    Opinion: Turning US versus THEM, into WE, As Leaders In SustainabilityBy Gov. Tom Ridge

    On June 28 the Pennsylvania Environmental Council honored former Gov. Tom Ridge with itsLifetime Achievement Award. Here is the text of Gov. Ridges remarks from that event--

    Thank you, Paul [King] and Jim [Mesloh]. Thank you Jim Seif and John Oliver.My thanks to all of you so man distinguished guests and friends.

    -- Friends of TREC, of course Elsie, Sally Wiggins, members of my former administration,current DEP and DCNR folks.-- And the Lake Erie Region Conservancy is nice for the "home town kid."

    Being here with so many former colleagues, with John Oliver, and tonight's awardees, isan enormous honor.

    In particular, it brings to mind one of my favorite quotes, by Woodrow Wilson whosaid I not only use all the brains that I have, but all that I can borrow.

    As Wilson knew quite well you surround yourself with good people; you worktogether; you achieve more.

    My public service career is one bolstered by many extraordinary people who servedalongside me in many a collective mission to get things done.

    And thats particularly the case when it comes to the work we ALL did to preserve thebeauty, the bounty and the potential that is, was and has always been Pennsylvania.

    For that reason, I accept this award on their behalf of behalf of my formercolleagues and our partners who collectively succeeded in bringing our economic needs andenvironmental protection into a peaceful and protected co-existence.

    The Award Citation, and John and Jim's remarks, describe some of what we tried to do inHarrisburg, from 1995 until the tragedy of 9/11 took me on quite a different trajectory.

    We wanted to turn Pennsylvania's environmental effort from a purely regulatory one, intoa full-fledged set of environmental programs, relevant to all Pennsylvanians.

    We wanted to go from being the environment police to being a partner with everyPennsylvanian who understood, or was willing to be educated about, why the environmentmatters so much, and in so many ways, wanted to help us to improve it.

    We wanted to turn "Us" versus "Them," into WE, as leaders in sustainability.We wanted to go from being just a nag, to being a catalyst, as the Pennsylvania

    Environmental Council has been for four decades.finding new ways to promote the oldvalues of William Penn, Gifford Pinchot, Rachel Carson, Maurice Goddard and millions of ourfellow Pennsylvanians.

    I believe that history will show that our initiatives were thoughtful responses to thechallenges of those times.

    Some of those efforts have shown long life, and some have faltered, for one reason oranother.

    We are proud of them all, but not so proud that we have to dwell upon them.

    Instead, let's think about the new challenges to which we must respond.We start with the obvious.Energy has come again to Pennsylvania.Energy, in every meaning of the word, and because of it, a Pittsburgh that could already

    be proud of its latest successful revitalization, is a more vibrant and optimistic place than itsever been.

    This community truly knows how to Seize the Moment.It was done starting with "smoke control" and the Gateway Center development in the

    late 1940s by the Heinz's, Mellons and the Hillmans as well as the visionary -- and I would add,bipartisan political leadership of that time.

    It continued through Dick Caliguiri, and starts anew now with Marcellus, and Utica, and

    crackers, and many other kinds of economic bounty.But to seize this moment We need to do all of this right. And vigorously.We are indeed being vigorous. The activity is fast and furious, and is spinning off good

    jobs, steady royalty payments and revitalized basic industries.I have no doubt that the free enterprise system will continue to innovate and continue to

    find and create wealth here and for the nation, just as it did in past centuries.Indeed hydro-fracturing is a perfect example of an innovation that turned tight shale into

    the promising resource that it has become.Doing this right may be trickier. But the Pennsylvania Environmental Council has helped

    lead us on sustainable path in the gas field.Some groups fear the development of the shale gas fields, or at least find a thrill in

    causing others to fear it.Some foreign nations, like France and Vermont, have even banned it. New Jersey

    recently legislated that frack waste can't go there. I wonder if they remember what the USSupreme Court said about our Constitutions Commerce Clause when Pennsylvania tried to banNew Jersey trash a few decades ago.

    PEC and most Pennsylvanians, and the Governor and General Assembly, however, havegotten it right.

    Act 13 adds new regulation for the new drilling practices. It strengthens an alreadyadmirable regulatory history gong back decades.

    We Pennsylvanians knew the wealth that coal and oil and gas brings, but knew that "digand dump" and "drill and spill" practices of past centuries were no way to seize the moment forthis generation.

