Citation and commencement. These Regulations may be cited as the Patents Regulations 1986 and shall come into force on the 1st October 1986. Regulation 2. Fees. (1) The fees to be paid in respect of all matters arising under the Act and these Regulations shall be as specified in Schedule I. (2) The fees shall be paid to the Patent Registration Office by such means and in such manner as the Registrar may direct. Regulation 3. Forms. The forms referred to in these Regulations are those set out in Schedule II. Regulation 4. Interpretation. In this Part, unless the context otherwise requires, "application" means an application for the grant of a patent and "applicant" shall be construed accordingly. Regulation 5. (2) TheapplicationshallbefiledatthePatentRegistrationOffice.Regulation5A.Filingofaninternationalapplication.(1) Aninternationalapplicationshallbefiledinthreecopies.(2) Where an international application is filed in less than three copies, the PatentRegistrationOfficeshallpreparetheadditionalcopiesrequiredandtheapplicantshallpaytothePatentRegistrationOfficetheprescribedfeesforpreparingsuchadditionalcopies.

Regulation6.Nameanddeclarationofinventor.(1) Theapplicationshallcontainthenameandaddressoftheinventor.(2) Aninventorwhodoesnotwishtobenamedinapatentmay,bydeclarationinwritingsignedbyhimandsubmittedtotheRegistrar,indicatethathedoesnotwishtobesonamed.Regulation7.Requestforthegrantofapatent.(1) Arequest forthegrantofapatentshallbemadetotheRegistraronForm1togetherwiththepaymentoftheprescribedfee.(2) The title of the invention shall indicate clearly and concisely the subject‐matter towhichtheinventionrelates.Regulation8.Namesandaddresses.Namesandaddressesgivenintheapplicationshallinallcasesbethefullnamesandaddresses.

Regulation9.Nationalityandresidence.(1) Theapplicant'snationalityshallbeindicatedbythenameoftheStateofwhichheisanationalor,iftheapplicantisnotanaturalperson,thenameoftheStateunderwhoselawsitisconstituted.(2) Theapplicant'sresidenceshallbe indicatedby thenameof theStateofwhichhe isaresident.Regulation10.Applicant'srighttopatent.(1) Wheretheapplicantistheinventor,therequestshallstatethatfact.(2) Where the applicant is not the inventor, the request shall be accompanied by astatementjustifyingtheapplicant'srighttothepatent.(3) Forthepurposesofsubregulations(1)and(2), therequestshallbemadeinForm22andshallbesubmittedtogetherwithForm1andForm17.Regulation11.Commonrepresentative.If an application is submitted by more than one applicant and the applicants have notappointedapatentagenttorepresentallofthem‐

(a) the request shall designate one of the applicants as their commonrepresentative;or

(b) if the request does not designate one of the applicants as their common

representative,theapplicantfirstnamedintherequestshallbeconsideredthecommonrepresentative.

Regulation12.Description.(1) Thedescriptionshallfirststatethetitleoftheinventionasappearingintherequestandshall‐

(a) specifythetechnicalfieldtowhichtheinventionrelates;

(b) indicate thebackgroundartwhich, as far as is known to the applicant, canberegarded as useful for the understanding, searching and examination of theinvention,and,whereverpossible,citethedocumentsreflectingsuchart;

(c) disclosetheinventioninsuchtermsthatitcanbeunderstoodandinamannersufficiently clear and complete for the invention to be evaluated and to becarried out by a person having ordinary skill in the art, and state anyadvantageouseffectsoftheinventionwithreferencetothebackgroundart;

(d) brieflydescribefiguresinthedrawings,ifany;

(e) describe the best mode contemplated by the applicant for carrying out the

invention, using exampleswhere appropriate and referring to the drawings, ifany;and

(f) indicateexplicitly,when it isnotobvious fromthedescriptionornatureof the

invention,thewayinwhichtheinventionisindustriallyapplicableandthewayinwhichitcanbemadeandusedor, ifitcanonlybeused,thewayinwhichitcanbeused.

(2) The description shall be presented in the manner and order specified in sub‐regulation(1)unless,becauseofthenatureoftheinvention,adifferentmanneroradifferentorderwouldresultinabetterunderstandingandamoreeconomicalpresentation.(3) Thedescriptionshallnotcontaindrawings.Regulation13.Claims.(1) Theclaimsshallbe clearandconciseand fully supportedby thedescription; and the

number of the claims shall be reasonable taking into consideration the nature of theinvention.

(2) Ifthereareseveralclaimstheyshallbenumberedconsecutivelyinarabicnumerals.(3) Claimsshallnotcontaindrawingsandshallnot,unlessnecessary,rely,inrespectofthetechnicalfeaturesoftheinvention,onreferencestothedescriptionordrawings.(4) Where the application contains drawings, the technical features mentioned in theclaims shall,whereverpossiblebe followedby reference signs relating to such features andplacedbetweenparentheses,subjecttothefollowing:

(a) reference signswhichdonot particularly facilitate quicker understanding of aclaim,shouldnotbeincluded;

(b) the same features, when denoted by reference signs, shall, throughout the

application,bedenotedbythesamesigns.(5) Theclaimsshalldefinetheinventionintermsofthetechnicalfeaturesoftheinvention.

(6) Wheneverappropriate,claimsshallcontain–

(a) statement indicating those technical features of the invention which arenecessary for the definition of the claimed subject‐matter but which, incombination,arepartofthepriorart;

(b) a characterizing portion, preceded by the words "characterized in that",

"characterizedby", "wherein the improvementcomprises",oranyotherwordstothesameeffectstatingconciselythetechnicalfeatureswhich,incombinationwiththefeaturesstatedunderparagraph(a),itisdesiredtoprotect.

