Purpose of the Report

1. This report provides an update for Elected Members on the development of the Shared Regulatory Service (SRS) between Bridgend, Cardiff and the Vale of Glamorgan Councils.

Recommendation

1. The Committee is asked to consider and note the information within the attached report.

Background

2. On 4th February 2016, this Committee received a report on the implementation of the Shared Regulatory Service. This report provides a further update on matters pertaining to the creation and development of the new service.

Relevant Issues and Options

Human Resources Update 3. Since the creation of the shared service, Members have been apprised at each

Committee meeting of the work undertaken to populate the new organisational structure. The population of the new structure was carried out against some challenging timelines and involved a process of role matching and in some instances, competitive interviews.

4. At the end of the process, a number of employees were "at risk". The implications and costs of this were anticipated as part of the business plan for the new service and managed sensitively as part of best practice change management principles.

5. In accordance with the above, consideration was given to applications for both voluntary redundancy and where necessary compulsory redundancy. Consequently,

the Vale of Glamorgan's Early Retirement and Redundancy Committee has considered and approved 23 applications. It is important to note that applications have only been supported where the applicant has not been successfully assimilated to the new structure and where no suitable alternative post is available.

6. The costs of the majority of the above mentioned redundancies have been funded from the former employing authority for each of the employees in accordance with the SRS Joint Working Agreement. The funding of any redundancies that are effective beyond 30th April 2016 will be met by the new service.

7. Appendix 1 illustrates the officers who have left the service since 1st May 2015 along with the originating authorities for those officers. Of the 40 officers who have left the service, 10 were previously employed by Bridgend, 18 by Cardiff and 12 by the Vale of Glamorgan. The table below summarises the way in which those officers left the employ of the Council.

8. Appendix 1 also illustrates the time periods for those officers leaving the service;

those who left before the population of the new structure and those who left following a decision by the ERR Committee.

9. The service has undertaken a recruitment exercise to fill posts where existing members of staff were unable, or unwilling, to fill the roles. That process is now complete and the organisational structure is now complete. ICT and mobile working update Development of the SRS Website

10. The SRS website has moved into the second phase of development. A number of staff have been selected for website CMS (content management system) training. Training will take place this month from which point officers will be able to make amendments to the website and enable immediate updating of the site. SRS database

11. The Project Board approved the Business Case that recommended the adoption of a new database provider, Tascomi; the procurement process for the new database to replace the four instances of Civica App Flare is underway. The chosen system must incorporate the necessary security protocols to ensure compliance with data protection legislation. Officers are completing a Privacy Impact Assessment that considers a change in working practices to ensure continued data compliance within a consolidated database.

SRS mobile rollout 12. Mobile phones have been issued to all agile staff in the service. This has been a

major undertaking to maintain business as usual as staff transition from legacy systems to the Vale network. Accommodation stream

13. Officers have been identifying the ICT requirements across the three major hubs and establishing the need for :

• Fixed desks, hot desks or agile working points

• User requirements relating to hardware, software

• ICT requirements in respect of infrastructure demands and wi-fi connectivity 14. Close attention has been taken to ensure the Health and Safety provisions are in

place for all staff. One number

15. Work has progressed developing a single telephone contact number for the service; 0300 123 6696. Officers have agreed the call messaging and routing and are in the final stages of implementing the new number. Archiving and migration

16. Officers continue to explore the extent of data migration to the new database and data archiving. This is a vital piece of work and is integral to the success of the consolidated database system. Financial monitoring

17. A financial monitoring report for the period 1st May 2015 to 31st March 2016 will form Appendix 2 to the report, this supplementary information will be made available to Members prior to the meeting being held next Wednesday.

18. All staffing costs for the SRS are held within Vale's Oracle system, non -staffing costs are currently held remotely by each Authority and details are provided on a monthly basis from finance colleagues at Cardiff and Bridgend. It should be noted that progress is being made on increasing the use of the Vale's systems.

