It has been three years this month since this “Supervisor’s Notes” column first appeared in

Our Town Guilderland. Our intention was then, and still is, to provide readers with some basic information on current happenings in the Town of Guilderland in an informal manner. I feel that we have been successful in attaining this goal, but we are always open to suggestions on how we could improve this feature. If you have comments or suggestions, please share them either with me at Town Hall (356-1980, ext. 1040), or with Lowell Knapp, the Publisher of Our Towne, who I would like to thank once again for allowing this publication to be utilized as a communication vehicle for the community.

During June, the Guilderland Chamber of Commerce held a very successful celebration of its 40th Anniversary, and as part of that celebration, I was privileged to present the annual Town Beautification Awards to several local businesses that have demonstrated their commitment to the community through their financial and creative investment in the creation of or improvements to their physical facilities. Awards were presented this year to Mio Vino on Main Street in Altamont, to The Carhartt Store in Crossgates Mall, and to Hamilton Square (formerly 20 Mall) on Western Avenue. These businesses help to make Guilderland a more appealing community, and I would like to use this opportunity to recognize and celebrate that commitment, particularly since it was made in an economic climate that has not yet fully recovered from the recent recession.

Please take advantage of the summer weather to explore and make use of the recreational opportunities offered to Guilderland families by our wonderful array of Town parks. The warm weather and adequate rainfall have combined to keep our facilities green and fresh-looking, with the help of our Parks and Recreation Department staff. Guilderland’s facilities range from neighborhood parks such as Abele, Fort Hunter, and Volunteer Firemen’s Parks to facilities that emphasize sports, such as DiCaprio, Keenholts, and Nott Road Parks, to Tawasentha Park, our largest and most expansive facility, featuring over 5 miles of hiking trails, the Town Pool, Guilderland Performing Arts Center, and the colorful Ruth Lawlor Memorial Garden, as well as picnicking, playgrounds, tennis and basketball. More information on our

facilities and their use can be found on the Town website, www.townofguilderland.org, or by calling the Parks and Recreation Office at 456-3150.

At this time of year, I also like to remind residents that Guilderland sits square in the middle of the Albany Pine Bush Preserve, a natural area encompassing over 3,000 acres, with over 18 miles of trails for hikers and mountain bikers, and an array of educational programs held in or near the Pine Bush Discovery Center on New Karner Road. Please visit their website, www.albanypinebush.org, for complete information on Discovery hours and programs available throughout the Preserve.

Warm weather and adequate rainfall combine to create golf course conditions that players can enjoy, and that is definitely the case at Guilderland’s Western Turnpike Golf Course. Residents should be sure to obtain their special discounted rate for greens fees by presenting their resident I.D. cards. If you are a resident, but do not have an I.D, card, you can obtain one at the Pro Shop by providing two forms of identification showing that you are a Guilderland resident. Please call the Pro Shop at 456-0786 for information on course conditions or to book a tee time for your group.

Warm summer Thursday evenings are a wonderful time for you and your family to visit the Guilderland Performing Arts Center for an evening of free music under the stars. Bring a lawn chair or blanket and enjoy the variety of musical programs that have been offered to Guilderland residents each summer for the past 33 years. Happy Summer! We at the Chamber are very

excited to be collaborating on this issue with Our Towne and the Town. The past month has been filled with several events to benefit local businesses and organizations, and we need to highlight our towns accomplishments and amenities!

The Guilderland Chamber of Commerce was proud to kickoff its summer community project, “3 Chairs for Guilderland”. The Adirondack chairs, designed by local artists, debuted at the Altamont Arts in the Park on June 2nd. Since then, they have toured the town, making appearances at the Chamber’s 40th Annual Dinner, Crossgates Mall, and Tawasentha Park among other locations. We would like to thank all of those who have participated in this event, from area businesses and our talented artists to enthusiastic town members who have enjoyed the chairs. If you haven’t had the chance to check out the 70 beautiful, wacky, and artistic creations, you have all summer. The chairs will be available to the public through October 6th, the date of our annual “Souped Up on Guilderland” event. The day culminates in a “chair-itable” auction to benefit Guilderland students through the Guilderland PTAs and Friends of Guilderland Athletics to help with programs that have been cut.

As a part of the Guilderland Chamber’s celebration of its 40th Anniversary, we hosted an extra special annual Awards Dinner, recognizing business owners and businesses that have gone above and beyond, making Guilderland an even better place to live and work. Comedian Steve Van Zant left the crowd roaring with laughter- it was surely a night the audience will never forget.

We are very excited to welcome new businesses to the area. We hosted two ribbon cuttings recently, one for Apropos Prom and Bridal and another for Mio Vino in Altamont. I encourage you to support these new members of our town in addition to our other wonderful local businesses and organizations. Enjoy the rest of the summer months!

