PREAMBLE

This Agreement and the Supplemental Agree-mentsattachedheretoisaSuccessorAgreementto the 2013-2016Southern IdahoLaborAgree-ment and is hereby entered into this 1st day of June,2016,byandbetweenCandHConstruc-tion Group Inc., and Intermech Inc. collectivelyrecognized as the “SOUTHERN IDAHO CON-TRACTORSGROUP”,hereinafterreferredtoas“EMPLOYER”, and the PACIFICNORTHWESTREGIONALCOUNCILOFCARPENTERS,here-inafterreferredtoas“UNION”andactingasthebargainingagentfortheLocalUnionsandCoun-cils who have assigned their bargaining rights.TheEmployerandUnionhaveentered into thefollowingAgreementand thosespecificSupple-mentalAgreementsthathavebeenexecutedbytheEmployer for thepurposeofpromotingandimproving the relations between the Employ-er, its employees, and the Union, establishinga formal understanding relative to all conditions ofemployment,andprovidingthemeansfortheamicable and equitable adjustment of grievances whichmayarise.

WITNESS: Inconsiderationofthemutualcove-nantshereinsetforthwhichhavebeenmutuallyagreedto,theEmployerandtheUnionshallbebound as follows:

ARTICLE IPURPOSES

1.1 The purposes of thisAgreement are topromote the settlement of labor disagreementsbyconference,topreventstrikesandlockouts,tostabilizeconditionsinHighway,HeavyandBuild-ingconstructionworkintheareaaffectedbythisAgreement,topreventavoidabledelaysandex-pense,generallytoencourageaspiritofhelpfulcooperationbetweentheEmployerandtheEm-ployeeGroupstotheirmutualadvantage.

1.2 The person signing this Agreement onbehalf of each Employer warrants and guaran-teeshis authority to act for andbind suchEm-ployer. EachpersonsigningthisAgreementonbehalfoftheUnionwarrantsandguaranteeshisauthoritytoactfor,bindandcollectivelybargainforandonbehalfoftheUnion.

ARTICLE 2PARTIES

2.1 ThisAgreementshallapplytoallBuilding,Heavy,HighwayConstruction(exceptresidentialconstruction)comingwithintherecognizedjuris-dictionofthePacificNorthwestRegionalCouncilofCarpentersoftheUnitedBrotherhoodofCar-pentersandJoinersofAmerica,andthesignato-

ryLocalUnions,andindividualmembersthereof,exceptthatitshallnotapplytoSuperintendents,Master Mechanics, Civil Engineers, Timekeep-ers,Messengers,Guards,Confidential Employ-ees,Clerksorotherofficeemployees.

2.2 TheUnionisrecognizedassolebargain-ingagent foremployeescoveredby thisAgree-ment .

ARTICLE 3MANAGEMENT’S RIGHTS

3.1 TheEmployers retain fullandexclusiveauthorityforthemanagementoftheiroperations.TheEmployersshalldirecttheirworkingforcesattheir soleprerogative,which includesbut isnotlimitedtohiring,promotion,transfer,layoffordis-charge.Norules,customs,orpractices,shallbepermittedorobservedwhichlimitorrestrictpro-duction,or limitor restrict theworkingeffortsofemployees.TheEmployersshallutilizethemostefficientmethodsor techniquesof construction,tools,orotherlaborsavingdevices.Thereshallbe no limitations upon the choice of materialsordesign. TheEmployersshallschedulework,shall determine when overtime will be worked,andthenumberofemployeestobeutilized.

3.2 The foregoing enumeration ofmanage-mentrightsshallnotbedeemedtoexcludeotherfunctionsnotspecificallysetforth.TheEmploy-ers,therefore,retainalllegalrightsnotspecifical-lycoveredbythisAgreement.

ARTICLE 4NO STRIKES - NO LOCKOUTS

4.1 Itismutuallyagreedthatthereshallbenoauthorizedstrikes,lockouts,orotherslowdownsorcessationofworkbyeitherpartyonaccountofany labor differencespending the full utilizationof thegrievanceproceduresetup inArticle13,providedthatemployeescoveredbythisAgree-mentshallnotbeexpectedtopassthroughadulyauthorizedpicketline.

4.2 FailureofanEmployertopaywage,trav-el, or other negotiated fringe payments as out-linedinthisAgreementisaviolationofthisAgree-ment and not subject to grievance procedure as outlinedinArticle13.Intheeventofviolationandafterforty-eight(48)hournoticetotheEmployer,theUnionmaytakeeconomicactionagainstsuchEmployertocollectsuchmoniesowed,includingattorneyfees,liquidateddamagesandauditfees.

ARTICLE 5TERRITORY COVERED

5.1 ThisAgreementshallcoverallHighway,HeavyandBuildingConstructionwork inall thearealyingwithintheboundarieswithinthestateofIdaho,southofParallel46whichistheexten-sion of theOregon-Washington state line east-ward from the Idaho-Oregon state line on thewesttotheIdaho-Montanalineontheeast.

ARTICLE 6UNION SECURITY

6.1 All employees covered by this Agree-ment and coming under the jurisdiction of theUnion,assetforthinArticle2shall,asaconditionofemployment,becomemembersoftheappro-priateLocalUnionwithineight(8)daysfollowingthe date of their employment, and shall remainMembersingoodstandingduringthetermofthisAgreement.“Goodstanding”forthepurposeofthisAgreementisinterpretedtomeanallemploy-eesshallmaintaintheirMembershipwithcurrentmonth’sduespaidintheirLocalUnion.Whenanemployee fails to tender toanauthorizedagentoftheUnionsuchinitiationfeesorperiodicuniondues as are required for good standing member-ship,theEmployerwill,uponwrittenrequestfromtheUnion,dismisstheemployeeatthecloseoftheshift.