Regulation14.Dependentclaims.(1) Any claim which includes all the features of one or more other claims ("dependentclaim")shallcontain,ifpossibleatthebeginning,areferencetotheotherclaimorclaimsandshallthenstatetheadditionalfeaturesclaimed.(2) [DeletedbyP.U.(A)262/95](3) Adependentclaimshallbeconstruedas includingall the limitationscontained in theclaims to which it refers or, if the dependent claim is a multiple dependent claim, all thelimitationscontainedintheparticularclaiminrelationtowhichitisconsidered.(4) Alldependentclaimsreferringbacktoasinglepreviousclaim,andalldependentclaimsreferringback toseveralpreviousclaims, shallbegrouped together to theextentand in themostpracticalwaypossible.Regulation15.Drawings.(1) Subjecttosub‐regulation(2),drawingsshallberequiredwhentheyarenecessaryfortheunderstandingoftheinvention.(2) Notwithstanding sub‐regulation (1), where the nature of the invention admits ofillustrationbydrawingstheapplicantmayincludedrawingsintheapplicationwhenfiled.(3) Flow sheets and diagrams shall be considered drawings for the purposes of theseRegulations.

Regulation16.Abstract.(1) Theabstractshallcommencewithatitlefortheinvention.(2) Theabstractshallcontain‐

(a) asummaryofthedisclosureascontainedinthedescriptionandtheclaimsanddrawings,ifany;and

(b) whereapplicable,thechemicalformulawhich,amongalltheformulaecontained

intheapplication,bestcharacterizestheinvention.(3) The summarymentioned in sub‐regulation (2)(a) shall indicate the technical field towhich the invention pertains and shall be drafted in a way which allows the clearunderstandingof the technicalproblem, thegistof thesolutionof thatproblemthrough theinvention,andtheprincipaluseorusesoftheinvention.(4) The abstract shall be as concise as the disclosure permits and shall preferably notcontainmorethanonehundredandfiftywords.(5) Theabstractshallnotcontainstatementsontheallegedmeritsorvalueoftheinventionoronitsspeculativeapplication.(6) Eachmaintechnical featurementionedintheabstractandillustratedbyadrawingintheapplicationshallbe followedby the referencesignused in thatdrawingplacedbetweenparentheses.(7) The abstract shall not contain drawings but shall be accompanied by the mostillustrativeofanydrawingsfurnishedbytheapplicant.(8) The abstract shall be so drafted that it constitutes an efficient instrument for thepurposesof searching in theparticular technical field, inparticularbymaking it possible toassesswhetherthereisaneedtoconsultthedescription,theclaimsorthedrawings.Regulation17.Measures,terminologyandsigns.(1) Unitsofweightsandmeasuresshallbeexpressedintermsofthemetricsystem.(2) TemperaturesshallbeexpressedindegreesCelsius.(3) Densitiesshallbeexpressedinmetricunits.(4) Forheat,energy,light,sound,andmagnetism,aswellasformathematicalformulaeandelectricalunits,therulesofinternationalpracticeshallbeobserved.

(5) Forchemicalformulae,thesymbols,atomicweights,andmolecularformulaeingeneraluseshallbeemployed.(6) Ingeneral,onlysuchtechnicalterms,signsandsymbolsasaregenerallyacceptedinthefieldinquestionshouldbeused.(7) Theterminologyandthesignsshallbeconsistentthroughouttheapplication.Regulation18.Physicalrequirements.(1) Unless provided otherwise, the application and any accompanying statements ordocumentsshallbefiledinduplicate,buttheRegistrarmayrequirethattheybefiledinmorethantwocopies.(2) All documents of the application shall be so presented as to admit of directreproductionbyphotography,electrostaticprocesses,photooffsetandmicrofilming.(3) Allsheetsshallbe free fromcracks,creasesandfoldsandonlyonesideofeachsheetcontainedintheapplicationshallbeused.(4) AlldocumentsoftheapplicationshallbeonA4paper(29.7cmx21cm)whichshallbestrong,white,smooth,non‐shinyanddurable.(5) Notwithstandingsub‐regulation(4),theRegistrarmayacceptsheetsofsizesotherthanA4.(6) Theminimummarginsofsheetsshallbe2cm.(7) Allsheetsshallbenumberedatthetopofthesheet,inthemiddle,inconsecutivearabicnumerals.(8) Thetextmatteroftheapplicationshallbetypedorprintedinadark,indeliblecolourinatleast1½linespacing,butgraphicsymbols,chemicalormathematicalformulaeandcertaincharactersmay,ifnecessary,behandwrittenordrawn.(9) Intheapplication,everyfifthlineofeachsheetofthedescriptionandtheclaimsshallbenumbered in arabic numerals placed to the left of the relevant lines but to the right of themargin.(10) Drawings shall be executed in durable, black, sufficiently dense and dark, uniformlythickandwell‐definedlinesandstrokeswithoutcolouring.(11) Theapplicationandanyassociatedstatementordocumentshallbefiledinthenational

languageorintheEnglishlanguage.Regulation19.Unityofinvention.(1) Forthepurposesofsection26oftheAct,thesamepatentapplicationmayinclude‐

(a) inaddition toan independentclaim foragivenproduct, an independentclaimfor a process specially adapted for the manufacture of the product, and anindependentclaimforauseoftheproduct;or

(b) inadditiontoanindependentclaimforagivenprocess,anindependentclaimfor

anapparatusormeansspecificallydesignedforcarryingouttheprocess;or

(c) inaddition toan independentclaim foragivenproduct, an independentclaimfor a process specially adapted for the manufacture of the product, and anindependentclaimforanapparatusormeansspecificallydesignedforcarryingouttheprocess.

(2) Subjecttosection26oftheAct,anapplicationmaycontaintwoormore independentclaimsofthesamecategorywhichcannotbecoveredreadilybyasinglegenericclaim.(3) Subject to section 26 of the Act, an applicationmay contain a reasonable number ofdependent claims claiming specific forms of the invention claimed in an independent claimeven when the features of any dependent claim could be considered as constituting inthemselvesaninvention.Regulation19A.Divisionofapplication.Forthepurposeofsection26B(1)oftheAct–

(a) whereanapplicationisdividedpursuanttoanobjectioninanExaminer'sreportmadeundersection30(1)or30(2)oftheAct,fornon‐compliancewithsection26oftheAct,therequestforthedivisionoftheapplicationshallbemadewithinthreemonthsfromthedateofmailingofsuchreport;

(b) inanyothercase,theapplicantmay,ofhisownvolition,requestforthedivisionof the application not later than threemonths from the date ofmailing of theExaminer'sfirstreportmadeundersection30(1)or30(2)oftheAct.