Bus Trip to Bean Town!

Boston is always a blast, but never more than in the summer when the marketplaces are thriving with wares from all over. You can “leave the driving to us,” and spend a day in “America’s Walking City” by going on our Saturday, August 18 bus trip.

We will leave from the Library parking lot at 7 am, get dropped off in the Quincy Market area, and be picked up near the market at 7 pm.

Cost is $50 per person. Proceeds help underwrite Library programs not funded by taxpayer dollars. This event is cosponsored by the Guilderland Chamber of Commerce and the Library.

According to Clancy the local real estate market continues to show signs of improvement and strength. Home affordability is the best it has been in years and buyers are taking advantage of 30 year fixed rate mortgages in the 3.5% range. Multiple offers are starting to be seen again for the first time in years and marketing times are decreasing in the primary market areas. Clancy points to a home he recently sold for $25,000 more than asking price in under a week due to multiple offers as an example of the market strength. It seems more than a bit surreal that this is the last time I’ll be writing an article for my favorite hometown newspaper.

As many of you already may know- I am leaving The Spinal Wellness Center. There have been all sorts of rumors swirling about as to why my husband and I have sold our practices, so let me explain first hand. Chiropractic is an extremely physical profession when done in its traditional form. Anyone who has been to a chiropractor knows that. I love the hands-on approach and difficult physical techniques I’ve utilized in my practice, however, that comes with consequences. After 20 years (25 for David) there is wear and tear, particularly to the small joints of the wrist, hand and shoulder that begins to be irreversible. That, unfortunately, is the primary reason we have found it is time to move on. We want to make sure we have a future full of activity and vitality and health and we know if we continued along the path we were going, that most likely would not be the case –at least where our joints are concerned.

Fortunately, thanks to our amazing patients and the Guilderland community, business is better than it has ever been and we were able to find a wonderful chiropractor to buy the business and call The Spinal Wellness Center her new home. It’s hard to find the words to say how sad I am to leave this job and this community I love so much, but I am grateful to be leaving it in the hands of Dr. Kim Keeling, who I feel is a perfect match to continue the personalized, patient-centered care The Spinal Wellness Center has become known for.

Dr. Keeling is an experienced chiropractor with extensive knowledge about sports injuries and nutrition. She is a Certified Chiropractic Sports Physician, Certified Strength and Conditioning Specialist and holds a Diplomate in Clinical Nutrition. She moved to the Capital Region 16 months ago from Minnesota, where she had a practice for 8 years. During her years of practice, she worked extensively with running clubs as a coach and giving seminars. Dr. Keeling acted as team chiropractic physician for high school rugby, baseball, soccer and football teams. She volunteered as chiropractic physician and EMT for the Susan G. Komen Breast Cancer 3-Day for the Cure and the Minnesota Special Olympics. She provided sports medicine care for the St. Paul Pioneers Semi-Pro Football Team, National Junior Olympics Taekwondo Championships and Minneapolis Rugby.

So thank you all for your continued support over the years. I trust you will give Dr. Keeling that same support. Enjoy a very healthy and happy summer, and as one of my favorite people says, “Goodbye for now.”

GUILDERLAND, NY—At a special meeting held June 21, the Guilderland Central School District Board of Education ratified a three-year contract with the Guilderland Teachers’ Association (GTA), concluding a bargaining process that began in December 2010.

Members of the GTA voted on June 20 to ratify the agreement, which covers the period of July 1, 2011 through June 30, 2014, by a margin of nearly three-to-one. The contract calls for salary schedule improvements of 2.4% in 2011-12, 1.5% in 2012-13, and 1.4% in 2013-14. Salaries for teachers during the 2011-12 school year will range from $45,200 for first year staff to $74,131 for those with at least 23 years of experience.

“Considering the current economic climate, we are thankful andpleased that both parties could come to an agreement that not only meets the needs of our committed staff but that is also fair to our taxpayers, as well,” said Board of Education President Colleen O’Connell.

The negotiated agreement calls for no change in the salary schedule from 2010-11 to 2011-12, making it a “step-only” year. In addition, the contract also includes a delayed step salary increase for the 2012-13 and 2013-14 school years. GTA members eligible for advancement on the salary schedule will do so on February 1, 2013 and February 1, 2014—an agreement that will save the district approximately $420,000 per year.

Other changes in the contract include clarified language and updates on the use of personal leave, tuition reimbursement, evaluation for teacher leaders and coaches, and the development of the district’s Annual Professional Performance Review Plan and related appeals process. The contract also includes the transition of the high school English teacher schedule from a four course to a five course workload beginning July 1, 2013. This change in schedule will result in a savings of $280,000 forthe district in 2013-14.

