This Streambed Alteration Agreement (Agreement) is entered into between theCalifornia Department of Fish and Wildlife (CDFW) and Redwood City (Permitee) asrepresented by Ahmad Haya.

RECITALS

WHEREAS, pursuant to Fish and Game Code (FGC) section 1602, Permittee notifiedCDFW on October 2, 2014 that Permittee intends to complete the project describedherein.

WHEREAS, pursuant to FGC section 1603, CDFW has determined that the projectcould substantially adversely affect existing fish or wildlife resources and has includedmeasures in the Agreement necessary to protect those resources.

WHEREAS, Permittee has reviewed the Agreement and accepts its terms andconditions, including the measures to protect fish and wildlife resources.

NOW THEREFORE, Permittee agrees to complete the project in accordance with theAgreement

PROJECT LOCATION

The proposed project sites encompass several locations in Redwood City, San MateoCounty, within Redwood Creek and its tributaries, Kensington Branch, Stulsaft Branch,Jefferson Branch and Emerald Branch, which are all within the Cordilleras Creek-Frontal San Francisco Bay Estuaries watershed and discharge into the San FranciscoBay subbasin (Exhibit A). Emerald Branch, Jefferson Branch, and Stulsaft Branchoriginate in the hills to the west of Redwood Creek. Emerald Branch and Stulsaft Branchjoin Jefferson Branch near Red Morton Park. Jefferson Branch flows into RedwoodCreek near Main Street in downtown Redwood City. Redwood Creek flows through a

culvert under U.S. Highway 101 and enters San Francisco Bay between Bair and Grecoislands. Stulsaft Branch and Jefferson Branch are labeled “Arroyo Ojo" on the USGS7.5 minute topographic map but are known as Stulsaft and Jefferson branches.

PROJECT DESCRIPTION

Under this Agreement, Permittee will conduct “routine maintenance activities”, asdescribed below, on Redwood Creek, and its tributaries, Kensington Branch, StulsaftBranch, Jefferson Branch and Emerald Branch. Routine maintenance activitiesauthorized under this Agreement shall be defined as those activities periodicallyscheduled and implemented as necessary to maintain water transport capacity andmaintain structural and functional integrity of existing concrete flood control channels.Routine maintenance activities described below are limited to the repair andrehabilitation of stormwater structures including trapezoidal and rectangular concretechannels and concrete culverts and other structures including trash racks and fenceposts within Redwood Creek and its tributaries. Exhibit B shows the amount of area tobe repaired for each category of activity described below. A total of approximately42,200 linear feet (8 miles) of creek will be maintained with approximately 12,000 linearfeet (2.2 miles) maintained per year. Routine maintenance activities will not beconducted in natural channels with natural bed and/or natural bank consisting of rock,gravel, vegetation and soil, and will not be conducted to the north of U.S. Highway 101.Specific routine maintenance activities include the following:

A. Repair Damaged Trash Rack: The trash rack will either be replaced in-kind orthe damaged rails repaired. This work will be implemented and outside of thetop-of-bank.

B. Repair Degraded Fencepost: Damaged portions of the concrete panel where thefence post is installed will be removed. New concrete will be cast in place withthe existing or new fence post and reinforced with a supplemental hairpin. Allwork will occur above the OHWM, however, workers may be required to accessthe worksite from a ladder placed within the channel bottom. The new concretewill be framed and cast in place. Once the concrete is dried the framing will beremoved.

C. Repair Spalling and Honeycomb Concrete on Panels and Inlets: Spallingconcrete is concrete that has broken up, flaked, or become pitted. Honeycombrefers to voids left in concrete due to failure of the mortar to effectively fill thespaces among coarse-aggregate particles. To repair areas identified withspalling or honeycomb concrete the damaged concrete will be removed using awire brush or sandblast to expose sound material. The exposed area will bepainted with a corrosion inhibitor and patched with a polymer modifiedcementitious mortar with aggregate. Work will be implemented using hand tools(e.g. wire brush, compressor and sandblast tool, ladder etc.). No heavyequipment will be placed within the channels.Repair sites below the OHWM or near the channel base will require temporary

dewatering. Approximately 5 linear feet and 5 square feet of spalling orhoneycomb repairs per each maintenance location will be required below theOHWM. The volume of fill material is based on the average depth of each repairtotaling 0.25 feet.

D. Repair Spalling and Corrosion (Below-Grade Culverts): The repair work willrequire reconstruction of the grating seats and inlets in general. To repair areasidentified with spalling or corrosion the damaged concrete will be removed usinga wire brush or sandblast to expose sound material. The exposed area will bepainted with a corrosion inhibitor and patched with a polymer modifiedcementitious mortar with aggregate. Work will be implemented using hand tools(e.g. wire brush, compressor and sandblast tool, ladder etc.). No heavyequipment will be placed within the channels. Approximately 5 linear feet and 5square feet of spalling or honeycomb repairs per maintenance location will berequired below the OHWM. The volume of fill material is based on the averagedepth of each repair totaling 0.25 feet.