    I urge strong and vigilant enforcement of these new provisions, and I know that the vastmajority of companies and workers in the Marcellus field agree with me.

    After all, we did not retire the environment police, we just made them one of our manypartners and advisers.

    If Pennsylvania does it right with gas, and a with sensible national energy policy, we willhave a better and cleaner community, a more prosperous one, and the same will be true for thewhole nation.

    Every president in my adult life has promised Energy Independence.Each was acutely aware of the distortions of our foreign policy, the stains in our fiscal

    system and the military vulnerability brought about by Energy Dependence.But it is taking the ingenuity of hydraulic fracturing and horizontal drilling, and

    America's competitive free enterprise system, to make good on those Presidential promises.

    The threat of terrorism has been another issue with which this state and this country haswrestled but the that threat and the issue of energy independence are closely related.We all know that frisking Grandma at the airport won't suffice to stop terrorism. What

    will do the job in the is a strong foreign policy, backed by a vibrant economy, and an energypolicy that we can make by ourselves, and for ourselves.

    And Southwest Pennsylvania and gas fields around the world will make that possible.We will be stronger and safer when we don't have to fear for our energy supply and

    economic strength whenever we take strong steps against a rogue regime who tries to hold ushostage for oil.

    We can gain further strength by the export of our energy.To send energy abroad is to reverse the troubling foreign trade deficits of past decades,

    caused mostly by energy imports.Let's redress that balance. Other nations need this energy, for just the same purposes wedo, and we can and should use it to make friends and allies.

    The Cove Point facility in Maryland, owned by our friends at Dominion, is close by theMarcellus field. Lets finish the job of turning the valves to run outbound, and earn some tradecredits.

    While we're at it, let's create a system for the use of gas in our vehicles -- like Giant Eagleis doing -- and let's find even more uses for natural gas by-products.

    And let's be sure that a state with gas and an award-winning Brownfields program putsevery gas facility it can on a brownfield.

    Lets turn the well pads and rights of way back into the fields and forests and wetlandsthey were -- even improving those natural assets.

    Let's use our water wisely, including water we thought we'd never retrieve, the acid minewater.

    And let's include everyone in this mission because it serves the greater mission, here inthe beauty of Pennsylvania and throughout our great country.

    For we arent just any country.And we arent just any state were a Commonwealth what a Commonwealth.We are the land of new beginnings the land where liberty was born.We are a wonderful, eclectic mix of Keystone pride, and national pride of economic

    leadership, with a history inventivenessand even unity.You may wonder about unity as we walk through another presidential election.And yet, whether you wear a red hat or a blue hat we all wear the badge of citizenship.That doesnt mean we must always agree. Unity doesnt require unanimity.Often, its the infusion of opposing ideas that makes us think a little more broadly more

    creatively to be open to different approaches and still reach common ground and like-mindedgoals.

    Weve proven to be too optimistic to be limited thinkers.Those of you here tonight are contributing in tremendous ways to the advancement of our

    energy resources, the protection of our environment and the revival of our economy. I thank you

    for that service.Teddy Roosevelt once said, Far and away, the prize that life offers is the chance to work

    hard at work worth doing.A country, a Commonwealth and communities that we can give to our children that are

    safe and clean and green and prosperous that is hard work worth doing.

    I appreciate your hard work in this important endeavor. And I very much appreciate theopportunity to have worked alongside you in that effort as your congressman, your governorand your friend.

    Senate Passes Resolution Commemorating 10th Anniversary Of Quecreek Mine Rescue

    The Senate unanimously adopted Senate Resolution 341, sponsored by Sen. Richard Kasunic (D-

    Somerset), designating the week of July 22-29 Mine for Nine Tenth Anniversary RememberWeek to commemorate the 2002 Quecreek Mine Rescue in Somerset County.

    The text of the resolution follows--

    A RESOLUTION

    Designating the week of July 22 through 29, 2012, as "Nine for Nine Tenth AnniversaryRemembrance Week" in Pennsylvania, commemorating the tenth anniversary of the heroic andunyielding efforts of those persons involved in the rescue of the nine coal miners trapped in theQuecreek coal mine, Somerset County, from July 24 through 27, 2002.

