However, the two decisions just rendered and the one handed down in November in Manhattan will probably all be appealed to the Court of Appeals, and that court will then have an opportu- nlty to pass on all aspects of the problem. As previous articles on the ques- tion have indicated, the problem concerns the Interest payable on mortgages in existence prior to the enactment of the moratorium, which have sińce been extended at a reduced ratę of interest and whlch have now matured. Can interest be collected at the old ratę provided in the pre-mora- torium mortgage or is the mort- gage limited to the amount stated in the post-moratorium exten- sion? Limited to Facts An attempt was madę by the Mortgage Commission to submit this ąuestion to the courts upon an agreed statement of facts.. But when the case was presented to the Appellate Division in Brook- lyn lt expressly limited its deci- sion to the particular facts before it and refused to pass upon the exact meaning of the statute. (Mortgage Commission v. Fay, 225 App. Div. 622.) An appeal was taken to the Court of Appeals, which affirmed the Appellate Di- vislon, but wrote no new opinion. The actual decision in this case held that, under the particular ex- tension agreement which was then before the court, the owner was only reąuired to pay interest at the reduced ratę provided in the extension agreement. The mort- gagee could not revert to the old interest ratę called for by the terms of the mortgage as it ex- isted at the time of the enactment of the moratorium. However, be- cause of the language of the Ap- pellate Division's opinion, many judges apparently did not feel that the case was conclusive. Two Brooklyn justices, there- fore, held that the ratę payable after the maturity of the exten- sioh agreement was 6 per cent and n A r m i t t o / ^ n\VT"*Or<* tO I n s t i t u t e fOTO- closure prooeedings if that ratę was not paid. It was the deci- siohs of these two judges which were modifled by the appellate caiatt. Both Brought by Bank Both of the cases were brought by the Manufacturers Trust Com- pany as the mortgagee. Silber- man & Steinfeld of Brooklyn, rep- resented the owner in one of the actions; Nugent & Nugent of Man- hattan, were the attorneys for the owner in the other action. While these two cases were be- fore the Appellate Division in Brooklyn, the Manhattan Appel- late Division handed down a con- trary decision in a case involving a most peculiar set of facts. A mortgage was extended, and the agreement provided that the own- er need pay no interest during the period of the extension. A strict interpretation of the Court of Appeals decision would lead to the conclusion that the owner need pay no interest at all after the maturity of the extension agreement. Two of the justices of the Appellate Division adopted this view, but the majority of the court held the other way and charged the owner 6 per cent. It is difficult to determine whether this case may be interpreted as a ruling on the entire problem or whether its decision is limited to the peculiar facts before the court. —(Reprinted from N. Y. However, the two decisions just rendered and the one handed down in November in Manhattan will probably all be appealed to the Court of Appeals, and that court will then have an opportu-nlty to pass on all aspects of the problem.

As previous articles on the ques-tion have indicated, the problem concerns the Interest payable on mortgages in existence prior to the enactment of the moratorium, which have sińce been extended at a reduced ratę of interest and whlch have now matured. Can interest be collected at the old ratę provided in the pre-mora-torium mortgage or is the mort­gage limited to the amount stated in the post-moratorium exten-sion?

Limited to Facts An attempt was madę by the

Mortgage Commission to submit this ąuestion to the courts upon an agreed statement of facts.. But when the case was presented to the Appellate Division in Brook­lyn lt expressly limited its deci-sion to the particular facts before it and refused to pass upon the exact meaning of the statute. (Mortgage Commission v. Fay, 225 App. Div. 622.) An appeal was taken to the Court of Appeals, which affirmed the Appellate Di-vislon, but wrote no new opinion.

The actual decision in this case held that, under the particular e x -tension agreement which was then before the court, the owner was only reąuired to pay interest at the reduced ratę provided in the extension agreement. The mort-gagee could not revert to the old interest ratę called for by the terms of the mortgage as it e x -isted at the time of the enactment of the moratorium. However, be-cause of the language of the Ap­pellate Division's opinion, many judges apparently did not feel that the case was conclusive.

Two Brooklyn justices, there-fore, held that the ratę payable after the maturity of the exten-sioh agreement was 6 per cent and nArmitto/^ n\VT"*Or<* tO I n s t i t u t e fOTO-closure prooeedings if that ratę was not paid. It was the deci-siohs of these two judges which were modifled by the appellate caiatt.

by the Manufacturers Trust Com­pany as the mortgagee. Silber-man & Steinfeld of Brooklyn, rep-resented the owner in one of the actions; Nugent & Nugent of Man­hattan, were the attorneys for the owner in the other action.

While these two cases were be­fore the Appellate Division in Brooklyn, the Manhattan Appel­late Division handed down a con-trary decision in a case involving a most peculiar set of facts. A mortgage was extended, and the agreement provided that the own­er need pay no interest during the period of the extension.

A strict interpretation of the Court of Appeals decision would lead to the conclusion that the owner need pay no interest at all after the maturity of the extension agreement. Two of the justices of the Appellate Division adopted this view, but the majority of the court held the other way and charged the owner 6 per cent. It is difficult to determine whether this case may be interpreted as a ruling on the entire problem or whether its decision is limited to the peculiar facts before the court. —(Reprinted from N. Y. 'Disputed Passage,' 'Allegheny Uprising' At Capitol Theater

"Disputed Passage," with Doro­thy Lamour, John Howard and Akim Tamiroff and "ATłoghpnv Uprising," featuring John Wayne and Claire Trevor, opened yester­day at the Capitol Theater.
