Minutes of the 53rd Annual General Meeting

Sunday 25th October 2020, 10.30 am - 2.15 pm

1 Call to order

1.1 The masters of ceremony MPS Council member, Ms Syireen Alwi (MMPS

2496), welcomed all the attendees, introduced all the Council Members, MPS

Legal advisors and MPS Executive Director.

1.2 MPS President, Mr Amrahi bin Buang (MMPS 581) , as the Chairperson,

called the Annual General Meeting to order and thanked everyone for their

attendance.

2 Establishment of Quorum

2.1 The MPS Executive Director, Mr Lam Kai Kun (MMPS 435) informed the

house that the number of members who were present at 10.30 am was 166,

hence there was a quorum for the AGM to proceed.

2.2 Refer Appendix 1 : AGM Attendance

3 Opening remarks by Chairperson

3.1 Notice of 53rd AGM was sent out on 3rd September 2020

3.2 In the PRISMA system there are 19970 registered pharmacists out of which

17184 renewed their ARC for 2020. The ratio of government pharmacist vs

private pharmacist is 1:1.95. This means ⅓ of pharmacists are in the private

sector and ⅔ are in the government sector. MPS members are around 5000.

3.2 Recap of past activities since the last AGM. The main highlights were :

a) The MPS meet up with the previous HHM

b) The interest by the previous HHM to support mandatory prescriptions,

c) Malaysia was to host FAPA 2020; however this was postponed due to

the Covid-19 pandemic

d) The MCO affected MPS 53rd AGM date and the ROS directive was to

postpone the date to after June 2020.

e) MPS created history by having the 1st virtual National Pharmacist

Convention which was attended by 960 participants which was

officiated by the Health Minister, YB Datuk Seri Dr Adham Baba

f) On 29 September 2020 , MPS brought up 14 pharmacists related issues

in a meeting with Datin Dr Faridah Aryani, the Senior Director of

Pharmaceutical Services.

g) On 22 October 2020, MPS brought up 8 pharmacists related issues in

the meeting with the Health Minister, YB Datuk Seri Dr Adham Baba

and the top management of MOH.

3.3 International affiliation updates

a) For FAPA: we have submitted our bid to host the 2022 FAPA Congress

b) For CPA: Datuk Nancy was elected as Vice President and John Chang

was conferred an Honorary Fellowship

c) For FIP: MPS want to work with MOH to be in line with the 21 FIP goals

4 53rd AGM Agenda

4.1 Datuk Nancy Ho (MMPS 812) proposed to accept the meeting agenda for

the 53rd AGM and was seconded by Tan Yong Syn ( 5788 )

5 52nd AGM Minutes

5.1 The minutes of 52nd Annual General Meeting of the Malaysian

Pharmaceutical Society held on 28th April 2019 at Hotel Istana Kuala Lumpur

were read and proposed to be confirmed by Mr Leow Yeow Ming (MMPS 799)

and seconded by Mrs Chong Hwei Yen (MMPS 893).

6 Matters Arising from 52nd AGM

6.1 No matters arising from the minutes of the 52nd AGM

7 Emergency General Meeting (EGM) 8th December 2019

7.1 The minutes of the Emergency General Meeting of the Malaysian

Pharmaceutical Society held on 8th December 2019 at Wisma MPS, Puchong

were read and proposed to be confirmed by Jennifer Tan See Hui (MMPS

3571) and seconded by Abida Haq Binti Syed M. Haq (MMPS 767)

8 Emergency General Meeting (EGM) 15th February 2020

8.1 Question from Datuk Nancy (MMPS 812) : Does the constitution provide

for emergency or extraordinary general meetings? MPS President, En Amrahi

( MMPS 581) stated that the constitution provided for both.

8.2 Question from Jemima Ho (MMPS 3131) : Did ROS accept the constitution

amendments? Honorary Secretary, Harpreet Kaur (MMPS 4490) responded:

All amendments accepted except for the name change and this will be

addressed during item 12 and 13 of the agenda.

8.3 The minutes of the Emergency General Meeting of the Malaysian

Pharmaceutical Society held on 15th February 2020 at Wisma MPS, Puchong

were read and proposed to be confirmed by Teoh Cherh Yun (MMPS 8508)

and seconded by Manvikram Singh Gill (MMPS 14635).