19. To summarise the apportionment of costs of the new service, all core costs of the service, which are shared by each Authority, are allocated based on population whilst several services are provided uniquely within each Authority and these 'Authority-specific' services are charged back to the relevant Authority at cost plus an element of management and administration.

20. One-off implementation costs of the service, including redundancy and ICT costs will be included in the supplementary Appendix 2. Costs of redundancy have been borne by the Authority where employment originated. ICT costs are recharged to Participants on a relative population basis. Performance Monitoring

21. Joint Committee Members have asked the service to provide data on activity levels to help reassure local Members that SRS activity continues to tackle issues across the region. The 2015/16, performance data is set out at Appendix 3 and in due course will be reported to each Council in line with the legacy performance management regimes and existing service plans.

22. A presentation on the current performance will be provided at the Joint Committee meeting. Service Updates Compulsory Micro-chipping of dogs

23. On 6th April 2016, the Microchipping of Dogs (Wales) Regulations 2016 came into force meaning that all dog owners are obliged to have their dogs microchipped, and the keepers’ details registered on an approved database. The new law applies to dogs over the age of 8 weeks.

24. The microchip has a unique reference number which is revealed by scanning the dog with a special wand, and this reference number can then be checked against the approved databases to establish details of ownership.

25. Under the new Regulations, where a dog is found not to be microchipped or the details held are incorrect or out of date, the owner can be served with a notice requiring the dog to be microchipped / the correct details registered, within 21 days. In the event that the notice is not complied with, local authorities can make arrangements for the dog to be microchipped and take steps to recover the cost of doing so. The maximum penalty upon conviction for failure to comply with the notice is £500.

26. The Microchipping of Dogs (Wales) Regulations enhance the work the Shared Regulatory Service undertakes to promote responsible dog ownership and minimise straying. It is envisaged that the Service’s approach initially will be one of working with dog owners to ensure that the new rules are understood and voluntary compliance sought, before proceeding to formal action. Sale of Tobacco Products

27. Two pieces of legislation come into effect on 20th May, which will affect the way tobacco products are sold in the UK.

28. Firstly, the Standardised Packaging of Tobacco Regulations 2015 will standardise the packaging of all cigarettes and hand rolling tobacco for retail sale by:-

• Specifying mandatory colours for retail packaging (dull brown for the outside and white for the inside).

• Permitting only specified text (such as the brand and variant name) and making sure any permitted text conforms to particular requirements.

• Allowing required markings such as health warnings and fiscal marks to remain in place.

29. Appendix 4 contains some images of how packs of cigarettes will appear in the standardised packaging.

30. Secondly, the Tobacco and Related Products Regulations 2015 will implement the European Tobacco Products Directive to give effect to a wide range of tobacco control measures, including

• bigger health warning pictures

• a ban on flavourings, including menthol

• packaging controls to help combat the illegal tobacco trade 31. Both pieces of tobacco control legislation are being introduced on the same timeline

and provide retailers with a transitional period to May 2017 to sell through old stock.

Withdrawal of the Welsh Government Public Health Bill

32. The much-anticipated Welsh Government Public Health Bill failed to get the necessary support recently to see it become law.

33. A number of high profile measures due to have been brought in by the Bill would have been the enforcement responsibility of the Shared Regulatory Service, for example

• A tobacco retailers register for all outlets selling tobacco in Wales

• An additional offence in Wales for delivering tobacco to minors

• A national Specialist Procedures Register to regulate standards for activities such as cosmetic piercing and tattooing

• A ban on the use of electronic cigarettes in certain public places New Funding Arrangements for the Wales Illegal Money Lending Unit

34. After some uncertainty over future funding of the UK’s Illegal Money Lending Units (including the Wales Unit), new arrangements have been announced to provide this area of work moving forward.