Regulation20.Disclosurestobedisregardedforpriorartpurposes.Anapplicantshallstateintherequestoratanyothertimeanydisclosurewhichheisawareofandwhichinhisopinionshouldbedisregardedforpriorartpurposesundersection14(3)of

theActandshallstatethefactsinanaccompanyingstatement.Regulation21.Declarationclaimingpriority.(1) Adeclarationclaimingpriorityundersection27(1)oftheActshallstate‐

(a) thedateofeachearlierapplication;

(b) subjecttosub‐regulation(2),thenumberofeachearlierapplication,

(c) subject to sub‐regulation (3), the symbol, if any, of the International PatentClassificationwhichhasbeenallocatedtoeachearlierapplication;

(d) thenameof theState inwhicheachearlierapplicationwas filedor,where the

earlierapplicationisaregionaloraninternationalapplication,thenameoftheStateorStatesforwhichitwasfiled;and

(e) where the earlier application is a regional or an international application, the

officewithwhichitwasfiled.

(2) Whereatthetimeoffilingthedeclarationreferredtoinsub‐regulation(1)thenumberofanyearlierapplication isnotknown, thatnumbershallbe furnishedwithin threemonthsfromthedateonwhichtheapplicationcontainingthedeclarationwasfiled.(3) WhenasymboloftheInternationalPatentClassificationhasnotbeenallocatedtotheearlierapplicationorhadnotyetbeenallocatedatthetimeoffilingthedeclarationreferredtoinsub‐regulation(1),theapplicantshallstatethisfactinthedeclaration.(4) Wheretheprioritiesoftwoormoreearlierapplicationsareclaimedinaccordancewithsub‐regulation(1),theinformationrelatingtothoseearlierapplicationsmayheincludedinasingledeclaration.(5) [DeletedbyP.U.(A)262/95]Regulation22.Copyofearlierapplication.(1) Wheresection27(2)oftheActapplies,theapplicantshallfurnishthecertifiedcopyofeachearlierapplicationwithinthreemonthsfromthedateoftheRegistrar'srequest.(2) Wherethecopyreferredtoinsub‐regulation(1)hasalreadybeenfurnishedforanotherapplication,theapplicantmaymakeareferencetothatotherapplication.(3) Where the earlier application referred to in sub‐regulation (1) is in a language other

thanthenationallanguageortheEnglishlanguage,theRegistrarmayrequiretheapplicanttofurnishhim,withinthreemonthsfromthedateoftheRegistrar'srequest,withatranslationoftheearlierapplicationinthenationallanguageorintheEnglishlanguage.Regulation23.Correctionsindeclarationclaimingpriority.(1) If the Registrar finds that the requirements of regulations 21 and 22 have not beencomplied with he shall request the applicant to file the required particulars, documents orcorrectionswithinthreemonthsfromthedateoftherequest.(2) Iftheapplicantdoesnotcomplywiththerequestreferredtoinsub‐regulation(1),theRegistrar shall inform the applicant in writing that the declaration is deemed to be invalidundersection27(4)oftheActandshallstatethereasons.Regulation24.Withdrawalofapplication.(1) AnapplicantmaywithdrawhisapplicationbyadeclarationonForm2addressedtotheRegistrarandsignedbytheapplicantorhisagentsoauthorizedforthatspecificpurpose.(2) Inthecaseofseveralapplicantsthedeclarationreferredtoinsub‐regulation(1)shallbesignedbyalltheapplicantsoronbehalfofalltheapplicantsbytheiragentsoauthorizedforthatspecificpurpose.(3) Whereadeclarationissignedbyanagent,suchdeclarationshallbeaccompaniedbytheletterauthorizinghimtosignthedeclaration.Regulation25.Filingdate.(1) When the Registrar records the filing date of the application he shall send to theapplicant a certificate of filing in the form of a copy of the requestwith the filing date andapplicationnumbermarkedthereon.(2) The required correction under section 28 (2) of the Act shall be filed within threemonthsfromthedateoftheRegistrar'srequest.(3) WheretheRegistrartreatstheapplicationasinvalidinaccordancewithsection28(3)oftheAct,heshallinformtheapplicantinwritingofthereasons.(4) Thedrawingsunder section28 (4)of theAct shallbe furnishedwithin threemonthsfromthedateoftheRegistrar'srequest.

Regulation25A.Enteringthenationalphase.(1) An international application entering the national phase under section 78O or 78OAshallbesubjecttotheprescribedfeeswhichshallbepaidbyusingPatentsFormNo.2A.(2) Anapplicantshallbedeemedtohavefulfilledtherequirementofsection78O(1)(a)or78OA(1)(a),as thecasemaybe, if the internationalapplication intheEnglish languagehasbeenmadeavailablebytheInternationalBureautothePatentRegistrationOffice.Regulation26.Preliminaryexamination.(1) The requirements of regulations 5, 6, 7 (1), 8, 9, 10, 11, 18 and 51 shall be formalrequirementsforthepurposesofsection29(1)oftheAct.(2) Wheresection29(2)of theActapplies, theRegistrarshallnotify theapplicantofhisfindingsandtheapplicantshallmakeanyobservationonsuchfindingoranyamendmenttothe application or both within three months from the date of mailing of the Registrarsnotification.Regulation27.Requestforsubstantiveexamination.(1) A request for a substantive examination shall be made to the Registrar on Form 5togetherwiththepaymentoftheprescribedfeewithineighteenmonthsfromthefilingdateoftheapplication.(1A) Notwithstanding subregulation (1), a request for a substantive examination of aninternationalapplicationwhichhasenteredthenationalphaseshallbemadetotheRegistrarinPatentsFormNo.5togetherwiththepaymentoftheprescribedfeewithinfouryearsfromthefilingdateoftheinternationalapplication.(2) Where an application is divided under regulation 19A, a further request for asubstantiveexaminationshallbemadeatthetimeofthefilingoftherequestforthedivisionoftheapplication.(3) Arequestforasubstantiveexaminationshall,whereappropriate,beaccompaniedby–

(a) informationrelatingtotheapplicationnumberandfilingdateofanyapplicationfor a patent or other title of industrial property protection filed with anyprescribedindustrialpropertyofficerelatingtothesameoressentiallythesameinventionasthatclaimedintheapplication;

(b) information relating to the number assigned to a patent or other title of

industrial property protection granted for the same or essentially the same

invention as that claimed in the application by any prescribed industrialpropertyoffice;

(c) the results of any searches or examinations carried out by any prescribed

industrialpropertyofficerelatingtothesameoressentiallythesameinventionas that claimed in the application and where the results of any searches orexaminations are not in the English language, a certified translation in theEnglishlanguageofsuchsearchorexamination.