9 2019 Annual Report of the Council

9.1 The MPS Annual Report 2019, Area Committee Reports, Chapter Reports

and Committee Reports was presented by the Honorary Secretary, Ms

Harpreet Kaur (MMPS 4490).

9.2 Questions, Comments & Corrections

a) Council Member, Ms Susan Pan’s attendance for Council Meeting

had a typo and this will be corrected. in the minutes. Refer Appendix

2 : Council attendance

b) The Kedah Perlis Area Committee Financial Report was missed out

and will be amended as Appendix 3: KPAC Financial Report.

c) Lim Sui Lun (MMPS 14688) Requested to provide a committee list for

the Halal Pharmaceutical Chapter. The Honorary Treasurer responded

that this will be updated into the reports.

d) Assoc Prof Dr Mogana Sundari Rajagopal (MMPS 3244) : Not all the

area committees have shared their financial reports in their annual

reports. The Honorary Treasurer explained that this is being

standardized by Honorary Secretary and Honorary Treasurer so that

the area committee reports can be audited.

e) Leow Yeow Ming (MMPS 799) : With regards to the Shopee

collaboration, does MPS have a mechanism to continuously monitor all

the pharmacies in that platform that is MPS sanctioned. The Honorary

Treasurer explained MPS is monitoring on a yearly basis whether

● There is a valid ARC

● There is a valid Poison A license

● If the pharmacist is a MPS member

f) Choe Tong Seng (MMPS 393) : What is MPS' stand on halal

pharmaceuticals? MPS President, Amrahi Buang responded it is a

national agenda on economy (exports, etc), therefore MPS input is

important especially with regards to the anti-vaxxers agenda on

vaccines.

h) The Honorary Secretary commended all the area committees,

chapters and committees who submitted their reports and thanked

them for supporting the agenda to standardize reports.

9.3 The MPS Annual Report 2019 was proposed to be confirmed by Leow

Yeow Ming (MMPS 799) and seconded by Lim Lee Ping ( MMPS 11867)

10 Audited Statement of Accounts 2019

10.1 The MPS Honorary Treasurer, Mr Jack Shen Lim (MMPS 4872) presented

the accounts for the financial year ended 31st December 2019. The financial

report was reviewed by internal auditors Mr. Abdul Aziz Jamaludin (MMPS

1812) and Mr. Kong Jiang Foong (MMPS 2106 ) as well as by external auditors

Leong Yip Ong & Co.

10.2 Question and Answer Session

a) MR Leow Yeow Ming (MMPS 799) : With more online meetings, do we

expect much savings from expenditure in the next budget?

MPS Honorary Treasurer, Mr Jack Shen Lim (MMPS 4872): From 2020

you can see that expenditure for meetings would have dropped, but

we are not sure as 2021 with the new normal being lifted we will

actually have to see whether we will be spending money on meetings,

so that’s actually a very variable, we can’t do a projection for that,

however there is also cost on online meetings, like this one, if you want

formal online meeting that we do, there is cost or expenditure to run

these meetings, and there is also a monthly cost on the ZOOM account.

So there is a reduction in expenditure, but that’s something we will

only see in this year’s report 2020.

b) Mr Choe Tong Seng (MMPS 393) : Is there any revenue from the

Shopee tie-up?

MPS Honorary Treasurer, Mr Jack Shen Lim (MMPS 4872): We do not

receive any revenue from Shopee at all. This is not a commercial tie-up,

our Shopee engagement is purely on education and verification, where

we want to bring pharmacists into all the online platforms. Just to

highlight, there is a 3-times increase in the last 5 years in online sales,

and we truly believe that pharmacists need to be there to educate the

public with regards to their health supplements.

c) Datuk Nancy Ho (MMPS 812) enquired what was the income from Interest of FD's MPS Honorary Treasurer Mr Jack Shen Lim replied this is on pg 134 and is RM144,990

d) Datuk Nancy Ho further enquired what is the breakdown for the 200k

debtors.

MPS Honorary Treasurer clarified that on page 133 of the Annual

Report, Item 9, majority debtors are RM121,350 from life membership

instalment as not pay all at once; other debtors are RM78,673 include

some of sponsorship promised in 2019 for 2020. All had been resolved

except one internal issue with MPS Kelantan which is a small amount

e) Chong Hwei Yen ( MMPS893) enquire are the financial reports audited

by external auditor?