E. Repair Soffit Missing Structural Concrete (Below-Grade Culverts): One areawithin a below-grade culvert near City Hall is missing structural concrete on thesoffit (Maintenance Location H11). In order to repair this section, this area willrequire infill of the missing soffits with a metal deck with concrete topping slab.Work will be implemented using crews with hand-tools (e.g. welding equipment,caulking gun, ladder, wire brush etc.) during low flow periods to minimize theneed to dewater. Although this work will be occurring on the ceiling well abovethe OHWM.

F. Repair Tapered Impact Deflector Panel at Culvert: Damage was found to atapered impact wall on the leading edge of the interior walls of a box culvert(Maintenance Location RW-305 & RW-050). To repair the deflector thedamaged portion will be removed as well as the existing channel invert slabapproximately one foot from the wall on each side. New concrete will be cast inplace and doweled into existing channel slab on each side. Work will beimplemented using hand tools (e.g. jackhammer, shovels, ladders, compressorsetc.). No heavy equipment will be placed within the culvert. The volume of fillmaterial is based on an average depth of 1 foot, length of 20 feet and height of 5feet to the OHWM.

G. Repair Transverse and Diagonal Panel Cracks and Longitudinal Cracks on baseof Rectangular & Trapezoidal Concrete Channel Structures: Cracks in theconcrete of widths between approximately 1/16-inch and %-inch wide will be filledwith an approved epoxy injection product. Work will be implemented using crewswith hand-tools (e.g. caulking gun, ladder, wire brush etc.) during low flowperiods to minimize the need to dewater. If dewatering is required for repairsalong the base, a cofferdam constructed of sandbags or other non-erodiblematerial will be temporarily placed upstream of the repair site. Approximately 10linear feet of cracks per maintenance location at an average width and depth of0.02 feet will occur below the OHWM.

H. Repair Transverse Cracks in Soffit (Below-Grade Culverts): Soffit refers to theceiling portion of the below-grade culvert. Cracks in the concrete of widthsbetween approximately 1/16-inch and %-inch wide shall be filled with anapproved epoxy injection product. Work will be implemented using crews withhand-tools (e.g. caulking gun, ladder, wire brush etc.) during low flow periods tominimize the need to dewater, This work will be occurring on the ceiling wellabove the OHWM.

I. Repair Out-of-Plane Offset on Wall of Trapezoidal-Concrete Channel Structure:The out-of-plane offset occurs where two panels meet and have become slightlyseparated over time. To repair the offset portions of concrete approximately 6inches to 12 inches from the offset on each side will be removed and replacedwith new concrete doweled into the existing channel slab and keyed with aflexible connection on the other side. Work will be implemented using hand tools(e.g. jackhammer, sledge hammer, shovels, ladders, compressors etc.). Noheavy equipment will be placed within the culvert. The volume of fill material isbased on an average depth of 1 foot, length of 1 foot and height of 5 feet fromthe base/bed to the OHWM.

J. Repair Out-of-Plane Offset on Wall of Rectangular-Concrete Channel: Torehabilitate the out-of-plane offset, rigid backing board and a waterproofmembrane will be placed behind the panel. To install the backing board, soilswill be excavated from behind the panel and backfilled once the backing boardand waterproof membrane is installed. Implementation will require working fromthe top of the bank and excavating behind the panel. Work for this repair will notbe conducted below the OHWM and will not result in fill.

K. Replace Trapezoidal-Concrete Channel Panel: The trapezoidal-concretechannel panels were constructed in approximately 30-foot-long-sections. Panelsections with excessive cracking and excessive offsets will be replaced in-kind.The concrete base will remain in place. Removal of the existing wall will requirethe use of heavy equipment such as a back hoe and/or jackhammer. Once thepanel is removed temporary shoring may be required where existing residentialproperties abut the top of the bank. Once the existing panel is removed a cast-in-place concrete panel on a shallow slab foundation will be installed. Acofferdam will be in place upstream of the work area. For each 30-foot section oftrapezoidal-concrete channel panel replaced, it is estimated that 15 cy ofconcrete will be required below the OWHM. A cofferdam will also be placeddownstream to prevent any water from permeating upstream into the work site.

L. Replace Rectangular-Concrete Channel Section: Rectangular-concrete channelsections were constructed in approximately 75 foot sections. Sections withexcessive cracking and excessive offsets will be replaced in-kind. Removal ofthe existing section will require the use of heavy equipment such as a back hoeand/or jackhammer. Once the section is removed, temporary shoring may berequired where existing residential properties abut the top of bank. Once theexisting section is completely removed cast-in-place rectangular-channel

sections will be installed. For each 75-foot section of rectangular-concrete panelreplaced it is estimated that 37.5 cy of concrete will be required below theOHWM. A cofferdam will be in place upstream of the work area. A cofferdamwill also be placed downstream to prevent any water from permeating upstreaminto the work site.