(4) TheRegistrarmaywaive,ashedeemsfit,anyrequirementundersubregulation(3).(5) Whereanapplicationisdeemedtobewithdrawnundersection29A(5)oftheAct,theRegistrarshallinformtheapplicantinwritingofthatfactandshallstatethereasonstherefor.(6) ForthepurposesoftheseRegulations"prescribedindustrialpropertyoffice'meansthePatentOfficeofAustralia,thePatentOfficeofJapan,thePatentOfficeoftheRepublicofKorea,thePatentOfficeof theUnitedKingdom,thePatentOfficeof theUnitedStatesofAmericaorthe European Patent Office, as the casemay require, in its capacity as a national office or,whereappropriate,asanInternationalSearchingAuthorityorasanInternationalPreliminaryExaminationAuthorityunderthePatentCo‐operationTreaty.Regulation27A.Requestformodifiedsubstantiveexamination.(1) A request for amodified substantive examination shall bemade to the Registrar onForm5A togetherwith the payment of the prescribed feewithin eighteenmonths from thefilingdateoftheapplication.(1A) Notwithstandingsubregulation(1),arequestforamodifiedsubstantiveexaminationofan international application which has entered the national phase shall be made to theRegistrarinPatentsFormNo.5Atogetherwiththepaymentoftheprescribedfeewithinfouryearsfromthefilingdateoftheinternationalapplication.(2) Whereanapplicationisdividedunderregulation19A,afurtherrequestforamodifiedsubstantiveexaminationshallbemadeatthetimeofthefilingoftherequestforthedivisionoftheapplication.(3) Arequestforamodifiedsubstantiveexaminationshallbeaccompaniedby‐

(a) acertifiedtruecopyofthepatentorothertitleofindustrialpropertyprotectiongrantedtotheapplicantorhispredecessorintitleintheprescribedcountryorundertheprescribedtreatyorConvention,andwherethepatentorothertitleofindustrial property protection is not in the English language, a certifiedtranslationintheEnglishlanguagethereof;

(b) wherethedescription,claimsordrawingsof the inventiongrantedapatentorothertitleofindustrialpropertyprotectionbytheprescribedcountryorunderthe prescribed treaty or Convention are not, apart from matters of form,substantially the same as the description, claims or drawings of the inventionclaimedintheapplication,theamendmentsrequiredforthepurposeofbringingthemintoconformity.

(4) Whereanapplicationisdeemedtobewithdrawnundersection29A(5)oftheAct,theRegistrarshallinformtheapplicantinwritingofthatfactandshallstatethereasonstherefor.(5) ForthepurposesoftheseRegulations‐"prescribedcountry"meansAustralia,Japan,theRepublicofKorea,theUnitedKingdomortheUnitedStatesofAmerica,asthecasemayrequire;“prescribedtreatyorConvention"meanstheEuropeanPatentConvention.Regulation 27B. Deferment of filing of request for substantive examination andmodifiedsubstantiveexamination.(1) Arequestforadefermentofthefilingofarequestforasubstantiveexaminationunderregulation27oramodifiedsubstantiveexaminationunderregulation27Aoradefermentoftheprovisionofinformationordocumentsrequiredunderregulation27(3)shallbemadetotheRegistrarofForm5B.(2) For the purposes of section 29A(7) of the Act, the maximum period of defermentallowed‐

(a) subject to regulation27B(3), for the filingof a requestunder regulation27orregulation27A,shallbefiveyearsfromthefilingdateoftheapplication;and

(b) for the provision of the information or documents required under regulation

27(3),shallbefiveyearsfromthefilingdateoftheapplication.(3) Where the applicant is unable to file in a request for a modified substantiveexamination within the time period specified in paragraph (a) of subregulation (2), theapplicantmay file in a request for a substantive examinationwithin threemonths from theexpiryofthetimeperiodspecifiedinthatparagraph.Regulation27C.Substantiveexamination.(1) Therequirementsofsections13,14,15and16,PartV,andsections26,26A,26B,and27oftheActandregulations7(2),12to17,21and50shallbesubstantiverequirementsforthe

purposesofsection30(1)oftheAct.(2) Forthepurposeofdeterminingwhethertheapplicationcomplieswiththesubstantiverequirements, in particular sections 14 and 15 of the Act, the Examiner shall search suchdocumentsastheRegistrardeemsnecessary.(3) UponreceiptoftheExaminer'sreportundersection30(1)(b)oftheAct,theRegistrarmay request the Examiner to conduct a further search or other investigation to determinewhether the requirements of sections 14 and 15 of the Ad have been satisfied andsubregulation(2)shallapplyinrelationtosuchfurthersearchorotherinvestigation.(4) Where section 30 (3) of the Act applies, the Registrar shall send a copy of theExaminer's report to the applicant and the applicant shall make any observation on suchreport or any amendment to the application or both within two months from the date ofmailingofthereport.(5) Where the applicant makes any observation on the Examiner's report or anyamendmentto theapplicationorbothwithintheprescribedperiod, theRegistrarshallreferthemtotheExaminerwhoshallreporthisdeterminationtotheRegistrar.(6) (Deleted)Regulation27D.Modifiedsubstantiveexamination.(1) Therequirementsofsections13and14,PartV,andsections26A,26Band27oftheActandregulations21and50shallbesubstantiverequirementsforthepurposesofsection30(2)oftheAct.(2) Inaddition, itshallalsobeasubstantiverequirementthatthedescription,claimsanddrawingsoftheinventionclaimedintheapplication,whetherasfiledorasamendedundertheAct or theseRegulations, apart frommatters of form, shall be the sameor substantially thesameasthedescription,claimsanddrawingsoftheinventiongrantedapatentorothertitleofindustrial property protection by the prescribed country or under the prescribed treaty orConvention.(3) Forthepurposeofdeterminingwhethertheapplicationcomplieswiththesubstantiverequirements,inparticularsection14oftheAct,theExaminershallsearchsuchdocumentsastheRegistrardeemsnecessary.(4) UponreceiptoftheExaminer'sreportundersection30(2)(b)oftheAct,theRegistrarmay request the Examiner to conduct a further search or other investigation to determinewhethertherequirementsofsection14of theActhavebeensatisfiedandsubregulation(3)shallapplyinrelationtosuchfurthersearchorotherinvestigation.

