Gauteng’s City of Ekurhuleni has adopted a revitalisation strategy to support the growth of manufacturing in the province, executive mayor of the municipality, Mondli Gungubele, told delegates at the opening of a two-day Manufacturing Indaba Conference and Exhibition on Monday.

WCO New HS MembersOn 12 June 2015 the World Customs Organisation (WCO) announced that Sierra Leone and Djibouti would become the 152nd and 153rd contracting parties to the Harmonised System (HS) Convention.

On that date the two countries deposited with the secretary general of the WCO their instruments of accession to the International Convention on the Harmonised Commodity Description and Coding System. More than 98% of international merchandise trade is classified in terms of the Harmonised System.

Sierra Leone has been a member of the WCO since 6 November 1975. The country’s principal export commodities are diamonds, rutile, cocoa, coffee and fish. The country’s principal import commodities are foodstuffs, machinery

and equipment, fuels and lubricants, and chemicals.

Djibouti has been a member of the WCO since 19 March 2008. Its principal export commodities are hides and skins, coffee (in transit) and scrap metal. The country’s principal import commodities are foods, beverages, transport equipment, chemicals, petroleum products and clothing.

The HS Convention will enter into force in Sierra Leone on 1 January 2017, unless Sierra Leone decides to specify an earlier date. Djibouti has specified that the HS Convention will enter into force in Djibouti on 1 September 2015.

Revised Kyoto ConventionThe WCO announced on 17 June 2015 that the Revised Kyoto Convention (RKC), which entered into force on 3 February 2006, now has

101 contracting parties following the accession of Thailand and Sierra Leone. Then on 19 June 2015 the WCO announced Argentina as the 102nd contracting party to the RKC. Argentina’s federal administrator of public revenue, Ricardo Echegaray, deposited his country’s instrument of accession to the International Convention on the Simplification and Harmonisation of Customs Procedures of RKC on 19 June 2015.

Efforts by the government of Zimbabwe to introduce a costly and time-consuming cargo verification system for all imports has so far come to naught.

It was introduced in association with the bi-lateral trade body, the EU Chamber of Commerce & Industry for Southern Africa, and the conformity assessment company, Bureau Veritas, and was intended to achieve “conformity to standards and declared value of goods intended to be exported to Zimbabwe”. And this “to be verified prior to shipment in the country of export”.

And all this cost you anything between US$350 and US$7 000 (depending on value of goods) to get your appropriate gold stamp of approval.

This consignment-based conformity assessment (CBCA) document was due to become mandatory on March 16.

“But the inspections were just taking too long and were very costly,” said our trucking source.

Joseph Musariri, CEO of the Shipping & Forwarding Agents’ Association of Zimbabwe, has however revealed that the whole CBCA shemozzle has apparently hit the back-burner – postponed, if not possibly even cancelled

completely.An e-mail to

Musariri from Abigail Shonhiwa, the permanent secretary in the ministry of industry and commerce, stated: “As discussed please be advised that the implementation of the CBCA has been delayed due to outstanding administrative and technical issues plus the need to take into account issues that arose during the awareness campaigns.”

Musariri added: “Industry, together with ourselves, are also set to

meet with the minister this week” – and that the results of this “get to the

bottom of it” meeting will be released to association members.

Zimbabwe verification scheme kicked back into touch

The SA aviation authority has just won SA another global record – for the slowest issuance of a charter permit in the world, by a long way.

The discovery of this World No 1 was the result of a phone call from a frustrated SA charter service provider who complained to FTW about the fact that “it now takes 21 days to apply for a permit” from the SA Civil Aviation Authority (CAA). A timespan, he added, “which defeats the whole

object of quick turnaround”.The FTW global

comparative time study was carried out at the behest of Maria Du Preez, business development director of Bidvest Panalpina Logistics. She quizzed the company’s air charter fundis in Belgium, and they came up with the following averages for foreign operator permits.

“For Korea/Japan/China it takes 10 days. Elsewhere usually three to five days. But

some are flexible and tolerate a letter of urgency – and this can speed up the process to 24 hours.

“21 days! This is the longest period known in the market.”