M. Trash cleanup: Removal of non-natural materials from the flood control channelswith hand tools including come-along cable pullers.

PROJECT IMPACTS

Existing fish or wildlife resources the routine maintenance activities could potentiallysubstantially adversely affect include, but are not limited to: nesting birds; roosting bats;water quality and riparian vegetation.

The adverse effects the project could have on the fish or wildlife resources identifiedabove, without implementation of the Measures to Protect Fish and Wildlife Resourcesspecified below include: change in PH, short term release of contaminants; disruption tonesting and migratory birds and roosting bats from project activities and disturbance towildlife associated with construction noise.

MEASURES TO PROTECT FISH AND WILDLIFE RESOURCES

1. Administrative Measures

Permittee shall meet each administrative requirement described below.

1.1 Documentation at Project Site. Permittee shall make the Agreement,any extensions and amendments to the Agreement, and all relatednotification materials and California Environmental Quality Act(CEQA) documents, readily available at the project site at all timesand shall be presented to CDFW personnel, or personnel fromanother state, federal, or local agency upon request.

1.2 Providing Agreement to Persons at Project Site. Permittee shallprovide copies of the Agreement and any extensions andamendments to the Agreement to all persons who will be working onthe project at the project site on behalf of Permittee, including but notlimited to contractors, subcontractors, inspectors, and monitors.

1.3 Notification of Conflicting Provisions. Permittee shall notify CDFW ifPermittee determines or learns that a provision in the Agreementmight conflict with a provision imposed on the project by anotherlocal, state, or federal agency. In that event, CDFW shall contactPermittee to resolve any conflict.

1.4 Project Site Entry. Permittee agrees that CDFW personnel mayenter the project site at any time to verify compliance with theAgreement.

1.5 Additional Measures. As a result of any field inspection, CDFW mayrequire that additional measures be applied to specific activities toprotect sensitive biological resources. Such measures may beamended into this Agreement with the agreement of both parties, orif an exception to authorized activities is identified, Permittee may beasked to submit separate written notification to CDFW pursuant toCondition 1.7, below.

1.6 Authorized Routine Maintenance Activities. Only those activitiesspecifically described in the Project Description shall be conductedunder this Agreement.

1.7 Exceptions to Authorized Activities. Permittee shall submit separatewritten notification (Forms FG 2023 and FG 2024) pursuant toSection 1602 of the FGC, together with the required fee prescribed inthe CDFW Streambed Alteration Agreement fee schedule, andotherwise follow the normal notification process prior to thecommencement of work activities in all cases where one or more ofthe following conditions apply:

■ The proposed work does not meet the criteria established forroutine maintenance activities in the Project Description of thisAgreement;

■ The nature of the proposed work is substantially modified from thework described in the Project Description of this Agreement;

■ CDFW advises Permittee that conditions affecting fish and wildliferesources have substantially changed at a specified work site orthat such resources would be adversely affected by the proposedmaintenance activity.

1.8 Exhibit C. Exhibit C shall be updated as warranted on an annualbasis with the annual notification.

1.9 Unauthorized Take. This Agreement does not authorize the take ofany State or federally listed threatened species, endangeredspecies, or candidate species. If CDFW determines, or Permitteefinds that there are such species on the work site, Permittee shallnotify CDFW, US Fish and Wildlife Service (USFWS), and/orNational Oceanic Atmospheric Association, National Marine

Fisheries Service (NMFS) as appropriate. Permittee shallimmediately cease work until CDFW and other applicable agenciesdeem that the concern over special status species has beenresolved. If a project could result in take of a listed species,additional analyses under CEQA may be necessary and a separatenotification for a standard Agreement should be submitted for thatproject.

1.10 CNDDB Forms. If any sensitive species are observed in projectsurveys, the Permittee shall submit California Natural Diversity DataBase (CNDDB) forms to the CNDDB for ail pre-construction surveydata within five working days of the sightings, and provide CDFWBay-Delta Region with copies of the CNDDB forms and survey maps.

2. Avoidance and Minimization Measures

To avoid or minimize adverse impacts to fish and wildlife resources identified above,Permittee shall implement each measure listed below.

2.1 Concrete Only Channels. Routine maintenance activities will not beconducted in any natural channels with natural bed and/or naturalbank consisting of rock, gravel, vegetation and soil.

2.2 Seasonal Work Periods. The work period for completing activitieswithin the stream zone shall be limited to the following:

2.2.1 Work within all the tributaries to Redwood Creek andRedwood Creek downstream to the intersection of MainStreet and Jefferson Avenue (where tidal influence begins)shall be limited to April 15 to October 31.

2.2.1.1 If work needs to be conducted beginning April 1,Permittee shall submit a written request for a workperiod variance to CDFW as described in Measure2.2.3. by March 20. Work variances between April1 and April 15 may be approved only in thislocation.

2.2.2 Work within Redwood Creek from the intersection of MainStreet and Jefferson Avenue downstream to Bradford Streetshall be limited to June 1 to October 31.