6.2 UnionSecurity,shallnotbeapplicableonworkwithinthestateofIdahountiltherepealormodificationof the IdahoRight-to-Work lawen-ablingthelegalimplementationoftheclause,atwhichtimetheclauseshallautomaticallybecomeapplicable toworkperformedwithin thestateofIdaho.

ARTICLE 7SUBCONTRACTING

7.1 IfacontractorboundbythisAgreementcontracts or subcontracts any work covered by thisAgreementtobedoneat the jobsiteof theconstruction, alteration, or repair of a building,structureorotherwork toanypersonorpropri-etorwhoisnotsignatorytothisAgreement, theEmployershallrequiresuchsubcontractortobebound to all the provisions of the Agreement,suchcontractorshallmaintaindailyrecordsofthesubcontractorsemployees’jobsitehours,andbeliableforthepaymentoftheseemployees’wag-es, travel,Health&Security,Retirement,CreditUnion, and Apprenticeship and Training contri-butions (or differential) in accordance with thisAgreement . 7.2 In the areas of drywall, acoustical andinsulation,iftheEmployerisunabletofindqual-ifiedcompetitiveUnionsubcontractors,Article7

will be waived by mutual agreement after review ofthebidsbytheUnionunderthefollowingcon-ditions:

7.2.1(A) If the contractor receives three(3) union subcontractor bids on any one segment ofwork(drywall,acousticalandinsulation)refer-encedabove, thecontractorwill selectanduseoneoftheunionsubcontractors.

7.2.2(B) If three(3)unionsubcontractorbids are not received on any segment of work (drywall, acoustical and insulation) referencedabove,thentheEmployermayusethenon-sig-natory subcontractor provided:

7.2.3(C) The non-signatory subcontrac-tor’sbid ismore than5%lower thanthe lowestUnionsubcontractorbid;thisbidmaybeusedbythe Employer, provided the non-signatory sub-contractor is an established licensed contrac-torwho has operatedwithin the territory of theAgreement .

7.3 Exemptionsbeyond theseareasas ref-erenced in7.2mustbeagreed toby theUnionpriortothestartofwork.

7.4 Whenever the Employer is obligated tosatisfyMBE-WBE requirements, theUnion and

the Employer will agree to waive this provisionintheeventanEmployerandUnionareunableto find qualified competitive Union MBE-WBEsubcontractorspriortothebidopening.Thispro-vision shall not be implementedwith any intentotherthantomeetMBE-WBErequirements.

7.5 It is understood that thisArticle appliesonly to work jurisdiction claimed by the UnitedBrotherhoodofCarpentersandJoinersofAmeri-ca .

ARTICLE 8HOURS OF WORK - SHIFTS - OVERTIME

TheworkweekwillstartwiththefirstshiftonMon-dayandconcludewith the third shift onFriday.Eight (8) hours per day shall constitute a stan-dardwork day between the hours of 6:00 a.m.and 6:00 p.m. with one-half (½) hour unpaidlunchperiod.HoursofworkmaybechangedbytheEmployerwithtwenty-four(24)hourpriorno-tificationtotheUnion.Forty(40)hoursperweek,MondaythroughFriday,shallconstitutearegularwork week .

8.2 Employeeswillbeattheirplaceofwork,readyforwork,atthestartoftheshift.Theplaceofworkshallbedefinedasthegangortoolboxor equipment at the employee’s assignedwork

location.Dryand/or lunchshacksand/orcheck-inlocationsshallbeplacedasnearthegangboxorworklocationaspossible.Crewsonshiftwillbegivenadequate time togatherup their toolsbefore quitting time . Employees being terminated orlaidoffshallbegivenadequatetimetocollecttoolsandbelongingspriortotheendoftheshift.On jobswhere theEmployerorownerprohibitsprivate vehicles beyond a designated area, theEmployerwillfurnishamanhaulorpermittheem-ployeessufficienttimetowalktotheparkinglotby quitting time . 8.3 Work performed in excess of eight (8)hoursperdayMondaythroughFriday,oroutsidethenormalshift,andallworkonSaturdaysshallbepaidattimeandone-halfthestraighttimerate.All work performed on Sundays and Holidays shallbepaidatdouble(2)thestraighttimerateofpay.Innocaseshallovertimepayexceeddou-ble thestraight timerateofpay. TheEmployershallhavethesolediscretiontoassignovertimeworktoemployeeswithconsiderationofretentionoftheJobSteward(SeeArticle12). 8.4 Shiftsmaybeestablishedwhenconsid-erednecessarybytheEmployer.Shifthoursandrates will be as follows:

8 .4 .1 Two Daylight Shift Operations: Onatwoconsecutiveshiftoperation,noshiftdiffer-entialisinvolvedforworkperformedoneitherofthese twoshifts. Eachshiftmustbescheduledforatleasteight(8)hoursexceptasprovidedforin Section 1 of thisArticle. On a two shift op-eration,thesecondshiftshallbeestablishedforaminimumofthree(3)days.Oncethestartingtimesareestablishedforthetwoshiftoperation,theyshallnotbechangedexceptuponthree(3)days’noticetotheUnion. 8 .4 .2 Three Shift Operation: On a threeshift operation, the following shall apply:

FIRST SHIFT:Theregularhoursofworkonthefirstshiftofmultipleshiftoperationsshallbeeight(8) hours of continuous employment except forlunch period at midshift, between the hours of6:00 a .m . and 6:00 p .m . SECOND SHIFT: Thesecondshiftshallbesev-enandone-half (7½)hoursof continuousem-ploymentexceptforlunchperiodatmidshift,andshall be paid for eight (8) hours at the straighttimehourlyrate. THIRD SHIFT: Thethirdshiftshallconsistofsev-en(7)consecutivehoursofemployment,exceptforlunchperiodatmidshift,betweenthehoursof