    WHEREAS, A near-tragedy of epic proportions began at the Black Wolf Mining

    Company's Quecreek coal mine on July 24, 2002, when nine miners became trapped 240 feetbelow the surface of the mine entrance; and

    WHEREAS, Due to the actions of the nine trapped miners, a greater potential tragedywas averted when an urgent radio warning was sent by the trapped miners to another crew whowere able to escape from icy flood waters; and

    WHEREAS, As days passed and the danger of the situation became more and moreevident, many heroic people devoted limitless hours to saving the nine trapped miners and wereunyielding to the possibility that their efforts might be in vain; and

    WHEREAS, The true heroes of the event, the nine trapped miners, demonstratedexceptional faith, endurance and raw courage: Randy Fogle of Garrett, Thomas Foy of Berlin,Dennis Hall of Johnstown, Ronald Hileman of Gray, Harry Mayhugh of Meyersdale, John

    Phillippi of Boswell, Mark Popernack of Somerset, Robert Pugh of Boswell and John Unger ofHollsopple; andWHEREAS, Other true heroes included then-Governor Mark S. Schweiker and the

    leadership team he assembled, along with the many fire companies and volunteer rescue workersof Somerset County; and

    WHEREAS, The miracle which occurred at the Quecreek coal mine is that all nineminers survived the ordeal, thereby originating the "nine for nine" legacy while affirming theefforts of the many people who were involved in the rescue and enriching the spirit of our nation

    Governor Signs Pittsburgh Summer Gas/Stage II Emissions Bill Into Law

    Sen. Elder Vogel (R-Butler) Friday announced the Governor signed into law Senate Bill 1386which he introduced with Sen. Tim Solobay (D-Washington) designed to make gasoline cheaperfor western Pennsylvania motorists.

    Senate Bill 1386, as amended by the House, would require the Department ofEnvironmental Protection to review and reevaluate the state implementation plan under theFederal Clean Air Act in relation to compliance requirements for low Reid Vapor Pressure(RVP) gasoline, or "summer gas."

    The review will require DEP to conduct meetings to consult with impacted organizationsor entities including gasoline refining and distribution companies, gasoline retailers, pipelineowners, impacted businesses, public utilities, local governments and other interested entities andprovide regular updates to the legislature.

    The bill also provides that if a supply disruption occurs, the Governor shall submit arequest to EPA to waive the requirements of summer gas if 5 percent of all existing gasolineretailers in the 7 county region of Allegheny, Armstrong, Beaver, Butler, Fayette, Washington

    and Westmoreland counties are unable to obtain an adequate supply of RVP gasoline."While my hope had been to eliminate the summer gas requirement, it becamenecessary to move this issue forward so that we address the issue of supply disruptions forWestern Pennsylvanians," Sen. Vogel said. "The Administration and DEP are opposed torepealing the requirement because of the federal government holding back transportationfunding for Pennsylvania, but I will continue to strongly advocate the repeal of the summer gasrequirement."

    In addition, the legislation will allow for the termination of another regulation requiringgas stations in the same seven county region in Pittsburgh, as well as the five county region ofBucks, Chester, Delaware, Montgomery and Philadelphia, to install Stage II vapor recoverysystems on fuel pumps.

    These pumps prevent the release of gasoline vapors when in use, but the law containsa specific provision to eliminate the requirement if onboard refueling emissions controls invehicles became widespread.

    Since 2000, all passenger cars and light trucks have been required to be manufacturedto include onboard refueling emissions controls. These controls work by stopping gasolinevapors from coming back out the fill pipe by circulating the vapors back into the fuel tank. Thecombination of onboard refueling controls and Stage II systems on fuel pumps are less effectivethan either system alone.

    The law will take effect immediately.

    while in the rest of the state local communities have no control over controversial gas drillingand the effects of hydraulic fracturing or fracking.

    Where was our study? Where was our six years? asked Rep. Jesse White (D-Washington) who represents communities in the heart of drilling country in southwesternPennsylvania. What makes Bucks and Montgomery [counties] so special?

    "We were here four months ago under the guise of, we had to have uniformity, we had tohave consistency, we needed to be fair," Rep. White noted. "And now, four months later, we'resaying, 'Maybe, for whatever reason, we're going to give a few people a pass.'"