2.2.3 Work Period Modification. If Permittee needs more time tocomplete project activities, work may be authorized outsideof the work period as stated in Measure 2.2.1 and 2.2.2 and

extended on a day-to-day basis by CDFW representative,Suzanne Deleon, at [email protected], (831)440-9433, or if unavailable, through contact with the CDFWBay Delta Regional Office by mail, phone (707-944-5500) orfax (707-944-5553). Permittee shall submit a written requestfor a work period variance to CDFW for approval at leastseven (7) calendar days prior to October 31. The workperiod variance request shall: 1) describe the extent of workalready completed; 2) detail the activities that remain to becompleted; 3) detail the time required to complete each ofthe remaining activities; and 4) provide photographs of boththe current work completed and the proposed site forcontinued work. Work period variances are issued at thediscretion of CDFW. CDFW will review the written request towork outside of the established work period and may requireadditional measures to protect fish and wildlife resources asa condition for granting the variance. Any additionalmeasures shall be made part of this Agreement.

2.3 Completion by End of Seasonal Work Period. No project shall beinitiated unless there is a high likelihood that it can be completedbefore the end of the seasonal work windows designated inMeasures 2.2.1 and 2.2.2. After September 15 of each year,projects that have not been started or are still underway shall beevaluated to ensure they can be completed before the end of theseasonal work period. Those projects unlikely to be completedbefore the end of the seasonal work windows shall not be started.

2.4 Weather Forecast. Permittee shall monitor the 72-hour forecast fromthe National Weather Service (http://www.nws.noaa.gov). Whenthere is a forecast of more than 40% chance of rain, or at the onsetof unanticipated precipitation, the Permittee shall remove allequipment from the creek zone, shall implement erosion andsediment control measures, and all Project activities shall cease.

2.5 Dry Out Period. No work shall occur during a dry out period of 24hours after a % inch or more of precipitation has fallen.

2.6 No Equipment in Wetted Areas. No heavy equipment shall beoperated within the active creek (i.e. wetted channel) except in orderto divert water around the project site if necessary. No heavyequipment shall be operated in other wetted areas such as ponds orwetlands without prior written approval from CDFW.

2.7 Tidallv Influenced Area. Work within any tidally influenced area shallbe completed at low tide periods only. All equipment shall be out ofthe channel prior to the incoming tide.

2.8 Concrete - Primary Containment. Permittee shall install thenecessary containment structures to control the placement of wetconcrete and to prevent it from entering into the stream channeloutside of those structures. No concrete shall be poured within thehigh flow line if the 15-day weather forecast indicates any chance ofrain.

2.9 Concrete -Designated Monitor. At all times when Permittee ispouring or working with wet concrete, there shall be a designatedmonitor to inspect the containment structures and ensure that noconcrete or other debris enters into the channel outside of thosestructures. Runoff from the concrete shall not be allowed to enterthe stream channel at any time.

2.10 Isolate Poured Concrete for 30 Days. If feasible, poured concreteshall be excluded from the wetted channel for a period of 30 daysafter it is poured. During that time the poured concrete shall be keptmoist, and runoff from the concrete shall not be allowed to enter alive stream. CDFW-approved commercial sealants may be appliedto the poured concrete surface where difficulty in excluding waterflow for a long period may occur. If sealant is used, water shall beexcluded from the site until the sealant is dry.

2.11 Concrete Curing Alternative. If rain does occur after pouring orconcrete cannot be excluded from the wetted channel for a period of30 days, the Permittee shall monitor the pH of any water that hascome into contact with the poured concrete. If this water has a pH of9.0 or greater, the water shall be pumped to a tanker truck or to alined off-channel basin and allowed to evaporate or be transported toan appropriate facility for disposal. During the pH monitoring period,all water that has come in contact with poured concrete shall beisolated and not allowed to enter the water or otherwise come incontact with fish and other aquatic resources. The water shall beretested until pH values become less than 9.0. Once this has beendetermined, the area no longer needs to be isolated. Results of pHmonitoring shall be made available to CDFW upon request. A non¬toxic substance that can buffer the pH shall be made available onsite to use if any contamination to water occurs.

2.12 CDFW-Approved Qualified Biologist(s) and Biological Monitor(s).Within a minimum of 30 days prior to initiating species surveys withinthe Project area, Permittee shall submit to CDFW for approval, the

names and resumes of all qualified biologists and biological monitorsinvolved in conducting surveys and/or monitoring work.

A qualified biologist is an individual who shall have a minimum of fiveyears of academic training and professional experience in biologicalsciences and related resource management activities, with aminimum of two survey seasons years (for e.g. two seasons duringthe blooming season of sensitive plants) conducting surveys foreach species that may be present within the Project area.

A biological monitor is an individual who shall have academic andprofessional experience in biological sciences and related resourcemanagement activities as it pertains to this Project, experience withconstruction-level biological monitoring, be able to recognize speciesthat may be present within the Project area, and be familiar with thehabits and behavior of those species.