“We are so appreciative of the work that went into approving this contract,” said Superintendent of Schools Dr. Marie Wiles. “Our teachers are the cornerstone of the district, and their willingness to work with district leaders to settle on a contract that includes concessions only proves their commitment to the children and families of the Guilderland Central School District.”

The Guilderland Teachers Association is comprised of 481 district staff members.

Wills and Trusts – Part 2 of 3In last month’s first part series, we discussed wills and the types of assets which are eligible to pass through wills. This month, we focus on another asset distribution tool - the Revocable Living Trust.

In general, a trust is created when one person (the grantor) transfers to another person (the trustee) a property interest to be held for the benefit of himself or others (the beneficiaries). If the trust is created during the grantor’s lifetime, it is known as a living trust. When the grantor retains the right to dissolve the trust arrangement, it is known as a revocable living trust.

A typical revocable living trust arrangement involves the grantor and trustee being the same person (or people, such as in the case of a married couple who create a single revocable living trust). The trust document specifies a number of important elements, including naming an alternate or successor trustee and the beneficiaries of assets that are owned by the trust.

A revocable living trust can generally own any property that a person can own in his/her name. Such assets include real estate, bank accounts, investment accounts, and personal property. Additionally, the living trust can be named as a beneficiary on certain types of assets such as life insurance, annuities, or individual retirement accounts.

The primary benefits of a revocable living trust over a traditional will include the following:

• At the death of the grantor, the assets are distributed to beneficiaries by the successor trustee without being subject to probate. Probate, as mentioned last month, involves the will becoming a part of public record, may involve substantial court and/or legal fees, and opens up the potential for a person to contest the will.

• The use of an alternate or co-trustee allows another person to manage the trust-owned assets when the grantor is still alive yet unable to handle his or her own affairs.

A revocable living trust does not protect assets from creditor claims or Medicaid. It also does not introduce any income or estate tax benefits compared to individual ownership of the assets. Nevertheless, a revocable living trust can be a very useful tool in providing simplified estate administration for your heirs, while retaining full flexibility to make changes as desired. As with any legal strategy, please consult with a qualified estate planning attorney to implement any legal documents.

In Part 3 of this series, we will discuss Irrevocable Trusts.

guilderland High school graduating Class gives $5,000 senior gift to Huntington’s

Disease society of america

on Friday, June 22, members of the Guilderland High School Class of 2012 presented a check for $5,000 to the Huntington’s Disease Society of America. The senior class chose the HDSA as a way of showing their support to a fellow senior classmate whose family has been impacted a great deal by Huntington’s disease.

The donation, part of the Class of 2012 senior gift, was established through various fund-raising activities throughout the past four years including an ongoing high school apparel sale as well as car washes, bake sales, pancake breakfasts, and more. The gift was accepted by Marcella Junco, chairperson of the HDSA Albany Chapter. Marcella said that the donation would be used by HDSA for research and support programs.

many of you remember the “Dream Team” that represented O.J. during his trial. While opinions may differ about why O.J. was acquitted, I

believe O.J. won because of the quantity of the representation, not the quality. Basically, for two years nine lawyers and their staff focused only on O.J.’s case.

After 25 years, I still have not had a client walk into my office with a blank check and tell me that money was no object and that they should be my only client. Most people have a finite amount of money to spend on their legal matter and are looking for the most “bang for their buck.” Here are some ways to help you do that.

1. Be honest – no matter how bad it is. My job is to advocate, not judge. There is nothing that you can tell me that I cannot process and hopefully address for you. In matrimonial and family law cases you are generally litigating against the person who knows you best. Usually any lies told to your lawyer will catch up to you. At that point, not only am I not at the starting gate, but I now have to catch up and restart.

2. Be realistic. Seriously consider reasonable solutions outlined by your lawyer. If you decide to take another stance, be prepared to spend lot of money to get nowhere. Recently, I had a case where my client’s husband spent $10,000 more in legal fees than she did to fight over property worth $3,000. Had he just given her $3,000 up front, he would be $7,000 ahead!

3. Communicate effectively. Ask your attorney the best way to communicate with her. Just because there are many ways to communicate does not mean you should use all of them. A telephone call during business hours is the best way to reach me or to find out if I am available. If you text, call my cell phone, send an email, and then call my office, I have received the same communication 4 ways!

4. Ask what you can do. There may be tasks that you can do that will save your attorney and her staff time. For example, if your attorney needs financial records gather them yourself and ask how many copies are needed. It is probably less expensive and more time efficient for you to do this rather than your lawyer and/or her staff.

5. Listen to your lawyer. All too often a client tells me what his/ her spouse said, or what advice his/her lawyer allegedly gave, and then questions who is giving the “right” advice. It is likely that what is being told to you is what the other person wants you to think, and not what s/he was told.