(5) Where section 30 (3) of the Act applies, the Registrar shall send a copy of theExaminer's report to the applicant and the applicant shall make any observation on suchreportoranyamendmenttotheapplicationorbothwithintwomonthsfromthedatemailingofthereport.(6) Where the applicant makes any observation on the Examiner's report or anyamendmentto theapplicationorbothwithintheprescribedperiod, theRegistrarshallreferthemtotheExaminerwhoshallreporthisdeterminationtotheRegistrar.(7) (Deleted)Regulation27E.ExpeditedExamination.(1) An applicant who requests or has requested for substantive examination underregulation 27 may request the Registrar to undertake an expedited examination of theapplicationonceithasbeenmadeavailableforpublicinspectionundersection34oftheAct.(2) A request for expedited examination shall bemade to the Registrar in Form 5H andshallbeaccompaniedwith—

(a) a statutory declaration stating the grounds for requesting the expeditedexamination;and

(b) theprescribedfee.

(3) Ifanapplicanthasrequestedforanexpeditedexamination,theRegistrarmaydosoiftheRegistrarisreasonablysatisfiedthat—

(a) itisinthenationalorpublicinterest;

(b) thereare infringementproceedingstakingplaceorevidenceshowingpotentialinfringementwithregardstothepatentbeingapplied;

(c) theapplicanthasalreadycommercializedtheinventionorplantocommercialize

the inventionwithin two years from the filing date of a request for expeditedexaminationunderthisregulation;

(d) application for grant of the patent is a condition to obtainmonetary benefits

fromtheGovernmentorinstitutionsrecognizedbytheRegistrar;

(e) the inventionrelates togreen technologies thatwillenhance thequalityof theenvironmentorconservationofenergyresources;or

(f) thereareotherreasonablegroundswhichsupporttherequest.

(4) TheRegistrarshallnotifytheapplicant inwriting,assoonaspracticableaftermakinghisdecision,whethertheexpeditedexaminationshallbeconductedornot.(5) If the Registrar is satisfied that a request for an expedited examination of theapplicationiswarranted,theapplicantshall,withinfiveworkingdaysfromthedateofreceiptoftheRegistrar’sdecisioninsubregulation(4),fileForm5Iandpaytheprescribedfee.(6) Forthepurposeofsubstantiveexaminationoftheapplication,iftheExaminerreportsthat any of the requirements referred to in subsections 30(1) and (2) of the Act was notcomplied with, the Registrar shall give the applicant an adverse report to explain to theapplicanttherequirementswhichwerenotcompliedwithandtheapplicantshallbegivenoneopportunity tomakeobservationson the report and to amend the application as to complywith those requirements within three weeks from the date of the issuance of the adversereportbytheRegistrar.(7) If the applicant fails to amend the application within the time stipulated undersubregulation(6),therequestforexpeditedexaminationisdeemedtobewithdrawn.Regulation28.Notificationofrefusalofapplication.Whereanapplicationisrefusedundersection29(2),30(3),30(6),31(1)or85oftheAct,theRegistrar shall notify the applicant in writing of that decision and shall state the reasonstherefor.Regulation29.Certificateofgrantofpatent.(1) Thecertificateofthegrantofapatentreferredtoinsection31(2)(a)oftheActshallcontain‐

(a) thenumberofthepatent;

(b) thenameandaddressoftheownerofthepatent;

(c) thenameoftheinventor(exceptwherehehasindicatedhedoesnotwishtobenamed);

(d) thefilingdateandtheprioritydate,ifany,oftheapplication;

(e) thedateofthegrantofthepatent;and

(f) thetitleoftheinvention;and

thereasonsthereforandshallgivethepersonmakingtherequestanopportunitytobeheard.(4) Uponreceiptofanotificationundersubregulation(3), thepersonmakingtherequestmay,withinonemonthfromthedateofthemailingofthenotification,requestforahearing.(5) WheretheRegistrarreceivesarequestforahearingundersubregulation(4),heshallgivethepersonmakingtherequestanopportunitytopresenthiscaseandshallthereaftergivehisdecision.(6) WherenorequestforahearingisreceivedwithintheprescribedperiodorwherethepersonmakingtherequestdoesnotappearonthedatefixedforthehearingoftherequesttheRegistrar shall refuse the request for reinstatement and shall inform thepersonmaking therequestinwritingofthatdecision.(7) WhereacaseforreinstatementhasbeenmadeouttothesatisfactionoftheRegistrar,heshallnotifythepersonmakingtherequestinwritingofthatfact.(8) Uponreceiptofanotificationundersubregulation(7), thepersonmakingtherequestshall,withinonemonthfromthedateofthemailingofthenotification,paytotheRegistrarallannualfeesdueandtheprescribedsurchargeforreinstatement.(9) TheRegistrarshall,uponreceiptof theannual feesdueandtheprescribedsurchargeforreinstatement,reinstatethepatent;andthedateofreinstatementshallberecordedintheRegister.Regulation33B.Protectionofpersonswhoexploitlapsedpatents.(1) Any person who has exploited or taken definite steps, by contract or otherwise, toexploit a patent after it is notified in theGazette that the patent has lapsed andbefore it isnotifiedintheGazettethatthepatenthasbeenreinstatedmayrequestforalicencetoexploitthepatentedinvention.(2) Arequestundersubregulation(1)shallbemadetotheRegistraronForm5F.(3) Acopyoftherequestshallbeservedontheownerofthepatent.(4) TheRegistrarmayrequirethepersonmakingtherequestortheownerofthepatentorbothtoappearbeforehimforthepurposeofgivingastatementorsubmittinganydocumentorotherinformation.(5) TheRegistrarmay,whereheissatisfiedthatalicencetoexploitthepatentedinventionshouldbegranted,grantalicencetothepersonmakingtherequestsubjecttosuchtermsandconditions as the Registrar deems fit and the owner of the patent shall be deemed to haveconsentedtosuchgrant.

