In the last year, Luis Fernando Iberico Castañeda has been in charge of the defense of corporate clients and mainly of mining companies. He has obtained important results, among which we can mention the case of Río Ragre of the company Volcan Compañía Minera, where it was established that the general manager and senior officials of a mining company could only be held criminally liable for acts that they are under their functional scope. With this decision, the process concluded in favor of the general manager and the operations manager of the company in question. Luis Fernando Iberico Castañeda was in charge of preparing the cassation appeal and performing the oral arguments at the Supreme Court. Another relevant case is that of Laguna Shegue (Volcan Compañía Minera), where he managed to have the criminal judge acquit the general manager and the environmental officers of the company, by judicially establishing that in order to hold criminal liability for the level of pollution in a lagoon, it had to be declared so by a competent state entity and not just any entity. In this case, Luis Fernando Iberico Castañeda was in charge of the defense of the company's officers, which involved both the design of the legal strategy and their defense in court. www.ccfirma.com