MPS Honorary Treasurer Mr Jack Shen Lim confirmed that they are

externally audited as well as internally audited

f) Assoc Prof Dr Mogana Sundari Rajagopal (3244) enquired the

following and was clarified by the MPS Honorary Treasurer as follows:

i. What are items under media expense Rm9k not in 2018

This was PR company we engage for press release and all the PR

we did subsequently brought MPS to media attention and now

when we do press release it gets pick up,

ii. Postage increased by nearly 4k from 2018,

This is because Pos Malaysia increase their rate last year

iii. Why MPS young pharmacist chapter being allocated rm15k?

Are they not generating own income?,

It was clarified that they generate their own funds but we want

to support them with RM15k giving to YPC, and we are also

giving RM10k to myPSA for organising their internal events and

training

iv. What is the breakdown of town hall meeting rm15k expense?

This was held in Putrjaya with RM6k for general worker interns,

meeting RM728, souvenir RM2180 and travelling and

accommodation RM6202.

v. Why upkeep of building increased nearly 16 k compared to

2018?

This is because of renovation due to water flooding the

basement when it rain, and leaking from the roof.

vi. Why nearly RM30k travelling and accommodation increment

and is there a breakdown ?

This is due to normal travelling as most council are outstation

vii. The WPD Kuala Selangor travel from KL to KS increased to

about 3k?

It was clarified that there were more accommodation as we

have to go to Kuala Selangor

g) Goh See Yik (13624) enquired why is the receivables increase almost

about 3 times as compared to year 2018 ?

MPS Honorary Treasurer explained that these are receivables mean

debtors because we have more life member who pay by instalment

h) Goh See Yik (13624) asked what is our fixed deposits rate with licensed

institutions and will the interest generated enough for our future

operating expenses ?

The MPS Honorary Treasurer explained that the rate we had was for

2019. The new rate is 1.75% and some banks even below 1%. It will

not be enough for our future operating expenses.

10.3 The Audited Statement of Accounts 2019 were proposed to be accepted

by Datuk Nancy Ho (MMPS 812) ) and seconded by Leow Yeow Ming (MMPS

799) & Choe Tong Seng (MMPS 393)

For item 11-15 on the voting on resolutions and proposals:

● The Honorary Secretary, Harpreet Kaur (MMPS 4490) explained each

item in detail

● The Assistant Honorary Secretary, Tan Zhi Shan (MMPS 14569)

explained the voting method step by step before the voting process

commenced. The tabulation process and the voting closing time was

also explained.

● With regards to the membership with Majlis Bersama Kebangsaan,

members requested for clarification on the purpose of the MBK and

wanted to ensure the selection of the member who would represent

MPS would be done after a selection meeting. Council Member, Dr

Nour Hanah (MMPS 772) and MPS President, En Amrahi (MMPS 581)

assisted to clarify on the purpose of MBK.

● Many members raised questions to understand the name change in

agenda item 12 and the maintaining the BM name in agenda item 13.

The Honorary Secretary, Harpreet Kaur (MMPS 4490) explained the

ROS stand on the name change and shared DBP definition on the BM

name.

11 Vote on MPS Constitution structure amendments as per ROS instructions 11.1 The proposed structural changes to the MPS Constitution were put to a vote. 11.2 The amendments to the constitution were passed with the following votes of more than 2/3 (66.67%)

a) Agree (116， 99.1%)

b) Disagree (1, 0.9%) c) Abstain (10)

12 To vote on the change of name of the Society

12.1 The proposed name change from Malaysian Pharmaceutical Society to Malaysian Pharmacists Society was put to a vote.

12.2 The amendments to the constitution were passed with the following votes of more than 2/3 (66.67%)

a) Agree (83, 70.3%)

b) Disagree (35, 29.7%)

c) Abstain (9)

13 To vote to maintain the name of the Society in BM 13.1 The maintaining of the name Persatuan Farmasi Malaysia was put to a vote. 13.2 The amendments to the constitution were passed with the following votes of more than 2/3 (66.67%)

a) Agree (105, 89.7%) b) Disagree (12, 10.3%) c) Abstain (10)

