A bill seeking to outlaw boycotts of Israeli institutions and products inc lud ing i n s e t t l emen t s i s

d ip loma t i ca l l y exp los iveA new anti-boycott bill, the third

in a series of proposed laws that aimto curtail the ability of civil society tocriticise Israeli government policy,wi l l punish Is rae l is or fore ignnationals who initiate or promote aboycott of Israel.The bill not only prohibits boycotts

of legal Israeli institutions, but also of settlement activities and products. Itseeks to impose fines on Israelis whopromote boycotts and transfer thefines to boycotted organisations.It will impose a 10-year entry ban on

fo re ign r e s iden t s engag ing in

boycotts, and forbid them to carry outany economic activities in Israel.

Heavy sanct ions wi l l a lso beimposed on fore ign pol i t ica lentities engaging in boycotts. Anygovernment promoting a boycott willbe prohibited from carrying out anyaction in Israeli bank accounts, inshares traded in Israel, in land or inany o the r p rope r ty r equ i r i ngregistration of transfer, and nomoney or property will be transferredfrom Israel to that government.Since the Palestinian Authority is

defined by Israel as a foreignpolitical entity, its recent decision to

end its economic dependence onsettlements for products, jobs andservices wi l l lead to puni t ivemeasures .According to the bill, even money or

property due to Palestinians and tothe PA by virtue of previous laws,a g r e e m e n t s o r g o v e r n m e n t a l

decisions will not be transferred tothem.The geographical application of the

anti-boycott bill to the West Bank (Judea and Samaria) and thepo ten t i a l annu lmen t o f p r io ragreements will signal a de jureannexation of the West Bank to Israel

and a final demise of the Osloaccords signed by the PA and Israelin the mid-1990s.This bill, like others recently tabled,

comes against the backdrop of recentanalys is by the current Is rae l igovernment and its advocates, whohave sought to draw a distinctionbetween legitimate criticism of Israel and criticism or campaigningthat delegitimises Israel and istherefore beyond the pale.Alan Dershowitz has called this

approach the 80% case for Israel that is, the possibility of criticisingspecific Israeli policies, such as the

settlement project, while emphaticallysupporting Israel as a Jewish state.Examples of illegitimate activities

include universal jurisdiction (theprosecution of officials suspected of war crimes overseas), BDS (boycott,divestment and sanctions), andquestioning the definition of Israel asa Jewish and democratic state. Therecent series of proposed bills inIsrael echoes each of these categoriesby seeking to prohibit them throughlaw and to criminalise human rightsac t i v i s t s who engage i n suchac t iv i t i e s .This approach is deeply flawed.

There i s a d i fference betweendisagreeing wi th cr i t ic ism andseeking to silence it through law. If Israel is a democracy, its activistsmust be allowed to voice criticismand engage in protest, howeverunpopular.By failing to distinguish between a

boycott of settlements and that of Israel itself, the initiators of the billare demonstrating that they are notprotectors of Israel but promotersof a Greater Israel.For them, a boycott of all Israeli

products, as such, is no longerdistinguishable from alternative, more

limited options: the decision of Israelior international activists to boycottsettlement products in order to endthe occupation, or the decision of thePalestinians themselves to stopsupporting the very settlements thatare denying them their sustenance.The settlers and their supporters thus

expect Palestinians not only to acceptthe divestment of their land andresources, but also to support thosewho have robbed them by buyingtheir produce and working (for sub-minimum wages) on the verybuilding sites that are encroaching ontheir lands.

The EU, also a foreign politicalentity under the Israeli definition, islikely to disagree strongly with thisbill. The EU association agreementswith Israel (1995) and with the PLO(1997) have a mutually exclusiveterritorial scope: the EC-Israelagreement applies to the territory of the state of Israel, whereas the EC-PLO agreement appl ies to theterritory of the West Bank and Gaza.When challenged on the issue of

settlement products from the WestBank, the European court of justicer e c e n t l y r u l e d t h a t o n l y t h ePalestinian Authority can issue origin

certificates for goods originating inthe West Bank.In court, the EU advocate-general