2.13 Designation of Work Area. Prior to maintenance activities in naturalcreeks or where access may occur near riparian vegetation, abiological monitor or qualified biologist shall clearly mark/flag or erecttemporary construction fencing to designate the work area and todelineate the areas that shall be avoided. In the concrete linedchannels, the contractor can clearly mark the project areaboundaries. The boundaries shall be inspected on a regular basis toensure that work has remained within the marked boundaries. If oneor more boundary(ies) has/have been violated, work shall cease untilPermittee has taken appropriate action to ensure there is norecurrence of the trespass. Flagging and/ or temporary constructionfencing shall be removed immediately after the completion ofconstruction work.

2.14 Narrow Width Trail. Where necessary, Permittee may clear a narrowwidth trail to provide vehicular access to a work site. Vegetationremoval shall be limited to the minimum amount necessary toprovide access.

2.15 Vegetation Removal. Vegetation shall not be removed orintentionally damaged beyond the narrow width trail for access.Woody debris, trees, or shrubs greater than 4 inches in diameter atbreast height on top of the bank shall not be removed unlesspreviously approved by CDFW.

2.16 Limitations on Vegetation Removal. The disturbance or removal ofvegetation shall not exceed the minimum necessary to completemaintenance activities. Precautions shall be taken to avoid other

damage to vegetation by people or equipment Branches and/orlimbs overhanging the water flows shall be properly pruned.

2.17 Disposal of Invasive Plant Material. Invasive plant material removedduring work activities shall be bagged and appropriately incineratedor disposed of in a landfill or permitted composting facility.

2.18 No Project Activities within Flowing or Standing Water. Permitteeshall make every effort to carry out routine maintenance activitieswhen the channel is dry. If this is not possible, work must beperformed in isolation from the flowing stream. To isolate the workarea, water tight coffer dams shall be constructed upstream of thework area and water diverted through a suitably sized pipe fromupstream of the coffer dam and discharged downstream of the workarea. Coffer dams shall be constructed of a non-erodible materialwhich does not contain soil or fine sediment. Coffer dams and thestream diversion system shall remain in place and functionalthroughout the construction period. If the coffer dams or streamdiversion fail, they shall be repaired immediately. Normal flows shallbe restored to the affected stream immediately upon completion ofwork at that location. As an alternative for portions of the channelthat contain small isolated ponded areas and/or where a coffer damis not practicable, the Permittee may deploy tarps or catchmentdevices, around the concrete removal and repair sites to prevent anydebris or concrete shavings from entering the ponded area. Pumpsmay be used to pump isolated ponded water away from the workzone to pump water downstream when using a cofferdam. A smallpump can be used to remove any small puddles or areas of nuisancewater No other diversion method shall be used without authorizationof CDFW. If another diversion method is preferred, the Permitteemust submit a plan detailing the desired diversion method.Authorization of any other diversion method shall be at the discretionof CDFW.

2.19 Check for Stranded Aquatic Life. The biological monitor or qualifiedbiologist shall check daily for stranded aquatic life as the water levelin the dewatering area drops. All reasonable efforts shall be made tocapture and move all stranded aquatic life observed in the dewateredareas. Capture methods may include fish landing nets, dip nets,buckets and by hand. Captured aquatic life shall be releasedimmediately in the closest body of water adjacent to the work site.This measure does not allow for the take or disturbance of any stateor federally listed species.

2.20 Catchment Devices. When working above OHWM, the Permitteeshall deploy tarps or catchment devices, around the concrete

removal and repair sites to prevent any debris or concrete shavingsfrom entering the creek whether the site is dewatered or not. Thesedevices shall be maintained throughout all phases of the excavationand construction activities.

2.21 Spoils. Concrete, debris or other construction material shall not beplaced where it could enter the stream. Spoils shall not be placedover riparian or wetland vegetation except as specifically noticed toand accepted by CDFW.

2.22 Removal of Trash and Debris. Permittee shall remove all rawconstruction materials and wastes from work sites following thecompletion of maintenance activities. Food-contaminated wastesgenerated during work shall be removed on a daily basis to avoidattracting predators to work sites. All temporary fences, barriers,and/or flagging shall be completely removed from work sites andproperly disposed of upon completion of maintenance activities.Permittee or its contractors shall not dump any litter or constructiondebris within the riparian/stream zone.

2.23 Staging and Storage Areas. Building materials and/or constructionequipment shall not be stockpiled or stored where they could bewashed into the water or where they will cover aquatic or riparianvegetation.

2.24 Equipment over Drip-pans. Staging and storage areas forequipment, materials, fuels, lubricants and solvents shall be locatedaway from the wetted areas. Stationary equipment such as motors,pumps, generators, compressors and welders, located within oradjacent to the creek shall be positioned over drip-pans.

