    I.InvestigationsandProsecutionsOvertheweek,theOTPpresented10filingsinthevariouscasesandconducted5missionsin5countries.

    I.1.SituationintheDemocraticRepublicoftheCongo(DRC)This situationwas referredby the DRC in April 2004. The OTP opened its investigation inJune 2004, focusing on Ituri where the most

    seriouscrimeshadbeencommittedbythemainarmedgroups.FourarrestwarrantshavebeenissuedagainstThomasLubangaDyiloand

    Bosco Ntaganda, leaders of the UPC, and Germain Katanga and Mathieu Ngudjolo Chui, leaders of FNI and FRPI. The trial of Thomas

    LubangaDyilobeganon26January2009.ThetrialofKatangaandNgudjoloChuibeganon24November2009.BoscoNtagandaisatlarge.

    InSeptember

    2008,

    the

    OTP

    announced

    the

    start

    of

    its

    investigation

    into

    alleged

    crimes

    in

    the

    Kivus.

    1June UN Special Rapporteur on extrajudicial, summary or arbitrary executions, Philip Alston, concluded in his DRC

    missionreportthattheDRCauthoritiesrefusetoinvestigateandarrestsuspectedwarcriminals,includingBoscoNtaganda,

    subjectofanICCarrestwarrant,andexpressedconcernregardingtheimpunityforseniormilitarycommanders.

    I.2.SituationinUgandaThissituationwasreferredbyUgandainJanuary2004.TheOTPopeneditsinvestigationinJuly2004.Fivearrestwarrantshavebeenissued

    against top leaders of the Lords Resistance Army (LRA):Joseph Kony, Vincent Otti (allegedly killed in 2007 on order of Kony), Okot

    Odhiambo, Raska Lukwiya (killed on 12 August 2006, whose arrest warrant hasbeen withdrawn), and Dominic Ongwen. These arrest

    warrantsareoutstanding.Sinceearly2008,theLRAisreportedtohavekilledmorethan1,500,abductedmorethan2,250anddisplacedwell

    over

    300,000

    in

    DRC

    alone.

    In

    addition,

    over

    the

    past

    year,

    more

    than

    80,000

    people

    have

    been

    displaced,

    and

    close

    to

    250

    people

    killed

    by

    theLRAinSouthernSudanandtheCentralAfricanRepublic.

    toICCwarrantstojustice.ItismyferventwishthatthethreesurvivingLRAleadersforwhomICCarrestwarrantshavebeenissued

    willverysoonbecapturedandprosecuted.PillayalsocalledontheUgandanauthoritiestoinvestigatehumanrightsviolations

    duringarmyoperationstodisarmresidentsintheKaramojaregion.I.3.SituationinDarfur,theSudanThissituationwasreferredbytheUNSecurityCouncilinMarch2005.TheOTPopeneditsinvestigationinJune2005.Threearrestwarrants

    andonesummonstoappearhavebeenissuedagainstAhmadHarunandAliKushayb,OmarAlBashir,andBaharIdrissAbuGarda.Three

    arrestwarrantsareoutstanding.TheProsecutionappealedthedecisionofthemajorityoftheChambertodismissthechargesofgenocide

    againstPresidentAlBashir.On3February theAppealsChamberruled that itwasa legalerror toreject thechargesofgenocideagainst

    PresidentAlBashir.AbuGardavoluntarilyappearedbeforetheCourtpursuanttoasummons.Followinghisinitialappearanceon18May

    2009,hewasallowedtoleaveTheNetherlands.Theconfirmationofchargeshearingwasheldon1930October2009.On8February2010the

    PreTrialChamberissuedadecisiondecliningtoconfirmthecharges.TheOTPrequestedleavetoappealthisdecisionon15Marchandthis

    wasdeniedbythePTCon23April.TheOTPwillpresentadditionalevidence.On25MaythePTCChamberissueditsDecisioninforming

    theUnitedNationsSecurityCouncilaboutthelackofcooperationbytheRepublicoftheSudaninthecaseagainstHarun&Kushayb.

    3 June UnderSecretaryGeneral for Humanitarian Affairs, John Holmes, in his briefing to the UN Security Council

    highlightedthedifficultiesofaccessingmanyareas inDarfur,notingthatlittlehaschangedsincetheGovernmentofSudan

    expelled more than a dozen aid groups in 2009. According to Holmes, displacement, conflict, lack of access and the

    kidnappingof

    humanitarian

    workers

    continued.

    I.4.SituationintheCentralAfricanRepublic(CAR)This situation was referredby the CAR in December 2004. The OTP opened its investigation in May 2007. One arrest warrant hasbeen

    issuedagainstJeanPierreBembaGomboforcrimescommittedin20022003.Theconfirmationofchargeshearingwasheldon1215January

    2009.On15June2009,PreTrialChamberIIrendereditsconfirmationofchargesdecision.On18September,thecasewasreferredtoTrial

    ChamberIII.Thetrialissettostarton5July2010.On2728April,theTrialChamberheldahearingonadmissibility.Inparallel,theOffice

    continuestomonitorallegationsofcrimescommittedsincetheendof2005.

