What is Assistive Technology(AT)?

Legal Definition of AT DEVICE

Assistive technology device means any item, piece of

equipment, or product system, whether acquired

commercially off the shelf, modified, or customized, that

is used to increase, maintain, or improve the functional

capabilities of a child with a disability.… (Authority: 20

U.S.C. 1401(1)

Any service that directly assists a child with a disability in

the selection, acquisition, or use of an assistive

technology device. Such term includes:

(A) the evaluation of needs including a functional

evaluation, in the child’s customary environment;

(B) purchasing, leasing or otherwise providing for the

acquisition of assistive technology devices;

(C) selecting, designing, fitting, customizing, adapting,

applying, maintaining, repairing, or replacing of

assistive technology devices;

"…nothing in this section would relieve an SEA

(or LEA) of its responsibility to ensure that

children with disabilities who need instructional

materials in accessible formats, but who do not fall

within the category of children for whom the SEA

may receive assistance from NIMAC, receive

those instructional materials in a timely manner.

Timely access to appropriate and accessible

instructional materials is an inherent component of

public agencies' obligations under the Act to ensure

that FAPE is available for children with disabilities

and that they participate in the general education

curriculum as specified in their IEPs." (Section §300.172(b)(3))