2.25 Maintenance of Vehicles. Any equipment or vehicles driven and/oroperated adjacent to the creek areas shall be checked andmaintained daily to prevent leaks of materials that if introduced towater could be deleterious to aquatic life, wildlife or riparian habitat.Vehicles must be moved away from the stream prior to refueling andlubrication.

2.26 Hazardous Materials. Debris, soil, silt, bark, slash, sawdust, rubbish,creosote-treated wood, raw cement/concrete or washings thereof,asphalt, paint or other coating material, oil or other petroleumproducts, or any other substances which could be hazardous toaquatic life, wildlife, or riparian habitat resulting from the projectrelated activities shall be prevented from contaminating the soiland/or entering the waters of the State.

2.27 Spill Cleanup. Permittee shall begin the cleanup of all spillsimmediately. CDFW shall be notified immediately by the Permitteeof any spills and shall be consulted regarding cleanup procedures.The Permittee shall have all spill clean-up equipment on site duringconstruction.

2.28 Spill Containment. All activities performed in or near a stream shallhave absorbent materials designated for spill containment and clean¬up activities on-site for use in an accidental spill. The Permittee shallimmediately notify the California Emergency Management Agency at1-800-852-7550 and immediately initiate the clean-up activities.CDFW shall be notified by the Permittee and consulted regardingclean-up procedures.

2.29 Debris and Waste Disposal. The contractor shall not dump any litteror construction debris within the project area. Ail such debris andwaste shall be picked up daily and properly disposed of at anappropriate site.

2.30 Change of Conditions. If, in the opinion of CDFW, conditions arise,or change, in such a manner as to be considered deleterious to thestream or wildlife, operations shall cease until corrective measuresapproved by CDFW are taken.

Species Avoidance Measures

Raptors, Birds and Bats

2.31 Nesting Bird Survey. For maintenance activities requiring heavyequipment scheduled during the nesting season of raptors andmigratory birds, a focused survey for active nests of such birds shallbe conducted by the qualified biologist within 15 days prior to thebeginning of project-related activities. Surveys shall be conducted inall suitable habitat located at project work sites and in staging andstorage areas. The minimum survey radii surrounding the work areashall be the following: i) 250 feet for passerines; ii) 500 feet for othersmall raptors such as accipiters; iii) 1,000 feet for larger raptors suchas buteos. The bird survey methodology and the results of thesurvey shall be submitted to the CDFW prior to commencement ofProject activities.

Nesting seasons shall be defined as followed: i) March 15 to August30 for smaller bird species such as passerines; ii) February 15 toAugust 30 for raptors.

2.32 Active Nests. If active nests are found, the Permittee shall consultwith the CDFW and the USFWS regarding appropriate action tocomply with the Migratory Bird Treaty Act of 1918 and the FGC. If alapse in project-related work of 15 days or longer occurs, anotherfocused survey shall be conducted before project work is reinitiated.If active nests are found, the Permittee shall consult with the CDFWand the USFWS prior to resumption of project activities.

2.33 Active Nest Buffers. Active nest sites shall be designated as“Ecologically Sensitive Areas" and protected (while occupied) duringproject activities with the establishment of a fence barriersurrounding the nest site. The minimum distances of the protectivebuffers surrounding each identified nest site shall be the following: i)500 feet for large raptors such as buteos; ii) 250 feet for smallraptors such as accipiters; iii) 250 feet for passerines. A biologicalmonitor or qualified biologist shall monitor the behavior of the birds(adults and young, when present) at the nest site to ensure that theyare not disturbed by project-related activities. Nest monitoring shallcontinue during project-related construction work until the younghave fully fledged, are no longer being fed by the parents and haveleft the nest site, as determined by a biological monitor.

2.34 Nesting Habitat Removal or Modification. No trees or shrubs shallbe disturbed that contain active bird nests until all eggs havehatched, and young have fully fledged (are no longer being fed bythe adults, and have completely left the nest site). To avoid potentialimpacts to tree or shrub-nesting birds, any trimming or pruning oftrees or shrubs shall be conducted during the time period ofSeptember 16 to February 14. No habitat removal or modificationshall occur within the Ecologically Sensitive Area fenced nest zoneeven if the nest continues to be active beyond the typical nestingseason for the species (refer to Measure 2.31), until the young havefully fledged and will no longer be adversely affected by the project.

2.35 Bat Avoidance. The qualified biologist shall conduct a habitatassessment for bats at work sites where culverts, bridges andstructures would be disturbed. The habitat assessment shall includea visual inspection of features within 50 feet of the work area forpotential roosting features (bats need not be present) no more than48 hours prior to disturbance of such features. Habitat features foundduring the survey shall be flagged or marked. If bat habitat isdetected during the habitat assessment, CDFW shall be notifiedimmediately. CDFW reserves the right to provide additionalprovisions to this agreement in the event that roosting bats arefound. Permittee shall not attempt to directly disturb (e.g. shake,prod) roosting features

2.36 Stop Work Authority. The biological monitors or qualified biologistshall have the responsibility and authority of stopping the proposedproject if any crews or personnel are not complying with theprovisions outlined in this Agreement.