14 To vote on a resolution that the election of Council for the year 2020 be postponed to the next AGM which is scheduled to be April 2021

14.1 The resolution was passed with the following majority votes a) Agree (123, 98.4%) b) Disagree (2, 1.6%) c) Abstain (2)

15 To vote on a resolution that the appointment of internal auditors for the year 2020 be postponed to the next AGM which is scheduled to be April 2021


16 To vote on a resolution to approve MPS to be a member of the Majlis Bersama Kebangsaan


17 Matters Arising 17.1 MPS Deputy President Mr Andrew Tan (MMPS 2083), MPS Vice President I Datin Mariani (MMPS 2498), MPS Vice President II Ms Bharati Suresh Chand (MMPS 2583), MPS YPC Chairman Mr Cedric Chua (MMPS 14880) where they

shared updates on MPS campaigns and projects, thanked members and requested for the continuous support from the members. 17.2 The Honorary Treasurer, Mr Jack Shen Lim (MMPS 4872) shared MPS Covid-19 initiatives :

a) During the 1st wave MPS Council approved funds to provide face masks to community pharmacists throughout Malaysia as a recognition that they were front liners and also because there was a shortage of quality face masks for private sector front liners.

b) During the recent spike of cases in Sabah and Labuan the Council voted to release RM 20,000 to Sabah Pharmaceutical Society to purchase PPE’s

c) The above expenses will be shared in the 2020 Financial Report 17.3 President of Sabah Pharmaceutical Society, Jemima Ho (MMPS 3131) requested to put on record the following statement : “ On behalf of Sabah Pharmaceutical Society , we will like to thank MPS for the recent COVID Funds of RM 15k to Sabah and RM 5k to WP Labuan. Thank you for your kind consideration to help your association members in Sabah and this is truly a Malaysia Spirit. Thank you very much” 17.6 Members queried if they were entitled to 4 CPD points since the AGM had gone beyond the planned hours. Answer : only 2CPD points will be awarded because AGM falls under category B3 17.7 MPS General Legal Counsel, Dato’ Dr Manjit Singh and Mr Neoh shared a congratulatory message on the well planned and well executed 53rd AGM.

18 18.1 The MPS President, En Amrahi Buang thanked everyone for attending the

53rd AGM.

18.2 The MPS 53rd AGM was adjourned at 2.15 pm

PROFESSIONAL INDEMNITY INSURANCE COVERAGE FOR PHARMACISTS

The MPS has entered into an MOU to provide Professional Indemnity Insurance Coverage for Pharmacists This MOU is between MPS, Minaris Corporate Solutions ( a registered insurance agency ) and Chubb Insurance Malaysia Berhad ( a licensed insurer ) The initial and benefits will include Professional Negligence, Vicarious Liability, Legal Representation at Inquiry, Defamation, Intellectual Property Infringement, Loss of Documents, Emergency Defence Costs, Advancement of Defence Cost, Unlimited Run Off, Unlimited Retroactive Date, Public Relation Expenses, Cyber & Privacy Infringement, Nil Excess and Good Samaritan Act As the scheme develop, more benefits will be added as in Loss Mitigation, Pharmacy Indemnity, Auto Reinstatement and Personal Accident. As the practice of pharmacist now being in the forefront more and more, it is important that a professional indemnity plan be available. For example with the expected increased exposure in the participation of the Covid-19 vaccination rollout and MQuit program. There will be an easy registration online with Product Information, Payment, Claim Notification, Policy Renewal, and Customer Service. The scheme is ready for roll out sometime end June

In 2020 Malaysia faced the Covid-19 pandemic with many movement control orders in place, including shutting down of universities. MPS CPD Chapter together with UCSI University, Faculty Of Pharmaceutical Sciences (FPS) jointly organized a virtual Pre-NPC2020 Refresher Course on Compounding. Annual Report of Malaysian Journal of Pharmacy 2020

1. Introduction

MALAYSIAN JOURNAL OF PHARMACY is a professional journal with registered International

Standard Serial Number ISSN 1675-3666 covering various aspects of pharmacy and pharmaceutical

sciences. It is published annually by the Malaysian Pharmacists Society. The goal of the journal is to

keep local pharmacists, scientists, and other allied healthcare professionals in contact with the

profession in their related fields, while promoting research and innovation. This would be a way of

cultivating closer personal and research-oriented partnerships between practitioners and the scientific

community.

