    PEC: Any Severance Tax Should Go First To Environmental Restoration, Protection

    Davitt Woodwell, Executive Vice President for PA Environmental Council, issued the following

    statement Monday on state budget negotiations and the potential for a severance tax on natural gas

    development.

    Many legislators in the General Assembly are introducing new legislation that would enact aseverance tax on natural gas drilling in Pennsylvania, and with it, bring an end to desperately-needed

    shale gas revenues for environmental protection.

    Different severance tax proposals are also being advanced by the candidates for governor.

    Already there is a confusing flurry of words and numbers to support or challenge this legislation, dissect

    how the tax should be calculated, and decide how the monies should be spent.

    Whats behind all this? Big money.

    For years Pennsylvaniaconsidered enacting a severance tax, but ultimately the

    county-by-county impact fee established by Act 13 of 2012 won out. Funds from those fees have

    reached $630 million and are used for a variety of critical programs. And while that number may seem

    large, it is dwarfed by potential revenues a severance tax would generate.

    Because Pennsylvania is facing a significant budget shortfall in the next year, policy makers ofall stripes see the potential of a severance tax as a solution to their revenue problems.

    The problem is that most of the discussion of severance tax focuses on spending the money

    significantly or solely on education at the expense of environmental protection. And while quality

    education is a critical piece of ensuring Pennsylvanias future, the proposals are being made to the

    immediate detriment of Pennsylvanias environmental health and public resources.

    The very legislation that authorized the imposition of impact fees includes a sunset provision for

    those fees the moment a severance tax is passed in Pennsylvania. That means critical support for state

    government oversight of the natural gas industry, as well as funding for an array of restoration and

    recreational programs which deliver tangible economic and quality of life benefits to the people of

    Pennsylvania will disappear overnight. It will also increase pressure to open up more state forest and

    park lands for natural gas development.This situation is unacceptable.

    Any severance tax must dedicate a significant share of revenues to supporting state agencies

    charged with overseeing the natural gas industry, as well as for initiatives like combating enormous

    environmental legacy issues like abandoned mine drainage, watershed restoration, protecting key

    habitats, and restoring and enhancing our public lands and recreational amenities.

    Revenues from a severance tax should also expand and make permanent the standing

    executive order to prohibit any future development on state forest and park land.

    Pennsylvania has a long history of both environmental devastation and renewal. The General

    Assembly and Governor should not abdicate their responsibility, or the opportunity presented by a

    severance tax, to restore our Commonwealth and to protect against future impacts to the resources

    owned and enjoyed by all Pennsylvanians.

    Growing Greener Coalition Says Include The Environment In Any Severance Tax

    The PA Growing Greener CoalitionTuesday urged state legislators to include funding for environmental

    programs and initiatives in any legislation that would enact a severance tax on natural gas extraction in

    Pennsylvania.

    Any severance tax must dedicate funds toward the protection of our land, air and water, said

    Andrew Heath, executive director of the Coalition. The Pennsylvania Growing Greener Coalition urges

    lawmakers to remember the critical need for funding to protect our farms and open spaces, restore our

    waterways, enhance our parks and trails, conserve our wildlife habitat, and preserve our historic sites

    and heritage areas.

    The Coalitionpointed to a new surveythat found overwhelming public support for continuingexisting dedicated state funding for conservation and for increasing state funding to protect land, water

    and historic sites.

    Overall, the survey found that more than 97.4 percent of Pennsylvanians surveyed think that

    state funds dedicated to protecting rivers and streams conserving open space, forests, natural areas and

    wildlife habitats providing parks and trails, and preserving farmland should continue to be used for these

    purposes. This figure represented strong bipartisan support, and is up by five percentage points since

    2012.

    The survey also found that more than three-quarters of respondents 82.6 percent would

    support increasing state funds to address these issues, even if it would cost the average household $10

    more annually. This figure is up from 77.7 percent in 2012.

    The survey was conducted between March 17 and April 16 this year by the Center for Survey

    Research at Penn State Harrisburg. The survey questions were commissioned by The Nature

    Conservancy and The Trust for Public Land.Public support for protecting Pennsylvanias extraordinary natural and historic treasures has

    always been strong, and this survey shows that it continues to grow, said Heath. If there is to be a

    severance tax on natural gas extraction, it makes sense that a significant portion should be invested in the

    forests, fields, rivers and streams that Pennsylvanians value so highly.

    Despite the success of such programs like the Growing Greener Environmental Stewardship

    Fund Keystone Recreation, Park & Conservation Fund Agricultural Preservation Marcellus Shale

    Legacy Fund Heritage Areas Program, and Historic Preservation, there is much more work that needs

    to be done.

