Sentencing ReformSentencing reform

must be a priority in thecoming months alongwith greater reliance onalternatives such as drugcourts, mental healthcourts and other special-ty courts. The Chief Justice

expressed her belief thatGeorgia can maintainthe safety of its citizens,reduce recidivism andsave money, if state poli-cy-makers come togetherto enact reform.

Once a novelty in the state,Georgia’s accountability courts havebecome a model for the nation, theChief Justice told those assembled.Drug, DUI, Mental Health, andveterans courts have made the pub-lic safer by breaking the cycle ofcrime. In the civil arena, BusinessCourts are proving effective and effi-cient in handling complex businesslitigation.

As Chief Justice Hunstein notedin her speech to the GeneralAssembly, our state leads all othersin its rate of correctional control;yet, we have a cheaper, more effec-tive alternative for offenders whosecrimes are tied to alcohol or drugabuse. Drug and DUI Courts com-bine judicial oversight with commu-nity supervision, therapeutic inter-vention and frequent drug testing toalter the individual’s behavior.Currently 37 of the 49 judicial cir-cuits in Georgia have established atleast one accountability court thatfocuses on behavioral change. 2011 Time & Motion Study

The Judicial Workload AssessmentCommittee will conduct a new Timeand Motion Study to precisely meas-ure the workload of the superiorcourts. For the first time, judges pre-siding over accountability courts willuse timesheets specific to those calen-dars, as well as recording time spenton more traditional case-types. Allsuperior court judges are being askedto participate in the month-longstudy.

Training for judges will take placein February; actual timekeeping willbe March 1 to March 31. The AOCresearch staff will analyze the timeand motion data for presentation bythe Workload Assessment Committeeat the August 2011 Judicial Councilmeeting.

2011 Legislation

The Judicial Council voted to sup-port legislative measures as follows:1) rewrite of Title 27, the EvidenceCode of Georgia; 2) authorize theChief Justice to extend the durationof a judicial emergency order duringa public health emergency; 3) allowDATE fines to be assessed on addi-tional criminal offenses; 4) authorizecreation of mental health courts; 5)remove requirement for rehearingson certain decisions by associatejuvenile court judges; 6) allow modi-fication of certain child custodyrestrictive orders; 7) authorize theMagistrate Courts Training Councilto establish requirements for annualtraining hours; 8) provide for noticeof show cause hearings on GoodBehavior bond applications.

Jury reform legislation has alsobeen endorsed by the JudicialCouncil and the State Bar ofGeorgia.

AOC Leaner, More Focused

The AOC is now organized intothree line divisions: Court Services,Information & Technology, andFinancial Services with a total of 74staff positions. Over the past eigh-teen months the Director has re-eval-uated agency goals and put in place aleaner, more focused staff configura-tion. During this same period theOffice of Dispute Resolution and theGeorgia Commission on FamilyViolence have become part of theAOC.

Since FY10 the Judicial Councilbudget unit has absorbed a 30%reduction in state-funded positions;AOC has seen a 26% reduction instate-funded positions while agencysub-programs have seen a 60%reduction in state-funded positions.The estimated annual cost savings ofthese changes is roughly $282,000.

ward with this model and pursuefunding for more accountabilitycourts.

For many citizens either sub-stance abuse or untreated mental ill-ness is often a pathway into thecriminal justice system. Since thenation’s first drug court was launchedin the late 80’s, the accountabilitycourt model has spawned some2,500 drug courts. Georgia now has69 drug courts in operation; almosthalf of them provide treatment andsupervision for felony offenders inour superior courts.

A recent report by the GeorgiaDepartment of Audits and Accountsfound these programs had the lowestrecidivism rates of other dispositionaloptions at a cost substantially lessthan most traditional sentencingoptions. The drug court model hasalso proven effective in juvenilecourts, family dependency treatmentcourts, mental health courts and vet-eran’s courts.

Georgia’s Accountability Courtshave made headlines across the stateand in international publications (seebox). Judge Jason Deal’s Drug Courtis featured in the February 26 editionof the The Economist (Drug courtsStay out of jail clean.)

In addition the AOC has promot-ed creation of the state’s first ChildSupport Problem–Solving Courtwhich began operation in May 2009.Judge John Simpson of the CowetaJudicial Circuit previously presidedover the Carroll County drug courtand now oversees cases of parentswho have a history of not payingtheir child support obligations. Thecourt provides job counseling forunemployed fathers who in the pastoften served jail time for nonpay-ment.

The Task Force on DomesticViolence Courts has plans for twopilot court projects that will handledomestic violence cases exclusively.These courts will link victims toservices, schedule hearings promptlyand create “safe places” in the court-house for those whose cases arepending. The project is fundedthrough a STOP Violence AgainstWomen Act grant administered bythe Criminal Justice CoordinatingCouncil.

Accountability Courts Coordinator

The Administrative Office of theCourts now has an AccountabilityCourts Coordinator to provide tech-nical assistance and promote thework of these courts. The JudicialCouncil’s Standing Committee onDrug Courts continues to ensurethat courts adhere to agreed uponstandards. For further informationcontact Mr. John Zoller, at 404-463-1906.

On February 28, 2011, the U.S. Senate confirmed the nominations ofJudge Steve C. Jones and Judge Amy Totenberg to the U.S. DistrictCourt in Atlanta.

Judge Steve Jones has served as a superior court judge in the WesternJudicial Circuit since 1995. Judge Totenberg is a former part-time AtlantaMunicipal Court judge and mediator.

President Barack Obama has nominated federal public defenderNatasha Perdew Silas and U.S. Magistrate Linda Walker to fill tworemaining vacanices on the U.S. District Court in Atlanta.

Additionally, there are two vacancies on the 11th Circuit Court ofAppeals. Judge Stanley Birch took senior status in August 2010; JudgeSusan Black took senior status on February 25, 2011.

“Season of Giving” Means a Year-round

Commitment for AOC Staff

As anyone who volunteersor donates to charitiesknows, the “season of giv-

ing” is not just around theThanksgiving and Christmas holi-days. Year-round volunteer effortsare needed to assist families inthese difficult economic times.

Atlanta Community Food BankTwenty-six AOC staff members

put in a combined 78 hours at theAtlanta Community Food Bank onFebruary 1 and February 10.Reporting to the ACFB’s ProductResource Center in west-Atlanta,volunteers worked an assembly linepacking boxes with cereal, pasta,juice, and canned goods while oth-ers weighed and stacked boxes fordistribution. The two-day volun-teer drive resulted in 930 boxes,approximately 26,400 pounds ofgoods packed.

The Atlanta Community FoodBank distributes nearly two millionpounds of food and other grocery

items each month to 700 nonprofitpartner agencies in 38 counties inmetro Atlanta and north Georgia.

Two Atlanta attorneys, Mr. MillerP. “Pete” Robinson of TroutmanSanders, and Mr. J. Randolph Evans ofMcKenna, Long & Aldridge, wereappointed co-chairs of the new 20-member Commission. All members areresidents of the State and serve at thepleasure of the Governor.