12:30a.m.and8:00a.m.,andshallbepaid foreight(8)hoursatthestraighttimehourlyrate. 8 .4 .3 SPECIAL SHIFTS:

WhenduetoconditionsbeyondthecontroloftheEmployer,orwhencontractspecificationsrequirethatworkcanonlybeperformedoutsidethereg-ulardayshift, thenbymutualagreementaspe-cialshiftmaybeworkedatthestraighttimerate,eight(8)hoursworkforeight(8)hourspay.Thestartingtimeshallbearrangedtofitsuchcondi-tions of work . If employeesare calledback to the jobwithoutreceivinganeight(8)hourbreakbetweenshifts,they shall continue at the applicable overtimerate . 8 .5 Option for 4-Ten Hour Shift: TheEmployermay,athisoption,establishafirstand/orsecondshiftconsistingoften(10)hoursofwork,exclusiveofaone-half (½)hournon-paidlunchperiodperday,thatshallconstituteanor-mal forty (40) hour workweek, provided that itdoesnotconflictwithFederal,Stateorlocalreg-ulationsorlaws.TheEmployercanchangefroma5-eighttoa4-tenhourscheduleorbacktotheother,subjecttothelimitationsthatitwillgivethe

Unionatleastseven(7)calendardays’noticeofsuchchangeandmaintainsuchshift foramini-mumofone(1)workweek.Allhoursofworkontheseshiftsshallbepaidforatthebasicstraighttime hourly wage and fringe rate, overtime willapplyafter ten(10)hours. Notenhoursecondshiftmaybeestablishedwithoutaprecedingtenhourfirstshift.(AlsoseeArticle16) 8.5.1 Intheeventthejobisdownforanyrea-sonbeyondtheEmployer’scontrol,includinghol-idaysasdefinedbyArticle10,thenFridaymay,attheoptionoftheEmployer,beworkedasavolun-tarymake-up (noemployeeshallbe terminatedfor refusal to work a make-up day) .

8 .6 Weekend Shutdowns:

Where thework is started and completedwith-inaperiodbetween12:00p.m.Fridaynightand8:00a.m.thefollowingMondaymorning,allworkwillbeperformedat the timeandone-half (1½)theapplicablerate.

8.7 On a project working a makeup day, ifone (1) carpenter is paid overtime, all affectedCarpenterswill be paid the applicable overtimerate .

ARTICLE 9LUNCH

9.1 Employeesshallnotberequiredtoworkmore than five (5) hours from the start of theirshiftwithoutaone-half(½)hour(normorethanone<1>hour)breakforlunch.Thisperiodshallnot begin earlier than three and one-half (3½)hoursafterthestartoftheshiftandshallnotbe-ginlaterthanfive(5)hoursafterthestartoftheshift. If theyarerequiredtoworkpastthistimeandtheyaredeniedtimetoeat,theyshallbepaidattheapplicableovertimerateuntilsuchtimeastheyareallowedtoeattheirlunch.Ifnotallowedtoeatlunch,employeeswillbepaidanaddition-alone-half(½)hourofovertime.Employeesre-quiredtoworkmorethantwo(2)hoursaftertheendoftheregularshiftshallbeallowedtoatleastone-half(½)hourmealperiodwhichshallbecon-sideredastimeworked,andifitisimpracticalfortheemployeestoleavethejob,theyshallbepro-videdalunchbytheEmployer.

9.2 Employee’s lunch period may be stag-geredduringtheperiodofthreeandone-half(3½)tofive(5)hoursfromthestartof theshift tocover necessary work of a continuous nature .

9 .3 Rest PeriodsEmployeesshallbeallowedarestperiodofnot

Restperi-odsshallbescheduledasnearaspossibletothemidpointoftheworkperiod.Noemployeeshallbe required to workmore than three (3) hourswithoutarestperiod.Therestperiodmaybetak-enattheworkstationwhenreasonable.Wherethenatureoftheworkallowsemployeestotakeintermittent rest periods equivalent to ten minutes foreach4hoursworked,scheduledrestperiodsare not required . A rest period means to stop workduties, exertions, or activities for personalrestandrejuvenation.Itwillbetheresponsibilityofeachemployeetotakerestperiods.Ifanem-ployeedoesnottakearestperiod,thentheem-ployeemustnotifyhis/hersupervisorandarestperiod will be provided .

ARTICLE 10HOLIDAYS

10.1 The followingseven (7)daysshall con-stitutetherecognizedholidayswithinthetermsofthisAgreement. Ifanyof thefollowingholidaysfalls onaSunday,Mondaywill beobservedastheholiday.IfanyholidayfallsonaSaturday,theprecedingFridayshallbeobservedasaholiday.The holiday shall be the twenty-four (24) hourperiodcommencingwiththeestablishedstartingtimeofthedayshiftonthedayoftheholiday.

ARTICLE 11PAY DAY

11.1 Employees shall be paid in full prior toquittingtimeonthe jobsiteonceeachweek(onthesameday),but innoeventshallmore thanfive(5)days’(Saturday,Sundayandholidaysex-cluded)wagebewithheld. If theregularpaydayfallsonaholiday, theem-ployeeshallbepaidonthelastregularworkdaybeforetheholiday.

Anemployee’spaycheckstuborattachedstate-mentshallcontainanitemizedstatementshowingthe breakdown of straight time hours, overtimehours,rateofpay,andallauthorizeddeductions,andmust indicatethenameandaddressof theEmployer.IntheeventanemployeereceivesanN.S.F.Check, thereafterallpaymentsshallbemadebycashorcertifiedcheckandhe/sheshallbeconsiderednotpaid timelyandshall receive

No adjustment of disputed pay will be made unless the employee or the Union shall makeaclaim inwriting to theEmployer’s representa-tiveten(10)workingdaysfromthepayperiodinquestion .