6. Get proper counseling. Emotions run high in divorce and family court cases. Your attorney is a “counselor of law,” not a counselor. Many issues presented to me are better directed to a friend or mental health counselor.

Following these suggestions will help you utilize your attorney’s time in the best manner possible, which will save you money in the long run.

This month I would like to quote an article written by one of our fantastic students, Mr. Clancy. I thought it was awesome in every way possible. Enjoy…

Last week I belt tested to move up in Tae Kwon Do. I remember standing in front of like 100 people doing my forms and contemplating the board I had to break thinking “what the heck am I doing here?” I was like a fish out of water

and totally uncomfortable. But that is exactly why I was there; I was out of my comfort zone. You don’t grow staying where you are comfortable and there are no risks of failure. However, as my time to break my board in front of the crowd approached, I kept focusing on what would happen if I didn’t break the board. I was focused on exactly what I didn’t want. Breaking the board is all physics and really just results in hitting the center cleanly. Long story short, I threw my kick and missed the center of the board and it didn’t break. I regained my composure and broke on my second attempt. Afterwards, I was talking to one of the black belts about what had happened. I was surprised when he told me how easily he breaks concrete in practice but failed 3 times in a row the last time he was in front of a crowd. He gave me advice on staying focused and it really helped me. It is why I like TKD. Everyone steps up to help you and no one feels threatened by your success. When a member of the Tae Kwon Do community advances the sport is promoted and everyone benefits. It’s funny but I remember saying to my wife afterward how I was actually glad I missed on my first attempt because I learned so much more about myself. I became stronger from the failure and appreciated my eventual victory of the board break, and new belt even more.

The contrast between Tae Kwon Do and business competitors was amazing to me. When I first started in business I literally wanted to “crush” my competitors. However, when my thoughts changed and I began subscribing to the abundance theory I realized a competitor doesn’t have to fail for me to succeed. We can both succeed. It was a turning point for me in business and in life. Quite frankly competition in business makes everyone raise their game and ultimately the consumer benefits. Besides everything else in my chaotic week last week, I had a competitor offer me two tickets he couldn’t use to a Yankee game Tuesday night for my Birthday. I am sure he could have offered them to clients, but he offered them to me. I didn’t realize until later in the week the reason he couldn’t use the tickets was he was driving his mom to the doctor to have eye drops put in. When I heard this, I realized what a true champion my competitor is. He skipped a Yankee game to help his mom and offered me, a guy that competes with him everyday, his tickets because it was my birthday. That was truly humbling. I can tell you if he ever needs anything I am going to be the first to step up and I know where I am sending my referrals I can’t handle. So in one week one of my competitors ran an organized smear campaign against me and another offered me Yankees tickets. In the game of life who do you think wins?

So my thoughts this week are to subscribe to the TKD and my Yankee ticket competitor’s philosophies. If your success is pinned to seeing or making someone fail, is it really a success? The person you want to compete with is yourself. Just like I lost my focus on my board break, don’t focus on making the competition look bad, focus on improving your game. Don’t get me wrong I love competition and winning. I want to win, but winning doesn’t involve trying to make someone else fail or look bad. I truly believe making everyone around you successful raises everyone’s game. - Kevin Clancy

Upcoming summer activities at gCsDWhile school may not be in session during the months of July and August, the Guilderland Central School District continues to provide students with opportunities for learning throughout the summer.

• The Guilderland Central School District is pleased once again announce the opening of Butterfly Station, a student-run butterfly house and native plant garden. Located on the grounds of Farnsworth Middle School (6072 State Farm Road, Guilderland), this is the station’s 13th year of operation. Besides walking among butterflies, visitors can watch how butterflies are raised in the metamorphosis room or make free butterfly projects in the craft room. Community members of all ages will enjoy the many interactive butterfly exhibits in the museum room. Butterfly Station is free and open to the public Monday through Friday, 10 a.m. to 1 p.m., from July 16 through August 17. Guests are also invited to stop by and purchase seasonal produce at the FMS Organic Farmer’s Market. The garden, located adjacent to the middle school, offers a wide variety of fresh organic produce as well as an exciting opportunity for both students and the community to learn about the art of organic gardening. The garden will also be open to the public Monday through Friday, 10 a.m. to 1 p.m., from July 16 through August 17. • In partnership with the national nonprofit Invent Now, GCSD is pleased to offer the nationally-acclaimed Camp Invention program to children entering grades one through six this summer. This exciting, weeklong adventure in creativity immerses children in imaginative play that reinforces and supplements school-year learning in the subjects of science, technology, engineering, and math (STEM). Children will work together to seek innovative solutions to real-world problems and sharpen critical 21st century learning skills such as teamwork and creative problem solving as they rotate through four modules each day. The base price of the camp is $215. Availability is limited.