But then Du Preez came up with the good news. “We have heard from the local guys,” she told FTW, “that the time has been reduced to between seven and nine days over the past two weeks.”– Alan Peat

Despair over slow issuance of charter permits

The International Monetary Fund (IMF) has added its support to the push for higher electricity tariffs to make Eskom financially sustainable.

“But this should be complemented by cost containment (including through improved procurement practices), efficiency enhancements, and governance improvements to minimise the impact on consumers

and business costs,” said an IMF spokesperson.

He added that at the same time consideration should be given to further private participation to increase capacity and reduce the cost of generation.

“Addressing other infrastructure bottlenecks, for example in transport, is important; the planned rail expansion is a step in the right direction,” he said.

Bribery and corruption are alive and well at South Africa’s border posts, evidenced by an increasing number of non-tariff barrier (NTB) complaints – and feedback from agents and transporters.

Truck drivers, particularly foreign-owned transport companies, continue to be targeted and this is likely to continue until companies and drivers stop playing into the hands of corrupt officials, according to FTW sources.

“We are aware that some transporters give their drivers a certain amount of cash to clear their goods quickly and avoid hefty fines or delays,” said Mike Fitzmaurice, head of the Federation of East and Southern African Road Transport Associations (Fesarta).

He told FTW that issues often arose out of a misinterpretation of cross-border or transit regulations or they were simple extortion. “However, when the drivers pay

a bribe to avoid a ticket, there is no proof for us to be able to follow up on their behalf.”

He said that while anyone could register on the NTB website and submit an NTB, it was recommended that they direct their issues through Fesarta. “Not all issues are classified as NTBs and often need to be clarified by us first. It is only called an NTB when there is an intervention required at a high government level related to policies or regulations or if the problem that arises is a regular occurrence,” he said.

Fitzmaurice added that for an NTB complaint to receive the necessary attention and resolution, documentary proof of the incident was vital.

The latest NTB, submitted by Fesarta, refers to a driver who was fined US$1 500 for allegedly violating the third country rule by collecting a load in South Africa, transiting Zimbabwe and offloading in Beira, Mozambique.

When issuing the fine, the official noted that there was no cross-border permit. “However, the ticket issued referred to Article 102 of the Road Traffic Act (designated areas which allow for pedestrian traffic) and was not related to the offence. Furthermore, it did not specify the nature of the offence and only referred to the detention or removal of documents as per Article 122 of the Road Traffic Act,” said Fitzmaurice.

In this case, the fine was submitted as evidence.

Several transporters and clearing and forwarding agents submitted anecdotal evidence, on condition of anonymity, to FTW. These are evidence that the issuing of incorrect fines or an element of extortion at several southern African borders are not isolated incidents.

One agent told FTW that Mozambican officials had only recently started closely scrutinising cross-border permits and seemed to be

issuing a number of fines. “The highest fine received to date has been for R3 000,” he noted.

A transporter told FTW that his small delivery goods vehicle had been stopped by a Cross-Border Road Transport Agency (CBRTA) official near a tollgate on the N4 (en-route to the Lebombo/Ressano Garcia border post) and a spot fine of R2 500 was demanded as the goods were destined for Mozambique but the vehicle did not have a cross-border permit. “He demanded we pay the fine in cash on the spot before we could continue, even though we explained that the goods would be off-loaded and consolidated at a

warehouse in Komatipoort to be moved across the border at a later stage – in a truck that which would have a cross-border permit.” After much discussion, the vehicle was allowed to pass, with a written fine in the driver’s pocket (the fine due date was for late the next month).

SA is in a distinct business slowdown, with confidence only just measuring a mere 0.1 off the deep freeze level, but our interior neighbour Lesotho is teetering on the brink of losing its right to import duty-free exports into the US.

Lesotho has taken advantage of the African Growth and Opportunity Act (Agoa) to become the largest exporter of garments to the US from sub-Saharan Africa

Africa’s textile and apparel exports to the United States could quadruple to about R50 billion over the next decade through an extended duty-free trade treaty, according to a US official.

Last year, US clothing imports from sub-Saharan countries reached R12.25 billion, up nearly 6% from 2013 – and at that stage, Lesotho was up there with fellow big boys in the Agoa programme.