11.2 Anemployee shall be paid in fullwhendischargedduringnormalworkinghours.Whenemployeesare laidoffordischarged,afternor-malworkinghourspaymentshallbemadewithintwenty-four (24) hours (Saturday, Sunday, andHolidaysexcepted). In theevent that paymentis notmadewithin twenty-four (24) hours (Sat-urday,Sunday, andHolidays excepted), he/sheshallreceivetwo(2)hourspayattheapplicablewagerate foreachtwenty-four(24)hourperiodthereafteruntilsaidcheckismailedtoanaddressoftheemployee’schoice.Thepostmarkontheenvelopewillserveasthecutoffforanypenalty.

ARTICLE 12UNION REPRESENTATIVES &

JOB STEWARDS

12.1 TheAuthorizedandCredentialedRepre-sentatives of theUnion having jurisdiction overtheworkcoveredbythisAgreementshallbeal-lowed admission to any job at any time for thepurpose of investigating conditions on the job;provided,however,thattheyshallgivenoticetotheofficeorsuperintendentofthejob.

12.2.1 TheUnionshallsubmit inwriting to theEmployerthenamesofitsJobStewards,when-everpossible,andsuchchangesofJobStewardsasmayoccurfromtimetotime,andtheEmploy-er shall recognize such Job Stewards selectedbytheUnion. OralnotificationofJobStewardswillbeacceptablewheneverwrittennoticeisnotpractical .

12.2.2 Every Job Steward shall perform workfor the Employer to the same extent as otheremployees; however, a Job Steward may takereasonabletimeofffromhisregulardutieswhenan employee (or group of employees) desires to takeupwiththeJobStewardanymatterwhichisbelievedtobeinviolationofthisAgreement.Insuchcases,beforeleavinghisworkarea,theJobSteward shall inform his immediate supervisor

12.2.3 Whenforcesmustbereduced,ifallotherconsiderationsareequal, theSteward shall notbedischargedexceptforjustcauseandshallre-mainon the jobprovided that thereareat leastfour(4)Carpentersontheproject.WhenaJobStewardmustbelaidoffordischarged,theUnionwillbenotifiedforty-eight(48)hourspriortosuchaction . A Job Steward will be given a reasonable amountoftimetotakeuphisreportonceaweek.

12.2.4 EachshiftmayhaveaJobSteward.NoJobStewardshallbeallowedtosolicitMember-shipinhisorganizationortocollectanymoniesfrom any employees on the job duringworkinghours.NoJobStewardwillbedischargedbytheEmployerbecauseofhisUnionactivities.

12.2.5 Stewardsarenotauthorizedtothreaten,direct or cause a work stoppage or slowdown .

ARTICLE 13SETTLEMENT OF DISPUTES & GRIEVANCES

13.1 Itismutuallyagreedthatthereshallbenoauthorizedstrikes,lockouts,orotherslowdownsorcessationofworkbyeitherpartyonaccount

ofanylabordifferencespendingtheutilizationofthegrievanceprocedureassetforthbelow,pro-videdthatemployeescoveredbythisAgreementshallnotbeexpectedtopassthroughadulyau-thorizedpicketline.

13 .2 STEP 1:Intheeventthatadisputearis-ing on the job cannot be satisfactorily adjustedon the job between the representative of theUnioninvolvedandtheEmployer,thesameshallpromptly (not later than five (5) working days),be referred to theAuthorizedRepresentativeoftheUnionandtheEmployerorhis/herauthorizedrepresentative.Shouldtheyfailtoeffectasettle-ment:

STEP 2: TheyshallreferthemattertoaBoardofConciliationwithinfifteen (15)workingdaysofwhichBoardshallconsistoftwo(2)per-sonsappointedbyeachparty,and if these four(4)personscannoteffectasettlementwithinsev-en(7)daysafterthedisputehasbeenreferredtothem:

STEP 3: AnArbitrationCommittee,con-sistingofone(1)representativeofthecompany,one (1) representative of theUnion anda thirdmember tobechosenby these two (2). In theeventthetwo(2)representativesdesignatedbythepartiesshallbeunabletoagreeuponthethird

13.3 This decision shall be final and bindinguponthepartieshereto.AnydecisionrenderedshallbewithinthescopeofthisAgreementandshall not changeanyof its termsor conditions.The arbitrators shall, in their decision, specifywhetherornotthedecisionisretroactiveandtheeffectivedatethereof.

13.4 Failureofeitherpartytoselecttheirrep-resentative for the purpose of arbitrating a dis-puteuponthissectionwithinthirty(30)daysfromthedatesucharbitrationisrequestedshallresultinthedisputebeingadjustedinfavorofthecom-plaining party .

13.5 Anymutualexpenseincurredinthepro-cessofarbitrationshallbeborneequallybytheEmployerandtheUnion.

13.6 Itisfurtherunderstoodthatthegrievanceprocedureaboveset forthshallnotbeused forthepurposeofarrivingatanagreementtosuper-sedethisAgreement.

13.7 By mutual agreement the aforemen-tionedtime-framesinthisarticlemaybewaivedorextended.

ARTICLE 14JURISDICTIONAL DISPUTES

14.1 The parties agree that there will be nocessation or stoppage of work because of juris-dictionaldisputespendingsettlementbythefol-lowing outlined procedures . 14.2 TheEmployerwhohastheresponsibilityfortheperformanceandinstallationshallmakeaspecificassignmentoftheworkasfollows:

14.3 Whereadecisionofrecordappliestothedisputedworkorwhereanagreementofrecordbetweenthedisputing tradesapplies to thedis-putedwork, theEmployershallassign theworkinaccordancewithsuchagreementordecisionof record . Decisions of record are applicable to all trades . Agreements of record are applicable onlytothepartiessignatorytosuchagreements.Wherenodecisionoragreementapplies to the

work, the Employer shall assign the disputedwork in accordancewith the prevailing practiceinthelocality.Thelocalityforthepurposeofde-terminingtheprevailingpracticeshallbedefinedordinarilytomeanthegeographicaljurisdictionofthelocalBuildingandConstructionTradesCoun-cilinwhichtheprojectislocated.