    The legislatures hidden language came on the heels of the passage of Act 13 earlier thisyear, the omnibus gas drilling legislation that many Democrat and Republican local officialsopposed since it virtually eliminated the ability of Pennsylvanias municipalities to zone gasdrilling in a way that will protect the health, environment and quality of life for their townships.

    We seem to have leadership in Harrisburg that believes in different rules for differentpeople, stated Brian Coppola, Republican Supervisor for Robinson Township in WashingtonCounty. Act 13 sounded like a good idea to some of the eastern state senators until they foundout it applied to everyone throughout the state. Now theyre trying to protect themselves from

    it. Deron Gabriel, Township Commissioner for South Fayette Township in AlleghenyCounty went on to state, Act 13 poses a very real threat to all Pennsylvania residents, and tiesthe hands of municipal officials who were elected to protect the health, safety and welfare ofresidents. Now the legislature has evidently seen fit to delay drilling in two politically connectedcounties.

    For years, the debate around Marcellus Shale gas drilling and fracking has grownto become one of the most highly watchedand most politicizedissues in Pennsylvania.This reached a crescendo earlier this year when legislators passed a far-reaching gas drillinglaw that met the approval of the gas industrybut was also met with the loud opposition ofenvironmental groups, local officials, public health organizations and outdoor groups.

    Why are we treating anyone like second class citizens in the state? remarkedPennEnvironment Director David Masur. These are not the values that we hold near and dear toour hearts as Pennsylvanians. This is the antithesis of following the Golden Rule.

    Concern has grown across the nation on gas drilling, as an ongoing flow of news storiesshow cases of air and water pollution, violations of cornerstone environmental laws, andheightened concern about the effects of fracking on public health. And Pennsylvania is in thebelly of the beast for these examples.

    Decisions about gas drilling and fracking must be made based on environmentaland community impacts, not back room politics, noted Maya van Rossum, the DelawareRiverkeeper. This law is a sham - its a power play to try to get a few politicians who voted togut community rights off the hot seat in their backyard at the expense of every place else andthats just dead wrong. We need a statewide moratorium on gas drilling now.

    Myron Arnowitt, PA State Director for Clean Water Action stated, Most voters inPennsylvania dont believe we should have a separate and unequal system for gas drilling. Everycommunity deserves to be able to protect itself from drilling. Once again our state legislatorsneed to go back and fix their unfair treatment of residents living with gas drilling.

    Moreover, as legal experts, local officials and environmental advocates reviewed thelanguage hastily buried in the state budget, concern has grown that the language actuallyincludes massive loopholes that may insure that the moratorium for Bucks and Montgomery

    The Schuylkill Action Network is a collaboration of agencies, companies, individuals,and nonprofit organizations founded in 2003 to help clean up the Schuylkill River and the many

    waterways flowing into it. The SAN does this by collaborating on projects in Berks, Chester,Montgomery, Philadelphia, and Schuylkill counties, among others. In this way it helps to protectnearly 2 million Pennsylvanians, all of whom depend on these waterways for safe drinkingwater.

    The Department of Environmental Protection is reminding homeowners and landowners who areconducting work in or along streams and wetlands that a permit may be required from DEP orthe U.S. Army Corps of Engineers.

    Homeowners and landowners may not be aware that state or federal law requires aDEP permit for work they want to do on their own property, DEP Secretary Mike Krancersaid. DEP is here as a resource and a partner for Pennsylvanians who are planning any activityin or around streams and wetlands, so that their work can be done safely and without harming theenvironment or downstream neighbors.

    Just like the Public Utility Commissions PA One Call for excavators, the best firststep for homeowners and landowners is to call the local DEP office to find out what is requiredbefore work starts.

    During the summer months, DEP typically receives a higher volume of complaints fromthe public regarding work in streams and wetlands.

    DEP frequently finds that a number of activities have occurred without permits, includingdredging, which is cleaning out a stream; ditching, defined as filling in or draining wetlands;placing fill in a floodway to build up the property; relocating a stream; stabilizing a stream bank;and installing culverts, bridges, boat docks or ramps.