The scope of this journal includes research conducted in clinical, community or laboratory-based

settings, social administration and pharmaceutical education. Relevant content from academics,

pharmacy students (final year projects), pharmaceutical industry research, and mandatory research by

the provisionally registered pharmacists (PRP) are also welcomed. Editors and the Malaysian

Pharmacists Society welcome publications in the Malaysian Journal of Pharmacy. This peer-reviewed

journal covers areas related to pharmacy in the form of Short Communication, Original Research Article,

Case Study, Review, and Book.

a. DOI – Metadata management through crossref

In order to get individual DOI for each paper, MJP has applied to crossref to be a

platform for digital object identification registration. Status of the membership is

pending. We are awaiting confirmation from crossref and MPS on this.

b. MJP metadata update in MyJurnal for consistent indexing

The metadata update in Malaysia platform will be carried out annually to ensure

content availability nationwide. This is also a minimum requirement to get MyCite

indexing which will only happen after 3 year on MyJurnal Platform.

c. Web of Science (2 years track record is required)

Quality of the paper and DOI are the keys for WoS indexing. We will apply for WoS in

2023 tentatively . Document preparation and submission will be done in June 2022

tentatively.

d. Scopus (2 years track record with 20 papers annually)

REPORT ON MPS PARTICIPATION IN THE FEDERATION OF ASIAN PHARMACEUTICAL ASSOCIATIONS (FAPA) & THE

INTERNATIONAL FEDERATION OF PHARMACY (FIP)

PREAMBLE 2020 has been a challenging year for the participation of MPS on the international stage physically but the COVID-19 pandemic has instead increased international collaboration via virtual platforms. These activities have increased international dialogue and collaboration, in particular with regards to the profession’s response to the unfolding COVID-19 pandemic over the course of the past year. This report highlights notable events through 2020.

(1) MARCH 2020 – PREPARING COMMUNITY PHARMACIES FOR THE COVID-19 PANDEMIC

In March 2020, FAPA released an expert guidance on the COVID-19 pandemic that provide guidance to community pharmacies responding to the developing situation. Areas covered includes preparations, infection prevention & control and managing pharmaceutical supply This guidance was adopted and adapted by the MPS into the COVID-19 Guidance Document for Malaysian Pharmacists released in April 2020. FAPA Secretary-General Ms. Christine Ching Benosa also served as a contributor to the MPS Guidance.

(2) MAY 2020 – PHARMACY EDUCATION DURING AND BEYOND COVID-19

In May 2020, MPS collaborated with FAPA to host the inaugural web event for the FAPA Pharmacy Education Section. Moderated by Assoc. Prof Dr. Mohd Haniki Nik Mohd, Chairperson of the FAPA Pharmacy Education Section, this forum focused on the changes, challenges and experiences of pharmacy education during and beyond the COVID-19 pandemic. Speakers for the event includes Dr Mohd Zulkefeli (Malaysia), Dr Vivienne Mak (Australai), Dr G Sumalatha (India), Dr Agung Nugroho (Indonesia), Dr Edwin Faller (Philippines) and Dr Enkhjargal Dorjbal (Mongolia)

(3) OCT 2020 – POSTPONEMENT OF FAPA CONGRESS KUALA LUMPUR 2020

Due to the prevailing conditions, the 28th FAPA Congress slated to be hosted by the MPS in Kuala Lumpur was postponed from October 2020 to April 2021. This was then further postponed to 2022 as travel restrictions remain in place. With the theme Pharmacists Building Better Health Systems, the FAPA Congress will focus on the role of pharmacists in their respective health systems and is even more relevant amidst a worldwide public health crisis. The organising committee hopes to update MPS members on the event soon.

(4) DEC 2020 – IN MEMORY OF FAPA PRESIDENT MR MOHD DANI PRATOMO

It is with great sorrow that FAPA announced the late December passing of FAPA President Mr. Mohd Dani Pratomo. He had served FAPA with great dedication for many years in various capacities and has made enormous contributions to improving the pharmacy profession. He had also been a tremendous support to MPS and our activities to highlight the role of pharmacists in Malaysia.

