State Parks, in their complaint, alleges: Newmont is liable for contribution to State Parks for all or a substantial portion of past, future, and present costs incurred in response to the contamination, the release or the threatened release of hazardous substances at Empire Mine Park. A judicial determination of Newmont's liability is necessary and appropriate at this time so that State Parks may ascertain its existing and future rights against Newmont.
