ofProcedureandEvidence(theRules).

2. AnnexAcontainstheDocumentContainingtheCharges.AnnexBcontainstheListofEvidence.TheProsecutionrequeststhatAnnexBbereceivedbytheSingleJudge

asConfidentialitcontainsinformationofasensitivenaturenotcurrentlyavailable

tothepublicand/orwhichwasobtainedfromconfidentialsources.

3. The Prosecution notes that the List of Evidence is comprehensive, containing allitemswhichweredisclosedasincriminatoryorforusebytheProsecutorasevidence

for thepurposes of the confirmation hearingpursuant toRule 77 of theRules. It

currentlyshowseach itemsEvidenceRegistrationNumber (ERN),anddoesnot

includetheEVDnumbers.Thisisbecause:(1)theProsecutiondidnotreceivealistof

EVDnumbersassigned todiscloseddocumentsuntil29July2011,and (2) this list

received is not comprehensive, particularly because the Prosecution disclosed

documentstotheDefenceafterthatdate.AssoonaspracticableaftertheProsecution

receivesacomplete listofEVDnumbers, theProsecutionwillsubmitanamended

ListofEvidencecontainingboththeERNandEVDnumbers.