But Lesotho is at risk of losing an estimated R37bn a year in apparel and textile exports to the US and 35 000 jobs in the industry. That’s if the US strips it of its Agoa membership. Something which the US labour group, the Alliance of Progressive Trade Unions, is calling for – citing the worsening political tension in the country as the reason. This challenge is backed by the then-incumbent prime minister “alleging” and “claiming” an attempted coup last August. Things have worsened since then and there have been reports of assassination attempts against opposition lawmakers.

This would of course see the mountain state follow Swaziland, which lost its membership regalia in June last year because of a lack of protection for workers’ rights.

But the Lesotho government, which was formed from a coalition of three formerly opposition

parties after the February election, is determined to stave off a similar fate.

Organised by Lesotho’s ministry of trade and industry (MTI), a mission is busy lobbying the US Senate and House of Representatives to have its continued membership of the African Growth and Opportunity Act (Agoa) extended beyond expiration on September 30 this year.

Currently, the mission has contracted a consultant, and he’s now busy trying to schedule appointments and meetings with appropriate persons in the two houses.

However, several other agents noted that they had never seen cross-border officials harassing drivers. “We have offices at a number of Mozambican borders and can honestly say we have never seen drivers being harassed. Some drivers also make mistakes and try to cover for themselves. Alternatively the fines may not be related to a municipal offence,” our source said, adding that FTW should “check its facts” before discrediting Mozambique customs or police officials.

Promoting and increasing South African wine exports into the tough United States market remains a top priority for Wines of South Africa (Wosa) according to the organisation’s CEO, Siobhan Thompson.

Addressing the Exporters Club Western Cape (ECWC) recently, Thompson said it was a market that offered exporters tremendous opportunity but breaking into it was difficult which was why a more focused strategy had been adopted.

“It is for all intents and purposes 50 countries in one,” she said. “Rules and regulations vary on a state-by-state basis and targeting retailers directly is impossible due to its three-tier trade system with regard to alcoholic beverages.”

This system controls the sale of alcohol across the US and ensures that exporters cannot target retailers directly. The three tiers are producers, distributors and retailers.

“Basically this legal system ensures that producers can only sell their product to wholesale distributors who in turn then sell to retailers who then sell to consumers,” said

Thompson. “As South African producers we have

to convince these wholesale

distributors that are

massive in

comparison to what we are used to here that South African wines are what they want. This is not easy. One has to put up a real fight to get into this system.”

The US initially implemented this system to increase the minimum price of alcoholic drinks, to control alcohol abuse, and to decrease the potential political power of large producers who could create a monopoly in the market and limit consumer choice.

“We are finding though that there is real excitement around South African wines once we get a foot in the door,” said Thompson. “And reviews of our wines

are very positive. People who

take the time to taste our

product are of the opinion

that it is world standard and will then commit to stocking more as has been the case recently with a US buyer.”

She said in an effort to penetrate the market more effectively Wosa was targeting fewer states in the US. “We are not looking at the USA as one market but rather focusing on specific states.”

She said a more focused strategy was sure to see exports grow far more than has been the case to date.

“It is a market that is important to us and we want to grow our footprint, but we are doing it in a more compact way. It remains a country where we see growth for wine exports.”

It has two main services into West Africa – MAF and FAX – the Far East Express Line which calls on Durban and then Nigeria (both TICT and Apapa ports), Ghana and Benin.

The route is Shanghai-Ningbo-Nansha-Singapore-Port Klang-Colombo-Durban- Apapa-Tin Can Island-Tema-Cotonou-Port Klang- Shanghai.

The creation of one agency to handle all aspects of border control could considerably streamline customs clearance and fast-track the movement of goods. But there are potential pitfalls, including a potential increase in corruption.

This was the view of customs clearance experts who told FTW that the government’s launch of the Operation Pyramid pilot study earlier this month was the first “major step” towards the creation of a single border management agency.

Operation Pyramid was officially launched by Home Affairs minister, Malusi Gigaba, in the Kruger National Park on June 19. He stated that

the department would soon be appointing a ‘transaction adviser’ to evaluate proposals for the revamp of infrastructure and systems at six key ports of entry.

The six border posts – Beitbridge, Lebombo, Kopfontein, Oshoek, Ficksburg Bridge and Maseru Bridge – would serve as a pilot project for Operation Pyramid, he said. “Lessons from Operation Pyramid will be carried over to the proposed border management agency,” said Gigaba.