    Residents should follow these tips when conducting stream activities:-- If there are low-lying, wet areas on the property that a landowner would like to fill in, consultfirst with the DEP Waterways and Wetlands program that serves your home county.-- Do not mow or cut trees and shrubs along a streams edge. This can potentially lead to stream-

Leaving a buffer along the edge of a stream or wetland is an effective way toincrease a stream banks stability, reduce stream bank erosion, increase wildlife habitat andprovide a pollutant filtering area for surface water that drains through the buffer.-- If a project is being planned in a stream channel or floodway, work should not be conductedwithout the required permits within the channel or 50 feet from the top of the stream bank. A

    streams floodway is typically 50 feet from the top of each stream bank unless a detailed FederalEmergency Management Agency (FEMA) flood study determines that the floodway is smalleror larger than 50 feet. FEMA floodplain study information can be found at local township andborough offices.-- Filling, ditching or draining of a wetland requires a permit from DEP and the Army Corps.

    USDA: Nearly 60 Percent Of PA Farm Acreage Practices No-Till Farming

    Western PA Conservancy Acquires 23 Acres In Butler County

    The Western Pennsylvania Conservancy recently acquired 23 acres of land, which will be addedto the Conservancys 115-acre Wolf Creek Narrows Natural Area. The tract includes forestedbluffs and over 1,100 feet of frontage along Wolf Creek in Slippery Rock Township.

    Wolf Creek Narrows is known for its spring wildflowers, including large areas oftrillium, bluebell and trout lily. It is across the road from Miller Woods, a 42-acre certifiedAudubon Wildlife Sanctuary owned by Slippery Rock University.

    Wolf Creek Narrows is a distinct destination for its rare natural environment, saidTom Saunders, president and CEO of the Conservancy. The spectacular display of springwildflowers and its tall bluffs makes it one of Western Pennsylvanias rare landscapes.

    The Western Pennsylvania Conservancy acquired the majority of the Wolf CreekNarrows property from Mary Clutton Colvin and Charlotte Clutton Friedline in 1979. The sistersdonated a portion of the value of their property to the Conservancy, in memory of their parentsand grandparents.

    The narrow valley of Wolf Creek is believed to have been created by the erosion andcollapse of a cave ceiling due to melting glaciers millennia ago. Forested bluffs, over 50 feet tall,rise above the creek and its floodplains. The property includes a small wetland area dominatedby cattails and sedges, and a diverse, mature forest of sycamore, tuliptree, eastern hemlock andred oak. The propertys multiple limestone outcrops support plant species such as walking fernand American yew.

    Birds include belted kingfisher, Louisiana waterthrush, red-eyed vireo and wood thrushcan be seen there. Ospreys and bald eagles have also been observed along this section of the

    creek. This new parcel connects the nesting habitat of a pair of osprey birds to their foragingregion at the creek. This section of the creek is also breeding habitat for the ocellated darner, adragonfly species of concern.

    As a Slippery Rock University alumna, I had the opportunity to utilize this area asan outdoor classroom and for research, said Jane Iksic-Menchyk, WPCs land protection

    specialist. I feel honored to personally be involved in the permanent protection of this landscapefor future generations to use, be it for scientific research, bird-watching or just fishing in thecreek.This property will be held by the Conservancy and open to the public for hiking, natureobservation and other low-impact outdoor recreation. A bequest from the estate of Helen Katzsupported this acquisition.27th Annual Wildlife Art Show At Middle Creek August 3-5

    The Game Commissions Middle Creek Wildlife Management Area visitor center will featurehundreds of original paintings and fine-art prints from some of the best-known wildlife artists in

    the state during its annual Wildlife Art Show from August 3-5.The show is free, and the hours are: Friday, 1-6 p.m.; Saturday, 9 a.m.-6 p.m.; andSunday, 10 a.m.-5 p.m.

    In addition to the artists sales, the show will offer tickets for $2 each or three for $5 towin a selection of artwork in a drawing that will be held at 4 p.m. on August 5. Proceeds fromthe drawing will benefit The Wildlands Preservation Fund land acquisition program.

    The Middle Creek Wildlife Management Area is a special tract owned and set aside bythe Game Commission for the protection, propagation, management, preservation and controlledharvest of wildlife. This area of more than 6,200 acres provides habitat for waterfowl, forestwildlife and farmland wildlife and includes a 400-acre shallow water lake and 70 additional acresof impoundment.

    Visitors to the wildlife area can see a variety of wildlife, including bald eagles, and fromlate February to late March can be fortunate to witness and photograph the flocks of beautifulsnow geese and tundra swans that stop in Pennsylvania during migration.     DCNR Reorganizes Ecological Services, Conservation Science Program