14.4 If thedisputedworkcannotbesatisfac-torilysettledbetween theLocalUnionsand theEmployer,theLocalUnionsshallpromptlysubmitthedisputetotheInternationalUnionswhoshallmeetwiththeEmployertoreviewtheissuesandsettlethedispute.

14.5 ItwillbeaviolationoftheAgreementbytheEmployerorbytheUnioniftheEmployerortheUnionfailstoabidebythedecisionreachedunderthisprocedureorbyanarbiterordecisionof record .

14.6 Craft jurisdiction is neither determinednor awarded by classification and/or scope ofwork appearing in any Labor Agreement .

ARTICLE 15HEALTH, SAFETY AND

ACCIDENT PREVENTION

15.1.1 TheEmployershallcomplywiththeSafe-tyStandardsforconstructionworkintheStateofIdahoandMinimumSafetyStandardsandPrac-tices forBuildingandConstruction IndustryandFederal Safety Standards as required by law in theappropriateareasaffectedbythisAgreement.ThisAgreementisnotintendedto,norshallitbeconstruedascreating, recognizingor imposing,ontheUnionoritsagents,anycommonlawdu-tiesintheareasofsafety.Allforemenandgener-alforemenshallcarryacurrentfirstaidcard.

15.1.2 In the event of an injury requiring hos-pitalization to an employee, the Employer shallnotifytheproperStewardandUnionoftheinjuryas soon as possible . Industrial reports received bytheEmployeraretobesignedandprocessedimmediatelybytheEmployer.

15.2.1 Clean, cold, fresh drinking water andsanitary,disposablecupsshall bekept incloseproximitytotheworkmenatalltimes.IcetobefurnishedduringhotweatheruponrequestoftheBusinessRepresentative.

15.2.2 Toilets, urinals, or latrines in clean andsanitaryconditionsshallbeprovidedonall jobsaccording to State and Federal requirements .

15.3.1 Toimprovethegeneralsafetyconditionson the job, theEmployerwill furnish clean andsanitary items of safety equipment and will re-quire theemployeedrawingsuchequipment, tosignanauthorizationpermittingadeductionasadepositagainstthereturnoftheequipment.

15.3.2 Rubbergearotherthantonormallyturnfoul weather and welding or burning protectiveequipmentsuchashoods,goggles,lens,leatherwelding gloves and jackets, etc., shall be sup-pliedonall jobswhereneeded, insuitablecon-ditionsandsizes toeachworker. Theseare tobe charged to the worker who is to guaranteetheir return, regardlessofcondition. Incaseofintentional destruction, it will be charged to theemployee .

gyplantownerfromwhomtheemployerholdsaconstructioncontract.

Employersagreetoplanworkforthemostevendistribution of radiation/hazardous material ex-posure amongst the employees consistent withefficientutilizationofmanpower.

LEVEL D: + $.25 PER HOURFootnote: This is the lowest level of protection. No res-pirator is used and skin protection is minimal.

LEVEL C: + $.50 PER HOURFootnote: This level uses an air purifying respirator or additional protective clothing.

LEVEL B: + $.75 PER HOURFootnote: Uses same respirator protection as Level A. Supplied air line is provided in conjunction with a chemical “splash suit.”

LEVEL A: + $1.00 PER HOURFootnote: This level utilizes a fully encapsulated suit with a self-contained breathing apparatus or a supplied air line.

16.2 Employeeswhohavenotbeengivenno-ticenot to report toworkat least two (2)hourspriortothenormalstartingtimeoftheirshiftwhoreportforworkshallreceive:

Inside the 15-mile Radius Zone: One (1) hour reporting pay

Outside the 15-mile Radius Zone: Two (2) hours reporting pay

16 .3 Employees prevented from completing theshiftdueto inclementweatherafter theone(1) hourminimum shall be paid for actual timeworked and applicable fringes .

Intheeventanemployeehaslefttheprojectandiscalledbacktoperformovertimeworkafterhisshift, or onSaturday,Sundayor holidays, suchemployee shall be paid a minimum of four (4)

ARTICLE 17EQUAL EMPLOYMENT OPPORTUNITY

17.1 Theparties to thisAgreement acknowl-edgeandagreetocomplywiththerequirementsofFederalandStatelaws,ExecutiveOrdersandotherrulesandregulationsgoverningcivilrightsto insurethatthereshallbenodiscriminationinemployment against any employee or applicant foremploymentbecauseofage,race,color,reli-gion,sex,ornationalorigin.

17.2 ThepartiesheretorecognizethattheEm-ployerscompliancewithprojectspecificationsisofparamountimportance.Itismutuallyagreed,therefore, by the parties to thisAgreement thatprovisionsof thisAgreementwillbe interpreted,appliedandenforcedinamannerthatwillservetoassurecompliancewithprojectspecificationsastheyrelatetorecruiting,training,andhiring.

ARTICLE 18SAVINGS CLAUSE

18.1 IfanyprovisionofthisAgreementortheapplicationofsuchprovisionsshall,inanycourtorgovernmentaction,beheldinvalid,theremain-ingprovisionsandtheapplicationshallnotbeaf-fected.Andprovidedfurther,thatthepartiesshallimmediately proceed to negotiate a valid provi-sionandArticle14shallnotapplytothisArticle.