(6) TheRegistrarshallinformthepersonmakingtherequestandtheownerofthepatentinwritingofhisdecision.Regulation33C.Conversionofapplications.(1) Arequestundersection17B(3)oftheActtoconvertanapplicationforapatentintoanapplicationforacertificateforautilityinnovationortoconvertanapplicationforacertificateforautilityinnovationintoanapplicationforapatentshallbemadetotheRegistraronForm5Gtogetherwiththepaymentoftheprescribedfee.(2) WhereacaseforconversionhasbeenmadeouttothesatisfactionoftheRegistrar,heshallnotifythepersonmakingtherequestinwritingofthatfact.(3) Uponreceiptofanotificationundersubregulation(2), thepersonmakingtherequestshall,withinonemonthfromthedateofthemailingofthenotification,paytotheRegistrar–

(a) inthecaseofarequesttoconvertanapplicationforapatentintoanapplicationforacertificateforautilityinnovation,theprescribedfeepayableunderregulation45;

(b) in the case of a request to convert an application for a certificate for a utilityinnovationintoanapplicationforapatent,theprescribedfeepayableunderregulation7.

(4) Fortheavoidanceofdoubtitisdeclaredthatwhereanapplicationhasbeenconvertedinaccordancewiththisregulation,theprescribedfeepaidontheoriginalapplicationshallnotberefundable.Regulation34.Applicationtorecordortransmission.(1) Anyapplicationundersection39(2)oftheActtorecordintheRegistertheassignmentortransmissionofapatentapplicationorapatentshallbemadetotheRegistraronForm6togetherwiththepaymentoftheprescribedfee.(2) The application shall be signed, in the case of an assignment, by or on behalf of thepartiestothetransferand,inthecaseofatransmission,byoronbehalfofthepersonentitledtothepatentapplicationorpatent.(3) Theapplicationshallbeaccompaniedbydocumentsproving to thesatisfactionof theRegistrarthechangeofownership.(4) Whensub‐regulations(1)to(3)havebeencompliedwith,theRegistrarshallrecordtheassignmentortransmissionintheRegister.

Regulation40.NotificationoftheBoard'sdecision.(1) The Registrar shall notify in writing any party required to appear before the Boardundersection51(1)oftheActnotlaterthanonemonthbeforethedatesetfortheappearance.(2) WithinonemonthfromthedatetheBoardmakesitsdecision,andtheRegistrarshallnotifytheapplicant,thelicensororthelicensee,asthecasemaybe,ofthedecisionandshallrecordthedecisionintheRegistersettingoutthefollowingparticulars:

(a) thenameandaddressoftheapplicant;

(b) thedateoffilingoftheapplication;

(c) theapplicablestatutoryprovisionunderwhichtheapplicationwasmade;

(d) thetitleofthepatentedinvention;

(e) thenumberanddateofthegrantofthepatentinquestion;

(f) thedateandnatureofthedecision;and

(g) ifacompulsorylicencewasgranted,theparticularsreferredtoinsection52oftheAct.

(3) TheRegistrarshallpublishthedecisionoftheBoardundersection51(1)oftheActintheGazettesettingouttheparticularsmentionedinparagraphs(a)to(f)ofsub‐regulation(2).Regulation41.Amendmentandcancellationofcompulsorylicence.(1) The request under section 54 (1) of the Act to amend the decision granting acompulsory licenceshallbemadetotheRegistraronForm12togetherwiththepaymentoftheprescribedfee.(2) The request under section 54 (2) of the Act to cancel a compulsory licence shall bemadetotheRegistraronForm13togetherwiththepaymentoftheprescribedfee.(3) Theproceduresetoutinsection50and51oftheActandinregulations38,39and40shallapply,totheextentrelevant,foramendingorcancellingacompulsorylicence.Regulation42.Surrenderofcompulsorylicence.(1) Thewrittendeclarationof surrenderof a compulsory licenceunder section54 (3)oftheActshallbeaccompaniedbythepaymentoftheprescribedfee.

(2) TheRegistrar shall record the surrender in the Register and notify the owner of thepatent as required by section 54 (3) within one month from the date of receipt of thedeclarationofsurrender.(3) TheRegistrarshallpublishthesurrenderasrequiredbysection54(3)oftheActintheGazette.Regulation43.Surrenderofpatent.The written declaration of surrender of a patent under section 55 (1) of the Act shall beaccompaniedbythepaymentoftheprescribedfee.Regulation44.Invalidationofpatent.(1) Theownerof thepatent shall notify any licenseesof anyproceedingsbroughtundersection56oftheAct.(2) The person requesting the invalidation shall notify any beneficiaries of compulsorylicencesofanyproceedingsbroughtundersection56oftheAct.Regulation45.Certificateforautilityinnovation.(1) AnapplicationforthegrantofacertificateforautilityinnovationunderPartIVAoftheActshallbemadetotheRegistraronForm14togetherwiththepaymentoftheprescribedfee.(2) AnapplicationtoextendthetermofacertificateforautilityinnovationshallbemadetotheRegistraronForm15togetherwiththepaymentoftheprescribedfee.(3) The provisions of these Regulations, except regulation 19 and Part IV, shall apply toutilityinnovationstotheextentrelevant.(4) In the forms made applicable to utility innovations under subregulation (3),"certificate"meansacertificateforautilityinnovation.Regulation45A.Interpretation.InthisPart,unlessthecontextotherwiserequires‐"Board of Examiners" means the board of Examiners of Patent Agents established underregulation45G;