    Consider that:

    -- The Commonwealth has 19,000 miles of rivers and streams that do not meet basic water quality

    standards-- More than 2,000 family farms remain on the statewide list for preservation

    -- Pennsylvania continues to lose more forest, wildlife habitat, farmland and other open spaces to

    overdevelopment than we are able to preserve and

    -- Abandoned mines still scar almost 220,000 acres across the Commonwealth and are the cause of

    more than 5,000 miles of dead streams.

    Investments in conservation, recreation, and preservation also bolster the economy. A Trust for

    Public Land study found that for every $1 invested in land and water conservation, $7 in natural goods

    and services is returned to the state of Pennsylvania.

    Moreover, investments in parks, trails, greenways, and open space add billions of dollars to

    property values and help support Pennsylvanias tourism and recreation industry.

    A report by the Outdoor Industry Association indicates that outdoor recreation in Pennsylvania

    generates $1.6 billionin state and local tax revenue and supports 219,000 direct Pennsylvania jobs.

    In addition, conservation funding is an essential component for meeting federal Clean Water Act

    mandates associated with the Chesapeake Bay Blueprintand the need to reduce pollution in our local

    rivers and streams.

    The Coalition also strongly supports preserving the funding provided by the current impact fee in

    order to address the impacts of drilling on communities and the environment.

    Communities across Pennsylvania have benefited from the Marcellus Shale Legacy Fund, said

    Heath. These investments and the economic and quality of life benefits they bring must continue.

    Democratic candidate for Governor Tom Wolf Tuesday urged members of the General Assembly and

    Gov. Corbett to enact a five percent natural gas severance tax to help address the states budget deficit

    this year.

    Unfortunately, the severance tax proposal Tom Wolfhas made would not invest any of the

    revenue in environmental restoration and protection programs and projects.

    The text of Wolfs letters to the Governor and General Assembly follows--

    Dear Members of the Pennsylvania General Assembly,

    As budget negotiations continue in Harrisburg, the passage of a severance tax on natural gas at the

    effective rate of 5 percent is essential and should contain no exemptions. I have been publicly calling for

    this to occur for more than 5 years. This issue has to be about more than politics - the people of

    Pennsylvania deserve to get their fair share and they should be partners with the gas industry because

    the Marcellus Shale is an important economic catalyst for our Commonwealth.

    Right now Pennsylvania is facing an estimated $1.4 billion budget deficit and the threat of a

    credit downgrade. We have fallen to the bottom in job creation, and too often our leaders advocate for

    the same old tired policies that do little to solve our problems. We cannot keep placing greater financial

    burden at the feet of struggling families while oil and gas companies are not asked to pay up.

    As a former business owner, I believe the natural gas industry is vital to our state's economic

    future. Pennsylvania should not be the only major gas-producing state without a severance tax this is

    unacceptable and deprives our Commonwealth of the necessary resources needed to make investments

    in areas like education and infrastructure, as well as make sure that the proper environmental oversight isin place and that we are building a bridge to a renewable and sustainable energy future.

    Pennsylvania is home to an abundance of natural gas, and our geographic location provides

    direct access to the biggest markets in the world, but right now we are missing out on an opportunity to

    truly share in the benefits of this industry. It cannot be understated that with the revenue generated from

    a severance tax, our economy will reap great benefits that could lead to the development of

    good-paying energy jobs a safe and secure environment and the ability to make critical investments in

    education and infrastructure.

    Once again, I urge you to put politics aside and stand with the people of Pennsylvania and pass

    a 5 percent severance tax, which will put Pennsylvania in line with all major gas-producing states in the

    country.

    Now is the time to get to work and craft a plan that lays out how to best share in the benefits of

    the Marcellus Shale to enhance our economy. With the revenue generated from a 5 percent severance

    tax, we can build a 21st century economic infrastructure in Pennsylvania by providing theCommonwealth with the incentive and revenue needed to grow.

    Dear Governor Corbett,

    The urgent challenge facing our state leaders, now and into the future, is how to manage our remarkable

    natural gas resource so that the citizens of Pennsylvania broadly share its benefits for many years to

    come. I believe it is incumbent upon our leaders to put politics aside and pass a severance tax at the

    effective rate of 5 percent. I urge you to join me in supporting this and agree to not veto such a measure

    if it is passed by the General Assembly.