18.2 TheEmployerandtheUnionmayenterinto Addendums covering work performed on In-dianlandsandunderthecontrolofTribalCoun-cils .

ARTICLE 19PUBLIC WORKS PROJECTS

IDAHO STATE

Public Works Projects - Davis Bacon Act & Related Statutes

19.1 In theevent theEmployerbidsapublicjoborprojectbeingawardedbyaFederal,State,County,Cityorotherpublicentitywhichistobeperformed at a pre-determined and/or prevail-ing wage rate established pursuant to the pro-visionsof theDavis-BaconAct (Public Law74-

Uponwritten request, theEmployerwillprovideacopyofthenoticetoproceedtotheLo-calUnionshavingjurisdictionoftheproject.Thefringe benefit contribution rates shall be thoseas established and maintained by the MasterAgreement.Notwithstandingtheabove,theproj-ect agreements may be mutually agreed upon toallowuseofthepre-determinedwageforthedurationofaproject toexceed twenty-four (24)months.

In theevent thespecifications includeanesca-latorprovisioncoveringwages,suchamountwillbeincludedasanincreasetowagestotheextentthat theEmployermay recover in theescalatorclaim .

19.3 The Employer will, when requested inwriting,supplyaccurateandreliable informationoncompanystationerythatwillassisttheUnionin establishing the correct Davis-Bacon rateswhenrespondingtoDOLrequestsforprevailingwage data .

INTERPRETATIONS:

1. When wage and fringe are printed asprevailingrate,andthenpaythepublishedwageandtheMasterAgreementfringe.

3. Whenwageonlyisprintedandisgreaterthantheagreementwage,thensubtracttheMas-terAgreementfringetogetthewage.(Wageswillnotbedecreasedinordertomaintainbenefit.

ARTICLE 20SPECIAL CONDITIONS

20.1 Bothpartiesrecognizethattheremaybeextenuatingcircumstanceswhenitistothemu-tual interestofbothparties tomodify the termsofthisAgreement.Inthatevent,itwillnotbeaviolationofthisAgreementforthepartiestomeetandmutuallyagreetomakesuchmodificationstomeetaspecificneedonaspecificproject.

20.1.2 Inordertomaximizetheeffectofthispro-vision,allcraftswillberequestedtoactuniform-ly. Thegeneralcontractorshall requesthis/hersubcontractorstocomplywithanymodificationsgrantedunderthisprovision.

20.2 Whenever non-Union contractors arepresent on a bid list or negotiating for a job,thisArticle may be implemented upon request.Wherenounionbiddersarepresentonabidlist,the Union will request union contractors to bidthatworkwheneverpossible.ThisArticlewillbedenied any non-signatory contractor or any dou-ble-breasted contractor . Any decisions concern-ingSpecialConditionsofthisAgreementshallbefinalandbindingonallparties.

ARTICLE 21CRAFT SCHEDULES

21.1 Theclassificationsforemployees,wagerates, effective dates, health and security, pen-sions,trainingandotherbenefitsfunds,andotherconsiderations of employment, shall be as pro-videdintheseparateschedulesattachedheretoandmadeapartofthisAgreement.

21.2 Anindividualretirementplan,suchasa401K,401A,oranannuityprogram,maybees-tablishedbytheUnion,withtheagreementoftheEmployeronanindividualemployeebasis.Suchaprogramshall beat nocost to theEmployer.The plan participants will be responsible for allcostsassociatedwiththeplan.

ARTICLE 22EFFECTIVE DATE AND DURATION

22.1 This Agreement shall become effectiveas provided in thisArticle when signed by theSouthern IdahoContractorsGroupand thePa-cificNorthwestRegionalCouncilofCarpentersoftheUnitedBrotherhoodofCarpentersandJoin-ersofAmericaanditsaffiliatedLocalUnionshav-ingjurisdictionintheterritorydesignatedinArticle5 .

22.2 AllworkmencoveredbythisAgreementshall be classified and paid in accordancewiththeclassificationsandwageratesassetforthintheSchedulesattachedhereto,andherebymadeapartofthisAgreement,andnootherclassifica-tions orwage rates shall be recognized unlessthisAgreementshallbemodifiedasprovidedforintheSchedulesofthisAgreement.

22.3 This Agreement shall become effectiveuponallworkJune1,2016,andshallremaininfullforceandeffectuntilMay31,2019,andfromyear toyear thereafterunlessnotice isgiven inwritingbytheUnionortheEmployertotheotherparty .

22.4 Exceptbymutualwrittenagreement,ter-minationofthisAgreementoranyannualcontract

effectuatedthroughautomaticrenewal,must, totheexclusionofallothermethodsbeperfectedbygivenwritten“NoticeofTermination”notlaterthanninety(90)daysnormorethanonehundredtwenty (120) days prior to the expiration date,whereupon the contract shall, on its expirationdate,terminate.Effectiveterminationeliminatesautomaticrenewal.Thepartiesshallbeginnego-tiationswithinthirty(30)daysafterreceiptofanynotice .

22.5 Any “Notice of Opening” or “Notice ofTermination”givenwithinninety(90)daysofanyexpirationdateshallbeabsolutelynullandvoidand completely ineffective for all purposes .

ARTICLE 23 SUBSTANCE ABUSE POLICY

23 .1 Labor and Management are committed toprovidingemployeeswithadrug-freeandal-cohol-freeworkplace.Itisthegoaltoprotectthehealthandsafetyofemployeesandtopromoteaproductiveworkplace,andprotectthereputationofLaborandManagementandtheemployees.