    I.5.KenyaThe Office made its examination of the postelection violence of December 2007January 2008 public in February 2008. On

    9July2009,theAfricanUnionPanelofEminentAfricanPersonalities,chairedbyKofiAnnan,announcedthesubmissiontotheOTPofa

    sealedenvelopecontainingalistofpersonsallegedlyimplicatedandsupportingmaterialspreviouslyentrustedtoMr.AnnanbytheWakiCommission. On 5 November the Prosecutor informed President Kibaki and Prime Minister Odinga of his view that crimes against

    humanityhadbeencommittedandofhisduty, in theabsenceofnationalproceedings, toact.Both thePresidentand thePrimeMinister

    committed to cooperate with the Court. On 26 November the Prosecutor requested authorization from PreTrial Chamber II to open an

    investigation,noting that:1,220personshadbeenkilled;hundredsraped,with thousandsmoreunreported;350,000peoplewereforcibly

    displaced;and3,561injuredaspartofawidespreadandsystematicattackagainstcivilians.On31MarchthePreTrialChamberauthorized

    the Prosecutor to commence an investigation covering alleged crimes against humanity committed during the events that took place

    between1June2005and26November2009.TheProsecutormadehisfirstvisittoKenyasincethebeginningoftheinvestigationon812

    May.

    1June KenyasAttorneyGeneral,AmosWako,informeddelegatesattheopeningsessionoftheICCReviewConferencethat

    theKenyanGovernmentisfullycommittedtocooperatingwiththeICC:ThePresidentandthePrimeMinisterhaveassuredthe

    ProsecutoroftheICCoftheirsupportfortheongoinginvestigationandprosecution,ifany.

    ApreliminaryexaminationisthefirstphaseoftheOfficeoftheProsecutoractivities,inordertoassessifaninvestigationshouldbeopened.

    the

    Office

    first

    assesses

    the

    jurisdiction

    of

    the

    Court,

    whether

    crimes

    falling

    under

    the

    ICC

    jurisdiction

    may

    have

    been,orarepossiblybeing,committedinagivensituation;iftheconditionsaremet,whethergenuineinvestigationsandprosecutionsare

    being carried outby the competent authorities in relation to these crimes; and, as a third step, whether the possible opening of an

    investigationbytheProsecutorwouldnotgoagainsttheinterestsofjustice.Duringthisphase,andinaccordancewithArticle15,theOffice

    proactivelyevaluatesall informationonallegedcrimes frommultiplesources, includingcommunications from individualsandparties

    concerned.Thetriggeringofapreliminaryexaminationdoesnotimplythataninvestigationwillbeopened.

    7June Followingquestions,theOTPclarifiedthatSriLankaisnotaStatePartytotheRomeStatute.However,theICCcould

    potentiallyhavejurisdictionovercrimescommittedbynationalsofStatePartiesontheterritoryofSriLanka.

    II.1.AfghanistanThe

    Office

    made

    its

    examination

    public

    in

    2007.

    It

    examines

    alleged

    crimes

    within

    the

    jurisdiction

    of

    the

    Court

    by

    all

    actors

    involved.

    The

    OTP met outside Afghanistan with Afghan officials and organizations. The OTP sent requests for information to the Government of

    Afghanistanandhasnotyetreceivedananswer.

    II.2.ColombiaThe Office made its examination public in 2006. It examines alleged crimes within the jurisdiction of the Court and

    investigations/proceedingsconductedinColombiaagainsttheallegedlymostseriousperpetrators,paramilitaryleaders,politicians,guerrilla

    leaders and military personnel. The Office is also analysing allegations of international networks supporting armed groups committing

    crimesinColombia.

    II.3.GeorgiaTheOfficemadeitsexaminationpublicon14August2008.TheGeorgianMinisterofJusticevisitedtheOTP.Russia,aStatenotPartytothe

    Statute,has

    sent

    3,817

    communications

    to

    the

    OTP.

    The

    Prosecutor

    requested

    information

    from

    the

    Governments

    of

    Russia

    and

    Georgia

    on

    27August2008.BoththeRussianandGeorgianauthoritiesresponded.TheOfficeconductedavisit toGeorgia inNovember2008and to

    RussiainMarch2010.

    II.4.PalestineOn 22January 2009, the Palestinian National Authority lodged a declaration with the Registrar under Article 12(3) of the Rome Statute

    whichallowsStatesnotpartytotheStatutetoaccepttheCourtsjurisdiction.TheOTPwillexamineissuesrelatedtoitsjurisdiction:first

    whetherthedeclarationacceptingtheexerciseofjurisdictionbytheCourtmeetsstatutoryrequirements;andsecondwhethercrimeswithin

    theCourtsjurisdictionhavebeencommitted.The Officewill also considerwhether thereare nationalproceedings in relation toalleged

    crimes.AdelegationfromthePalestinianNationalAuthority,andRepresentativesoftheArabLeaguevisitedtheCourton1516October

    2009 to present a report in support of the PNAs ability to delegate itsjurisdiction to the ICC. On 11January, the OTP sent a letter

    summarizingitsactivitiestotheUnitedNationsattheirrequest,inthecontextoffollowingupontheGoldstoneReport.On3May,theOTP

    published

    of

    submissions

    on

    whether

    the

    declaration

    lodgedby

    the

    Palestinian

    National

    Authority

    meets

    statutory

    requirements.TheOTPhasnotmadeanydeterminationontheissue.

    II.5.CtedIvoireTheCourthasjurisdictionoverthesituationinCtedIvoirebyvirtueofanArticle

    12(3) declaration submittedby the Ivorian Government on 1 October 2003. The

    declarationacceptsthejurisdictionoftheCourtasof19September2002.Themost

    serious crimes, including alleged widespread sexual violence, were committed in

    20022005. On 1718 July 2009, highlevel representatives of the OTP visited

    Abidjan.

    toGuinea,ledbyDeputyProsecutorFatouBensouda,inthecontextofitspreliminaryexaminationactivities.From1921MayasecondOTP