    There is support for a severance tax from Republicans and Democrats alike along with a

    majority of Pennsylvanians, and the revenue generated can be used to make critical investments in

    priorities like education and local infrastructure, and help provide greater environmental oversight as we

    as deliver the tools to build a renewable energy future.I believe the natural gas industry is vital to our states economic future but right now

    Pennsylvania is the only major gas-producing state without a severance tax this is unacceptable. Our

    state has an abundance of natural gas, and the development of this resource offers the Commonwealth

    the opportunity to expand prosperity across our entire economy.

    If this is done right, individual citizens and businesses will benefit from the large reserves of

    natural gas trapped in the Marcellus Shale for many years, but not making gas companies pay their fair

    share while our schools are suffering and Pennsylvania families are struggling benefits no one.

    Making sure we do it right, therefore, should be on the top of everyone's mind, and a severance

    tax -- in line with other states in the region -- is the way to accomplish this.

    Gas Drillers Pay $225.7 Million In Impact Fees For 2013, 11.5% More Than 2012

    The Tribune Review reportedMonday afternoon the Public Utility Commission collected 11.5 percent

    more in drilling impact fees for 2013 than it did in 2012.

    The PUC collected $225.75 million for impact fees in 2013, up from $202.4 million for 2012

    and $204.2 million in 2011 totalling $632.35 million for the first three years of the program.

    The PUC also made available a list of how much money each county and municipalitieswillreceive from the 2013 impact fees.

    "These dollars are helping local communities all across Pennsylvania meet their critical

    obligations to their constituents without the need to raise local taxes," said Gov. Corbett. "With this new

    revenue, we are making significant investments in conservation and environmental protection projects

    throughout the commonwealth, including the first infusion of new money into the Growing Greener

    program since 2002."

    Under Act 13, county and municipal governments can use their shares of the money on various

    expenses related to natural gas development, including:

    -- Construction, repair and maintenance of roads, bridges and other public infrastructure

    -- Water, stormwater and sewer system construction and repair

    -- Emergency response preparedness, training, equipment, responder recruitment

    -- Preservation and reclamation of surface and subsurface water supplies

    -- Records management, geographic information systems and information technology

    -- Projects which increase the availability of affordable housing to low-income residents

    -- Delivery of social services, including domestic relations, drug and alcohol treatment, job training and

    counseling

    -- Offsetting increased judicial system costs, including training

    -- Assistance to county conservation districts for inspection, oversight and enforcement of natural gas

    development and

    -- County or municipal planning.

    On April 25 StateImpact Pennsylvania reported nearly half the townships and a quarter of thecounties receiving funds from the Act 13 drilling impact fee missed the April 15 deadline for reporting

    how they spent $17.4 million of last years money. Reports were filed covering $81.8 million.

    County and local governments spent just $3.1 million of the $98.9 million they received from

    2012 impact fees on projects in any way connected to environmental problems and just $7,296 on

    water preservation and reclamation, according to the Public Utility Commission.

    Additionally, state and county agencies with responsibility and oversight of natural gas

    development will receive $17 million in funding for this round of impact fee revenues, including the

    Department of Environmental Protection, Pennsylvania Emergency Management Agency, the PUC, the

    Office of the State Fire Commissioner, and the Pennsylvania Fish and Boat Commission.

    Approximately $123 million will be distributed to county and municipal governments in over 40 counties

    that host shale gas activity.

    Another $82 million will be distributed through the Marcellus Shale Legacy Fund to counties for

    parks, recreation, greenway trail and bridge improvements, as well as competitive grants awarded tolocal governments and non-profit organizations for environmental improvement projects.

    entire Commonwealth. These disbursements, which have increased more than 10 percent

    year-over-year, are providing critical revenues streams directly to local governments as well as for

    important environmental-focused programs.

    Act 13, a commonsense bipartisan law, aimed to strengthen our environmental regulations and

    ensure that local governments would realize these broad-based benefits, all while keeping Pennsylvania

    competitive and an attractive state to invest, grow jobs and do business. These tens of millions of dollarsin increased tax revenues are proof positive that this law is working.

    While were making meaningful, shared gains as Pennsylvania continues to be a top natural

    gas-producing state helping to create thousands of good jobs, especially in our manufacturing industry

    elected officials should not unnecessarily curb this positive progress with uncompetitive, short-sighted

    Devlins comments were made at the end of three days of hearings before Commonwealth

    Court in a lawsuit the PA Environmental Defense Fundfiled against the Rendell and Corbett

    Administrations over the transfer over $383 million in proceeds in DCNRs Oil and Gas Fund to

    balance the state General Fund. (PA Environment Digest June 2, 2014)During part of Devlins questioning, he said to meet the $75 million revenue goal the Governor

    set out in his proposal, DCNR would have to lease an additional 25,000 acres of Marcellus Shale

    lands.