"Secretary‐General" means the Secretary‐General of the Ministry charged with theresponsibilityforthedevelopmentofindustrialproperty.Regulation45B.Representationinproceedings.(1) Unless the Act or any regulation made thereunder otherwise prescribes, or theRegistrarotherwisedirects,anypersonmayberepresentedinproceedingsbeforethePatentRegistrationOfficebyapatentagentwhomayattend,filedocumentsandsigndocumentsonthatperson’sbehalf.(2) TheappointmentorchangeofapatentagentshallbemadeonForm17,signedbythepersonorpersonstoberepresentedbytheagentandsubmittedtotheRegistrar.Regulation45C.Registrationofpatentagents.(1) AnapplicationtoberegisteredasapatentagentintheRegisterofpatentsAgentsshallbemadetotheRegistraronForm18togetherwiththepaymentoftheprescribedfee.(2) InordertoberegisteredintheRegisterofPatentsAgents,theapplicantshallsatisfytheRegistrar‐

(a) thatheisdomiciledinorisapermanentresidentofMalaysia;

(b) thatheisanadvocateandsolicitoroftheHighCourtinMalayaoranadvocateoftheHighCourtinSabahandSarawak,orhasarelevantdegreeoritsequivalentinanappropriatebranchorengineeringorsciencefromaninstitutionofhigherlearningapprovedbytheBoardofExaminers,orhasqualificationsentitlinghimtograduatemembershipofaprofessionalengineeringorscientificinstitutionorthelikerecognizedbytheBoardofExaminers;and

(c) thathehaspassedtheexaminationspecifiedinregulation45D.

(3) TheRegistrarmay,atanytime,requireproofofthemattersspecifiedinparagraphs(a),(b)and(c)ofsubregulation(2).(4) TheRegistrarmayrefusetoregisteranypersonwhohasbeenconvictedofanoffenceinvolvingfraudordishonesty.(5) TheRegistrar,uponbeingsatisfied that theapplicantqualifies tobe registered in theRegisterofPatentsAgents,shallregistertheapplicantforatermexpiringon31Decemberofthatyear.

Regulation45D.Examinationforpatentagents.(1) For the purposes of regulation 45C(2)(c), the board of Examiners shall conduct anexaminationwhichshallconsistofthefollowingsubjects:

(a) technology;

(b) Malaysianpatentlawandpractice;

(c) Malaysiantrademarkanddesignslawandpractice;and

(d) foreignindustrialpropertylawandpractice.(2) An application for registration as a candidate for the examination specified insubregulation (1) shall bemade to the Board of Examiners of Form 18A togetherwith thepaymentoftheprescribedfee.(3) Anapplicationunder subregulation (2) shall be sent to theSecretary to theBoardofexaminersatthePatentRegistrationOfficeonorbeforethedatedeterminedbytheboardofExaminersforthesubmissionofsuchapplications.(4) Acandidateshallberequiredtosit foreachof thesubjectsspecified insubregulation(1)atasittingoftheexamination.(5) A candidate who has sat for and failed to pass any of the subjects specified insubregulationmay, ifheisdissatisfiedwithhisresultappealtotheSecretary‐Generalforre‐scrutinyof the resultswithin fourteendays from thedate of thenotificationof such resultstogetherwiththepaymentoftheprescribedfee.(6) Upon receipt of an appeal under subregulation (5), the Secretariat General shallconsidertheappealandmakeadecisionofthereon.(7) ThedecisionoftheSecretary‐Generalshallhefinalandconclusive.(8) A candidatewho has sat for and failed to pass any or all of the subjects specified insubregulation(1)atanexaminationmayapply tore‐sitsuchsubjectorsubjects,as thecasemaybe,atthenextsittingoftheexaminationandsuchapplicationshallbemadetotheBoardorExaminersonForm18Btogetherwiththepaymentoftheprescribedfee.(9) Anycandidatewhohas failedtopassallof thesubjectsspecified insubregulation(1)afterthreeattemptsshallbedeemedtohavefailedtheoverallexaminationandsubregulations(5),(6),(7)and(8)shallnotapplythereto.(10) Any candidate who is deemed to have failed the overall examination undersubregulation(9)mayre‐applytotheregisteredasacandidateundersubregulation(2).

Regulation45E.Renewalofregistrationofpatentagents.(1) An application for the renewal of registration as a patent agent shall bemade to theRegistraronForm19togetherwiththepaymentoftheprescribedfeeby31Januaryofeachyear:

Providedthat inthecaseofapersonwhoimmediatelybeforethedateofcomingintoforce of this regulationwas registered as a patent agent the application for the renewal ofregistrationasapatentagentshallbemadewithinthirtydaysoftheexpiryoftheregistration.(2) TheRegistrarshall,uponbeingsatisfiedthattheconditionsspecifiedinregulation45Ccontinuetobesatisfied,renewtheregistrationofthepatentagent foratermexpiringon31Decemberofthatyear:

Provided that apersonwho immediatelybefore thedate of coming into forceof thisregulationwasregisteredasapatentagentshallbedeemed tohavesatisfied theconditionsspecifiedinregulation45C(2)(c).(3) Notwithstandingsubregulation(2),theRegistrarmayrefusetorenewtheregistrationofanypersonwhohasbeenconvictedofanoffenceinvolvingfraudordishonesty.Regulation45F.Cancellationofregistrationofpatentagents.(1) TheRegistrarmaycanceltheregistrationofanypersonwhohasbeenconvictedofanoffenceinvolvingfraudordishonesty.(2) Wheretheregistrationofanypersoniscancelledunderthisregulationnofeespaidforthepurposeofregistrationorrenewalofregistrationshallberefundable.Regulation45G.BoardofExaminationofPatentAgents.(1) ThereisestablishedaBoardofExaminersofPatentAgentswhichconsistof‐

(a) theRegistrarofPatents,whoshallbeChairman;and

(b) fourotherpersonsproficientinthefieldofindustrialpropertyappointedbytheSecretary‐General.