INTERNATIONAL FEDERATION OF PHARMACY (FIP)

(1) FEBRUARY/MARCH 2020 – FIP HEALTH ADVISORY COVID-19 PANDEMIC

On the 6th of Feb 2020, FIP released information and interim guidelines for pharmacists and the pharmacy workforce to member organisations. This guidance was updated on the 19th of March 2020. The updated guidance was adopted and adapted by the MPS into the COVID-19 Guidance Document for Malaysian Pharmacists released in April 2020. As part of a worldwide collaboration effort, MPS’ COVID-19 guidance was included into their COVID-19 information hub for both English and Bahasa Malaysia.

(2) JUNE 2020 – EXPANDING IMMUNISATION COVERAGE THROUGH PHARMACISTS

A focus of the FIP is the continued expansion of the role of pharmacists in immunisation. On the 25th of June 2020, the FIP released a resource to member organisations that highlight the roles and technical requirements for pharmacy-based vaccine related services and potential paths to implementation. The MPS is highly supportive of this and is part of this effort and has created the MPS Immunisation Advocacy Chapter for this purpose.

(3) SEPT 2020 – FIP VIRTUAL 2020

As a consequence of the COVID-19 pandemic, the annual FIP Congress hosted in Seville, Spain was postponed to 2021 (and then 2022). In its place, the FIP conducted the FIP Virtual 2020 congress. MPS was represented by En Amrahi Buang (President) and Mr Lim Jack Shen (FIP Liaison) to the FIP Council Meeting.

(4) SEPT 2020 – FIP DEVELOPMENT GOALS

After consultation with its member organisations, FIP announced 21 Development Goals that will serve as a platform for the continued development of the profession. The MPS supports this initiative and will work with FIP to translate these goals to the local context to create a roadmap for Pharmacy in 2030. The 21 goals cover the areas of (1) Academic Capacity, (2) Early Career Training Strategy, (3) Quality Assurance, (4) Advanced and Specialist Development, (5) Competency Development, (6) Leadership Development, (7) Advanced Integrated Services, (8) Working with Others, (9) CPD Strategies, (10) Equity & Equality, (11) Impact & Outcomes, (12) Pharmacy Intelligence, (13) Policy Development, (14) Medicines Expertise, (15) People-Centred Care, (16) Communicable Diseases, (17) Antimicrobial Stewardship, (18) Access to Medicines & Services, (19) Patient Safety, (20) Digital Health and (21) Sustainability in Pharmacy.

(5) ONGOING – MEMBER ORGANISATION ENGAGEMENT

FIP is conducting ongoing member organisation engagement with all their members both as part of the FIP Council and under the FIP Regional Forums. Malaysia is represented on the Western Pacific Pharmaceutical Forum (WPPF) that corresponds to the WHO Western Pacific Region. This engagement will allow FIP to support MPS activities and objectives.

2. World Pharmacists’ Day 2020 18-19/9/2020 Pharmacies - SPS organized a “Visit your pharmacist, your medicine expert” event. Public are welcomed to bring their medicine to get professional advice from pharmacists and also to bring the unused medicine to be disposed properly.

3. Covid-19 Donation Drive 1.0 25/3/20 – 5/4/20

- - SPS organized a donation for our frontliners in Sabah. We have managed to raised RM226,248.50 for our frontliners

4. Covid-19 Donation Drive 2.0 26/10/20 – 5/11/20

- - SPS organized a donation for our frontliners in Sabah for the 2nd

time. We have managed to raised RM49,800.00 for our frontliners. MPS has donated RM20,000 towards this drive and SPS has spent RM15,000 for Sabah’s frontliners and RM50,000 for Labuan Hospital.

5. Immunity in the Viral World 10/10/20 Zoom 48 SPS together with Blackmores organized a webinar entitled Immunity in the Viral World: The role of nutrients and herbs.

6. Break free from joint pain 17/10/20 Zoom 52 SPS together with DKSH organized a webinar entitled Looking beyond the cartilage building effect of the Original Crystalline Glucosamine Sulphate (Viartril-S)

7. Management of Allergic Rhinitis

24/10/20 Zoom 60 SPS together with GSK organized a talk entitled Management of Allergic Rhinitis.