Consistentwith those goals, theEmployer pro-hibits the use, manufacture, possession, distri-butionorsale,atitsemploymentsites,ofdrugs,drugparaphernaliaoralcohol.Aprogramofurine

II. HEALTH & SECURITY TRUST FUND

Itisagreedbythepartiesheretothatallemploy-erscoveredbythisAgreementshallcontributeasumas listed inSchedule“A-1”herein foreachcompensablemanhourofCarpentersemployedbyEmployerscoveredbythisAgreement,whichcontributionshallbemadetotheWesternWash-ingtonCarpenters-EmployersHealth andSecu-rityTrustFundinthemannerassetforthintheTrustAgreementofsaidTrustFund.Thedetailsof theHealth and Security Plan established bythis Trust Fund and this Trust Fund itself shallcontinue to be controlled and administered by a JointBoardofTrusteescomposedofequalrep-resentation of labor and management who aresignatorstotheTrustAgreementoftheaforesaidTrustFund.EachTrusteeappointedbytheUnionshallbeamemberoftheUnionandemployedbytheUnionandeachManagementtrusteeshallbeasalariedexecutiveorofficerofasignatoryEm-ployer,oranemployeeofanEmployerassocia-tion,onbehalfofitsmemberemployers.

III. PENSION TRUST FUND

Itisagreedbythepartiesheretothatallemploy-erscoveredbythisAgreementshallcontributeasumas listed inSchedule“A-1”herein foreach

compensablemanhourofCarpentersemployedbyEmployerscoveredby thisAgreement intoaRetirementFundknownasthe“Washington-Ida-ho-Montana Carpenters-Employers RetirementFund”.Suchpaymentsshallbemademonthlyonorbeforethe15thofthemonthfollowingthatforwhichcontributionsarebeingmadeandshallbedeposited in a delegated bank or banks in accor-dancewith thenegotiatedTrustAgreementdat-edJuly20,1965,betweentheInlandNorthwestChapter of theAssociatedGeneral ContractorsofAmericaandtheWashingtonStateCouncilofCarpenters,DistrictCouncilsandsignatoryLocalUnionsoftheUnitedBrotherhoodofCarpentersandJoinersofAmericaandtheindividualmem-bers thereof.The signatory employersagree toabidebyallthetermsandconditionsoftheTrustAgreement and any amendments heretoforeor hereafter adopted. The TrustAgreement, asamended,isincorporatedbyreferenceandmadeapartofthisAgreement.

IV. **CREDIT UNION PROVISION

Effective January 1, 2008, the parties agreethatinadditiontothewageratesprovidedforinthisAgreement,the Employer shall pay into a credit union $1.00 per hour worked for each Carpenter and Millwright covered by this Agreement. The amount has been included

in the base wages listed in the SCHEDULE A 1. CLASSIFICATIONS, WAGE RATES AND EF-FECTIVE DATES.Thenameofthecreditunionto which such payments shall bemadewill bespecified inaseparateLetterofUnderstanding.Suchpaymentshallbemademonthlyonorbe-forethe15thofthemonthfollowingthatforwhichthecontribution isbeingmadeandshallbede-positedinthedepositorybankdesignatedtoac-cepttheotherfringebenefitsprovidedforinthisAgreement .

The purpose of these contributions is to createindividualshareaccountsintheCreditUnionforeachCarpentercoveredbythisAgreement.

Thedetailsconcerningtheadministrationof theCredit Union shall be as stated in their charterandbylaws,andanyamendment theretowhichmay be approved by theNationalCredit UnionAdministration.NeithertheEmployerAssociationnorindividualEmployer,northeUnionshallpar-ticipateintheadministrationofsaidCreditUnion.It is understood that the Employers will makethesecontributionsonthesametransmittalformsasareused for theother fringes. Thepro-ratacost of such forms, and the collection and ac-countingthereofwillbedeductedfromthecontri-butionsandbepaidtothefringebenefitadminis-trator.Thebalanceremainingwillbecreditedto

ItisfurtherunderstoodthatthecharterandbylawsofthedesignatedCreditUnionswillbeamendedtoextendmembershiptoallCarpenterscoveredbythisAgreement.

In order to eliminate onerous book and record keeping burdens on all parties, Employers willmakecontributionstoeachofthefundsbymeansofonecheckandonereporttoincludeallfunds.Pro-ratacostsofthereportformswillbepaidbythe fundsequally. TheFundAdministrator andthedepositorybankworkingjointlywilldistributethecontributionsasoutlinedinthereportandthisschedule.

In the event anEmployer fails tomake the re-quiredmonetarycontributionsinconformitywithSections1,2and4ofthisArticle,theUnionmaytakeanyeconomicactionnecessarytoinsurethepropercollectionofthesecontributions.

FAILURE TO PAY CONTRIBUTIONS. Severe penalties for delinquencies are provided intheTrustAgreements.

V. APPRENTICESHIP AND TRAINING TRUST FUND

Inadditiontothewagerateslistedherein,allper-sons, parties, firms, or corporationsas listed insignaturescheduleattachedhereto,orotherwisecomingunderthescopeofthisAgreement,whoare,ormaybecomesignatorytothisAgreement,agreethattheexistingOregon-WashingtonCar-penters-EmployersApprenticeship and TrainingTrust Fund, established December 28, 1965,shallcontinueinfullforceandeffectforthepur-poseofsupportingandexpandingapprenticeshipand training programs for all eligible employees coveredbythisAgreementandshallpayintotheexisting Oregon-Washington Carpenters-Em-ployer ApprenticeshipandTrainingTrustFund,effectiveJanuary1,2008,Apprenticeshipcontri-bution is1.4%ofGroup1 totalpackage (Wage+ Health and Welfare + Pension X 1.4%) perhourforeachcompensatedhourworkedforeachemployeecoveredby thisAgreement.Paymentshallbemademonthlyonorbeforethe15th day ofthemonthfollowingthatforwhichcontributionisbeingmadeandshallbedepositedintheTrustDepartment of Carpenters Trust Funds, WellsFargoBank,P.O.Box3984,Seattle,Washing-ton 98164-3984. The Employer agrees to andbecomesapartytotheTrustAgreementknown

VI. UNION DEDUCTIONS-DUES CHECK OFF

In accordance with terms of an individual andvoluntary written authorization for check-off ofmembershipduesordeductions in formpermit-tedbytheprovisionsofSection302(c)oftheLa-borManagementAct,asamended,theemployeragrees to deduct for working dues or deductions anamount fromwagesonceeachweek,whichhas been authorized by themembership. Theworkingduesordeductionswhicharedeductedshallbepaidmonthlybythefifteenth(15th)dayof themonth following themonth inwhich theyare deducted .

