The County Board of Commissioners, Ditch Authority for County Ditch 30, having held a public information meeting on County Ditch 30 on the 14th day of September, 2015, having received a report from Kevin Fellbaum, County Ditch Inspector, having reviewed the files and having been fully advised in the premises did on the 22nd day of September, 2015 order the redetermination of benefits for County Ditch 30. Based upon the previously held public information meeting, the County Board of Commissioners, acting in their capacity as Ditch Authority, found the following as referenced in the order dated September 22, 2015:

• that County Ditch 30 was established in 1907, • that the benefits for County Ditch 30 have not been re-determined since the original determination, • that because of the subdivision of land, it would be difficult for the County to establish who would appropriately be assessed

for any work done on the ditch, • that the original benefits determined in the drainage proceeding do not reflect reasonable present-day land values, which have

increased over the past century, • that there is work that needs to be done to repair the ditch, • that there is no current active maintenance fund available, • that a review of the benefited areas indicates that the original determination does not accurately reflect those areas benefited

by the ditch system, • that the original determination includes only some parts of the catchment area drained by the ditch, and do not reflect present

day ditch viewing principals, and • that because parts of Ditch 30 are not operating as originally designed portions of the benefited area drain into Ditch 70, and

have been included in a redetermination of benefits for Ditch 70. Based upon these findings, the County Board of Commissioners, as Ditch Authority for County Ditch 30, approved and issued the order for the redetermination of benefits. On Wednesday, March 30, 2016, the Otter Tail County GIS Department filed the detailed data report for County Ditch 30 with the Otter Tail County Auditor – Treasurer’s office. The Ditch Viewers’ Report dated Tuesday, December 15, 2015 and signed as of Friday, February 5, 2016 was filed with the County Auditor – Treasurer’s office on Friday, February 5, 2016 and a revised copy was filed with the County Auditor-Treasurer’s office on Monday, July 18, 2016. The Property Owners’ Report dated Monday, May 23, 2016, along with the Ditch Viewers’ Report as well as the detailed parcel information from the Property Owners’ Report was presented to the County Board of Commissioners on Tuesday, May 24, 2016. The Ditch Viewers’ Report, as well as the detailed parcel information from the Property Owner’s Report is incorporated as an official part of the Property Owner’s Report dated Monday, May 23, 2016.

On Monday, June 20, 2016, the Otter Tail County Board of Commissioners, Drainage Authority for County Ditch 30, held a public hearing on the benefits as re-determined by the Ditch Viewers. This public hearing was continued to Tuesday, July 26, 2016 and then to Tuesday, August 23, 2016, to allow the viewers an opportunity to reconsider the benefits as assigned to some parcels during the redetermination process. On Tuesday, August 23, 2016, the Otter Tail County Board of Commissioners received the Ditch Viewers’ Amended Report; the Board having considered the comments from the public hearing, and being fully advised in the premises adopted the “Findings and Order Re-determining Benefits” dated as of Tuesday, September 27, 2016. The Ditch Viewers’ Report along with the Property Owners’ Report and the Amended Property Owner’s Report provides the information required by Minnesota Statute 103E.321 and 103E.323. The Property Owner’s report dated Monday, May 23, 2016 reports that the total benefits assigned to the properties that are considered to benefit from County Ditch 30 as re-determined are $748,131.68, including benefits assigned to county and township roads, as well as, railroad acres in the amount of $84,497.94. The acres within the watershed/drainage area are approximately 2,466.47 of which approximately 2,164.32 acres are benefited. The Amended Property Owner’s Report dated Tuesday, August 23, 2016 reports that the total benefits assigned to the properties that are considered to benefit from County Ditch 30 as re-determined are $677,235.08, including benefits assigned to county and township roads, as well as, railroad acres in the amount of $77,062.77. The acres within the watershed/drainage area are approximately 2,264.97 of which approximately 1,997.69 acres are benefited. The following is a general description of County Ditch 30 from the petition for public ditch– Commencing at a point about the middle of the meander line of Lot 8 in Section 20, thence running in a southwesterly direction through said Lot 8, and through the Southeast Quarter (SE1/4) of Section 20, and thence southwesterly through Section 29, intersecting the public highway on the south line of Northwest Quarter of the Northeast Quarter (NW1/4 NE1/4) of Section 29, and intersecting the Great Northern Railroad right-of-way at a point in the Southeast Quarter of the Southwest Quarter (SE1/4 SW1/4) of Section 29, thence continuing South from the point of intersection with said railroad right-of-way and intersecting the public highway on the section line between Sections 29 and 32 at a point approximately 40 rods west of the middle point of said section line, thence south approximately 40 rods, thence southeast through Sections 32 and 33 to a creek in the southeast corner of Section 33 all-in said Township of St. Olaf, County of Otter Tail, State of Minnesota and terminating at the point of intersection with said creek and with it as its outlet. The benefited properties of County Ditch 30 as generally described above are located within Sections 16, 17, 19, 20, 21, 29, 30, 32 and 33 of St. Olaf Township.
