Non-commercial operation
An operation which is not a commercial operation
The term commercial operation is defined in Article 3 of the Basic Regulation

What is a complex motor-powered aircraft?
“(i) an aeroplane:
with a maximum certificated take-off mass exceeding 5 700 kg, or
certificated for a maximum passenger seating configuration of more than nineteen, or
certificated for operation with a minimum crew of at least two pilots, or
equipped with (a) turbojet engine(s) or more than one turboprop engine, or
(ii) a helicopter certificated:
for a maximum take-off mass exceeding 3 175 kg, or
for a maximum passenger seating configuration of more than nine, or
for operation with a minimum crew of at least two pilots, or
(iii) a tilt rotor aircraft”

ARTICLE 5 - Air operations-.
3. Operators of complex motor-powered aeroplanes and helicopters involved in non-commercial operations shall declare their capability and means to discharge their responsibilities associated with the operation of aircraft and operate the aircraft in accordance with the provisions specified in Annex III and Annex VI. Such operators when engaged in non-commercial specialised operations shall operate the aircraft in accordance with the provisions specified in Annex III and VIII instead.

Declaration - principles
embedded already in the Basic Regulation (EC)216/2008
is not a certificate or prior approval
after submitting the declaration, an operator can start operating
authority approval is not required

Declaration – operator responsibility
Operator submits declaration
•specifying details of the operator, aircraft and operation
•containing compliance statements (self-assessment of operator)
must be submitted before start of the operation
as soon as the operator has submitted its declaration, it can start operating
Operator must carry the declaration on board its aircraft
Operator must submit new declaration in case of changes

Declaration – authority responsibility
If the declaration doesn’t contain the required information or indicates non-compliances
authority notifies the operator and requests further information
authority may also inspect the operator and takes action, as necessary
Upon receiving the declaration
authority verifies if the declaration is formally correct (contains the information required)