    Devlin said the drilling leases entered into by DCNR contained significant protections for the

    environment and limited the number of well pads drilling companies could build. The leases also prohib

    conventional oil and gas drilling in the areas leased for Marcellus Shale development because DCNR

    felt conventional wells were more destructive.

    Devlin testified that when the drilling on state forests began [during the Rendell Administration],

    "we didn't have a clue what was going to happen," and although the agency "has a much better handle

    on the situation" now, he said, "we don't have a handle on the total impact, no."

    Poll: PA Supports Drilling 58-33%, Opposes Drilling In State Parks, Forests 57-36%, But

    Citing economic benefits over environmental concerns, Pennsylvania voters support 58-33 percent

    drilling for natural gas in the Marcellus Shale, according to a Quinnipiac University pollreleased Friday

    Except for Democrats, who oppose drilling 48-41 percent, there is support among all partisan,gender and age groups finds. Support by region ranges from 48 - 43 percent in the Philadelphia suburbs

    to 70-23 percent in the northwest corner of the state.

    Pennsylvania voters oppose 57-36 percent, however, Gov. Tom Corbett's Executive Order

    allowing drilling for natural gas under state parks and forests.

    Unfortunately, the question asked by the Quinnipiac poll-- Gov. Corbett has issued an

    executive order that would allow drilling for natural gas under state parks and forests. Do you support

    or oppose allowing drilling for natural gas under state parks and forests?-- does not include the key

    words non-surface disturbance leasing which could skew the polls results.

    There is a wide gender gap as women oppose the measure 65-26 percent, while men are

    divided 47-48 percent. Voters in northwest Pennsylvania support drilling in the parks 53-44 percent,

    while voters in every other region are opposed.Republicans support drilling in parks 58-38 percent, with opposition at 71-20 percent among

    Democrats and 58-35 percent among independent voters.

    "Pennsylvanians are generally willing on drilling, but it depends on where, drawing the line at

    state parks and forest land," said Tim Malloy, assistant director of the Quinnipiac University Poll.

    Because of Gov. Corbett's executive order, 39 percent of Pennsylvania voters are less likely to

    vote for him, with 13 percent more likely and 46 percent who say it won't affect their vote.

    The Morning Call reported ThursdayHouse Republicans are putting together a bare-bones $28.6

    billion General Fund budget which would match expenditures with expected revenues and deal with an

    estimated $1.6 billion budget deficit.

    The bare-bones option would also not assume any potential savings from adoption of pensionreform measures or any revenue from a tax increase or any new taxes.

    Pennsylvania collected $1.9 billion in General Fund revenue in May, which was $108 million, or

    5.5 percent, less than anticipated, Secretary of Revenue Daniel Meuser reported Monday. Fiscal

    2014-15 General Fund budget. The appropriations in it are identical to the FY 2013-14.

    Rep. Adolph told the House Tuesday he expects the House to actually consider the bill the

    week of June 16.

    The House GOP background budget document, which the Morning Call said is not a budget

    plan, includes these recommendations it said came from Gov. Corbett--

    Five percent cuts in all state departments with the exception of reductions to basic education,special education, preschools, state-funded universities and the state's college loan program.

    Taking $227 million in excess money from six grant and loan programs designed to help volunteer

    fire companies, local law enforcement and businesses.

    Saving $31 million by eliminating or reducing four tax credit programs that promote employment,

    historical preservation, help seniors find home-care and help families attend private or parochial schools.

    Most of the tax credit changes would come from a $20 million reduction in the $50 million Education

    Improvement Tax Credit businesses can get for donating to private and nonprofit educational

    institutions.

    -- Transferring $136 million to the general fund budget from special funds used for parks, agriculture

    preservation and the horse-racing industry. Part of that transfer includes $65 million from the Keystone

    Recreation Park & Conservation Fund.The Morning Call quoted Budget Secretary Charles Zogby as saying the governor does not

    support a bare-bones budget that removes proposals he made in February to spend $400 million more

    for public education, create a $25 million college scholarship for middle class students and $5.4 million

    more to reduce the waiting list for disabled adults to find community-based homes.

    The governor does not support using all the recommendations outlined in the House report,

    Zogby said. But those ideas were presented to House and Senate leaders to get rank-and-file

    Republicans to understand the financial reality the state is facing.