Therateforunionduesdeductionis3.85%4%ofthetaxablehourlywagerateconvertedtoacentsper hour, times all hours worked. Carpentersforemen, general foremen, or superintendentswouldbechargedusingthejourneymancarpen-

Upon serving 90 or more days written notice to the Employer, the Union shall be permitted todivert any portion of the wage package to anyof the trust fundsorwageratesset forth in thisagreement .

EmployerTrusteestothe:CarpentersHealthandSecurity Trust of Western Washington; Wash-ington-Idaho Montana Carpenters-EmployersRetirementTrustFund;Oregon-WashingtonCar-penters-EmployersApprenticeship and TrainingTrust Fund shall be contributing employers ortheirfull-timeemployees.

CARPENTERS WORK RULES

1 . TOOLS (Employees):

Allemployeesmusthavetheirtoolssharpandingoodconditionbeforegoingonanyjob.Sharp-ening of tools shall be the responsibility of theEmployer. Employees shall beallowed time tofile saws and sharpen tools, or SawFilermustbeemployedonthejob,ortheymaybetakentoUnionshopforsharpeningattheEmployer’sex-pense.Toolssharpenedwillbereturnedattimeof layoff or suitable arrangement will be made for theirreturn.

2 . TOOLS (Employers):

a. TheEmployershall,atthestartofajob,fur-nish suitable place for keeping employees’toolkitsandsame tobeprovidedwithsuit-able lock for protection during non-working hours.TheEmployerwillmaintaininsuranceto protect employees against loss of tools by fire, flood, robbery from forced entry, or bydamage from any Employer equipment and work clothing lost by fire, flood and forcedentry . Employers will require a list of tools

3. TRANSPORTATION:

All transportation or drayage furnished by theEmployer shall afford the maximum protectionagainst the exposure to the elements and thecostofsuchtransportationshallbebornebytheEmployer.Notransportationwillbefurnishedonthejobduringworkinghoursbytheemployee.

4. FOREMAN / GENERAL FOREMAN:

TheEmployershallbethesolejudgeoftheneedfor thenumberofandtheresponsibilitiesofsu-pervisory personnel and the Union shall in noway interferewith theperformanceof theFore-man/GeneralForemanincarryingouthisrespon-sibilitiesasdirectedbytheEmployer.Therewillbe no restrictions in crafts to be supervised by the Foreman/General Foreman. TransportationwillbeprovidedtoForemanattheoptionoftheEmployer .

APPRENTICESHIP & TRAINING

SECTION 1. Recognizingtheneedforanad-equate supply of qualified carpenters, the con-tractorandtheUnionmutuallyagreetoactivelypromote,andparticipate in, jointapprenticeshipand retraining programs designed to meet thisneed .

SECTION 2. Such programs which exist oraredevelopedtoachievethisendandaresup-portedinwholeorinpartfromfundsderivedfromthisAgreementshall:

A. Be jointly administered by equal represen-tation ofManagement, as appointedby thecontractor, and labor as appointed by theUnion .

B. ComplywithallapplicableStateandFederalregulations governing same .

C. Issue certification of achievement to eachperson satisfactorily completing the pro-grams’uniformstandardsasestablishedbypartiestothisAgreement.

D. AseparateOut-of-WorkList forApprenticesshallbemaintainedateachhiringhall.The

method of selection and dispatching of ap-prenticesshallbedeterminedbyeach localJ.A.T.C.andshallbecomepartofthisAgree-ment .

E. The employment ofApprentices shall be inaccordancewith the followingratios: EveryEmployerwhoemploystwo(2)ormorejour-neymensteadilymayhavetwo(2)apprentic-esandmayhaveone(1)additionalappren-ticeforeverythree(3)additionaljourneymenon the job. Everyemployershallhaveone(1)apprenticeforeverythree(3)journeymenemployed, ifapprenticesareavailable. Ex-ceptions to these provisions may be madeat the discretion of the jointApprenticeshipandTrainingCommittee.TheBureauofAp-prenticeshipandTrainingshallbeinformedinwritingofallexceptions.

F. Provide wages in accordance with herein

attachedSchedules“A”forthefollowingde-finedclassification:

APPRENTICE: Onewhoisactivelyenrolledin a FederalApproved JointApprenticeshipprogramdesignedtoprovideon-the-jobandrelatedclassroomtrainingsufficienttopermitapersontomeettheminimumuniformstan-dardsofaQualifiedJourneymanCarpenter.

G. When an Apprentice is be laid off or dis-charged for cause, the Union will be givenforty-eight(48)hourspriornotice.

H. All Apprentices shall be required to attendrelated training classes as per the J.A.T.C.schedule. Apprentices shall take time offthe job without pay for one (1) week, ap-proximately once every threemonths. TheApprenticewillbenotifiedinadvanceofthescheduleddatesandshouldnotifythejobsu-pervisorofthescheduleddaysfortraining.

I. Itisagreedthatallthecontractorswillcontin-uetomaintainandsupportApprenticeship.