3. Reporting Measures

Permittee shall meet each reporting requirement described below.

3.1 Notification of Proposed Activities. Permittee shall provide CDFWwritten notification of proposed routine maintenance activities to beperformed in the upcoming year by February 1 each year. Thewritten notification of proposed routine maintenance activities shallinclude:• Detailed description of project activity including length and width

of impact area; volume and type of material to be placed orremoved.

• Site location, including stream name.• Site map with project impacts clearly delineated, such as,

ingress, egress, and staging areas.• The earliest commencement date and estimated completion

date.• Potential presence of special status species.• Surveys to be conducted; include protocols and/or methodology

to be used• Spatially referenced pre-project photos.

3.2 Annual Notification. CDFW shall append annual notification reportsof proposed maintenance activities to this Agreement. Forstreamlined tracking, Permittee shall label annual notification reportsaccording to the following convention: Exhibit D~[year] (e.g. ExhibitD-2015, Exhibit D-2016).

3.3 Additional Sites. Permittee may notify CDFW of work at additionalsites (in addition to the sites described in Project Description andshown in Exhibit A) if the proposed work fits the definition of routinemaintenance, as specified in the Project Description. Work atadditional sites may be submitted as described above in Measure3.1.

3.4 Annual Reports for Completed Projects. On an annual basis,Permittee shall provide CDFW written notification of maintenanceprojects completed. Annual reports shall include the project

identification (site name, stream name and location), a brief projectdescription, and the appropriate fee from the current CDFWStreambed Alteration Agreement Fee Schedule for work completedunder this Agreement based upon the number of projects completedin the reporting period. The annual report is due on December 15 ofeach year. A report shall be submitted to CDFW regardless ofwhether work was completed. CDFW may terminate this Agreementif reports and fees are not submitted by this deadline.

3.5 Bird Survey Results. Permittee shall submit to CDFW prior tocommencement of Project Activities, the bird survey methodologyand results. Refer to Notification Number 1600-2014-0373-R3 whensubmitting the report to CDFW.

3.6 Notification to the California Natural Diversity Database (CNDDB). Ifany listed, rare, or special status species are detected during projectsurveys or on or around the project site during covered activities, thePermittee shall submit CNDDB Field Survey Forms to CDFW in themanner described at the CNDDB website(http://www.wildlife.ca.qov/bioqeodata/cnddb/submittina data to cnddb.asp) within 14 working days of the sightings. Copies of suchsubmittals shall also be submitted to the CDFW regional office asspecified below.

3.7 List of Nonnative Species. Permittee shall submit to CDFW withintwo weeks of project completion, a list of location and species for anynonnative invasive species found in the Project area.

LIABILITY

Permittee shall be solely liable for any violations of the Agreement, whether committedby Permittee or any person acting on behalf of Permittee, including its officers,employees, representatives, agents or contractors and subcontractors, to complete theproject or any activity related to it that the Agreement authorizes.

This Agreement does not constitute CDFW’s endorsement of, or require Permittee toproceed with the project. The decision to proceed with the project is Permittee’s alone.

SUSPENSION AND REVOCATION

CDFW may suspend or revoke in its entirety the Agreement if it determines thatPermittee or any person acting on behalf of Permittee, including its officers, employees,representatives, agents, or contractors and subcontractors, is not in compliance with theAgreement.

Before CDFW suspends or revokes the Agreement, it shall provide Permittee writtennotice by certified or registered mail that it intends to suspend or revoke. The noticeshall state the reason(s) for the proposed suspension or revocation, provide Permitteean opportunity to correct any deficiency before CDFW suspends or revokes theAgreement, and include instructions to Permittee, if necessary, including but not limitedto a directive to immediately cease the specific activity or activities that caused CDFWto issue the notice.

ENFORCEMENT

Nothing in the Agreement precludes CDFW from pursuing an enforcement actionagainst Permittee instead of, or in addition to, suspending or revoking the Agreement.

Nothing in the Agreement limits or otherwise affects CDFW's enforcement authority orthat of its enforcement personnel.

OTHER LEGAL OBLIGATIONS

This Agreement does not relieve Permittee or any person acting on behalf of Permittee,including its officers, employees, representatives, agents, or contractors andsubcontractors, from obtaining any other permits or authorizations that might berequired under other federal, state, or local laws or regulations before beginning theproject or an activity related to it.

This Agreement does not relieve Permittee or any person acting on behalf of Permittee,including its officers, employees, representatives, agents, or contractors andsubcontractors, from complying with other applicable statutes in the FGC including, butnot limited to, FGC sections 2050 etseq. (threatened and endangered species), 3503(bird nests and eggs), 3503.5 (birds of prey), 5650 (water pollution), 5652 (refusedisposal into water), 5901 (fish passage), 5937 (sufficient water for fish), and 5948(obstruction of stream).

