re-entry pending completion of the file to include obtaining 60 hours of CEUs, with one-half of those being Category A and three hours being ethics, for the compliance period ending 2021, and successfully completing 16.5 days of direct onsite supervision with an adequate performance evaluation provided to the Board from the supervising physical therapist. Ms. Berry seconded the motion and the vote was unanimous in the affirmative GINA HEOGH, applicant for Physical Therapist Assistant licensure, appeared remotely in support of her request for reconsideration of supervision requirements set forth by the Committee on May 15, 2020. Due to the situation of Covid she is unable to obtain the direct onsite supervision recommended on May 15, 2020 by the Committee. She would like to retake the board exam in place of the direct onsite supervision. Following Committee discussion, Ms. Ball move to recommend removing the requirement of direct onsite supervision which was previously recommended on May 15, 2020 and, in its place, require the applicant to successfully retake the Federation of State Board of Physical Therapy PTA exam. Ms. Berry seconded the motion and the vote was unanimous in the affirmative. MECHELLE PETTY, applicant for Physical Therapist licensure, did not appear remotely in support of her request for reconsideration of supervision requirements set forth by the Committee on December 6, 2019 because the issue was resolved prior to this meeting. CAROL COLEMAN, PT, appeared via audio only in support of her request for a Continuing Education Exception. She is not working and has not worked in a number of years, but would like to maintain an active license. Following discussion, Ms. Coleman withdrew her request.

ERANN WEST, PTA, appeared remotely in support of her request to sit a third time for the Federation of State Boards of Physical Therapy exam. She went through her study plan, which included Score Builders Advantage, with the Committee. She stated that she would be open to using PEAT exam for review. Ms. Ball moved to allow Ms. West to sit a third and final time for the Federation of State Boards of Physical Therapy PTA exam. Ms. Mason seconded the motion and the vote was unanimous in the affirmative.

Next, the Committee reviewed applications for licensure. Ms. Berry moved to recommend approval of the following incomplete applications for Physical Therapist Assistant licensure pending completion of the files. Ms. Lawrence seconded the motion and the vote was unanimous in the affirmative.

Next, Rachel Herbert, CEU processor, presented pre-reviewed continuing education courses for the Committee's consideration. Ms. Berry stated that the online review system is up and working perfectly. Following Committee review, Ms. Ball moved to recommend approval of the pre-reviewed courses listed on Attachment #1 hereto. Ms. Berry seconded the motion and the vote was unanimous in the affirmative.

Ms. Ball moved to recommend denying the pre-reviewed courses listed on Attachment #1 hereto. Ms. Berry seconded the motion and the vote was unanimous in the affirmative.

Ms. Herbert advised the committee that pre-reviewed courses will no longer be tabled but will remain in the "pending" category.

Rachel Herbert then advised the Committee that some licensees have expressed concern regarding obtaining all of their Category A courses since some do not have computer capability. Ms. Mason believed this to be a valid concern and stated some practitioners she knows have had the same issue. Ms. Berry believes there are a lot of opportunities to get information. Connectivity may, at times, be an issue but everyone is dealing with that, including our school children. Ms. Berry believes there should not be any change to the CEU requirements at this time. No formal action was required in this matter and none was taken. Next, Ms. Berry moved to make the following formal appointments to the Physical Therapy Rules Subcommittee: Mitsy Martin Davis, Brandon Trachman, Zachary Huff, Rebecca Acupan, Deborah Hicks, and herself. Ms. Ball seconded the motion and the vote was unanimous in the affirmative. Thomas Schneider, AAG, has agreed to join in an advisory role. Ms. Berry stated she is continuing to work on proposed amendments to the Physical Therapy Practice Act and/or administrative rules to allow permanent provisions of telehealth services. The goal is for emergency language allowing the practice of telehealth during the pandemic to be available for PT services in the state. Proposed language will be drafted for the practice act and, ultimately, administrative rules to make that permanent. Currently, PTs are still able to function under the Executive Order. The next step would be to draft proposed language (law) and find a legislative author. The legislative author's legal staff will draft the actual bill. An update of this matter should be placed on the December agenda. Jennifer Ball reported on the Federation of State Boards for Physical Therapy Leadership Issues Forum held in July of 2020. The Federation reiterated that our role as a regulator is not to support physical therapy endeavors, but to support the public's safety and access to services. She gave an update including, but not limited to, new versions of PEAT are now available; and many exams were cancelled due to social distancing in light of COVID-19 and FSBPT has a website specifically to provide information regarding testing options which is FSBPT.com/coronavirus. All meetings will be held virtually. Additionally, 1200 compacts were purchased and board resource tools have been published. FSBPT is studying FBI criminal history and background checks to make sure access to PT licensure is not limited based on a crime that does not put the public in danger. Twenty-six states were participating in the compact as of July. And finally, FSBPT is re-visiting the issue of competency to return to practice. Ms. Ball will be attending the annual meeting scheduled for October 22-23, 2020. A

telehealth and digital practice webinar will be held on October 27th.