In December 2014, Cabinet approved the establishment of a single border management agency (BMA) that would assume “full control of all port

of entry and border functions”. Operation Pyramid will test the feasibility of a new BMA which is set for operation in two years’ time, according to Gigaba.

Acting cabinet spokesperson, Phumla Williams, said in a statement that the department of Home Affairs (DHA) had assumed leadership of the Border Control Operational Coordinating Committee (BCOCC) and that 93 officials had been seconded to the BMA project management office.

The six ports of entry could be operational as test sites before the end of the year or by latest early 2016, said Williams.

“One agency handling border control would be ideal. It would put an end to multiple stops (ie,

from Customs and the South African Police Service) and it would avoid issues where one entity grants release but the other does not,” said Taryn Hunkin, customs consultant at commercial law firm, Shepstone & Wylie.

Independent customs consultant David Liebenberg told FTW that the United States Customs and Border Protection Agency served as a great example of a single border management agency working well. “However, should such an agency be implemented in South Africa, it is extremely important that those operating it have a full understanding of how it should be implemented and

that they bear the interests of legitimate traders in mind,” he commented.

Hunkin agreed, pointing out there could be a lack of knowledge among the staff facilitating the border control as they would effectively be representatives of many different agencies and would be expected to enforce various regulations.– Adele Mackenzie

The Imperial group – as part of its BBBEE commitment to ‘enterprise development’ – has conjured up an enterprising scheme to develop entrepreneurial skills among its workers. In simple terms, “this is a business-to-black-business transaction where the aim is to provide, contribute and assist in the

operational and financial development of the business’s sustainability” – including full rent-free premises and utilities.

Even more simply, it has led to the creation of Morajane’s enterprise, NOTOS Cleaning Services, a business unit now overseeing the washing and cleaning of over 400 Imperial

trucks a month, cleaning the yard and running an on-site canteen and tuck shop for truck drivers moving in and out of the Imperial facilities.

So successful has this been as a test case that Imperial is assessing the feasibility of other enterprise developments such as this and in funding sole suppliers to Imperial.

While press reports said the company had been “somewhat unlucky” in its choice of management over the years,

How can any corporate body take on someone for an important position like CEO, he suggested, without an extensive CV verification procedure being in place. The whole bells and whistles, he said – ID verification, reference verification, criminal record check, academic record check, credit record check, the lot.

How could they then miss out on a hidden a record of previous criminal offences and a criminal conviction; falsified information about her qualifications on her CV – qualifications she had claimed as being a

MBA and a doctorate. “Goodness,” said Steffens, “there was even the question of a change of name, said to be in 2008.” According to press reports, Van Coller had been born Yvette Coetzee in Rustenburg, North West.

A high-calibre verification weapon is the essence of any professional recruitment agency, Steffens told FTW. “I mean, we even contract a specialist verification outfit to conduct this essential, detailed research for Communicate Personnel,” he added. “You’d be amazed just how many applications are stopped dead when something like a ‘qualifications not verified’ flag comes up.”

Steffens agreed that this process was basically “muck raking”.

“You have to be sure that even a tiny finger-nail clipping of a skeleton in the cupboard is revealed,” he said. “The reputation and integrity of your company depends on it.”

But in this case, it appears they could not see the whole skeleton lurking there, never mind just a sliver of a toe nail.

CEO dismissal reveals flawed HR practices South Africa’s wine exports

have been on a steady upward growth trajectory, according to Siobhan Thompson, CEO of Wines of South Africa (Wosa).

In 1992 the country exported around 22 million litres compared to the 416.9 million in 2012.

“Our 2014 figures show a drop in exports but this is not a negative,” said Thompson. “In 2013 we exported 525.7 million litres of wine but this dramatic increase was due to a wine shortage across the world that South African producers took advantage of. Almost 65% of the 525 million was in bulk exports,” said Thompson. “In

2014 we saw exports decrease but it was to a normal level of 422.4 million litres – with a far better balance between bulk and packaged exports.”

“One of our biggest strategies – besides growing our export footprint – is also to increase our product value.”

She said whilst South African wine was ranked as high quality it was often a cheaper option on the retail shelf internationally.