35. From April 2017, funding responsibility will shift from the current arrangements through the Department of Business, Innovation and Skills to the Treasury, and for the first time the cost of funding the Units will be raised by a levy on businesses in the financial sector. This news is most welcome as it safeguards our crucial work in tackling loan sharks and in supporting the victims of this dreadful crime. Certainty of future funding will also safeguard the Unit’s input into the successful delivery of the Financial Inclusion Strategy for Wales. Recent Prosecution Cases

36. Details of recent cases investigated by the Shared Regulatory Services that have resulted in prosecution are set out in Appendix 5 to this report.

Resource Implications (Financial and Employment)

37. The Participants' contribution towards the Shared Regulatory Service is recharged on a quarterly basis, based upon the approved budgets for 2015/16. The quarter 4 recharge will take account of non-staffing costs incurred by Cardiff and Bridgend since May 1st 2015. Accounting for the full year will reported to the Committee in June 2016 at the Annual General Meeting.

A number of prosecutions have been successfully concluded in recent months, arising from investigations conducted across the Shared Service.

1 11.1.16 Breaches of food hygiene regulations at a Porthcawl takeaway premises which posed a serious risk of food poisoning. These included

Cooked pork found defrosting in filthy warm water, heavily contaminated with food debris and grease

cooked rice left out for over a day in dirty food containers and outside of temperature control limits

cooked crispy beef, crispy pork and chicken balls found stored on the kitchen floor at room temperature

Dirty cloths and scourers and staff in dirty clothing.

The defendant was fined a total of £1,800 for twelve food hygiene offences, and had to pay total costs of £2,304.22 and legal fees of £600.00. A victim surcharge of £20.00

2 14.1.16 Illegal street trading from a burger trolley in Cardiff City Centre

Activation of a previous suspended sentence (for food hygiene offences) meant that the defendant was imprisoned for 16 weeks. Upon release he will be subject to a 12 month supervision order.

3 1.2.16 A scaffolding business was found diving a vehicle in Cefn Cribbwr that was 43% over its permitted weight

The owner of the business was fined a total of £1812 and ordered to pay costs amounting to £538.61. The driver at the time of the offence was fined a total of £730 for the dangerous overload and banned from driving for a period of six months with immediate effect. He was ordered to pay costs £269.31 together with a victim surcharge of £55

4 1.2.16 Another scaffolding business was found to be driving a vehicle carrying 20% more than its permitted weight when it was stopped in Pyle.

The owner of the business was fined £465, while the driver at the time of the offence was fined £400.

5 29.2.16 Proceeds of Crime hearing following earlier conviction (June 2015) for illegal money lending

Proceeds of Crime monies amounting to £91073.00, comprising

Compensation awarded to the victims:-

Victim 1 – £23,950 Victim 2 – £25,650 Victim 3 - £16,460 Confiscation Order

£25013 to be paid within 28 days with an indication of 9 months imprisonment in default of payment.

6 3.3.16 Illegal street trading involving the selling of burgers during the Ireland v Canada rugby game in Cardiff. The defendant had eight previous convictions.

A fine of £280 (£140 for each of two offences), together with costs of £150 and a victim surcharge of £20.

7 3.3.16 The sale of hot food on two occasions after licence hours of 11pm, from premises in Cardiff .

A fine of £400 for the first offence and £600 for the second. The defendant was ordered to pay costs of £150 and a victim surcharge of £60

8 3.3.16 Exposing alcohol for sale and keeping alcohol for unauthorised sale at a Cardiff pub which was unlicensed. The defendant had seven previous convictions (including the same offences as those currently faced)

A fine of £1000 for the first offence and £1000 for the second offence. The defendant was also ordered to pay costs of £150 and a victim surcharge of £100.

9 3.3.16 Eleven offences relating to the ownership of a house in multiple occupation in Cardiff, including a failure to maintain fire doors; a fire alarm and fire-fighting equipment.

The defendant was fined a total of £1867.50 and ordered to pay costs of £2938.00.