8. Update in ART 5/12/20 Zoom - SPS together with SabahCare Fertility Centre organized a webinar on Update on Assisted Reproductive Technology.

TERMS OF REFERENCE: PUBLIC PHARMACISTS CHAPTER (PPC)

Introduction

The Chapter to be known as Public Pharmacists Chapter (PPC) which is based at

the registered address of the Malaysian Pharmacists Society (MPS). The Section

shall be governed by the Malaysian Pharmacists Society Constitution and Council

with the following objectives.

(i) It shall be a consultative body to the MPS, in matters pertaining to the pharmacists

in the public sector. All consultative processes, requests and decisions, which

PPC has with the government and with bodies outside the Malaysian

Pharmacists Society shall go through the MPS. Between them and to that end it

may discuss service, training and other matters, with the prior consent of the

MPS Council.

(ii) To inform pharmacists in the public sector who are not yet MPS members, of the

activities of the MPS and to encourage their involvement as members of the

MPS.

(2) Members of PPC

All MPS members by virtue of being employed in the public sector shall be deemed

members of PPC.

(3) MPS Area PPC

(i) There shall be, in each area, an area PPC Section.

(ii) PPC and Area PPC section shall be deemed to be a section of the MPS Council

and MPS Area Committee respectively and shall always be subordinate to the

MPS Council and Area Committee. The formation of the Area PPC shall be

recommended by the area concerned and approved by the Council.

(4) Management of PPC

(i) National Working Committee (NWC) of PPC shall function as the principal body

of PPC within the guidelines set out below.

(ii) Composition of the NWC of PPC

The NWC of PPC shall consist of:

Office bearers - A Chairperson - A Vice-Chairman

- An Honorary Secretary

- An Honorary Treasurer State Representatives - Each MPS Area PPC shall be entitled to

one (1) representative on the NWC of PPC

(5) NWC Meetings

(i) The NWC shall meet at least twice a year preferably at six (6) months intervals.

(ii) The Chairperson shall preside at all meetings of the NWC.

(iii) One half (1/2) of the total number of the NWC shall form a quorum.

(iii) The Notice of the NWC meeting shall be sent two (2) weeks before the meeting by the PPC Honorary Secretary.

(6) Executive Committee of PPC (Exco)

(i) The Exco shall consist of the principal PPC officials, i.e.

- A Chairperson

- A Vice- Chairperson

- An Honorary Secretary

- An Honorary Treasurer

No members of the PPC Exco shall hold the same office for more than three (3)

consecutive terms or six (6) years.

(ii) The quorum for the Exco shall be one half (1/2) of the members.

(iii) The Exco shall be in charge of the day-to-day affairs of PPC between meetings

of the PPC NWC, to carry out the mandate of the PPC NWC. (iv) The Exco shall not be competent to initiate or alter any policy decision of the

NWC except by way of a recommendation to the PPC NWC.

(v) The Exco shall meet at least four (4) times a year

(7) COMMITTEE OF PPC AND THEIR DUTIES

(i) The Chairperson

(a) The Chairperson shall take the Chair at all General Meetings of PPC and

all meetings of the PPC NWC.

(b) The Chairperson shall have the right to call meetings of Exco.

(c) The Chairperson shall have a casting vote in addition to his vote as a member.

(ii) Vice Chairperson

The Vice Chairperson will perform all the functions of the Chairperson in the absence of the Chairperson.

(iii) The Honorary Secretary

The Honorary Secretary of the National Working Committee (NWC) of PPC,

shall have the duty in consultation with the Chairperson, of calling for meetings

of PPC keeping the State MPS Area Committee informed of decisions made by

the NWC of PPC. He shall conduct all other correspondence of PPC under the

direction of NWC PPC. He shall submit the Annual Report of PPC to the MPS

Council at the end of each term.

(iv) The Honorary Treasurer

The Honorary Treasurer shall manage the allocation of funds by MPS Council

to PPC. He is to prepare a Statement of Accounts at the end of the year to the

Council and a budget for approval by MPS Council.

(8) Vacancies

(i) The NWC of PPC at its next succeeding meeting shall nominate one of its

members to act on vacancies in the NWC which are permanent, i.e. the post of

Chairperson, Vice-Chairperson, Honorary Secretary, and Honorary Treasurer.

