PETITION TO CHANGE TUITION CLASSIFICATION PLEASE READ THIS PAGE BEFORE YOU COMPLETE THE PETITION A student’s initial tuition classification decision is determined by the application for admission submitted by the student. A student’s resident status is not changed automatically. The burden of proof that the student qualifies as a legal resident under the regulations of the Board of Regents of the University System of Georgia rests with the student. The student is responsible for registering under the proper tuition classification. The combination of items requested and information provided on this petition will be taken into consideration in the review for tuition reclassification. The petition must be filed no later than 30 days after the semester begins in order for the student to be considered for reclassification for that semester. If the petition is granted, reclassification will not be retroactive to prior semesters or fiscal years. The eligibility criteria to be classified as a resident for tuition purposes is based on Board of Regents Policy 4.3 Student Residency. The student or their parent must have established domicile in Georgia the last 12 months immediately preceding the start month of the term. A person’s legal residence is the place where he/she is generally understood to reside with the intent to remain indefinitely and return when absent. In addition to living in Georgia, where the student and their parents file taxes play a large role in the definition of domicile. A dependent student (under 24 years old) trying to prove they are an independent student must prove: Moved to the state for reasons other than attending a post- secondary educational institution Abandoned all ties to their previous state or country of residence Has taken appropriate steps to assume the responsibilities of a Georgia resident Has lived in the state for at least 12 continuous months immediately preceding the first day of classes Receives no financial assistance from outside of Georgia Is not claimed as a dependent on the taxes of their parent/guardian who resides outside of Georgia Is a U.S. citizen, Lawful Permanent Resident, refugee, asylee, or other eligible noncitizen as defined by Federal Title IV regulations Earns a minimum yearly of $12,760 income (Dept. of HHS, 2020) A dependent student (under 24 years old) whose parent or U.S. court-appointed legal guardian lives in Georgia must prove: Moved to the state for reasons other than attending a post- secondary educational institution; Abandoned all ties to their previous state or country of residence Has taken appropriate steps to assume the responsibilities of a Georgia resident Has lived in the state for at least 12 consecutive months immediately preceding the first day of classes Is a U.S. citizen, Lawful Permanent Resident, refugee, asylee, or other eligible noncitizen as defined by Federal Title IV regulations Be claimed as a dependent on their parent or U.S. court- appointed legal guardian’s Georgia State tax return filed as a resident A dependent student of a Georgia-domiciled U.S. court- appointed legal guardian must provide evidence that the guardianship was not appointed to avoid payment of out-of- state tuition. Furthermore, a student’s eligibility to be classified as a resident also depends on his/her dependent or independent status. A dependent student is an individual under the age of 24 who receives financial support from a parent or United States court- appointed legal guardian. If you are under the age of 24 and your parent/guardian does not live in the Georgia, the chart above will help you determine if you can be considered an independent. The final approval is up to the Tuition Classification Officer to interpret your documentation to align with Board of Regents policy.
