Dear Fellow Conservatives,

I am pleased to present the American Conservative Union Foundation’s ratings for the 2015 meeting of the Idaho Legislature. Like our Congressional Ratings, our State Ratings reflect how elected officials view the role of government in an individual's life. The Idaho legislators with the strongest scores voted most consistently with the ideals articulated in the US Constitution: limited and transparent government, individual rights, personal responsibility, and a healthy culture.

The 2014 election completed a political transformation that began in 2010 and resulted in voters of almost half the states, 23 in all, entrusting Republicans with the governorships as well as control of both chambers in the respective state, the biggest sweep since the first half of the 20th Century.

By examining all our State Ratings (which cover a wide variety of issues) we can see which states have best used their Republican majorities to apply conservative principles, how others have struggled, and in yet other states, how conservatives have stood up against liberal majorities. I know that this guide will provide you with the most comprehensive evaluative tool to learn how your legislators measure up.

1. S 1044 Eminent Domain. This bill prohibits the use of eminent domain for the purpose of building bike trails, paths or greenways unless the property is adjacent to a highway or street. ACU supports restricting the use of eminent domain and supported this bill. The Senate passed the bill on February 23, 2015 by a vote of 20-13.

2. H 133 Capital Gains Taxes. This bill clarifies language regarding capital gains taxes by allowing children of farm owners to get the same tax breaks as their parents do on the sale of cattle and horses. ACU supports pro-growth tax reform and supported this bill. The Senate passed the bill on March 10, 2015 by a vote of 35-0.

3. S 1108 Self-Driving Vehicles. This bill authorizes the testing of self-driving vehicles and sets up the procedures to be used. ACU supports the growth of new technology and supported this bill. The Senate passed the bill on March 12, 2015 by a vote of 18-17.

4. S 1092 Knife Regulations. This bill bans all local knife regulations, making the law uniform throughout the state. ACU supports this effort to prevent a hodgepodge of local laws governing knives and supported this bill. The Senate passed the bill on March 16, 2015 by a vote of 25-10.

5. S 1096 Parental Rights. This bill adds to the existing rights that parents have over their children’s education by requiring school districts to prepare a plan for parental involvement. The plan must include a process by which parents can learn their children’s course of study, a way to review learning materials, and a plan for parents to withdraw their child from learning materials or activity if they deem them to be harmful. ACU supports every reasonable effort to empower parents within the public school system supported this bill. The Senate passed the bill on March 16, 2015 by a vote of 23-12.

6. H 189 Telemedicine. This bill establishes acceptable uses for telemedicine while also prohibiting the service from being used for abortions. ACU supports free market reforms in health care that help reduce costs and supported this bill. The Senate passed the bill on March 17, 2015 by a vote of 31-3.

7. S 1062 Health Care Regulations. This bill clarifies the law so that direct primary health care contracts are not insurance products and should not be regulated by the state Department of Insurance. ACU supports common sense regulatory reform and supported this bill. The Senate passed the bill on March 17, 2015 by a vote of 34-0.

8. H 154 Abortion Drugs. This bill sets restrictions on chemical abortions, such as the requirement that the doctor is in the room when prescribing the drug. ACU views abortion as a human tragedy and supports efforts to restrict the practice and educate patients, and supported this bill. The Senate passed the bill on March 23, 2015 by a vote of 27-7.

9. H 170 Government Contracting. This bill allows the Idaho Department of Education to contract with private companies to create education programs. ACU supports wider participation by private enterprise for government services and supported this bill. The Senate passed the bill on March 25, 2015 by a vote of 34-1.

10. H 262 Ride Sharing Regulation. This bill prohibits local regulations on ride sharing services such as Uber and Lyft, allowing them to operate freely. ACU supports a free market in transportation and supported this bill. The Senate passed the bill on March 25, 2015 by a vote of 23-11.

11. H 301 Concealed Carry. This bill clarifies Idaho's concealed carry permit law to make it clear that no permit is required in one's home or place of business or on private property with the owner's permission. The bill also makes clear that Idaho will recognize permits from other states. ACU supports the expansion of Second Amendment rights and supported this bill. The Senate passed the bill on March 31, 2015 by a vote of 30-5.

12. H 318 Liquor License Restrictions. This bill allows for a liquor license to be issued to the owner, operator or lessee of a conference and event center that is within the city limits of a resort city. ACU supports efforts to ease needless regulations on business and supported this bill. The Senate passed the bill on April 8, 2015 by a vote of 18-16.

2. H 170 Government Contracting. This bill allows the Idaho Department of Education to contract with private companies to create education programs. ACU supports wider participation by private enterprise for government services and supported this bill. The House passed the bill on February 26, 2015 by a vote of 58-9.

3. H 149 Price Fixing. This bill prevents manufacturers or distributors of contact lenses from forcing retailers to sell their products above a certain level. ACU supports free market competition and opposed this bill. The House passed the bill on March 3, 2015 by a vote of 40-29.

4. H 189 Telemedicine. This bill establishes acceptable uses for telemedicine while also prohibiting the service from being used for abortions. ACU supports free market reforms in health care that help reduce costs and supported this bill. The House passed the bill on March 3, 2015 by a vote of 66-3.

5. H 262 Ride Sharing Regulation. This bill prohibits local regulations on ride sharing services such as Uber and Lyft, allowing them to operate freely. ACU supports a free market in transportation and supported this bill. The House passed the bill on March 16, 2015 by a vote of 56-12.

7. H 252 Sales Tax. This bill eliminates the sales tax exemption for out of state purchasers of motor vehicles. ACU opposes this anti-growth tax increase on residents of another state when they are already subject to taxation by their home state and opposed this bill. The House passed the bill on March 20, 2015 by a vote of 39-31.

8. H 301 Concealed Carry. This bill clarifies Idaho's concealed carry permit law to make it clear that no permit is required in one's home or place of business or on private property with the owner's permission. The bill also makes clear that Idaho will recognize permits from other states. ACU supports the expansion of Second Amendment rights and supported this bill. The House passed the bill on March 24, 2015 by a vote of 57-11.

9. H 286 Corporate Subsidies. This bill dramatically expands property tax breaks that county commissioners can hand out for business expansions. Currently the breaks are restricted to new manufacturing plants that involve an investment of over $3 million. This bill would lower the threshold to a $500,000 investment for any non-retail commercial project. ACU opposes these subsidies as corporate cronyism that leads to a higher tax burden on those not favored by the government and opposed this bill. The House passed the bill on March 25, 2015 by a vote of 62-3.