(ii) The MPS Area PPC committee at its next succeeding meeting shall nominate

one of its members to act on a vacancy created by the resignation of the PPC

representative in the MPS Area Committee.

(9) Annual General Meeting

The PPC Annual General Meeting shall be held before 15 March of each year.

The meeting shall be in any one of the following means: physical, virtual or a

combination of both in a convenient venue decided by the Executive Committee.

(a) Notice

The notice of the PPC Annual General Meeting shall be sent to all PPC members

who are PPC in benefit at least twelve (12) weeks by email or post before the

date fixed for the PPC Annual General Meeting by the PPC Honorary Secretary

and he shall call for Resolution for discussion at the Annual General Meeting.

Any member desirous of moving any Resolution at the PPC Annual General

Meeting shall give notice in writing duly proposed and seconded to the PPC

Honorary Secretary not less than eight (8) weeks before the date of the PPC

Annual General Meeting.

(b) Agenda

(i) To adopt minutes of the previous PPC Annual General

Meeting.

(ii) To adopt the Annual Report for the year preceding.

(iii) To adopt the Statement of Accounts for the year preceding.

(iv) To elect the Office Bearers for the ensuing year.

(v) To accept and declare the various State representatives for the

ensuing year

(vi) To decide on any resolution which may have been duly submitted.

(vii) To appoint an alternative representative to the Executive Committee and Council if the Chairperson is unable to attend a meeting of either body. The said alternative representative will have the same voting rights as the Chairperson.

(c) The Honorary Secretary shall adhere to MPS Constitution in the preparation

of the PPC Annual General Meeting. (d) Any member who wishes to raise any issues, queries, or comments about the

minutes of the PPC Annual General Meeting, Annual Report, Accounts, or

any other matters listed and not listed in the Agenda of the PPC Annual

General Meeting, will need to submit his queries in writing to the PPC

Honorary Secretary at least seven (7) days before the PPC Annual General

Meeting. Any issues, queries, or comments not submitted to the PPC

Honorary Secretary in writing as specified above will not be allowed during

the PPC Annual General Meeting.

(11) Procedures for Election for PPC

(i) Election Committee The Election of the PPC Exco shall be conducted by the Elections Committee.

(ii) Nominations are called for the following post: Chairperson, Vice-Chairperson, Honorary Secretary, and Honorary Treasurer.

(iii) Nominations are accepted from the floor. Signed consent of the nominee must be presented in order to accept nominations.

(iv) Voting shall be by secret ballot (paper voting or electronic voting) as determined by the Elections Committee, at the PPC Annual General Meeting.

(v) A simple majority determines the winner. Proxy votes are not entertained.

(13) PPC FINANCIAL

(i) The financial year for PPC shall begin on the first day of January and ends on

the 31st December of each year.

(ii) The NWC PPC shall receive an allocation of funds from the MPS Council annually for its activities as a section of the MPS.

(iii) The MPS Branch PPC shall receive an allocation of funds annually from the

respective MPS Branch.

(14) GENERAL PROVISIONS REGARDING PPC

(i) Any other matter or matters not covered by these Terms of References shall be

dealt with according to the provision of the MPS Constitution.

(ii) In case of any dispute as to the interpretation, construction, rendering and meaning of all or any of these Terms of References or of any word or words contained in the Terms of Reference, the interpretation, construction, rendering and meaning determined and fixed by the Council of MPS shall be final and conclusive.

(iii) Neither PPC nor its members shall attempt to restrict or in any other manner

engage in any Trade Union activities as defined in the Trade Union Ordinance, 1959.

RESOLUTION FOR 54TH AGM Resolution: To amend the MPS Constitution with the addition of the following new clause to be inserted in the appropriate place. Clause: Add Glossary and Revision Dates Rationale: To ensure no disambiguity or misintepretation of the constitution terms and to ensure proper document control Background: In the year 2020, the constitution committee had proposed the various constitution amendments which was approved by members at the 53rd AGM. These amendments were submitted to the ROS which approved them on 3rd Dec 2020. However one of the amendments was missed out. This clause and the rationale was also already accepted and approved by members at last year AGM. In accordance to ROS requirement all amendment must be submitted with 60 days of the AGM and this date is already passed.