Nothing in the Agreement authorizes Permittee or any person acting on behalf ofPermittee, including its officers, employees, representatives, agents, or contractors andsubcontractors, to trespass.

AMENDMENT

CDFW may amend the Agreement at any time during its term if CDFW determines theamendment is necessary to protect an existing fish or wildlife resource.

Permittee may amend the Agreement at any time during its term, provided theamendment is mutually agreed to in writing by CDFW and Permittee. To request anamendment, Permittee shall submit to CDFW a completed CDFW “Request to AmendLake or Streambed Alteration” form and include with the completed form payment of thecorresponding amendment fee identified in CDFW’s current fee schedule (see Cal.Code Regs., tit. 14, §699.5).

TRANSFER AND ASSIGNMENT ;

This Agreement may not be transferred or assigned to another entity, and any purportedtransfer or assignment of the Agreement to another entity shall not be valid or effective,unless the transfer or assignment is requested by Permittee in writing, as specifiedbelow, and thereafter CDFW approves the transfer or assignment in writing.

The transfer or assignment of the Agreement to another entity shall constitute a minoramendment, and therefore to request a transfer or assignment, Permittee shall submitto CDFW a completed CDFW “Request to Amend Lake or Streambed Alteration” form

and include with the completed form payment of the minor amendment fee identified inCDFW’s current fee schedule (see Cal. Code Regs., tit. 14, § 699.5).

EXTENSIONS

In accordance with FGC section 1605(b), Permittee may request one extension of theAgreement, provided the request is made prior to the expiration of the Agreement’sterm. To request an extension, Permittee shall submit to CDFW a completed CDFW“Request to Extend Lake or Streambed Alteration" form and include with the completedform payment of the extension fee identified in CDFW’s current fee schedule (see Cal.Code Regs., tit. 14, § 699.5). CDFW shall process the extension request in accordancewith FGC 1605(b) through (e).

If Permittee fails to submit a request to extend the Agreement prior to its expiration,Permittee must submit a new notification and notification fee before beginning orcontinuing the project the Agreement covers [FGC, §1605, subd. (f)].

EFFECTIVE DATE

The Agreement becomes effective on the date of CDFW’s signature, which shall be: 1)after Permittee’s signature; 2) after CDFW complies with all applicable requirementsunder the California Environmental Quality Act (CEQA); and 3) after payment of theapplicable FGC section 711.4 filing fee listed athttp://www.wildlife.ca.qov/habcon/ceqa/ceqa chanqes.html.

TERM

This Agreement shall expire on December 31, 2020 unless it is terminated or extendedbefore then. All provisions in the Agreement shall remain in force throughout its term.Permittee shall remain responsible for implementing any provisions specified herein toprotect fish and wildlife resources after the Agreement expires or is terminated, as FGCsection 1605(a)(2) requires.

AUTHORITY

If the person signing the Agreement (signatory) is doing so as a representative ofPermittee, the signatory hereby acknowledges that he or she is doing so on Permittee’sbehalf and represents and warrants that he or she has the authority to legally bindPermittee to the provisions herein.

AUTHORIZATION

This Agreement authorizes only the project described herein. If Permittee begins orcompletes a project different from the project the Agreement authorizes, Permittee maybe subject to civil or criminal prosecution for failing to notify CDFW in accordance withFGC section 1602.

Below is a summary of Project maintenance activities.

The City of Redwood City contracted with an engineering firm to document deficiencies of structureswithin Redwood Creek and its tributaries. The engineering firm documented deficiencies withinrectangular-concrete channel structures, trapezoidal-concrete channels, below-grade concreteculverts (e.g. underground box culverts), and at points between differing types of structures referred toin this report as “transitions points”.

Refer to the USACE PCN, Section 2.4 (Attachment 2 CD) for a discussion of typical deficienciesfound within the structures and a description of how they would be repaired and/or rehabilitated.Included in the USACE PCN, Table 1 lists the type of repair and linear distance and cubic yard of fillmaterial. All maintenance work will be limited to the concrete channels to avoid impacts to water quality andaquatic resources (e.g. invertebrates, vegetation etc.). During the late spring, summer, and early fallthe concrete channels are either dry or have minimal nuisance water (urban runoff) flowing throughthem. It is very unlikely that fish could access the concrete channels during the late spring, summer,and early fall due to the lack of water flow within the concrete channels.

From Bradford Street, for approximately six City blocks, Redwood Creek flows underground in aconcrete box culvert (refer to USACE PCN Figure 4) which acts as a barrier or impediment to fishmigration upstream. Additionally, spawning habitat is not available and foraging habitat is marginal.During the late spring, summer, and early fall the concrete channels are either dry or have minimalnuisance water (overflow from lawn watering, car washing on street, etc.) flowing through them. It isvery unlikely that fish could access the concrete channels during the late spring, summer, and earlyfall due to the lack of water flow within the concrete channels and underground barriers. Therefore,with the implementation of the avoidance, minimization and BMPs, mitigation is not warranted.