was even clearer. He said that as amatter of international law, theborders of Israel are defined by the1947 partition plan for Palestine , andany territories outside the 1947

borders do not form part of theterritory of Israel for purposes of theassociation agreement.If the bill passes into law, the EU

would qualify as a promoter of boycott, whereas Israel could beseen to be breaking the terms of thea s s o c i a t i o n a g r e e m e n t . T h e

name Israel will find it impossible todeny the Palestinians a state merelybecause they have built a workingeconomy and political apparatus?I also find it humorous when Tom

describes Fayyad as if hes a Chicagoward-heeler:The economist-turned-politician

seems more comfortable mixing withhis constituents in the West BankConstituents? Forgive me, but in my

high school civics course I was taughtyou had to be elected to haveconst i tuents . Am I miss ingsomething here or is Tom perhapsmissing something? What wasFayyad ever elected to?I swear, Toms tooting of Fayyads

horn makes me swear the formerspalm is getting greased by someone.You couldnt pay a PR flack enoughto produce such unrelenting upbeatpropaganda. And he hasnt just donethis once, he does it several times ayear. In truth, I half-wonder whetherthe PA is paying Tom a consultingfee of some sort.Heres some more Tom delusion. He

claims conditions in the West Bank are so excellent that even someGazans are moving there. Excuseme Tom, do you realize theres asiege underway on Gaza and that noone gets in or out without Israeli

approval, which is practically non-exis tent? So the only peoplemoving from Gaza to the WestBank are those Israel has permitted todo so.Tom has a truly ambitious agenda for

Pres. Obamas July 6th meeting withBibi:The most important thing President

Obama can do when he meets Israelsprime minister, Bibi Netanyahu, onJuly 6 is to nudge him to begingradually ceding control of majorWest Bank Palestinian cities to thePalestinian AuthorityEver the gradualist even in the face

of mounting disaster, Tom goes forthe lowest common denominator. Ican think of many important thingsObama should nudge Bibi to do:end the siege, end the Occupation,enter final status talks. But switchingfrom Israeli to Palestinian uniforms ina few West Bank cities is not one of them.And all of you out there who like to

on this. The only thing Bibi iswilling to concede to Palestinians isthat Israel can nibble around theedges of Occupation and improve thePalestinians economy. So what tunedoes Tom sing? Its the economystupid. No, in this case its not theeconomy. Its political power andcontrol of land and resources. Youcant build a state or an economywithout having absolute control oversuch things. law. Syria in July 2009 scrapped alaw limiting the length of sentencesfor honor killings, but the new lawsays a man can still benefit fromextenuating circumstances in crimesof passion or honour provided heserves a prison term of no less thantwo years in the case of killing.In Jordan in 2003, the Parliament

voted down, specifically on Islamicgrounds, a provision designed tostiffen penalties for honor killings. Al

-Jazeera reported that Islamists andconservatives said the laws violatedreligious traditions and would destroyfamilies and values.This is why honor killings keep

happening because they are

broadly tolerated, even encouraged,by Islamic teachings and attitudes.Yet no authorities are calling Islamicleaders to account for this. Kurtev wasone of four delegates who set out forSofia to stop the deportation. Thefour delegates met with the Ministerof Interior, Gabrovski, who denied alldeportation plans. However, refusingto give up, Kurtev insisted that theedict be revoked.On telling Kurtevs story, Chairman

of Yad Vashem, Avner Shalev,described Kurtev as a Bulgarianpatriot, courageous fighter and loyalfriend to the Bulgarian Jewishcommunity.With the help of the other three

delegates, Kurtevs courageous anddetermined actions succeeded inreleasing all arrested Jews from oldBulgaria.Kurtev understood that he is a partof a civic society and, therefore, itwas his civic duty to put a stop towhat the Germans wanted, saidShalev. PA prime minister Salam Fayyad, inhis weekly radio address , spoke aboutthe growing movement to give morerights to Arabs of Palestinian descentwho are stuck in Lebanese refugeecamps with few rights.While he said that he supported

giving them more civil rights, hestopped well short of asking that theyshould have the rights of otherrefugees worldwide the right of citizenship in the country in whichone is born.