(2) AnofficerofthePatentRegistrationOfficeshallbeSecretarytotheBoardofExaminers.(3) AmemberoftheBoardofExaminersappointedundersubregulation(1)(b)shall,unlesshis appointment is sooner revoked or he sooner resigns, hold office for such period not

exceeding three years as the Secretary‐General may determine and shall be eligible forreappointment.(4) AtameetingoftheBoardofExaminersthreemembersshallfromaquorum.

(5) IntheabsenceoftheChairman,amembernominatedbytheChairmanshallpresideatthemeetingandsuchmembermayexerciseallthepowersoftheChairmaninrespectofthatmeeting.(6) If on anyquestion tobedetermined there is an equality of votes, theChairman shallhavethecastingvoteinadditiontohisdeliberativevote.(7) TheBoardofExaminersshallberesponsiblefor‐

(a) theconductoftheexaminationspecifiedinregulation45D;

(b) preparing and publishing the examination syllabus and determining the studymaterialtoberecommended;

(c) preparingexaminationpapers;

(d) registeringandadmittingcandidates;

(e) determiningthetime,dateandplaceforexamination;

(f) awardingcertificates;and

(g) advisingtheRegistrarastothepersonswhohavesatisfiedtherequirementsofparagraphs(b)and(c)ofsubregulation45C(2).

(8) The Board of Examiners shall enjoy the prerogative of awarding and withdrawingcertificates,withholdingandcancelling the resultsof any candidate, andbarringanypersonfromtakingtheexamination.Regulation45H.Setting,assessingandmarkingofexaminationsquestionsandanswers.(1) TheBoardofExaminersmayappointsuitablyqualifiedpersonstobeexaminersforthepurposeofsetting,assessingandmarkingquestionsoranswersfortheexaminationspecifiedinregulation45D.(2) TheBoardofExaminersmaygivesuchinstructionsinrelationtothesetting,assessingandmarkingofquestionsoranswersasitconsidersnecessary.(3) Theexaminersappointedundersubregulation(1)shallbepaidsuchallowancesasthe

(3) AdocumentpurportingtobesignedfororonbehalfofanassociationofpersonsmaybesignedbyanypersonwhoappearstotheRegistrartobedulyqualified.Regulation51.Addressforservice.(1) Everyperson concernedwith anyproceedingsunder theAct or any regulationmadethereunderandeveryownerof apatent shall furnish to theRegistrar,onForm20 togetherwith the payment of the prescribed fee, an address for service in Malaysia, which may betreated for all purposes concerning or connected with such proceedings or patent as theaddressofthepersonconcerned.(2) Notwithstanding sub‐regulation (1), where a patent agent has been appointed, theaddressforserviceshallbetheaddressofthepatentagent.(3) The furnishing of Form 20 is not required the address for service has already beenfurnishedinanyotherForminScheduleIItotheseRegulations,andthataddressforservicehasnotchangedinanyway.Regulation52.Servicebypost.(1) Anydocument or thing required or authorizedby theAct or theseRegulations to befiled at the Patent Registration Office shall be delivered by hand to the Patent RegistrationOfficeduringitsnormalbusinesshoursorsenttotheRegistrarbypost.(2) Sendingbypostshallbedeemedtobeeffectedbyproperlyaddressing,preparingandposting a letter containing the document or thing, with the prepaid postage on it, to theRegistraratthePatentRegistrationOfficeandthedocumentorthingshallbedeemedtohave

been received at the time when the document or thing is actually received at the PatentRegistrationOffice.(3) ThefilingofadocumentorthingatthePatentRegistrationOfficeshallbedeemedtobeeffected at such time as it is received at the Patent Registration Office and is recorded asreceived.Regulation52A.Electronicfilingofdocumentsandthings.(1) TheRegistrarmayprovideaservice for theelectronic filingof thedocumentor thingrequiredorauthorizedbytheActortheseRegulationstobefiledwiththeRegistrar.(2) Apersonwhointendstousetheserviceprovidedundersubregulation(1)shallcomplywiththetermsandconditionsasmaybespecifiedbytheRegistrar,eithergenerallybynoticepublished in the official website or, in any particular case, by notice, including throughelectronicmeans,tothepersondesiringtousesuchservice.(3) Adocumentorthingwhichiselectronicallyfiledunderthisregulationshallbedeemedtobeeffectedatsuchtimeasthatdocumentorthingisacceptedbytheelectronicfilingsystem.(4) Whereanyaccompanyingdocumentorthingisnotcapableofbeingfiledelectronically,suchaccompanyingdocumentorthingmaybedeliveredorsenttotheRegistrarinthemannerspecifiedinregulation8subjecttosuchtermsandconditionsastheRegistrarmayspecify.Regulation52B.Termsandconditionsforelectronicfiling.(1) Without limiting thegeneralityof subregulation52A(2), the termsandconditions forelectronicfilingshallincludethefollowing:

(a) the procedure to be complied with for the electronic filing of documents andthings;

(b) theformatormediainwhichadocumentorthingistoberecordedorstoredfor

purposesofelectronicfiling;(c) the manner of authenticating a document or thing which is required to be

stamped, signed, sealed or certified, including the requirement for a digitalsignatureofthepersonfilingthedocumentorthing;and

(d) the actions to be taken in the event of an interruption in the process of

performingtheelectronicfiling.(2) Notwithstanding regulation52A, theRegistrarmay refuse to accept or to register

anydocumentorthingwhichisfiledelectronicallyif—

(a) the information contained in such document or thingwhich is not capable ofbeingdisplayedinalegibleform;

(b) theelectronicrecordofsuchdocumentorthingisnotcapableofbeingstoredin

theelectronicfilingsystem; (c) theelectronicrecordofsuchdocumentor thingappears to theRegistrar tone

altered,damaged,incompleteorforged;or (d) anyof the termsorconditionsonelectronic filingspecifiedby theRegistrar is

notcompliedwith.Regulation53.Requestforextensionoftime.Arequestundersection82oftheActshallbemadetotheRegistraronForm21togetherwiththepaymentoftheprescribedfee.
